Order Instituting Investigation on the Commission's own motion to design and implement a program that provides for publicly available telecommunications devices capable of servicing the needs of the deaf or hearing impaired in existing buildings, structures, facilities, and public accommodations. OCTOBER 9,1997 SAN FRANCISCO OFFICE I.97-10-019 By this order, we institute a rulemaking and companion investigation proceeding into the design and implementation of a program to provide for publicly available telecommunications devices capable of servicing the needs of the deaf or hearing impaired (TDDS) in existing buildings, structures, facilities, and public accommodations, pursuant to the provisions of Public Utilities Code (PU Code) Section 2881.2, attached to this order as Appendix A. (Repealed and added by Stats. 1996, Ch.779. Sec. 3. Effective January 1, 1997.) Background By Decision (D.) 92603 (5 CPUC2d 305 (1981)) we designed and implemented a program whereby each telephone corporation provides TDDs funded through a "Communications Devices for the Deaf' surcharge scheduled to expire on January 1, 1997. Subsequently, the California Legislature enacted Assembly Bill 3152, signed by -1- R.97-10-018,1.97-10-019 ALJ/MFG/jac the Governor on September 21, 1996, which extended the surcharge from January 1, 1997 to January 1, 2001, and added Section 2881.2 to the PU Code. PU Code Section -2881.2 requires the Commission to design and implement a new program providing for the placement of TDDs in existing buildings, structures, facilities, and public accommodations through an appropriate committee under the Commission's control. This program is to be phased in, over a reasonable period of time, beginning no later than January 1, 1998. Program Issues We open this rulemaking and companion investigation proceeding to obtain input from interested parties on the selection of a committee under the Commission's control to assist the Commission in establishing implementation guidelines for this new program. All Local Exchange Carriers and Competitive Local Carriers should be named respondents to this rulemaking and investigation proceeding. Copies of this rulemaking and investigation should be mailed to interested parties including those on the service list of Investigation 86-07-031, an investigation into providing specialized or supplementary telephone communications equipment to subscribers who are certified disabled, and on all cities and counties within California. Named respondents and interested parties are invited to comment on the following program administration, funding and disbursement issues: 1. Program Administration A. Committee's Composition PU Code Section 2881.2(a) requires the Commission to implement this new public telephone and TDD equipment program through a committee under the Commission's control. There are currently in existence two public policy committees with public telephone or TDD equipment experience. They are the Deaf and Disabled Telecommunications Program Administrative Committee (DDTPAC) and the Customer Owned Pay Telephone Enforcement Program Subcommittee (COPT Subcommittee). -2- R.97-10-018,1.97-10-019 ALJ/MFG/jac The DDTPAC, established by D.92603, is responsible for providing telecommunications equipment and services to the deaf, hearing impaired, and disabled under three separate programs. These are the TDD, Dual Party Relay System, and Supplemental Telecommunications Equipmer-Lt Programs. This committee consists of five members representing the diverseinterests of disabled persons, Pacific Bell, GTE California, Incorporated, the independent telephone companies, and the Commission staff. The COPT Subcommittee, established by D.90-06-018 (36 CPUC2d 446 (1990)), is responsible for educating pay telephone service providers on the operation, signage and rate cap requirements for pay telephones; enforcing the tariffs in effect for pay telephone service; and educating consumers on the operations of pay telephones. The COPT Subcommittee was established by representatives of the pay telephone industry, Consumer Action, Pacific Bell, -GTE California, Incorporated, and the Commission staff to provide advice for the COPT Enforcement Program. Should the responsibility for this new program be delegated to an existing public program committee with public telephone or TDD equipment experience? Should a new committee consisting of a representative from the DDTPAC, COPT Subcommittee, and Commission staff be established or should a distinctly separate committee be established? If a new committee should be established, how many members should belong to the committee, what should the composition of the committee be, how should they be selected, and what should be their term limits? Is a committee charter necessary? If so, what should be included in the charter, should the charter be approved by the Commission, and how should it be accomplished? B. Committee Relationship to the Commission The statute specifically states that the committee shall be under the control of the Commission. What type of control should the Commission exercise over the committee? Should the Commission delegate policy decisions to the Committee? If so, how should we identify the types of decisions and guidelines? What types of reports should the committee be required