City Manager Weller and City Attorney Mullen also present. Minutes of a previous meeting, January 5, 1955, were approved as written and mailed. COMMUNICATIONS Letter from Sheriff Sousa inviting the City Council to attend dedication ceremonies of the San Joaquin County Female Detention Building at the Honor Farm site on '_'March 8, 1955• REPORTS OF THE CITY MANAGER FIRE RATING The City Manager announced that he had received a INCREASED letter dated February 21, 1955, from the Pacific TO CLASS IV Fire Rating Bureau announcing that the City of Lodi has been rated in Class IV in the Bureau's specific rate book. The effect of the rating change will. be to reduce rates for fire insurance in the Habita- tional Occupancy Class. Although the amount of re- duction will -vary, it should average about 5% to occupancies taking dwelling rates. It was stated in the letter that an inspection of the mercantile, industrial and public buildings would be made at some future date in order to prepare specific rates for these classes. Councilman Robinson stated that it was gratifying to advance in our fire rating, and suggested that it was now the proper time to construct a new fire house. He recalled that the City Council had been negotiating with the Elementary School Board for the Emerson School site, and stated that he felt it was now time to buy the property. Mr. 'Weller stated that he felt it would be wiser to plan a program for fire protection with the view of advancing to Class III in the fire rating. He suggested that the Council determine in what ways the City can advance with the least expense before embarking on any specific projects. Councilman EMERSON Robinson then moved, Mitchell second, that the SCHOOL City reopen negotiations for the purchase of the PURCHASE Emerson School site without any specific purpose in mind for its use. The motion was carried by unanimous vote. GAS TAX A supplemental memorandum of agreement for the AGREEMENT expenditure of Gas Tax Funds for the fiscal year 1953-54 was approved upon the adoption of Resolu- tion No. 1859 on the motion of Councilman Richey, Hughes second. CITY HALL The City Manager presented the plans for the remodel - REMODELING ing of the first floor and basement of the City Hall. He explained that the proposed remodeling of the basement to include three detention cells was not a permanent solution to the detention problems, but it did meet as many objections as we can meet on a temporary basis. There were no objections to the plans. Minutes of March 2, 1955, continued. ,99q FINAL MAP A final map entitled "York Homes" was presented "YORK HOMES" for approval. The final map was approved and the Mayor authorized to sign said map on the motion of Councilman Hughes, Mitchell second. The accep- tance of the streets offered for dedication is subject to improvement of the streets to City standards before they will.be maintained by the City. UTILITY Mr. Ed Werner, developer of York Homes Subdivision, WAIVER addressed the City Council to read a letter offering REQUEST seven reasons why the City Council should grant his request to a waiver from the subdivision policy. The City Clerk was directed to study Mr. Werner's request and report to the Council. CRESCENT The subdivider of Crescent Manor subdivision, MANOR recently approved by the City Council, asked per - STREET mission to change the name of Sylvia Drive to NAMES Dianna Drive and Dianna Drive to Ehrhardt Street. The permission was granted by unanimous consent. CLAIMS Claims in the amount of $70,419.74 were approved on the motion of Councilman Richey, Mitchell second. UTILITY The question of revision of the utility extension EXTENSION policy adopted February 2, 1955, held over from POLICY the February 16, 1955, meeting, was again brought up for discussion. Councilman Robinson stated that the subdividers had requested an extension of the refund period under the interim policy from five to six years. He pointed out that the five year refund period started six months after the date of the contract; therefore they were getting almost the six years requested. Mayor Fuller stated that the Council had received no protest to the principle involved in the new policy, and he felt that the Council had leaned over backward to be fair to all. Councilman Robinson then moved, Richey second, that the City Council reaffirm the utility extension policy as adopted February 2, 1955. The motion carried by unanimous vote. Mr. Weller pointed out that some of. the features of the policy may need clarification for the record. The Council agreed that for the purposes of deter- mining the proportion of the cost of electric extension refunded during a five year refund period, the refund for sewer, water and electricity would be in ratio to their cost. It was also agreed that the City Planning Commission should be asked to hold a special meeting on Monday, May 21 1955, for the purpose of receiving tentative maps, and that only tentative maps filed up to and including this meeting would be eligible for refunds. It was also agreed that it would not be necessary for the Planning Commission to approve the map, but the map must be a genuine tentative map and presented in such form as to be acceptable for filing by the Planning Commission. The Council further agreed that the deposit for utility extension must be made on or before August 15, 1955; however, the deposit may be accepted for subdivisions which have not completed annexation to the City at that date providing the annexation procedure has progressed in a normal manner. If the annexation is not completed or if the final map is not filed in a reasonable time after annexation, the deposit should be returned to the subdivider and any sub- sequent utility extension will take the policy in effect at the time of development. 400 Minutes of March 2, 1955, continued. CITY PLANNING COMMISSION A report from the Planning Commission stating that public hearings had been held on the following rezoning proposals and had then been approved by the Commission: WEST VIEW 1.. Rezoning from R-1 to R-3 the nine lots fronting REZONING on Fairmont Avenue that are within the tentative subdivision map entitled West View. MOOSE 2. Rezoning from R-1 to R-4 that property on the REZONING north side of Turner Road east of the Macke Tract commonly known as the old Lodi Steam Laundry site. The above proposals were set for public hearing on March 16, 1955, by unanimous consent. BY-PASS It was further reported from the Planning Commission ACCESS that action was taken at the February 23, 1955, ROUTES meeting of the Commission to report to the City Council that the Commission does approve the revised plan for the By-pass interchange at Turner Road and that the Commission does desire to encourage a revision of the interchange at Victor Road to provide that Victor Road directly connect to Locust Street in order to enable an even flow of traffic entering the City. The City Manager was authorized to write the State Division of Highways that the City Council has received a request from the City Planning Commission for a direct access from Victor Road to the City and request that the Division of Highways study the problem of a direct access. ORD.
