HomeMy WebLinkAboutMinutes - April 7, 19543Jt �- CITY COUNCIL, CITY OF LODI COUNCIL CHAMBER, CITY HALL APRIL 7, 1954 This regular meeting of the City Council of the City of Lodi held beginning at 8:00 o'clock p.m. of Wednesday, April 7, 1954; Councilman Hillman, Preszler, Rinn, Robinson and Richey (Mayor) present; none absent. City :vanager Weller and City Attorney Mallen were also present. Nrutes of the previous meetings of March 3, 1954 and March 17, 1954 were approved as written and mailed. COMMUNICATIONS WISE WORK letter from the Board of Trustees of the Lodi Elementary C0�^ENDED School District commending the City Council for the work that is being done by Harold Wise, Planning Consultant. The Board stated in its letter that it is of the opinion that his work will be of great value to the City and to the Lodi schools. SAFIAY Letter from Continental Properties Company, Division of Safeway UTILITY Stores, Inc., submitting a draft in the amount of $2,530.00 REL -CATION to cover the cost of relocating sewer and water lines in Block 36, City of Lodi, thereby complying with the conditions stipulated by the City Council to be met before action would be taken to abandon the alley in said block. CA:. AC-GlE Letter from the University of California at Davis announcing PICNIC DAY Cal Aggie Picnic Day'to be held on April 10, 1954 on she Davis Campus. BUDDIST Letter from the Buddist Church of Lodi stating that it plans CHURCH to erect a new church at 23 North Stockton Street and that it desired permission to block off the alley south of the church during the week of April 14-21 while the old church was being dismantled. The City Council instructed the City Manager to make certain that the alley was not needed during this period before notifying the church that permission had been granted. LCC,CVD Letter from the City of arced announcing a meeting of the I-EETLNG Cdntral Valley Division of the League of -California Cities on April 22, 1954. PUBLIC HEARINGS WINDSOR TRACT Mayor Richey opened the meeting to people wishing to be heard REZONING on the Question of rezoning of Lots 24, 25, 46 and 47 of the CRD. 508 Windsor Tract. Due notice and publication of the intention of INTRODUCED the City Council to rezone said property from the R-1 to the R-3 Residential District having been given and no protest being received, Councilman Robinson moved, Rinn second, the introduction of Ordinance No. 508, approving the rezoning as requested. ALLEY Mayor Richey opened the meeting to the reception of protests to ABANDONMENT the proposed abandonment of the alley in Block 36 of the City BLCCK 36,1rol of Lodi. There being no objections or protests offered, Council - RES. ;181.0 maa Preszler moved, Hillman second, the adoption of Resolution ADOPTED ":o. , ordering the abandonment of the alley in Block 36, City of Lodi, as described in Ordinance of Intention No. 507. The motion carried by unanimous vote. REPORTS OF THE CITY MANAGER OIL The City ;,anager presented specifications for an oil distributor DISTRIBUTOR which he recommended for purchase in the Engineering Department. SPECS The estimated cost of the equipment is $2,500. Mr. Weller explained that provisions for the purchase of this equipment had not been included in the 1953-54 budget; however, there was sufficient money in the fund to make the purchase. He added Fhrutes of April 7, 1954 continued. 31.9 that the City now rents this piece of equipment when needed, but the equip- ment is not always available when needed, thereby causing delays in Department operations. The City presently spends between $350 and $400 per year for the rental of this piece of equipment. "ouncilman Hillman asked if this was a sudden inspiration on the part of the City Engineer and why hadn't the Co,^ncil heard of the reed before. D%. 'Weller explained that the Street crews have been doing more work this year than was anticipated and the need for the equipment is more frequent. Since there are certain days when the application of the liquid asphalts is unsafe due to winds causing drifts which endanger cars, buildings, etc., it is important in the scheduling of work for the crews to have the equipment available when conditions are favorable. Councilman Robinson stated that he thought the Engineering crews had been very efficient and if this equipment was necessary to facilitate their work, he felt they should have it. The specifications were they_ approved or the motion of Councilman Rinn, Robinson second. BOARD OF ;'x. "eller then stated that he visited the Board of Fire Underwriters FIRE U^iDSR- in San Francisco, accompanied by Fire Chief Polenske and Assistant Fire WRITERS Chief Ritzmann, to discuss the recent survey conducted by the Board in RECOM - Lodi. The purpose of the survey was to determine whether Lodi qualifies ME.IDATICNS for a Class N fire rating, on the basis of recent improvements made in the Fire Department. %i'. Weller reported that the evaluation of the survey was not complete; however, the Board of Fire -Underwriters had made several suggestions for improvement of the City's position. HOUSE The first suggestion is to retitle the job classification of "House CAPTALN Captain" to that of "Fire Captain", with a clarification of the duties RECLASSI- for that position. The Board also wants the appointments to this FICATION position made by written competitive examination. At least for the present, it would not'involve any salary increase. Councilman Robinson asked if experience or time served on the job count for anything in the examination_ or appointment. 