HomeMy WebLinkAboutMinutes - November 7, 195678 CITY COUNCIL CITY OF LODI COUNCIL CHANAER, CITY HALL NOVEPIBER 7, 1956 This regular meeting of the City Council of the City of Lodi held beginning at 8:00 o'clock of Wednesday, November 7, 1956; Councilmen Fuller, Robinson, and Mitchell (Mayor) oresent; Council- men Hughes and Katzakian absent. City Manager Weller and City Attorney Mullen also present. Minutes of the meetings of September 19, October 3, and October 17, 1956 were approved as written and mailed. PUBLIC HEARING ORANGE AVE. This being the time and place set for the hearing ABANDONNuZ.NT of protests for the proposed abandonment of that portion of Orange Avenue north of Sylvia Drive in ORD. NO. 576 Crescent Manor Unit No. 2, Mayor Mitchell called INTRODUCED for such protests to be presented. There being no protests offered, Ordinance No. 576 ordering the abandonment of said portion of Orange Avenue was introduced on the motion of Councilman Fuller, Robinson second. CITY PLANNING CONINiISSION GENERAL MULLS A petition for the annexation of approximately ANNEXATION fifty acres of land owned by General Mills, Inc., was submitted with the recommendation of the City Planning Commission that the annexation be approved and that the property be zoned in the RESOLUTION OF M Industrial district coincident with the final INTENTION date of annexation. It further recommended that NO. 1975 the annexation be subject to the agreement with ADOPTED General Mills for the dedication and improvement of abutting streets. On the motion of Councilman Fuller, Robinson second, the Council voted to adopt Resolution of Intention No. 1978, giving notice of its intention to annex the property and settinz a public hearing on the question for December 19, 1956. The City Clerk was instructed to notify General Mills that the Council's action on December 19 would be subject to receiving assurance from General Mills that it would dedi- cate land for streets and make the necessary improvements abutting its property in accordance with the established policies of the City Council. MAJOR STREET Action on the major street plan as recommended by PLAN POST- the City Planning Commission was postponed until PGNED the meeting of December 5, 1956. C OMII•IUNIC ATIONS ANNEXATION IN A petition filed by the law firm of Litts, Mullen, SEC. 31, T4N, and Perovich requesting annexation of the firm's R7E property located at the juncture of Highway 99 and the Mokelumne River. The petition further recuested that the area be zoned as M Inddstrial at thO time of annexation. Councilman Robinson stated that he wished to call attention to the fact that the land lies east of the proposed 99 by-pass, and that it was contrary to the Master Plan in that it lay outside of the planned area. Sam Salas, President of the Chamber of Commerce, and bass Lorretta Mackenzie, "Nass Vintage" of the 75th Anniversary of Commercial Wine Production. MR. WELLER Letter from Nir. C.E. Martin, President, City ELECTED TO Managers' Department, Lea?ue of California Cities, EXEC. CON1N1. informing the City Council that Mr. Weller had LEAGUE OF been elected to the Executive Committee of the CALIF. CITIES City Managers Department of the League of California Cities. SERGEANTS The City Manager read a letter addressed to the EHRHARDT & Chief of Police from the District Attornev of SPERLING COM- San Joaouin County informing him that on October 23, PLII�I.NTED 1956, Judge M.G. Woodward complimented both Sergeants Ed Ehrhardt and i,:iles Sperling for their excellent work in gathering eviaence and presenting this evidence when ?iving testimony in his court. The District Attorney joined Mr. Woodward in complimenting both men for their work, both as investip-ating officers and as witnesses. The City Council extended their compliments to Sergeant Ehrhardt and Sperling and instructed the City Clerk to express this in a letter to both men. REPORTS OF THE CITY MANAGER AREA PLrNNING Mr. Weller presented the draft of a joint resolu- COLI&IISSION tion for establishment of an Area Planning Com- mission which would include the entire County and the five cities. On the motion of Council- man Robinson, Fuller second, the Council approved the proposal in principle with the understanding that minor corrections could be made in detail, particularly those provisions relating to the financial structure'of the District. - FLSTIVkL Nir. Weller presented a request from the Lodi G.ROUN DS PAv Grape and Wine Festival for an increase of $500 4Et'�TS INCP."rDin the City's payment to the Festival for use of the Festival grounds and facilities. It was explained that the cost of utilities has increased since the original agreement with the City. The Festival feels that the facilities used by the Recreation Department have contri- buted substantially to the increase. The re- quest for an additional sum of $500 payment to the Festival was aup_reved on the motion of Councilman Robinson, Fuller second. Resolution No. 1980 directing such a request to the Bureau of Recla- mation, was adopted on the motion of Councilman Fuller, Robinson second. Councilman Robinson stated he felt that the City should aid in any effort to bring water into the Lodi District. SPECS. STORM Plans and specifications for the installation of SEWER a 30 -inch storm sewer in the westward extension of Tokay Street at the estimated cost of $2,600 was considered and approved by the City Council on the motion of Councilman Fuller, Robinson second. CLk,Ii%5 Claims in the amount of $110,010.19 were approved on the motion of Councilman Robinson, Fuller second. JOINT POLE Mr. Weller submitted a proposed joint pole agree- AGREEI-L NT ment for the purchase of an interest in poles presently owned by P.G.&E. which will now be used by the City as a result of the recent pur- chase of the districution line from the P.G.&E. substation on Cherokee Lane. Mr. Weller explained RES. #1979 that the purchase price agreed upon by earlier action of the Council included funds for the purchase of interest in the poles; however it is necessary to execute a ioint pole agreement before the transaction is complete. Resolution No. 1979, approving the joint pole agreement, was adopted on the motion of Councilman Robinson, Fuller second. SCHOOL CROSS City Manager Weller reported that he had received WaLKS a recommendation from the Superintendent of Schools for cross walks necessary for school children. At the request of the Mayor, Mr. Weller agreed to make copies available for each Councilman for study. SCHOOL CROSS- The City Manager reported that two flashing; ING SIGNS school crossing signs had been ordered for in- stallation north and south of the intersection ' of Tamarack and South Hutchins Street. HUTCHINS ST.gotiating with Mr. De Pauli for a right of way for widening the west side of S. Hutchins Street north of Tokay Gardens Subdivision. It will also be necessGry for the City to move electric Poles al.onP the west side of S. Hutchins Street. Mr. De Pauli has refused to dedicate the necessary land for the street widening and Dole relocation because he feels the pity should install curb, gutter and side -walk in -exchange for the right of way. The City Manager was instructed to use his discretion and make the best possible deal for the City of Lodi.
