City Clerk, Glaves also present. rtes of the previous meetings of April 17, 1956 and May 2, approved as written and mailed. 'UBLIC HEARINGS Mayor Mitchell called for the continuation of 3NUE Public Hearing adjourned from the regular meeting of May 16, 1956. The City Clerk reported that a verification of the petition protesting the forma- tion of the Eureka -Louie Avenue lighting district contained the signatures of 39.6% of the property owners. The total front footage within the district was 13,411.81. The protest rerresented 5,322.24 front feet which failed by 1,383.66 front feet of 324 being 50% of the total. The Mayor asked for those people opposing, to offer protests. Mrs. Cella - Manna addressed the Council to state that she opposed the district formation on the basis that 925 she had a large amount of unimproved frontage. There were no other protests offered. Various property owners addressed the council to state that they favored the installation of street lights 928 under the special assesment proceedings. On the motion of Councilman Hughes, Katzakian second, Resolution No. 1924 overruling the protests, was adopted on the motion of Councilman Robinson, Hughes second. Resolution No. 1928, ordering the work, was adopted on the motion of Councilman Fuller, Katzakian second. PHER Mr. Bill Rempher, 115 S. Fairmont Street, addressed D BY the Council to state that he had a disagreement 1E with the City Engineer over a number of items. The City Engineer had placed a barracade at the inter- section of Pacific Avenue and Oak Street. He had asked that this barracade be removed and this had not been done. He stated he had a home for sale on Pacific Avenue and that the barracade interfered with the showing and sale of this house. He stated that he had further been irritated by the City Engineer's refusal to approve curb and gutter installation over the west 12 feet of the lots within the Cowda:;. Tract on Palm Avenue and Turner Road. He said he thought this was a pri- vate right-of-way and the responsibility for the installation should rest with him, the developer. The City Clerk pointed out that in the case of the barracade-of Oak Street, the property owners on the South side of Oak Street have protested the truck traffic involved with the construction of the High School and the dust problem created by these trucks spreading mud on the street. The matter was referred to the City Manager by ken- eral agreement of the City Council. .CCUMU- Mr. Jim Dagres addressed the Council to protest IN ALLEY the accumulation of water in the alley behind the South side of the 200 block of Pine Street and stated that this water originated at the rear of the Newspaper Office. COMMUNICATIONS QUONSET HUT USE A letter from the Church of God (Seventh day) dated May 29, 1956 requesting use of the city owned Quonset Hut on North Stockton Street in conjunction with a Conference to be held by the Church at the National Guard Armory. City Mana- ger reported that he had checked with the Fire Marshall, Building Inspector and Health Officer and found that the building would be approved for the occupancy of no more than 15 persons of ore sex. City Attorney Mullin stated that he felt the City would be needlessly letting them- selves open to liability. In so far as the build- ing was intended to quarter people and because the City would have little influence or control over its use. Councilman Robinson stated that he felt the City had no reason to be afraid of its use. He felt that the City should make visitors to the City welcome and comfortable. Councilman Robinson moved that the request be granted on the condition that it be limited to fifteen people of one sex and on the basis that the Church hold the City harmless for any mishaps. The motion was passed by the following vote: AYES: Councilmen - Hughes, Fuller, Kat- zakian and Robinson NOES: Councilmen - Mitchell ABSENT: Councilmen - None QUONSET HUT Councilman Hughes then moved, Katzakian second USE POLICY that no further use be made of the Quonset Hut for housing of people after this present instance. This motion was passed by the following vote:. AYES: Councilmen - Fuller, Hughes, Mit- chell, and Katzakian NOES: Councilmen - Robinson ABSENT: Councilmen - None PURCHASE OF Notice from P.U.C. regarding the decision No. 53144 SUNSET ADDITION dated May 28, 1956, approving the purchase by the ELECIL-1 C, D l St. City of Lodi from the Pacific Gas and Electric FAQ -M L`i I I� S Company of the electric distribution facilities in the "Sunset Addition" for the agreed sum of $5,195-00 plus tax. INVITATION TO Letter dated June 1, 1956, International City Mana- I.C.M.A. CON- gers Association extending aninvitation to the FERENCE City to be represented by the City Manager for the 42nd annual Conference of the I.C.M.A. to be held at Banff Canada, September 16, to 20, 1956. On the motion of Councilman Fuller, Hughes second, the council voted to leave the matter of attending to the descretion of the City Manager. FLORA EXTENSION Letter dated May 25, 1956 from Tokay Cold Storage BE ABANDONED Co. & Cecil V. Mumbert requesting that portion of Flora Street west of Main designated as lot 14 in Block A. Subdivision of Lot 72, Barnhart Track be abandoned. Councilman Robinson stated that two years ago the City Council had turned down a similar request from the writers of this letter and that he could see no reason for changing Minutes of June 6, 1956, continued rs_bp� Asa 3 RES. # 1932 that decision at this time since he felt ADOPTED that theCity may have use