Councilman Preszler, Richey, Rinn, Robinson and Haskell (Mayor) present; ab- sent, none. Minutes of the previous meeting, April 1, 1953, were approved as written and mailed. CON1NIIUNICATIONS The City Manager reminded the members of the Council that the City of Lodi will act as host to the Cen- REIMINDERS tral Valley Division of the League of California Cities on Thursday, April 23, 1953. The meeting is to be held in the Hotel Lodi. COUNTY tive in the State Senate. In a letter dated April SENATOR 10, 1953, Senator Hoffman expressed his appreciation for the donation to the office. PUBLIC HEARINGS Mayor Haskell opened the meeting to the hearing of those wishing to address the City Council. Mr. H.E. Looser addressed the Council to state that since June of last year he had conducted a careful inves- tirtion and found that Lodi businessmen have lost 30,a of their business due to the existence of park- ing meters in the downtown area. He then presented a petition which he claimed to have been signed by 719 Lodi citizens asking the City Council to either: PARKING a. Remove all parking meters from the streets bIETER of the City of Lodi, or PETITION b. Install parking meters in all areas in front of and adjacent to any commercial establishments within the City limits, or c. Submit the question of the continuance of parking meters in the City to the voters at a public election. Mayor Haskell ac- cepted the petition and assured Mr. Looser that after the signatures had been verified, the City Council would give the matter its fullest consideration. Mr. I. W. Loewne then addressed the Council as a spokesman for the residents of Central Avenue and Lodi Avenue districts to submit a petition, signed PARKING by 277 citizens, requesting the Council to submit METER the question of removing all parking meters from the PETITION streets of Lodi to the voters of the City at the next general City election. In accenting the petition, Mayor Haskell assured Mr. Loewen that his petition would receive the same consideration from the Coun- cil which had been extended to i%r. Looser. 204 This being the time and place set for the hearing REZONING of protests to the proposed rezoning of the PRESZLER Preszler Tract from the R-3 and R-4 districts to TRACT the R-2 Residential District, the Mayor invited all interested parties to address the Council. NO.485 being no protests forthcoming, Councilman Rinn IiTRODUCED moved, Preszler second, the introduction of Ordi- nance No. 485, approving the rezoning of the Pres- zler Tract as proposed. The motion carried. Mayor Haskell then called for those persons wish- ing to be heard to protest the formation of the South Church Street Lighting District. The City Clerk submitted a certificate to the fact that no protests or objections had been received by him. On the motion of Councilman Richey, Pres- zler second, the Council adopted Resolution No. RES. NOS. 1734, adopting the scale of prevailing wage rates 1734, 1735, for workmen needed to perform the necessary im- 1736 AND 1737 provement. Resolution No. 1735, declaring that ADOPTED the public interest and convenience require the emprovement and ordering the work to be done, was adopted on the motion of Councilman Richey, Preszler second. Resolution No. 1736, directing the work to be done under the supervision of the City En- gineer, was adopted on the motion of Councilman Rinn, Richey second. Resolution No. 1737, direct- ing that the assessment made distributing the costs of the work be prepared and signed by the Engineer of the Work, was adopted on the motion of Council- man Preszler, Robinson second. The Mayor then called for protests to the abandon- ment of the north -south alley between Lots 2 and'3; ST. ANNE'S Block 6, City of Lodi. No protests were offered. SCHOOL ALLEY Councilman Rinn stated that it was his understand - ABANDONMENT ing the curb and gutter on the south side of Wal- nut Street at the opening of the alley would be RES. NO.1740 replaced by the St. Anne's School authorities. He ADOPTED then moved the adoption of Resolution No. 1740, ordering the abandonment of said alley, with the provision that the recording of said resolution be withheld until such time as the curb and gutter work had been completed to the satisfaction of the City Engineer. The motion was seconded and passed. REPORTS OF THE CITY MANAGER The tentative map of the Kirst Estates subdivision was submitted for the information of the City Coun- cil. Said map provides for.the improvement of KIRST ESTATES Westwood Avenue north from Lockeford Street to the TENT. MAP south line of the Bowman property. Mr. Kirst ex - APPROVED plained that the property owners, Gregg and John- son, just south of Lake Street had been contacted with the offer to improve the street in exchange for the dedication of the necessary land. This offer, he explained, was not accented by these property owners. The Council found no objection to the tentative map as a pproved by the City Planning Commission. The council then found that the future extension of Westwood Avenue north from its -northerly termination on hte map of the Kirst Estates would benefit only those property owners owning property abutting upon said future extension. Mr. Weller explained that he had been LOADER SPECS. advised by the City Attorney that formal bids were APPROVED not required for this purchase; however, he wished to bring the matter before the Council for their information and/or suggestions. Councilman Richey moved, Robinson second, that the specifications be approved as submitted. The motion carried. Action on the proposed Traffic Ordinance was TRAFFIC deferred and the matter set over to a subsequent ORDINANCE meeting to allow time for the members of the City Council to study the possibility of including pro- visions for the establishment of truck routes in the ordinance. It was agreed that any action to STATEMENT amend the City's agreement with the Company should be deferred until the Council had had an opportunity to thoroughly study the financial statement. The City Manager reported that he had had a conver- sation with Bill Hunefeld of Stockton regarding STADIUM the possible use of Lodi Stadion to hold hardtop USE auto races during the summer months. Mr. Hunefeld would be interested if he could secure a reduction in the concession rate. Mayor Haskell stated that any arrangement the City wished to make should be approached with the view of including all users of the stadium rather than one individual. It was agreed