HomeMy WebLinkAboutMinutes - January 5, 1955CITY COUNCIL, CITY OF LODI COUNCIL CHAMBER, CITY HALL JANUARY 5, 1955 This regular meeting of the City Council of the City of Lodi held beginning at 8:00 o'clock p.m. of Wednesday, January 5, 1955; Councilmen Hughes, Mitchell, Richey and Robinson present; Mayor Fuller absent. City Attorney Mullen and City Manager Weller also present. Minutes of the previous meeting of December 15, 1954 were approved as written and mailed. The City Clerk called the meeting to order and called for nominations for Mayor pro -tem. On the motion of Councilman Richey, Mitchell second, Councilman Robinson was elected to fill the position. COMMUNICATIONS LCC -CVD Letter from the City of Tracy announcing the MEETING regular quarterly meeting of the Central Valley Division of the League of California Cities to be held January 20, 1955, in the Portugese Hall in that city. DR. BOEHMER Letter from Dr. A. C. Boehmer tendering his RESIGNS FROM resignation as representative on the Board of S.J.L.H.D. Trustees of the San Joaquin Local Health District due to illness. On the motion of Councilman Richey, Mitchell segond, the Council voted to accept Dr. Boehmer's resignation and directed that a letter expressing the Council's appre- ciation of his service be sent to Dr. Boehmer. COMIC BOOKS A letter, dated December 17, 1954, from the Presi- dent of St. Anne's Youth Club, Robert Comartin, expressing the Club's concern about the problem created by comic books which depict horror, crime and deeds of brutality and violence in such a way that they may be harmful to the morals of their readers. The Club asked that this matter be brought before the City Council with the view of the adoption of an ordinance similar to an ordinance adopted by the City of New Orleans prohibiting the sale of any objectionable comic book. The City Manager explained that this prob- lem has been a matter of concern to the Coordinat- ing Council, and that this organization has had some success in getting the cooperation of the local news dealers on a voluntary basis. He also pointed out that the Comics Magazine Association of ,America, an association of comic book Rublishers, has started a program of sel€=policing. "ouncil- man Richey stated that she did not believe a local ordinance would help the situation but suggested that there should be more effort from the homes and from the youth. Councilman Hughes stated that the St. Anne's Youth Club should be commended for its interest in the problem, but felt that to be effective the action should be taken at its source. City Attorney Mullen stated that attorneys attending the conference of NIMLO in San Francisco were generally of the opinion that an effective ordinance banning the objectionable types of comics would be difficult to write, but felt that volun- tary -regulation is the best answer. Mr. Weller stated that it might be suggested to the Coordinat- ing Council that juveniles be added to their committee. Minutes of January 5, 1955 continued. 3S On the motion of Councilman Hughes, Richey second, the Council voted to instruct the City Manager to write a letter to St. Anne's Youth Group thanking it for bringing the matter to the attention of the City Council. Councilman Robinson suggested that the Coordinating 0ouncil be asked what the City Coun- cil could do to help them in their program. Mr. Al Cooper, present in the audience, agreed to carry this message to the Coordinating Council. REPORTS OF THE CITY MANAGER SAM SALAS The City Manager pointed out that an appointment APPOINTED TO should be made to the Recreation Commission to fill RECREATION the vacancy created when the term. of Mr. Conklin COMMISSION exaired December 31,'1954. On the motion of eoun- ciiman Mitchell, Hughes second, Mr. Samuel D. Salas was appointed to the Recreation Commission for a term which expires December 31, 1958. DETENTION Mr. Weller then presented a report and recommenda- F ACILITIES tion for reaching a temporary solution to the problem of caring for prisoners while under the jurisdiction of the City. In his report Mr. Weller made the following recommendations: 1. Request a meeting with the Board of Super- visors as soon after January 1 as possible to discuss the terms under which the County might be willing to accept pre-trial prisoners. - 2. Remodel to a limited extent the Police Department quarters in the City Hall basement. Some changes will be required in any event to pro- vide adequate office space for present needs, and it would be possible at small additional cost to make a small interior area available as short-term "holding "facility until it is convenient to trans- fer prisoners to Stockton. 