City Attorney Mullen also present; City Manager Weller absent. Minutes of the previous meeting of October 6, 1954 were approved as written and mailed. COMMUNICATIONS THIEL CLAIM Letter from Athniel Thiel, 364 South Sunset Drive, submitted as a Verified Claim, asking $185 for damages to his house by road oil from City opera- tions. On motion of Councilman Richey, Mitchell second, the Council denied the claim and ordered it referred to the insurance carrier, and directed the City Clerk to include the complete letter in the minutes, as follows: VERIFIED CLAIM November 19, 1954 To City of Lodi City -Hall _ Lodi, California To City Clerk: I, Athniel Thiel, 364 South Sunset Drive, Lodi, California, hereby state that on August 30th, 1954 at about 430 p.m. said City of Lodi, thru its employees, agents or servants, did negligently allow road oil, or other foreign matter to become deposited upon my house at the above address. All to the damage of $185.00 for which I hereby make demand for payment. Respectively submitted, (signed) Athniel Thiel PUBLIC HEARINGS KNOLL SUBDIVISION This being the time and place designated for the ALLEY VACATION hearing of protests to the proposed abandonment of the west 225 feet of the alley lying between RES. #1850 ADOPTED Rimby Avenue and Tamarack Drive in the Knoll Sub- division, Mayor Fuller called for such protests. There being no protests offered, either written or oral, Resolution No. 1850, ordering the aban- donment of said alley, was adopted on the motion of Councilman Hughes, Richey second. REPORTS OF THE CITY MANAGER STAHL CONTRACT The City Clerk presented a letter from the City EXTENDED Engineer requesting that the contract for the con- struction of the sewage disposal plant be extended to February 2, 1955• The City Engineer explained that some of the equipment purchased by the City has not been delivered and is therefore delaying the work of the contractor. The extension was granted as requested on the motion of Councilman Robinson, Mitchell second. 378 8 Minutes of December 1, 1951+ continued STADIUM SEAT A new contract, between the City of Lodi and Lodi CONTRACT District Chamber of Commerce, drafted by the City APPROVED Attorney in accordance with the terms agreed upon at the meeting of November 17, 1954, providing for the repayment by the City for the cost of seat installation in the Lodi Stadium, was ap- proved and the Mayor authorized to sign on behalf of the City on the motion of Councilman Hughes, Richey second. EMPL OYEESResolution No. 1849, authorizing the City Manager CHRISTMAS to spend up to $400 for the purpose of holding a DINNER Christmas Dinner Party for the employees of the City, was adopted on the motion of Councilman RES. #1849 Richey, Hughes second.. In the discussion which preceded the action, it was agreed that the hold- ing of the Christmas dinner would be of value in maintaining the high morale of the City employees; however, such action is not intended to establish a precedent. SPECS Specifications for the purchase of three 1955 POLICE CARS sedans with V8 motors for use as patrol cars in the Police Department were approved on the motion of Councilman Robinson, Richey second. MORTENSON The City Clerk explained that the owner of the TRACT STREET Mortenson Tract had experienced difficulty in DEED obtaining loans from the Federal Housing -Adminis- tration because the dedicated width of Acacia Street was inadequate within the subdivision. The developer, Mr. Storro, had arranged for the dedi- cation of an additional 5 feet by the owners of the east 3 acres of Lot 48 of the Lodi Barnhart Tract, Mr. and Mrs. Harold E. Smith. Mr. and Mrs. Smith agreed to dedicate the necessary 5 feet only if they could be assured that they would not be required to improve the street until such time as their property was subdivided. Mr. Glaves presented a letter signed by Mr. and Mrs. Smith agreeing to the above terms. The City Clerk re- quested permission to accept the deed with the stipulated conditions. On the motion of Council- man Mitchell, Hughes second, the Council voted to authorize the acceptance of the deed and the conditions only if the grantors accept the follow- ing additions to the letter setting out the con- ditions: (1) The cost of improving the proposed strip shall be borne by the grantors or their successors and (2) the City will not require the grantors or their successors to improve the 5' strip until the additional 10' right of way is granted to the City and the remaining property of the grantors is subdivided. CENTURY MANOR The City Clerk pointed out that the City Council ADD. WITHDRAWN has not taken the necessary action to withdraw FROM W.R.F.P.D.the last two annexations from the Woodbridge Rural RES. #1847 Fire Protection District. On the motion of Coun- cilman Richey, Mitchell second, the Council adopted Resolution No. 1847, withdrawing the Century Manor Addition from the Woodbridge Rural Fire Protection District. Minutes of December.l, 1954 continued. 37 S.HUTCHINS ST. Resolution No. 1848, withdrawing the South Hutchins ADD. WITHDRAWN Street Addition from the Woodbridge Rural Fire FROM W.R.F.P.D. Protection District, was adopted on the motion RES. #1848 of Councilman Hughes, Richey second. HALL OF The City Clerk then reported that he had received JUSTICE the official results of the election held November VOTE RESULTS 2, 1954, in which the voters of the City were asked for an advisory vote on the Hall of Justice measure. The report from the County Clerk showed the follow- ing vote: PROPOSITION "B" - Yes 2819 No 2420 ORD. NO. 518 Ordinance No. 518, entitled "An Ordinance of the INTRODUCED City of Lodi Prohibiting the Construction of a Hall of Justice, Including Courtroom Facilities for the Justice Court, Lodi Judicial District, or Jail Facilities, or Police Department Facilities in the Area Bounded on the North by Elm Street, on the West by Pleasant Street, on the East by Church Street and on the South by Pine Street in Said City" was then read in full at the request of the Mayor. Ordinance No. 518, entitled as above, was then introduced on the motion of Councilman Robinson, Richey second. On the motion of Councilman Richey, the meeting was adjourned at 8:45 p. ATTES H A.
