HomeMy WebLinkAboutMinutes - July 6, 1955484, CITY COUNCIL, CITY OF LORI COUNCIL CHAMBER, CITY HALL JULY 69 1955 This regular meeting of the City Council of the City of Lodi held beginning at 8:00 o'clock n.m. of Wednesday, July 6, 1955; Councilmen Fuller, Hughes, Mitchell, Richey and Robinson (Mayor) present; none absent. City Manager Weller and City Attorney Mullen also present. Minutes of the meetings of February 9, 1955, February 16, 1955, March 2, 1955, March 16, 1955, June 1, 1955, June 15, 1955, and June 22, 1955, were approved as written and mailed. COM`{UNICATIONS COVELL A verified claim from Josephine Covell alleging an CLAIM injury suffered as a result of a fall on City side- walk on April 11, 1955• The claim was for the amount of 8634.00. The claim was denied and referred to the insurance carrier on the motion of Councilman Richey, Fuller second. PUBLIC HEARINGS APPROVE This being the time and place designated for the ANNEXATION hearing of the public regarding the proposed annexa - WILLOW GLEN tion of the "Willow Glen Addition", Mayor Robinson ADDITION called for those persons wishfng to protest said annexation to address the Council. There -being no ORD. N0.534 protests offered, either oral or written, Council - INTRODUCED man Richey moved, Fuller second, the introduction of Ordinance No. 534, approving the annexation of the "Willow Glen Addition" to the City of Lodi. The motion was adopted by unanimous vote. APPROVE Mayor Robinson then called for the hearing of pro - ANNEXATION tests to the proposed annexation of the "Tokay Gar- TOKAY GARDENS dens Addition". The City Clerk read the written ADDITION protest of Alice Goodman Burnett and Minerva Goodman to annexation of property belonging to them consisting ORD. NO -535 of nine acres with an assessed value of $3450. He INTRODUCED also read the protest of Etta Goodman to the annexa- tion of her property totaling 8.159 acres with an assessed value of $3405. The total protest consisted of 17.159 acres with an assessed value of $6855. The total area of the proposed annexation is 62.8 acres with an assessed value of $31,085. Since the protests represented less than one-half of the terri- tory proposed for annexation, both by area and assessed valuation, Councilman Richey moved, Mitchell second, the introduction of Ordinance No. 535, approv- ing the annexation of the "Tokay Gardens Addition" to the City of Lodi. The motion carried by unanimous vote. REPORTS OF THE CITY MANAGER AGREEMENT The City !Manager presented an agreement prepared by FOR HAM LA.iE the County for the reconstruction of Ham Lane between CONSTRUCTION Lodi Avenue and the Southern Pacific railroad tracks just north of Holly Drive. The agreement provides for the County to pay 15% of the cost of said re- construction, but not more than $4,125.00. On the motion of Councilman Fuller, Hughes second, the Council voted to approve the agreement and authorize the Mayor to sign on behalf of the City of Lodi. minutes of July 6, 1955 continued. 43 CONTRACT Mr. Weller presented a standard agreement with the STATE State Personnel Board for personnel services to PERSONNEL the City of Lodi during the fiscal year 1955-56• SERVICES Mr. Weller explained that this agreement was required before we could use the State services; however, RES. #1871 it did not commit the City unless the services were ADOPTED used. Resolution No. 1871, approving the contract with the State Personnel Board, was adopted on the motion of Councilman Hughes, Fuller second. CLAIMS Claims in the amount of $131,758.20 were approved on the motion of Councilman Fuller, Richey second. ORD. N0.531 ORDINANCE NO. 531, "AN ORDINANCE FIXING RATES FOR ADOPTED WATER AND REPEALING ORDINANCE NO. 46, ENTITLED 'AN ORDINANCE PROVIDING REGULATIONS FOR THE MUNICIPAL INCREASE HATER WORKS AND FIXING RATES FOR WATER', ORDINANCE WATER RATES NO. 56, ENTITLED 'AN ORDINANCE AMENDING SECTION 30 