COUNCIL CHAMBER, CITY HALL
NOVEMBER 4, 1953
This regular meeting of the City Council of the City of Lodi
e514beginning at 8:05 o'clock p.m. of Wednesday, November 4,
53; Councilmen Hillman, Preszler, Rinn, Robinson and Richey
(Mayor) present; absent, none.
Minutes of the previous meetings of October 7, 1953, October
12, 1953, October 21, 1953, and October 28, 1953, were approved
as written and mailed.
CONNUNICATI ONS
The City Manager reminded the Council of the
invitation to attend the annual meeting of the
Northern California and Central Valley Juvenile
Officers' Association at the Hotel Lodi, November
10, 1953.

This being the time and place set for the hearing
of objections to the rezoning of the 118 -foot strip
of land on the south side of Palm Avenue extending
from Grant Avenue west to Ham Lane, Mayor Richey
called for the presentation of said objections.
Upon the failure to receive protests, either written
or oral, Councilman Robinson moved, Preszler second,
the introduction of Ordinance No. 499, providing
for the rezoning of the above property from the
R-2 Residential District to the R-1 Residential
District. The motion was passed with a unanimous
vote.
Mayor Richey then opened the meeting to anyone
wishing to protest the annexation of the Sunset
Addition under the Annexation Act of 1913. There
being no protests offered, either oral or written,
the Council voted to adopt Resolution No. 1778 on
the motion of Councilman Rinn, Hillman second.
Resolution No. 1778 provides for the calling of
a special election on Tuesday, December 15, 1953.
Mayor Richey then announced the opening of the
public hearing on the matter of the completion of
work in the South Church Street Lighting District.
Anyone interested in the installation of street
lights within the district was invited to address
the City Council to protest the work or appeal the
assessment. There being no protest or appeal offered,
either oral or in writing, the Council voted to
adopt Resolution No. 1777, approving the assessment,
on the motion of Councilman Hillman, Robinson second.
Mr. John Reiswig addressed the Council to request
the aid of the City in obtaining land for a 50 -foot
right of way on Roper Avenue between Louie Avenue
and Falls Avenue. Mr. Reiswig explained that FHA
would not approve loans for homes on those lots
in the Reiswig Tract abutting on Roper Avenue until
the full right of way was dedicated and the paving
width increased. He explained further that he
had been unsuccessful in attempts to purchase the
additional 25 feet from the owner. He requested
that the City exercise its powers of eminent domain

to acquire the necessary land for the street
widening. Mr. Weller stated that he under-
stood that the possibility of private negotia-
tions was not dead. Councilman Rinn stated that
there is a possibility of working out an arrange-
ment through negotiation which will be less expen-
sive for A:r. Reiswig and all concerned. It was
agreed that no further action should be taken at
this time.
REPORTS
OF THE CITY MANAGER
For the information of the City Council, Mr. Weller

read an excerpt from the minutes of the Recreation
SCHOOL
Commission meeting of October 5, 1953, relating to
GROUNDS
the proposed development of the Emerson School
grounds. The Recreation Commission tabled the
matter until the length of time the City would
have use of the area could be determined, since it
was the general feeling of the Commission that the
lack of a definite term of use by the City con-
siderably hampers any recommendation the grout
might make. Air. Mullen reported that the High
School Board had decided not to put any money
into the present structure on the school grounds.
Councilman Robinson stated that there was little
the City Council could do to move the matter along
until it had heard from the Elementary School
Board. It was agreed that the City Manager should
direct a letter -to both school boards indicating
the views of the Recreation Commission and the
City Council and stating that the City Council
is anxious to go ahead with the proposal to develop
the area into a park if they can have some assurance
as to the time the land will be available to the
City.
The City Manager reported that the High School

on South California Street and the intentions of

the City Council to take the necessary action to
restrict student parking in this block. He reported
that the High School Board did not have any objection
to the intended parking restriction. It was sug-
uogested
gestedthat the High School authorities could help
with the problem. Mr. Weller pointed out that any
restrictions on the parking would apply year around,
including school vacations and holidays. On the
motion of Councilman Robinson, Preszler second, the
Council voted to authorize the City Manager to
direct a letter to the Student Council of the High
School asking them to study the problem and give
the City Council the result of their study.

complying with the tentative map filed with the
City Planning Commission, was approved for recor-
dation and the streets and easements therein
accepted as City streets on the motion of Council-
man Rinn, Hillman second. This acceptance is
subaect to the improvement of streets to City
standards before they will be maintained by the
City. Mayor Richey then signed the map.

The City Manager read a memorandum from the
ZECH24ZISTER Secretary of the City Planning Commission reporting
USE PERUV T the action taken by the Zoning Committee and the
Commission on the application of Airs. Dorothy
Zechmeister, 402 First Street, for the estab-
lishment of a State Certified Family Care Home
at her residence for two patients. The appli-
cation was referred by the Zoning Committee to
the Planning Commission after reviewing the
application and an accompanying petition, signed
by sixteen of the eighteen property owners in
the neighborhood, approving the application.
At its meeting of October 26, 1953, the Planning
Commission approved the Use Permit.
Mayor Richey asked if further communications
5P CO. had been received from the Southern Pacific
PARKING Company regarding the lease of the S.P. property
LOT on Sacramento Street for use as an off-street
parking lot. Mr. Weller replied that he had
heard nothing further from the Southern Pacific.
Thereupon Mr. Weller was requested to write a
letter to the Southern Pacific Company requesting
that a meeting be arranged between the City
Council and representatives of the Southern
Pacific Company.
Councilman'Robinson proposed the establishment
LODI AVE. of a set -back line on the north side of East
SET -SACK Lodi Avenue. He added that something should be
LINE done to forestall further building construction
PROPOSED on this street which would hamper the future
widening of the street. On the motion of Coun-
cilman Robinson, the Council voted to ask the
City Planning Commission to study the situation
to determine whether a different set -back line
should be established, and if so, how far should
such line be from the center of the street.
The meeting was adjourned on the motion of
Councilman Rinn at 9:05 o'clock p.m.
