City Clerk Glaves read a :-mitten protest filed b., Lillian Fuller. Said protest took 'issue with the method of assessing corner property, maintaining that the side frontage of a corner lot did not have the same value or derive as much benefit as the front of the lot. The written protest contained the suggestion that a reasonable relative relationship be established for the side street values, that such reasonable proportion be so charged, and that the balance be I by the lighting district as a whole at a re- figured cost per foot. amity Attorney Pullen stated that in his opinion, the protest was not based on va'_i: legal grounds and ahe felt the courts would uphold the assessment. 'Mr. Robert Fuller addressed the Council on behalf of the protestant to say that he did not believe the assessment to be `_'air nhen the side of the lot is assessed at the same rate as the front of the lot. He considered the School ASSESS,:ENT Street side of his mother's property to be the front CO�iFI3i ED and the ?:alnut Street side to be the side of the lot. Ccuncilrran Preszler stated that he believed RES. ,=1900 the Walnut frontage would be benefited more than. the ADOPTED School Street frontage. It was explained that assessments in the commercial district are based on all frontages in view of the fact that all frontages are used for commercial frontages. It was further pointed out that both sides of Krs. Fuller's lot received the same amount of li ht from the street lights installed. Councilman Robinson stated that he could not agree that there is a more equitable method of assessing the costs in this district. Councilman Freszler then moved, Robinson second, the adoption of Resolution No. 1806, confirming the assessment in the Downtown Street Lighting District. The motion passed by a unanimous vote. REPORTS OF THE CITY MANAGER The City Manager presented specifications for three FOLICE CAR automobiles to replace three police patrol cars. SFECIFICATIOPiS The specifications also called for offers for trade in of three cars owned by the City. P:r. Weller explained that the 1953-54 budget provided funds for leasing of police cars; however, the offers received for the leasing of the cars were not . comparable to the City's cost for owning and operating its own vehicles. He then recommended that the ,.hree vehicles be n -placed by the purchase of new autos. He pointed out that two of the cars to be replaced would be transferred to other depart - :rents with the trade-ins coring from these depart- ments. The third car to be traded in would be a 300 .,.inutes of January 20, 1954. police car. The specifications were amended to provide for alternate bids for cars equipped with automatic t:•ansmission, at the suggestion of Coun- cilcan Robinson. The specifications were then approved as amended on the :potion of Councilman 'inn, Preszler second. The Nlayor and City Clerk were authorized to sign a TELEPHONE CO. deed granting to the Pacific Telephone and Tele- EASEt•ENT graph Company an easement of 2 x 20 feet in Lawrence Park on the motion of Councilman Robinson, Rinn second. The final map entitled "Century Manor, Unit No. 211, FINAL MAP certified by the City Engineer as substantially CENTURY :KANOR complying with the tentative man approved by the UNIT #2 City Planning Commission, was approved for recorda- tion and the streets and easements therein accepted as City streets on the motion of Councilman Robin- son, Preszler second. This acceptance is subject to improvement of the streets to City standards before they will be maintained by the City. The Mayor and City Clerk then signed the map. CITY PLAiVp+_NG COP'I.-:ISSION Councilman Robinson reported that Mr. Wise, the ;i1S^LE' PLAYCity's planning 'consultant, has scheduled the first discussion of the masterplan for the meeting of the Planning Commission on January 25, 1954. "_ayor Richey recorrmended the attendance of those members of the City Council free to do so. Mayor Richey reported the letter of resignation M.ULLEN from the City Planning Commission submitted by h:r. RESIGNATIOty Robert H. Mullen. It was noted that the Planning FRJt,: C.P.C. Commission had regretfully recormended the accep- tance of Mr. Mullen's resignation. Blayor Richey . added the regrets of the City Council to that of the Planning Commission. Mr. Mullen's resigna- tion was then accepted by the City Council with regrets on the motion of Councilman Robinson, Preszler second. Councilman Robinson questioned if it would be in order to request the City Plan- ning Commission for recommendations for the re- placement. Councilman Rinn stated that he would prefer the word "suggestion" used in place of the word "recommendation". City Attorney Mullen re- minded the Council that the Planning Commission is an advisory body responsible to the City Council. He pointed out that under the statutes of the State of California the powers of the planning commis- sion, are increasing. He therefore questioned the advisability of developing a practice which might tend to enable the Planning Commission to perpetuate itself. Councilman Rinn expressed himself in support of the views of the City Attorney and sug- gested that the City Council select a name which could be discussed with the Chairman of the Plan- ning Commission in the interest of harmony. No further action was taken. :-,inutes of January 20, 1954 continued. 30 City Clerk Glaves then reported that the petition. S0. LEE AVE. for the formation of the South Lee Avenue Street STRUT LIGHTS Lighting District had been verified and failed to obtain the necessary signatures of owners of 60% of the property in the proposed district. He added that the petition would be returned to the proponents of the district without official action by the City Council.
