HomeMy WebLinkAboutMinutes - March 7, 1956486 CITY COUNCIL, CITY OF LODI COUNCIL CHAMBER, CITY HALL MARCH 7, 1956 This regular meeting of the City Council of the City of Lodi held beginhing at 3:00 o clock p.m. of Wednesday, March 7, 1956; Councilmen Fuller, Hughes, Mitchell, and Robinson (Mayor) present; — Richey absent. City Attorney Mullen and City Manager Weller also present. Minutes of the previous meeting of February 15, 1956, were approved as written and mailed. COMMUNICATIONS CITY HALL USE Letter from the County Election Department request - FOR ELECTION ing use of the City Hall on the evening of the Primary Election, June 5, 1956, to receive voted ballots. On motion of Councilman Hughes, Mitchell second, the Council voted to grant the request. FIRING Letter from Lodi Sportsman's Club, dated February RANGE 172 1956, stating that the Club had voted a recom- mendation to the City Council, Recreation Depart- ment and ?olice Department that steps be taken towards the installation of an area whereby those interested in fire arms or small bore caliber have a place to meet and encourage inter -city competitive shoots. The Club suggested the City -owned property at the sewage disposal plant be used for this pur- pose. The matter was referred to the Police and Recreation Departments for study and recommendation. COURTROOM A letter from the County of San Joaquin requesting REMODELING permission to alter the Court facilities in the City Hall by construction of temporary partitions in order to create a room for the Constable and a room for storage. On the motion of Councilman Hughes, Mitchell second, the Council voted to grant the request for permission to remodel the Courtroom with the provision that no permanent damage be done to the building and that the remodeling is carried out at no cost to the City of Lodi. ABC Applications for transfer of Alcoholic Beverage LICENSES Licenses were read as follows: (1) On -sale Beer and Wine by Art L. and Paul L. Gomez at 442 S. Main Street; and (2)'On-sale General Liquor License by Robert Fleck and Dave Piazza at "27 Club", 27 N. Sacramento Street. Also application for new Off - sale Beer and Wine License by Frank C. and Lillian C. White at 1+03 E. Locust Street. Applications were referred to Chief of Police for necessary action. PUBLIC HEARINGS SHAW Mayor Robinson called for those interested in the REZONING request for the rezoning of west 60 feet of the parcel of property at 603 S. School Street. The ORD. NO.549 request was for rezoning from R-2 to R-'+ Residen- INTRODUCED tial Zone. No protests, either written or oral, were received to the proposed rezoning. Ordinance No._ 549, amending the present Zoning Ordinance to effect the rezoning as proposed, was introduced on the motion of Councilman Hughes, Mitchell second. Stating that he felt that off-street parking should be encouraged, Councilman Hughes moved that the request for drive- ways be approved and that Resolution No. 1912, establishing a 40 -foot white loading zone, be adopted. The motion was seconded by Councilman Mitchell and adopted by unanimous vote. INCREASE The City Manager reported that the Board of Super - SALES TAX visors of San Joaquin County had adopted an or- dinance establishing the County -gide uniform sales ORD. NO. 550 tax to become effective July 1, 1956. On the INTRODUCED motion of Councilman Mitchell, Hughes second, the Council voted to introduce Ordinance No. 550, amendingthe present Sales Tax Ordinance (Ordinance No. 373to increase the sales tax from + of 1% to a full 1% effective July 11 1956. Mayor Robin- son stated that since the County had adopted the Bradley -Burns Uniform Sales Tax, the City Council found it necessary to act in order to prevent the Lodi citizens from being taxed the 1% sales tax in addition to the pressnt J% tax. On the motion of Councilman Fuller, Mitchell second, the Council then voted to introduce Ordinance No. 551, suspend- ing Ordinance No. 373, as amended, and levying a sales tax of 95/100 of 1% under the Bradley -Burns Uniform Sales Tax Act to become effective July 1, 1956. LAKE STREET Capell requesting the abandonment of Lake Street east of Pacific Avenue. He also asked that the RES. OF INT. No action was taken on the request to exchange parcels of land; however _ the Council voted, motion of Councilman Mitchell, Hughes second, to adopt Resolution No. 1914, declaring its intention to abandon Lake Street east of Pacific Avenue. LAKE PARK The City Manager read a memorandum received from BRIDGE the Recreation Commission recommending that the bridge on the north side of Lodi Lake Park be restored to a safe and usable condition through the process of jacking up the present foundation, as suggested in a report of the City Engineer. Councilmen Fuller and Hughes stated that they wished to reaffirm the previous action taken by the City Council in instructing the City Engineer to use his discretion. Mayor Robinson stated that he still felt the culvert would reduce the flow of water into the lake from the river, but he would withdraw his objection if it were under- stood that additional openings would be made into the river if it were found that additional flow was necessary. No further action was taken. POWER SAVINGS Mr. Weller reported that studies indicate -that the City has realized a savings of approximately $25,000 in cost of bulk power as a result of the amendments to the R rate negotiated with the Pacific Gas and Electric Company last fall. CITY PLANNING COMMISSION FINAL MAP A final map of Loma Park subdivision was presented "LONA PARK" for approval. The final map was approved and the Mayor authorized said map on the motion of Councilman Mitchell, Hughes second. The accep- tance of streets offered for dedication is subject to improvement of the streets to City standards before they will be maintained by the City. The acceptance of streets offered for dedi- cation is subject to improvement of the streets to City standards before they will be maintained by the City. STOKELY- The City Manager submitted a recommendation from VAN CAMP the City Planning Commission for the rezoning from REZONING R-3 and R-4 to M (industrial) district of portions of Lots 68 and 69 of the Lodi Barnhart Tract. The rezoning action was taken by the Planning Commis- sion at the request of Stokely -Van Camp Company. A public hearing on the rezoning request was set for March 21, 1956, on the motion of Councilman Mitchell, Fuller second. Minutes of March 7, 1956 continued. 48 9 CHRISTIAN The City Planning Commission also recommended the CHURCH rezoning of Lot 3, Block 4, Hutchins Addition REZONING (309 S. School Street) from R-4 to C-2 District. It was pointed out that the proposed rezoning would give the property the same zoning as the property immediately east and west of it. A public hearing to consider the rezoning was set for the meeting of March 21, 1956 on the motion of Councilman Hughes, Mitchell second. WITHDRAW Resolution No. 1911, withdrawing the 61st Addition 61ST ADDN. from the Woodbridge Rural Fire Protection District, FROM WRFPD was adopted on the motion of Councilman :Kitchell, RES. #1911 Fuller second. ELECTRIC ORDINANCE NO. 548, ENTITLED "AN ORDINANCE AMEND - CODE ING ORDINANCE NO. 519 ENTITLED 'ADOPTING AN AMENDED ELECTRICAL CODE REGULATING THE INSTALLATION, OPERATION, AND MAINTENANCE OF ELECTRIC WIRING AND ORD.'NO.548 ELECTRICALLY OPERATED APPLIANCES TO BE CONNECTED ADOPTED THERETO BY ADOPTING BY REFERENCE THE "NATIONAL ELECTRICAL CODE", 1953 EDITION, ESTABLISHING RULES AND REGULATIONS IN CONNECTION THEREWITH, AND RE- PEALING ORDINANCE NO. 488'", having been intro- duced in regular meeting of February 15, 1956, was brought up for passage on the motion of Councilman Fuller, Mitchell second. Second reading was omitted after reading by title, and was then passed, adopted and ordered to print by the following vote: AYES: Councilmen - Fuller, Hughes, Mitchell and Robinson NOES: Councilmen - None ABSENT: Councilmen - Richey Ordinance No. 548 was then signed by the Mayor in approval thereof.