that the City Manager should talk to Mr. Munson, holder of the concession rights to the stadium, for the purpose of working out a satis- factory arrangement. A letter from the San Joaquin County Chamber of Commerce stating that its Highway Committee was planning to present the needs of San Joaquin County to the State Highway Commission in Sacramento, April 17, 1953. The letter requested a resolu- RES. Secondly, early consideration should be given to the completion of (a) a new bridgge across the Mokelumne River on Sign Route g8 at Clements and (b) completion of the Rio Vista Cutoff from the Mokelumne River to the Sacra- mento River. Adoption of Resolution No. 1739, adopting the pro- gram of the San Joaquin County Chamber of Commerce was had on the motion of Councilman Richey, Rinn second. He explained further that it is very evident that the City, as well as other 206 Minutes of April 15, 1953 continued. interested parties, has in the past relied upon a court decision which abandoned the maps and which decision did not have any effect on the streets and alleys. He recommended that pro- ceedings should be initiated to abandon the streets and alleys which remain unopened pursuant to the statutory provisions contained in the ORD. N0.486 Streets and Highways Code. councilman Rinn INTRODUCED moved, Richey second, the introduction of Ordi- nance No. 486, declaring the intention of the City Council to abandon the following streets, or portions of streets, and alleys: As designated on the map entitled "Map of Lawrence Homestead Addition": Vine Street Willow Street That portion of Main Street lying north of lawrence Avenue, excepting and reserving therefrom an easement for public utilities of 15 feet lying 72 feet on each side of the center line of said Main Street. Almond Street, excepting the north one-half of said street which lies west of Stockton Street. That portion of Lawrence Avenue lying east of Stockton Street. As designated on the map entitled "Map No. 2 of Lawrence Homestead Addition": Portion of Central Avenue lying north of Lockeford Street. Portion of Washington Street lying north of Lawrence Avenue. Portion of Main Street lying north of Lawrence Avenue, excepting a 15 -foot easement lying 72 feet on each side of the center line of said street. Wilson Avenue. Almond Street, excepting the north half of said street lying west of Stockton Street. Pioneer Avenue. Portion of Lawrence Avenue lying east of Stockton Street. Those areas designated as "alley" lying within Blocks 7, 10, 11, 12, 15, 16, 17, 19, 20, 22, and 23. The motion carried by a unanimous vote. Claims in the amount of 471,722.18 were approved CLAIY3 and ordered paid on the motion of Councilman Preszler, Richey second. SPECS. The City Manager presented a recommendation from, the City Engineer for the removal of 32 street STREET trees which represent the greatest offenders to TREE sidewalks and curbs and gutters. The City En - REMOVAL gineer's recommendation also stated that the curb and gutter displacement in some instances are so severe as to injure the street sweeping equipment. Minutes of April 15, 1953. 204 Councilman Robinson pointed out that it was his understanding that the members of the City Council were to receive a list of the trees which the Engineer wished to remove for personal study before action for approval was taken. Councilman Rinn stated that he did not want to take issue with either the City Engineer or the Davey Tree Surgeon report regarding the advisability of re- moval of specific trees; however, he was inter- ested in making provisions for notification of property owners when a tree is to be removed. On the motion of Councilman Robinson, Richey second, the Council voted to request copies of the City Engineer's recommendations be furnished each member of the Council, and to instruct the City Clerk to prepare a form letter and a poster notice for use in notifying property owners of the intention of the City to remove trees. CITY PLANNING CONNiISSION A petition requesting the annexation of the 7.7 acre parcel lying immediately north of the Zion IREY ADDITION Reform Church, signed by the owners of the property, PETITION was presented by the City Manager. Resolution No. 1738, declaring the intention of the City RES, NO.1738 Council to annex said territory under the provi- ADOPTED sions of the "Annexation of Uninhabited Territory Act of 1939", designating the territory as the "Irey Addition", and setting the public hearing for May 20, 1953, was adopted by a unanimous vote. The City -Manager recd the minutes of the City Planning Commission for the meeting of April 13, 1953. The final map of the Preszler Tract, tentative map PRESZLER having been approved by the Planning Commission, TRACT was presented for approval. On the motion of FINAL MAP Councilman Rinn, Richey second, the Council ap- APPROVED proved said final map and authorized the Mayor to sign the map on behalf of the City Council. Councilman Robinson then commented that he had investigated the number of employees on the payroll over a six-year period and had found that the em- COUNCILINIAN ployees totaled 170 for the fiscal year 19478.48, ROBINSON whereas the total for the fiscal year 1952-53 was COPBIENTS ON 168. The total salaries over this same period had ADMINISTRATIVE increased by approximately 33%. However, he also EFFICIENCY learned that the water connections had increased by 32% over the same period. he stated that he could therefore conclude that the City was being operated efficiently and the overall picture was very encouraging. COUNCIL REORGANIZATION Mayor Haskell then referred to Resolution No. 1534, adopted on May 3, 1950, setting the term for Mayor at one year and calling for an election of the Mayor by the second meeting in April of each year. At this point he turned the meeting over to the City Clerk. Members of the Council extended their appreication to Mayor Haskell for his time and unselfish efforts as Mayor. Coun- cilman Robinson then nominated Councilman Richey COUNCILMAN for the post of Mayor. councilman Rinn seconded RICHEY the nomination, and Councilman Haskell called for ELECTED the closing of nominations and moved that a unani- MAYOR mous ballot be cast for Councilman Richey as Mayor. The motion carried with a unanimous vote. Mayor nichey, in accepting the position of Mayor, thanked the members of the Council for the confidence placed in her and stated that she would try to continue the active leadership exhibited by Mayor Haskell.