to provide to the Commission and at what frequency? What process should the committee use to submit its reports? -3- R.97-10-018, I.97-10-019 ALJ/MFG/jac C. Committee's Responsibilities Although PU Code Section 2881.2(a) sets forth the committee's specific responsibilities, assistance is requested by the Commission to provide the committee direction in carrying out its statutory responsibilities. Thesg specific responsibilities identified by statute are to determine and specify locations within existing buildings, structures, facilities, and public accommodations in i: -:-d of a TDD; to contract for the procurement, installation, and maintenance of TDDS; and to seek cooperation of the owners, managers, and tenants of locations determined to be in need of TDDS. 1. TDD Locations Parties should read the issues listed under the followini; -jgram phase-in discussion before addressing issues related to TDD locations. What criteria should the committee use to select and prioritize locations needing TDDS? Who should give input to the committee in establishing such a list and how should such input be given? Should this list be modified periodically? If so, how often? Should the committee submit its priority lists to the Commission for approval? If so, how should this be done, e.g., by resolution? 2. Procurement, Installation, and Maintenance Contract By statute, the committee is required to ensure consideration of for-profit and nonprofit corporations, including nonprofit corporations with demonstrated service to individuals who are deaf or hearing impaired and whose boards of directors and staff are made up of a majority of those individuals. What guidelines should be implemented for the letting of a contract for the procurement, installation, and maintenance of TDDS? For example, should the contract be based on a competitive bid process? Should separate contracts be let for the procurement, installation, and or maintenance of TDDS? What guidelines should be used to assess individual contract proposals? Who should own the TDD equipment and why? -4- R.97-10-018, I.97-10-019 ALJ/MFG/jac 3. Cooperation of Owners, Managers, and Tenants What type of cooperation is needed from owners, managers, and tenants of locations determined to be in need of a TDD with regard to its installation and maintenance? What guidelines should -be used to seek such cooperation? How should such owners be compensated for costs they incur in providing access to TDD's in their buildings? What type of costs should be recoverable? D. Committee's Day -to -Day Operations How should the committee oversee daily matters that may occur in carrying out its statutory responsibilities? Should the committee hire employees or retain outside counsel? If so, to what extent? E. Program Phase in This new program is to be phased in beginning January 1, 1998, giving priority to those locations determined by the Commission, with the advice and counsel of statewide nonprofit consumer organizations for the deaf, to be of utmost importance and useful to the deaf or hearing impaired. How should we seek the advice and counsel of statewide nonprofit consumer organizations for the deaf to prioritize locations? Should it be done by the Commission or delegated to the committee under the Commission's direction? How should it be accomplished? Any guidelines for prioritization? How should this program be phased in? Any proposed time line? 2. Program Funding and Disbursement Requirements PU Code Section 2881.2(b) requires the Commission to ensure that project costs are recoverable as they are incurred, including any costs incurred by the owners, managers, or tenants of locations being equipped with TDDs under this program. What should be classified as recoverable costs? Should committee members be compensated for their time? What guidelines should be used to verify the reasonableness of recoverable costs? How should requests for reimbursement of recoverable costs be processed? Who should be responsible for approving payments? -5- R.97-10-018, I.97-10-019 ALJ/MFG/jac* Although this program is to be funded as part of the surcharge set forth in Section 2881(d) of the PU Code, the Commission is required to account for this program distinctly separate from any other program. The program surcharge shall be in effect until January 1, 2001. Should a trust be established to receive the surcharge revenues applicablc> to this program, invest surcharge revenues, and pay program expenditures? If so, how should the trust be established, who should the trust report to and what type of reporting requirements should be implemented? Should the Commission impose investment restrictions on surcharge. revenues? If the surcharge is not maintained by a trust, who should be responsible for the receipt and disbursement of surcharge funds and how should it be implemented? What process should be used to disburse funds? What are reimburseable activities? The surcharge shall not exceed two -hundredths of one percent and shall be counted toward the maximum one-half of one percent surcharge uniformly applied to a subscriber's intrastate telephone service pursuant to PU Code Section 2881(d). What process should be used to set the initial surcharge for this program? Should the program retain a specific amount of funds in reserve? How often should the reasonableness of the surcharge be reviewed and under what process? Should the committee be required to submit a program budget on an annual or other basis? Should the program budget be approved by the Commission and if so what process should be used? IT IS ORDERED that: 1. A rulemaking and investigation proceeding is instituted to design and implement a program providing for publicly available telecommunications devices capable of servicing the deaf or hearing impaired in existing locations pursuant to Public Utilities Code Section 2881.2. 