HomeMy WebLinkAboutMinutes - July 16, 1952CITY CCUNC:" - CITY OF LODI COUNCIL CHAN:BERS, CITY HALL JULY 16, 1962 This regular meeting of the City Council of the City of Lodi held beginning -.at 8:10 o'clock p.m. on Wednesday, July 16, 1952; Councilmen Rinn, Richey, Robinson and Preszler present; Haskell (Mayor) absent. In the absence of Mayor Haskell, City Clerk Henry Glaves called for nominations for Mayor pro tem. On the motion of Councilman Robinson, Richey second, Councilman Preszler was elected to fill the position of Mayor during the absence of Mayor Haskell. The minutes of the previous meeting, July 2, 1952, were approved as written and mailed. COt12,1UNICATION3 Letter from the Central Valley Division of the League CVD,i.CC of California Cities announcing the next regular N:EETING meeting to be held in Stockton on July 17, 1952, was read. Councilman Robinson stated that he would be unable to attend due to his being absent from the City. PUBLIC HEARINGS At this time the meeting was opened to the hearing of protests in the matter of the annexation -of the 43rd 43RD ADDITION Addition. There being no protests, Ordinance No. 463, ORD. NO. 463 APPROVING THE ANNEXATION OF 43RD ADDITION, LANDS INTRODUCED BORDERING WEST LODI AVENUE AND SOUTH FAIRNONT AVENUE, TO THE CITY OF LODI AND DECLARING THAT THE SANTE IS ANNEXED TO AND MADE PART OF THE CITY OF LODI, was - introduced on the motion of Councilman Richey, Rob- inson second. As the next order of business, Mayor pro tem Preszler called for protests to the vacation of Cedar Avenue. VACATION OF No protests being offered, Councilman Robinson intro - CEDAR AVENUE duced, Richey second, Ordinance No. 464 entitled ORD. NO. 464 ORDERING THE VACATION OF THAT PORTION OF CEDAR AVENUE INTRODUCED LYING BETWEEN LOTS 27 AND 28 OF THE LAKE HOME SUB- DIVISION AND THAT PORTION LYING IN LAKE HONE SUB- DIVISIOA NUMBER TWO. REPORTS OF THE CITY MANAGER City Manager Weller requested the approval of speci- APPROVE SPECI- fications for a ton and one-half truck for use by the FICATIONS FOR Street Department. He stated that bids were to be 12 TON TRUCK open and that purchase of said truck had been provided for in the budget. The specifications were approved on the motion of Councilman Robinson, Richey second. At this point Mr. Weller introduced Mr. Richard Carpenter, Chief Counsel of the League of California Cities, who was visiting for the evening. Ordinance No. 465, AMENDING SECTIONS 5, 7 AND 13 OF ORDINANCE NO. ENTITLED "AN ORDINANCE FIXING THE Ai:ENDI�i ENT TO COi,:PENSATION OF OFFICERS AND E!•'PLDYEES OF THE CITY OF SALARY ORD. LODI AND REPEALING ALL ORDINANCES AND PARTS OF ORDI- ORD. ATO. 405 NANCES IN CONFLICT THEREWITH", providing for a one INTRODUCED step increase in salary for all classified employees, payment of overtime and increasing the number of days of sick leave that may be accumulated, was introduced on the motion: of Councilman Robinson, Rinn second. Weller submitted a sketch of South Hutchins Street between Lodi Avenue and Kettleman Lane showing the existing street widths and the recommendations of the Planning Commission and those of the City Engineer regard_ng the proposed width of the street. It was apparent that curb and gutter construction on the east side of the street at its southern end limited the widt:^ of the street, while the sidewalks con- structed along the street north of Vine Street per- mitted a street width of 56 feet. The City Planning Commission's recommendation called for a 56 foot width the entire length of the street from Lodi Avenue to Kettleman Lane. The City Panager and the City En- gineer recommended that the 56 foot wide street be maintained from Lodi Avenue south to Vine Street, at which point the eastern half of the street begins to gradually narrow until the eastern edege of the street becomes aligned with -existing curbs and gutters. HUTCHINS This proposal provides for 28 foot wide travel -gray STREET for south bound traffic for the entire length of ',iIDTH Hutchins Street from Lodi Avenue to Kettleman Lane, DETER•.I:NED and for a 20 foot wide travel -way for north bound traffic from nettleman Lane to the vicinity of Vine Street where the street will widen to allow a 28 foot travel -way north to Lodi Avenue. The Oity Engineer estimated that this proposal will reduce the cost of pavinb Hutchins Street by approximately X13,351. Councilman Rinn moved that the Council adopt the recomimendation of the City Engineer and the City Mana.