Councilmen Hillman,, Preszler, Rinn, Robinson and Richey (Mayor) present; none absent. J N;inutes of the regular meeting of August 5, 1953, were approved as written and mailed. REPORTS OF THE CITY MANAGER The City Manager reported that a meeting had been held with Mr. Wright and other interested merchants to discuss the type of street lights which would be acceptable in the business district. Mr. Killelea CONTRACT stated that the Line Material Company was willing to put up a bond guaranteeing satisfactory perfor- mance of all materials furnished by it for a 12 - month period. Mr. Killelea added that the merchants would like the opportunity to substitute a fluted light pole in the event the consensus of members present at.the next meeting of the Merchants Divi- sion of the Chamber of Commerce favored this type of pole over the conventional metal tapered pole. He pointed out that the cost of the fluted pole would be higher and would add to the expenses of the district. However, some of the merchants felt that the cost to each property owner would be only a relatively small amount. On the motion of Coun- RES. 71764 cilman Robinson, the Council voted to adopt Resolu- ADOPTED tion No. 1764, awarding the contract for the in- stallation of street lights in the Downtown Light- ing District to the low bidder, Collins Electrical Company of Stockton on the basis of the alternate bid of 440,743.00. The Council deferred action on the award of the SOUTH contract for the construction on South Hutchins HUTCHINS ST. Street upon learning that the report from the title company regarding the status of the right of way had not been received. Mr. Weller reported that he had received an agree- ment from the authorities at College of the Pacific to the payment of a flat sum to cover the head tax STADIUM for the anticipated number of student admissions to CONTRACT the football game to be held at the Lodi Stadium WITH in November 1953. While it is difficult to esti- C.O.P. mate the number of students attending, the college authorities feel that the number will be between 100 and 200; a small number due to the holiday date. The Council then approved the contract, as amended, and authorized the Mayor to sign for the City of Lodi. Mr. `:!eller presented a request from the Maco Gas DRIVEWAY Company for two 25 -foot driveways on its property REQ•EST on the north side of Victor Road. The request was based on the desire to establish off-street parking for the company's trucks. Councilman Robinson moved, Preszler second, that the request be granted in the interests of traffic safety. The motion was passed by unanimous vote. `i-1inutes of August 12, 1953 continued. ..:_, Kr. Weller reported that he had discussed the method of progress payments for the Master Plan and Off-stre^t Parking Plan with mr. wise. mr. wise suggested the ::ASTER PLAN following schedule: For the first six months, commene- PAYF;ENT ing at the end of July, monthly payments in the SCHEDULE amount of .800.00 each; for the subsequent three months, monthly payments in the amount of :600.00 each; a final payment at the end of the tenth month for the balance of the contract amount, which would be X1,173.00. the Council agreed that the suggested arrangement was satisfactory and authorized payment as scheduled. The City Manager presented a letter from M.J.3. Construction Company stating that the company would be willing to furnish a bond for maintenance of the STREETS IN streets in Lowe's Village to cover all but normal LOWE'S maintenance, as determined by the City Engineer. VILLAGE air. Beller stated that the City Engineer had agreed that the proposal was satisfactory. On the motion of Councilman Rinn, the Council voted to accept the streets in Lowe's Village subr..ect to the posting of a performance bond by ".J.B. Construction Company as approved by the City Manager, City Attorney and City Engineer. Weller recommended that he be authorized to write a letter to the Board of 6upervisors or be authorized to attend the budget hearing on August 20, 1953, together with those members of the City Council wish- ing to attend. He explained that the Board of Super- visors had been requested to transfer money from the General Fund to the County Road Fund for road COUNTY construction and maintenance, and the Board of BUDGET Supervisors had refused to do so at the preliminary HEARING budget hearings. He explained further that he had been informed that a new appeal will be made to the Board at the forthcoming hearings. Councilman Rinn stated that this was a very important matter. He added that he felt that the major mistake made by cities in the past, when the County is confronted with minority groups, has been the reluctance of the cities to appear and back up the Supervisors. It was then agreed that a'letter be sent to the Board of Supervisors and the members of the Council be notified of the time and place of the hearings by the City Manager. Mayor Richey then announced that a letter had been received from the Division of Parks and Beaches re- garding the acquisition of Lodi Lake Park by the LODI LAKE State to be used as a State park. She stated that PARK the letter contained the preliminary appraisal figures of 1149,430 for the value of the present park and $158,360 for the value of the land to be acquired by the State to enlarge the park. Mayor Richey added that further study would be given to the offer from the State and the public would be kept informed of the developments in the matter.