2. All Local Exchange Carriers (LECs) and Competitive Local Carriers (CLCs) are named respondents to this rulemaking and investigation proceeding. 3. Respondent LECs and CLCs and interested parties are invited to file written comments on the issues identified in the body of this order with the Commission's Docket Office on or before November 7, 1997. Copies need not be served on all parties receiving a copy of this investigation. However, copies of written comments shall be R.97-10-018, I.97-10-019 ALJ/MFG/jac provided to each respondent LEC and shall be made available to respondent CLCs and interested parties requesting such copies. In this regard, the Process Office shall maintain and make available to any party, upon request, a list of parties who file comments and their addresses. It is the responsibility of the individual parties seeking copies of comments to request such copies from the parties who file comments. 4. Respondent LECs and CLCS, and interested parties may file reply comments with the Docket Office on or before November 24, 19.97. Any party who files a reply comment shall serve a copy of its reply comments on all parties who file comments with the Docket Office. 5. The Commission's Executive Director shall cause a copy of this rulemaking and investigation to be served immediately upon respondent LECs and CLCs listed in Appendix B and C, respectively; the service list of Investigation 86-07-031; and all cities and counties within California. (a) In addition to the requirements of Section 2881, the commission shall design and implement a program that shall provide for publicly available telecommunications devices capable of servicing the needs of the deaf or hearing impaired in existing buildings, structures, facilities, and public accommodations of the type specified in Section 4450 of the Government Code and Sections 19955.5 and 19956 of the Health and Safety Code, making available reasonable access of all phases of public telephone service to .individuals who are deaf or hearing impaired. The commission shall direct the appropriate committee under its control to determine and specify locations within existing buildings, structures, facilities, and public accommodations in need of a telecommunications device and to contract for the procurement, installation, and maintenance of these devices. In the letting of the contract, the commission shall direct the committee to ensure consideration of for-profit and nonprofit corporations, including nonprofit corporations with demonstrated service to individuals who are deaf or hearing impaired and whose boards of directors and staff are made up of a majority of those individuals. The commission shall also direct the committee to seek the cooperation of the owners, managers, and tenants of the .existing buildings, structures, facilities, and public accommodations that have been determined to be in need of a telecommunications device with regard to its installation and maintenance. The commission shall phase in this program over a reasonable period of time, beginning no later than January 1, 1998, giving priority to those existing buildings, structures, facilities, and public accommodations determined by the commission, with the advice and counsel of statewide nonprofit consumer organizations for the deaf, to be of most importance and usefulness to the deaf or hearing impaired. (b) The commission shall ensure that costs are recovered as they are incurred under this section, including any costs incurred by the owners, managers, or tenants of existing buildings, structures, facilities, and public accommodations, and shall utilize for this purpose the rate recovery mechanism established pursuant to subdivision (d) of Section 2881. The commission shall also establish a fund and require separate accounting for the program implemented under this section and, in addition, shall require that the surcharge utilized to fund the program not exceed two -hundredths of 1 percent, that it be combined with the surcharge required by subdivision (d) of Section 2881, and that it count toward the limits set by that subdivision. This surcharge shall be in effect until January 1, 2001. (c) "Existing buildings, structures, facilities, and public accommodations," for the purposes of this section, means those buildings, structures, facilities, and public accommodations or parts thereof that were constructed or altered prior to January 26, 1993, or are otherwise not required by Section 303 of the Americans with Disabilities Act of 1990 (Public Law 101-336) (42 U.S.C., Sec. 12183) or any other section of that act and its implementing regulations and guidelines, to have a publicly available telecommunications device capable of serving the needs of the deaf or hearing impaired.