'It. Weller replied that the Fire chief feels that the examination should be confined to men at the top salary step. Ntl. Robinson stated that he felt that if the three men presently holding the title of "House Captain" receive a passing grade, they should receive the appointment regardless of their place on the eligible list. Yx. Weller stated that it was only fair to point out that the duties of the "'douse Captain" at original appointment was mainly to clean up and police the fire houses. It y --as agreed that if the incumbents to the position receive a passing grade in the examination., they should get the appointment regardless of their position or. the list. Ips. Weller stated that the Board also recommended FIRE HOSE the purchase of 1,000 feet of 3 -inch hose and 20 feet of 5 -inch hard SPECS suction hose. The total estimated cost is approximately $2,800. ins. Weller proposed that the purchase be made or an informal bid basis. After further discussion, the Council agreed to authorize the City Manager to deal on the open market and call for informal bids with the provision that a report be made to the City Council when the choice was made. "MA S Mx. Weller reported that the City still had a credit of $4,443.04 TRE" FUNDS in the Chapter 47 Funds (Xmas Tree Funds) which can be used on a RES.#1809 matching basis for plans. He stated that application should be made ADOPTED for these funds before the end of the fiscal year. On the motion of Councilman Rion Hillman second, the Council voted to adopt Resolu- tion No. 1809, authorizing the application for $4,443.04, for the plans for the sewer plant expansion_. CLAIrS Claims in the amount of $74,911.01 were approved on the motion of Councilman Hillman, Rinn second. GOLF 2°i'. Weller presented a draft of a contract between the City and IQ's. DRITII?tG Andy Devine for the operation of the golf driving range on the R.A"IGE Festival ggrounds. The contract provided for the construction by CONTRACT. the City of a building at a cost of approximately $1600 plus labor to be rented by i•r. Devine for the rental of $20 per month. 0ouncil- man Robinson stated that he felt a rental of $20 a month was not enough for a building of this type. The lot sizes in the subdivision do not cop -form to the R-1 requirements. idiS. E1 HARDT Mayor Richey stated that :mss. Ezra Ehrhardt had been honored CCVGRATULATED recently by being chosen as the National Motorcycle Girl. She stated that Mx. and ass. Ehrhardt are fine types of people and have done a fine job of advertising Lodi in their motor- cycle activities. The pity Council voted to authorize the Mr yor to write a letter of congratulations to Ins. Ehrhardt. V City Clerk the City Council agreed to hold the contract over to a sub- sequent meeting, but to permit Mr. Devine to operate until such time as the contract was signed, providing that he can give the City assurance that he has proper insurance coverage. PAF.K SITE The Council then considered a letter from the Recreation. Com - REQUEST mission recommending the purchase of Lots 27 to 39 of the Bel - GEORGE Air Estates subdivision as said lots were designated on the WASHINGTON tentative map approved by the Planning Commission. Said lots SCHOOL cover an area of approximately 2.5 acres which will lie west of George Washington School grounds and along the east side of Fairmont Avenue as said street is shown on the tentative map. she Recreation Commission stated that such purchase for park purposes would be in line with their recommendation for the purchase of land for recreation in conjunction with school site acquisition. Councilman Robinson stated that the City is rather limited in the amount of land that can be purchased at one time, and since we know there is going to be a school site acquired in the southwest area of the City where we need a park, he did not think the City could make the recom- mended purchase. It was agreed that this purchase could not be made at this time. The Uouncil expressed appreciation of the work being done by the Recreation Commission in planning the recreation program, but it felt that they must recognize the limitation on funds available for all the City's reeds. CITY PLANNING CO!!-IJSSICI! KUHLMAPtN The City Via^^ager read a report from the Zoning Committee VARIANCE granting an adjustment to LaVerne:Kuhlma.-n1 for front yard variance for a home to be constructed on Lot 28 and a portion of Lot 29 of the Koontz 'ubdivision. Said variance would permit a set -back of 16 feet due to the irregular shape of the '_ot which would place an undue hardship on the owner of the property.