�er and that the method of transition from the 48 foot width.to the 56 foot width be determined after further study. In making his motion, Mr. Rinn explained that the flow of traffic will not be hin- dered by the proposal and that the questionable bene- fits to be derived from having a 56 foot width through- out would not justify the additional expense. Coun- cilman Robinson stated that he favored a 56 foot width for the entire length of Hutchins Street; how- ever, he had understood that the only area in question was that area on the east side of the street between Tamarack and nettleman Lane. He further stated that since the area in question extended all the way to Vine Street the economics involved assumed greater importance. he thereupon seconded the motion of Councilman Rinn. The motion passed with a unanimous vote. in the matter of the setting of a flat fee for storm dram installation to be paid by the subdivider, as held over from the previous meeting, i'•r. Weller re- ported that, from the figures available to him the average cost per acre for the storm drain construction over the past 5 or 6 years was j163. Councilman Rinn submitted the observation that the chief argument against the proposal will be that the Council is adding to the cost of subdivider; however, the same amount is actually being paid, but the distribution of the vosts are spread out equally. Councilman Robinson ESTASLIS,: stated that he favored a flat acreage fee, but that he FEE FOR did not believe that 4163 would cover the current STOR:-: DRAIN costs inasmuch as the average was taken over a period INSTALLATION of years and the current construction costs are higher. - Councilman Rinn then suggested that the Council could set a fee at the present time and that the fee could be adjusted up or down, at the discretion of the Coun- cil, when it appears such action is warranted. Coun- cilman Robinson then moved that a flat fee of 4175 per acre be charged to subdividers in order to equal- ize the costs of storm drain construction among sub- dividers; such charge does not cover the costs of installing catch basins, which remain the responsi- bility of the subdivider. CITY CLERK TO CONSENT TO THE ACCEPTANCE OF DEEDS AND/OR CLERK TO GRANTS FOR AND ON BEHALF OF THE CITY OF LODI, was ACCEPT DEEDS adopted on the motion of Councilman Rinn, Robinson second. Ordinance No. 459, "AXENDING THE ZONE DISTRICT REAP OF THE CITY OF LODI AND THEREBY REZONING AND RECLASSIFY - ORD. NO. 459 IN' CERTAIN PROPERTIES IN BLOCK 12, HUTCHINS ADDITION (REZONING TO BE IN THE CCMMERCIAL DISTRICT ZONE", having been BOCKENHEIM regularly introduced on July 2, 1952, was brought up PROPERTY) for passage on motion of Councilman Robinson_, Richey ADOPTED second, second reading omitted on reading by title, by unanimous consent and then passed, adopted and ordered to print by the following vote: AYES: Councilmen, Rinn,Richey,Robinson and Preszler NOES: Councilmen, None ABSENT: Councilmen, Haskell iiayor pro tem Preszler then signed Ordinance No. 459 in approval thereof. CITY PLANNING COyu-ISSION The Council heard the request of the representative STONE BROS. for Stone Bros. for the annexation of territory south REQUEST of West Lockeford Street. Action on the annexation ANNEXATION was postponed pending the receipt of a petition by the property owners. The recommendation of the Planning "or -mission that a USE PERIXIT TO use permit be granted to the United Pentacostal Church PENTACOSTAL for a church in the Gunsch-Edinger Tract was adopted CHURCH on the motion of Councilman Rinn, Richey second. The City Manager read the recommendation of the City Planning Commission re: the chestnut-6rescent Street openings. The Commission recommended as follows: That proceedings be continued; that the Commissioners appointed by the Council take under consideration both locations of Chestnut Street and the feasibility of terminating the improved Chestnut Street at the point where the 20 foot easement along the east side of neszler's property, as extended south, would inter- sect Chestnut Street; that portion of Chestnut Street from the 20 foot easement westerly and that portion of Crescent Avenue extended northerly through Alli- CHESTNUT- son's property be secured legally by some means where CRESCENT this land would have to be dedicated some day in the STREET future when land development in the south would re— OPENING quire the streets to be fully improved. The Commis- sion further recommended that the City bear the ex- pense of the Board of Commissioners in the event the property owners reject the proposed opening as being too expensive. Councilman Rinn moved, Robinson second, that the City Clerk be directed to write a letter to each property owner involved, instructing him that the City council will not continue the pro- ceed_ngs until such time as it receives some positive indication that the property owners want to proceed with the street opening and that they are willing to bear the expense of the Board of Commissioners.
