HomeMy WebLinkAboutMinutes - December 16, 1953288 CITY COUNCIL, CITY OF LODI COUNCIL CHAR -MR, CITY HALL December 16, 1953 This regular meeting of the City Council of the City of Lodi held beginning at 8:00 o'clock p.m. of Wednesday, December 16, 1953; Councilmen Hillman, Preszler, Rinn, Robinson and Richey (Mayor) present; none absent. P.'Linutes of the previous meetings, November 16, 1953 and December 2, 1953, were approved as written and mailed. PUBLIC HEARINGS Nx. Ben Horton appeared before the City Council to request permission to construct two driveways thirty GRANT feet in width along the north line of Lot 6 of the DRIVEWAYS AT Peirano Tract and one 30 -foot driveway on tae east CORNER OF line of said Lot 6. Xr. Horton explained that the LOCKEFORD & driveways will be necessary to give access to the CALIFORNIA ST. service station which is to be constructed on this lot. He added that the proposed development on this corner would provide ample off-street parking svace to compensate for the curb space lost due to the extra width driveways. On the motion of Council- man Preszler, Robinson second, the Council voted to approve the request subject to the approval of the City Engineer and the Chief of Police. At this time, the City Clerk presented and read his CANVASS report on the special election held December 15, VuTE 1953, to determine whether the residents of the area SUNSET included in the Sunset Addition wished to be annexed ADDITION to the City of Lodi. The City Clerk presented the ELECTION tabulation of votes cast for the canvass by the City Council. Upon completion of the canvass of the returns, Councilman Robinson moved that the City Clerk be instructed to enter the results of the election in the Records of the City Council of the City of Lodi as follows: F(R ANNEXATION 46 AGAINST ANNEXATION 13 TOTAL VOTES CAST: 59 The Council then found and determined that a major- ity of the votes cast were in favor of the proposi- tion submitted: "Shall Sunset Addition be annexed to, incorporated in and made a part of the City of Lodi?" Councilman Robinson then moved, Rinn second, the A14NEXATION introduction of Ordinance No. 504, entitled "Approv- APPROVED ing the Annexation to the City of Lodi of Certain ORD. NO. 504 Inhabited Territory Designated as "Sunset Addition" INTRODUCED Which is Contiguous to the City of Lodi". The motion was passed by a unanimous vote. BOEHsIER the San Joaquin Local Health District informing the REAPPOINTED City Council that due to action by the Legislature TO BOARD OF in 1951 in extending the term of office for members TRUSTEES of the Board of Trustees from two to four years, S.J.L.H.D. the Board of Trustees of the ban Joaquin Local Health District had voted to vacate all positions on the Board of Trustees as of January 1, 1954• It is therefore necessary for the City of Lodi to appoint a member to the Board of Trustees effective January 2, 1954• Dr. A.C. Boehmer has represented the City of Lodi on the Board for many years, and it was generally felt that he would be willing to accept reaonointment' if the City Council so desired. On the motion.of Councilman Robinson, Preszler second, Dr. A.C. Boehmer was appointed to the Board of Trustees of the San Joaquin Local Health District for a term to confom with the rules as determined by the Board of Trustees. The report further stated that the owner of the property, William E. Handel, had been notified that a hearing on this report would be held before the City Council on January 6, 1954. 'Meller explained that the terms of STOC4T�,14 BOX the agreement were similar to those in the standard CU1-iPANY agreement form for utility extensions to subdivi- sions adopted by the City Council, but that the Stockton Box Company wished particular evidence of the 14ayor's authority to sign the agreement. Council- man Rinn moved, Hillman second, that the i-,ayor be authorized to execute the agreement for the City and that the City Clerk be instructed to mail an extract of the Minutes of the City Council to the Stockton Box Company. CITY PLAINNING CU1,ISSION Mr. Weller read a memorandum from the Secretary of REICH the Planning Commission informing the City Council VARIANCE that on December 1, 1953, the Zoning Committee granted a variance to Section 7.3(1) of the Zoning Ordinance to permit a 15 -foot set -bath for a house to be constructed by ?•sr. Weller then read a letter from the Superintendent E:•:ERSON Mr. Weller read a letter from the Shoreline Planning WOUNDED Association of California, Inc., regarding t"e in- TIDELHNDS terim Committee, set up by the 1953 Legislature, CIL FUNDS authorized to reconsider the provisions of Section 6816 of the Public Resources Code, which assigns 70a of the royalties from tidelands oil drillings for development of parks and beaches. The associa- tion stated that it is its belief that strong repre- sentations will be made to break down the present code. The City Council was urged to meet this A''ARD challenge by adopting a resolution urging the re- TRACTOR tention of the present provisions of Section 6816 of the Public Resources Code. Kayor Richey stated that she did not believe all of the impounded tide- lands funds should be used for parks and beaches, EHRHARDT but that there were more important uses for the funds. Councilman Rinn pointed out ADOPTED that the rapid rate of increase of population in California makes it necessary to acquire and develop park sites immediately before thay are taken over by commercial interests. at the suggestion of Councilman Rinn, I•ayor Richey instructed the City Kanager to contact Dr. Burns in Stockton to get his reaction to the suggestion of the Shoreline Planning Association and his opinion of the organization it- self. i,:r. Weller then read a letter from the Superintendent E:•:ERSON of Schools in reply to a letter from the Gity P•:anager SCHOOL Requesting -some guarantee of the years that the Emer- GhOUNU S son School grounds would be available for use by TO BE SOLD the City for recreational purposes. In his letter Mr. Nichols informed the City that the Elementary School Board had adopted a resolution offering the building and grounds for sale to the highest bidder. Further plans for disposing of the property will be discussed at the February 8, meeting of the Board. The award for the tractor for use in the Recreation A''ARD and Parks Department was made to the only bidder TRACTOR complying with the specifications, the Lodi Tractor Company, on the motion of Councilman Robinson, Rinn second. NO. 502 passage on the motion of Councilman Preszler, ADOPTED kobinson second, second reading omitted after read- ing by title, and then passed, adopted and ordered to print by the following vote: AYES: Councilmen - Hillman, Preszler, Rinn, Robinson and Richey NOES: Councilmen - None ABSENT: Councilmen - None Ma -,or hickey then signed Ordinance No. 502 in approval thereof. LIGHTING was presented and approved with the adoption of DISTRICT Resolution No. 1785. b;inutes of December 16, 1953, continued. 291 On the motion of Councilman Rinn, the meeting was then adjourned to Wednesday, December 23, 1953, at the hour of 5:00 o'clock p.m. On the motion of Councilman Robinson, Preszler second, the meeting was again called to order by i•:ayor Richey. Councilman Robinson stated that he felt the City CCURTHGuSE Council should take a stand on the question of the SITE location of the proposed County Courthouse. He related that members of the Planning Commission had recently attended a meeting in the City of Tracy at which this matter was thoroughly discussed. Councilman Preszler stated that the County Planning Commission expected to make a recommendation to the Board of Supervisors at the next meeting of the Planning Commission on December 18, 1953. Council - ran Rinn stated that he would be reluctant to take action on the question until the City Planning Commission had made a recommendation. Councilman Rinn was assured by City Attorney •iullen and Councilman Robinson that the City Planning Commission would not resent such action being taken by the City Council. On the motion of Councilman Robinson, the Council then voted to direct a letter to the Board of Supervisors of San Joaquin County stating that, assuming the City of Stockton will make the necessary land in the Civic Center available to the County, the City Council of the City of Lodi favors the Civic Center site for the location of the oroposed Courthouse. - On the motion of Councilman.