OF ORDINANCE NO. 46, ORDINANCE OF THE CITY OF LODI ENTITLED 'AN RODINANCE PROVIDING REGULATIONS FOR THE MUNICIPAL '.DATER WORKS AND FIXING RATES FOR WATER', AND ORDINANCE NO. 207, ENTITLED 'A.N ORDINANCE FIXING RATES TO BE CHARGED FOR THE SUPPLY OF WATER THROUGH METERS AND REPEALING THAT PORTIO14 OF ORDINANCE NO. 113 NOT REPEALED BY ORDINANCE NO. 115111, having been regularly introduced on June 29, 1955, was brought up for passage on the motion of Councilman Mitchell, Hughes second. Second reading was omitted after reading by title, and then passed, adopted, and ordered to print by the following vote: AYES: Councilmen - Hughes, Mitchell and Robinson ?TOES: Councilmen - Fuller and Richey ABSENT: Councilmen - None Mayor Robinson then signed Ordinance No. 531 in approval thereof. ORD. NO. 532 ORDINANCE NO. 532, ENTITLED "AN ORDINANCE AMENDING ADOPTED ORDINANCE NO. 506, ENTITLED 'AN ORDINANCE REPEALING ORDINANCE NO. 495 AND AlN=ING ORDINANCE NO. 444, AMENDS RELATING TO COMPENSATION OF OFFICERS AND EMPLOYEES SALARY OF THE CITY OF LODI"', having been regularly intro - ORDINANCE duced on June 29, 1955, was brought up for passage on the motion of Councilman Fuller, Mitchell second. Second reading was omitted after reading by title, and then passed, adopted and ordered to print by the following vote: 4N6 Minutes of July 6, 1955, continued. WALTER Mayor Robinson then reminded the Council that the REAPPOINTED terns of Robert Fuller and Ed Walter on the City TO C.P.C. Planning Commission expired on June 30, 1955. He stated that Mr. Fuller hzd indicated that he did not wish to be reappointed. On the motion of Coun- cilman Richey, Mitchell second, the Council voted to reappoint Mr. Ed Walter to a four year term on the Planning Commission and to defer action on the replacement for Mr. Robert Fuller. APPRECIATIOni On the motion of Councilman Richey, Hughes second, EXPRESSED TO the Mayor was authorized to send a letter to Mr. ROBERT FULLER Robert Fuller expressing the appreciation of the City Council for his outstanding service to the City of Lodi over the past ten years as Chairman of the City Planning Commission. Mr. Jack Hoggatt addressed the City Council to suggest that an award of more substance and lasting value than a letter be given to people accomplishing outstanding service for the City. The meeting was adjourned at 8:45 p.m. on the motion of Councilman. Fuller, Richey second. NO. 533 ORDINANCE NO. 533, "ADOPTING A BUDGET FOR THE SUPPORT ADOPTED OF THE VARIOUS DEPARTMENTS OF THE CITY OF LODI FOR THE FISCAL YEAR BEGINNING JULY 1, 1955, AND ENDING 1955-56 JUNE 30, 195611, having been regularly introduced BUDGET on June 29, 1955, was brought up for passage on the motion of ouncilman Richey, Fuller second. Second reading was omitted after reading by title, and then passed, adopted and ordered to print by the following vote: AYES: Councilmen - Fuller, Hughes, Mitchell, Richey and Robinson NOES: Councilmen - None ABSENT: Councilmen - None Mayor Robinson then signed Ordinance No. 533 in approval there.of. COLLECT The City Clerk explained that there were approxi - DELINQUENT mately sixty delinquent accounts with the City as STREET LIGHT a result of the five street lighting districts ASSESSMENTS formed within the past three years. He recommended ON TAX ROLL that the City take advantage of the provisions of Chapter 18.1 of the Streets and Highways Code and RES. #1872 have these delinquent assessments collected by the ADOPTED County Assessor with the 1956 taxes. Resolution No. 1872, "Resolution Providing for the Collection of Special Assessments for Street Light Construction on the South Church Street Lighting District, Down- town Lighting District, South Pleasant Avenue Light- ing District, Fairmont Avenue Lighting District and the South Lee Avenue Lighting District, by the County Tax Collector", was adopted on the motion of Councilman Richey, Hughes second.
