HomeMy WebLinkAboutMinutes - February 16, 1955W 4 CITY COUNCIL, CITY OF LODI COUNCIL CHAMBER CITY HALL FEBRUARY 19, 1955 This regular meeting of the City Council of the City of Lodi held beginning at 8:00 o'clock p.m. of Wednesday, February 16, 1955; Councilmen Hughes, Mitchell, Richey, Robinson and Fuller (Mayor) present; none absent. City Manager Weller and City , Attorney Mullen also present. COMMUNICATIONS UNIFORM Mr. Weller read a memorandum from the League of SALES TAX California Cities reporting on the progress of the Uniform Sales Tax program. IMPOUNDED A letter from the Shoreline Planning Association TIDELAND urging the Lodi City Council to resist legislation OIL FUNDS designed to divert tidelands funds impounded for use by Beaches and Parks Commission to other uses. Councilman Robinson stated that the impounded funds are derived from natural resources and it is only right to spend the money to redevelop our natural resources, and furthermore, it is expected that these funds will be needed to develop our own Lodi Lake Park. Councilman Richey stated that she felt that the money could be used for more worthwhile purposes, particularly for education. Mr. Weller pointed out that the sum in question is not large when compared to the total State budget. -On the motion of Councilman Robinson, Hughes second, the Council decided to ask the legislative representa- tives to limit any revised policy to parks and beaches and public schools. P.T.& T. A verified claim from the Pacific Telephone and CLAIM Telegraph Company for damages in the amount of $150.00 incurred when a tree being topped by the City damaged a telephone cable was denied and referred to the City's insurance carrier on the motion of Councilman Richey, Mitchell second. UTILITY Mr. Weller read a letter from Ted Schneider, build - EXTENSION ing contractor, representing Lodi builders and POLICY subdividers, stating that the group had met as suggested by the Council at its last meeting and had developed the following recommended changes in the new utility extension policy: (1) Extending former policy to include tentative maps filed up to May 11 1955, and extending the refund period from 5 to 6 years. (2) Permitting a deposit of 25% of utility cost prior to August 15, 1955, with the balance to be paid in three equal payments as the installation progresses or in the case of larger parcels of land could be developed in units with the first unit cost of utilities to be deposited in full and the subsequent units to be paid as developed. Action on the letter was deferred to later in the agenda. PUBLIC HEARING TRAFFIC Mr. Harry Walker addressed the Council to state SAFETY that he was interested in public safety at the corner of Lodi Avenue and Hutchins Street. He stated that it is extremely hazardous for the north - south traffic on Hutchins Street to cross Lodi Minutes.,£ February 16, 1955 39.7-, Avenue during busy hours of the day. He asked that the City Council take the matter up with the heads of the various departments to work out recommendations for correcting the situation. Mr. Weller stated that this was one of three intersections which the Chief of Police believes should have automatic signals. He cited the other intersections as those at Lodi Avenue and School Street and Church and Pine Streets. He explained that there was no provision made in this year's budget for the installation of the needed signals. However, he urged caution in the use of four-way stop signs. Councilman Hughes then moved that the recommendation of the Chief of Police be given consideration and the three intersections be included in the proposed ordinance amending the Traffic Ordinance with the installation of the signs to be made as needed. The motion was seconded by Councilman Mitchell and adopted by unanimous vote. REPORTS OF THE CITY MANAGER ORD. NO.521 The City Manager presented a proposed ordinance INTRODUCED providing for the establishment of regulations governing connections, payment, and discontinuance UTILITY of utility services. The proposed ordinance would REGULATIONS also repeal Ordinances Nos. 362 and 422. On the motion of Councilman Hughes, Richey second, Ordinance No. 521, "An Ordinance Establishing Regulations for Connections, Payment, and Liscontinuance of Utility Services, including Water Electricity, Garbage and Sewage Disposal, and Aepealing Ordinance No. 362 Entitled 'An Ordinance Relating to the Water, Elec- trical, Garbage Collection, and Sewage Disposal Services Rendered by the City of Lodi and Repealing Certain Ordinances and Parts of Ordinances in Con- flict tlerewith Insofar as Such Conflict May Ezist', ORD. N0.523 and Ordinance No. 422 Amending Said Ordinance",. INTRODUCED was introduced. ORD. NO.522 A proposed ordinance to regulate and license card INTRODUCED rooms was presented by the City Manager. He stated that the proposed ordinance was similar to the REGULATE one adopted by the City of Stockton recently. CARD ROOMS The ordinance requires operators of card rooms to secure a license from the Chief of Police and requires employees of card rooms to secure work permits from the Chief of Police. A -suggestion by Mayor Fuller that the Board of Appeals provided for in the ordinance consist of the entire City Council rather than only three members was incor- porated in the ordinance by unanimous consent. On the motion of Councilman Robinson, Richey second, Ordinance No. 522, "An Ordinance Regulat- ing and Licensing Card Rooms in the City of Lodi; Providing for the Registration of the Owners and Employees of Such Establishments; Fixing a Penalty for Violations" was introduced. ORD. N0.523 Ordinance No. 523, "An Ordinance of the City of INTRODUCED Lodi Amending Ordinance Number 493, Entitled 'An Ordinance of the City of Lodi Regulating Traffic AMENDS Upon the Public Streets and Repealing Ordinances TRAFFIC 64, 137, 222, 238, 446, and All Other ORDINANCE _Numbers Ordinances and Parts of rdinances in Conflict Herewith'", was then introduced on the motion of Councilman Mitchell, Richey second. Said ordinance provides for the inclusion of Saturday afternoon among the days designated as holidays for the purpose of enforcement of parking regulations, as well as the provision for the inclusion of the three inter- sections described during Public Hearing as four- way stop intersections. 