3. Work with the County and other cities in the County to develop plans for the use of County facilities or the Honor Farm as a central detention facility. On the motion of Councilman Mitchell, Richey second, the Council voted to appoint the City Manager to negotiate with the Board of Supervisors for the handling of City prisoners, and, if found necessary, to call a meeting of the City Council with the Board of Supervisors. BUS REPORT Mr. Weller reminded the Council that at its October 6, 1951+, meeting the Council granted rate increases to the Lodi Transit System contingent upon the receipt of certain revenue data and other assurances from the Company on or before January 13, 1955. He reported that Mr. Mehrer had submitted a written and oral report indicating that he is now receiving approximately $95 per month from advertising, most of which is on a six-month basis. He also indicated that gross revenues have increased despite a slight drop in patronage since the fare increase. _Councilman Robinson suggested that the Bus Committee be dismissed with thanks, since it appeared that its work was complete. Mr. Al Cooper, a member of the Bus Committee, addressed the Council to 3H4 Minutes of January 5, 1955 continued. emphasize the importance of the advertising to the continued operation of the Company. He pointed out that the Committee feels that nothing can be done to insure continued operation of the system If the advertising revenues drop off. He further suggested that Mr. Mehrer report to the City Manager every six months regarding the advertis- ing situation. Upon receiving such a request from the City Council, Mr. Mehrer stated from the audience that he would agree to make such a report. UNIFORM Mr. Weller presented a request from the Electrical ELECTRIC Inspector requesting the adoption of the 1953 CODE Edition of the "Uniform Electrical Code". The 1951 Edition is presently in effect in the City ORD. NO -519 of Lodi. Electrical Inspector Paul McClure then INTRODUCED explained the changes incorporated in the proposed ordinance which would adopt said Uniform Electrical Code. Ordinance No. 519, entitled "Adopting an Electrical Code Regulating the Installation, Operation, and Maintenance of Electric Wiring and Electrically Operated Appliances to be Con- nected Thereto by Adopting by Reference the 'Uniform Electric Code', 1953 Edition, Which in Turn Adopts by Reference the 'National Electric Code', 1953 Edition, Establishing Rules and Regu- lations in Connection Therewith, and Repealing Ordinance No. 488", was then introduced on the motion of Councilman Richey, Mitchell second. ELECTRIC CODE On the motion of Councilman Mitchell, Richey RES. OF INT. second, the Council then adopted Resolution No. #1853 ADOPTED 1853 entitled "Resolution of the City Council of the City of Lodi of Intention to Adopt Or- dinance Entitled 'Adopting an Electrical Code Regulating the Installation, Operation, and Maintenance of Electric Wiring and Electrically Operated Appliances to be Connected Thereto by Adopting by Reference the Uniform Electric Code' 1953 Edition, Which in Turn Adopts by Reference the 'National Electrical Code', 1953 Edition, Establishing Rules and RegulationsinConnection Therewith and Repealing Ordinance No. 488' and Fixing a Time and Place for a Public Hearing Thereon". Resolution No. 1853 provides a public hearing on February 2, 1955. METER RULES Mr. McClure also explained that the installation ORD. N0.520 of electric meters has never been regulated by INTRODUCED ordinance in the City. He reported that such an ordinance had been drafted and requested that it be adopted by the City Council. Following an explanation by Mr. McClure of the contents of the proposed ordinance, Mr. Ted Schneider informed the Council that the contractors of Lodi were generally in favor of such regulatory or- dinance. Ordinance No. 520, entitled, "Adopting Rules and Requirements Governing the Installation of Electrical Meters" was introduced on the motion of Councilman Hughes, Mitchell second. CLAIMS Claims in the amount of $134,077.18 were approved on'the motion of Councilman Richey, Mitchell second. Minutes of January 5, 1955 continued. 3S S. LEE AVE. Resolution No. 1852, Approving the Assessment LIGHTS Diagram for the South Lee Avenue Lighting District, RES. #1852 was adopted on the motion of Councilman Mitchell, Richey second. - The meeting was adjourned at 9:15 P.M. on the order of Mayor Pro -tem Robinson.