396 Minutes of February 16, 1955, continued. ORD. NO.524 Ordinance No. 5241 "An Ordinance of the City INTRODUCED of Lodi Amending Ordinance Number 353 Commonly Known as the 'Parking Meter Ordinance;", providing AMENDS for the addition of Saturday afternoons to the PARKING METER list of holidays excepted from parking meter ORDINANCE operating days, was introduced on the motion of Councilman Richey, Mitchell second. PROJECT The City Manager then presented the project state - STATEMENT ment for the major street system proposed by the MAJOR City Engineer for the fiscal year 1955-56. The STREETS provision for the widening of East Lodi Avenue again raised the question of the amount that the north side of said street should be widened between WIDTH Stockton and Main Streets. The City Engineer re - E. LODI AVE. ported that the State requires a 6OtToot street for expenditure of gas tax funds, whereas this street is 58 feet. Councilman Robinson objected that the widening of the street by 7 feet on the north side would reduce the sidewalk width to only 5 feet. Mayor Fuller stated that he felt that since the widening had been established at 7 feet between Washington and Stockton Streets, the 2 foot difference in width of the street west of Stockton Street would be dangerous. Councilman Hughes agreed and added that he felt the City should assume the cost of the 2' additional feet of paving. On the motion of Councilman Richey, Mitchell second, the Council voted to accept the project statement for major streets with the provision that the widening of the north side of East Lodi Avenue between Stockton and Main Streets be 7 feet. FINAL MAP A final map entitled "Storro Tract" was then STORRO TRACT presented for approval. The final map was approved and the Mayor was authorized to sign said map on the motion of Councilman Richey, Mitchell second. The acceptance of the streets offered for dedication is subject to improvement of the streets to City standards before they will be maintained by the City. CLAIMS Claims in th-e amount of $64,681.27 were approved on the motion of Councilman Richey, Mitchell second. CITY PLANNING COMMISSION RES. #1858 Mr. Weller presented a recommendation from the ADOPTED City Planning Commission that Resolution No. 1719, adopting the Commercial Use List, be amended to AMEND COMM. include "Laundries - Neighborhood Family Tyree only USE LIST (Maximum size washers to be 50 pounds)". Resolution No. 1858, amending Resolution No. 1719 as recommended by the Planning Commission, was adopted on the motion of Councilman Hughes, Robinson second. ANNEXATION Mr. Weller then presented a memorandum from the PETITIONS Secretary of the Planning Commission -stating that the Planning Commission had approved the annexations requested in the two petitions filed by Ada Hutchins, Chris R. and "a Vita Keszler and Carlton D. Dethlefson and by the Board of Trustees of the Minutes of February 16, 1955, continued. 3 4 ATTEST: HENRY . GLA ES, J . City. Clerk Lodi Elementary School District and Mr. Ted Hochhalter. The School Board and Mr. Hochhalter request the annexation of approximately 25.2 57TH ADDN. acres north of Kettleman Lane and east of South Fairmont Avenue. Ada Hutchins, et at, request WESTERN ADDN. the annexation of approximately 88.8 acres on the south side of Sargent Road west of the present City limits. On the motion of Councilman Robin- son, Hughes second, the Council adopted Resolution No. 1856, declaring its intention to annex the "57th Addition, Lands North of Kettleman "ane and East of Fairmont Avenue", and setting a pub- lic hearing for April 6, 1955• Resolution No. RES. #1856 1857, declaring the intention of the City Council AND #1857 to annex the "Western Addition and setting the ADOPTED public hearing on the question, was adopted on the motion of Councilman Hughes, Robinson second. ZONING Mr. Weller read a letter from Dr. H. Lawson NEW HIGH Smith, Superintendent of Lodi Public Schools, SCHOOL stating that the High School Board wished the City Council to give consideration to the zoning in the area around the site of the new school be not zoned for commercial use. UTILITY On the motion of Councilman Robinson, Hughes POLICY second, the Council deferred action on the new DEFERRED utility extension policy until the next regular meeting. _ JAIL City Attorney Mullen explained the contract CONTRACT received from the County Board of Supervisors providing for the care of City prisoners in the County detention facilities. The contract submitted is temporary to cover the situation until the County has an opportunity to complete its cost studies. The Council approved the contract and authorized the Mayor to sign it on behalf of the City Council on the motion of Councilman Mitchell, Richey second.