for the property some time in the future. On the motion of Councilman Hughes, Katzakian second, resolution No. 1932, declaring the decision d' the City Council to abandon that portion of Flora street west of Main Street, was then adopted by a unanimous vote. INCREASE ADV. Letter from the Chamber of Commerce stating that BUDGET OF because of the additional expense as a result of CHAMBER OF the Jubilee Celebration, the Chamber of Commerce COMMERCE requests the addition of 3500 to the Advertieir4 fund for 1955-57 budget. , _ The' motion' of Councilman Hughes, Katzakian second, the Council instructed the City Manager to increase the item in the 1956-57 budget for the Chamber of Commerce from $2800 to $3300. PETITION RE- A petition requesting the installation of street QUESTING LIGHTS lights on that portion of Otange Avenue between ON ORANGE AVE. Oak and Dockeford Streets, excepting Lot 21 of the Handel Subdivision, containing the signatures of owners of property representing 63% 'of the RES. # 1933 front footage in the proposed district was sub - ADOPTED mitted by the City Clerk. The signatures on the Petition being sufficient to give the City Coun- cil jurisdiction. Resolution No. 1933, declar- ing the intentions of the City Council to form the RES. # 1934 Orange Avenue lighting district was adopted on the ADOPTED motion of Councilman Katzakian, Robinson second. On the motion of Councilman Robinson, Fuller second, the Council then adopted Resolution No. 1934 adopting the plans and specifications for lighting district. REPORTS OF THE CITY MANAGER BUDGET SUB- The City Manager reported that draft copies of the MITTED TO Budget for 1956-57 had been submitted to the mem- COUNCIL bers of the City Council. It was agreed that no action would be taken at this meeting but the matter would be taken up at a subsequent meeting. COURTESY MAIL Mr. Weller reported that the request from the Post BOX Office for a courtesy mail box on the East side of Church Street North of Lodi Avenue had received no objections from the City Engineer or Chief of Police. The Council agreed to take the matter up with other requests involving street contols. " STATE PERSONNEL Mr. Weller reported that a standard agreement SERVICES with the State Personnel Board for the use of personnel facilities for the next year had been submitted by the Board and he recommended its approval. He pointed out that this only made it possible for the City to use its services, but RES. # 1929 would not obligate us to the expenditure of any ADOPTED funds unlesstheir services were requested. The contract was approved and the Mayor authorized to sign with the adoption of Resolution No. 1929 on the motion of Councilman Robinson, Katzakian second. RES. # 1930 Resolution No. 1930 authorizing and establishing ADOPTED Cross Walks adjacent to public schools was estab- lished on the motion of Councilman Katzakian, Fuller second. Councilman Robinson objected to the pro- cedure whereby the walks had been painted prior to receiving the approval of the City Council. a c4 Minutes of June 6, 1956, continued LOADING ZONE The City Manager then presented a recommendation from the City Engineer to increase the loading zone in the front of the Sunset theatre on West Lodi Avenue. He pointed out that the present loading zone was not long enough to accommodate the users, and resulted in double parking and traffic congestion. The result will be the elimination of one parking stall. Councilman Robinson stated that he did not feel that the Sunset Theatre provided sufficient parking space for their patrons. He felt that they had other property in the vicinity of the Theatre and that they should provide additional parking for their GIBSON LOADING Datrons. As a second recommendation from the ZONE ELIMINATED City Engineer, the City Manager explained that the bus stop formerly used by the Gibson Bus Lines at the corner of Elm and School Streets was no longer needed and that leading zone could now be eliminated. Resolution No. 1931 establishing a loading zone for the mail box RES. # 1931 on south Church Street, increasing the loading ADOPTED zone in front of the Sunset Theatre, and eliminating the Bus stop at the corner of Elm and School Streets wasthen adopted on the motion of Councilman Fuller, Robinson second. ADDITIONAL PARK- Councilman Robinson then moved, Hughes second, ING SPACE FOR that the City Manager write a letter to the Sunset SUNSET THEATRE Theatre requesting them in their own interest, and in the interest of the public to provide additional parking space on their property for their Theatre patrons. This motion was adopted by the following vote: AYES: Councilmen - Hughes, Katzakian, Robinson, and Mitchell NOES: Councilmen - Fuller ABSENT: Councilmen - None DRIVEWAY A request for two thirty-foot drive ways on Locke - APPROVED ford Street ;"P of Ham Lane and on Ham Lane north of Lockeford Street by Associated Oil Com- pany was approved on the motion of Councilman Robinson, Katzakian second. The motion included the qualifications that the request was granted under existing conditions and could be withdrawn or amended when conditions warrant it. CLAIMS Claims in the amount of .4$112,934-78 were approved on the motion of Councilman Katzakian, Fuller second. CRD. NO. 557 ORDINANCE NO. 557, ENTITLED "ORDERING THE VACATION ADOPTED OF THE PUBLIC RIGHT-OF-WYA AT THE INTERSECTION OF TURNER ROAD AND MILLS AVENUE", having been intro- duced in regulAr meeting of May 16, 1956, was brought up for passage on the motion of Council- man Robinson, Katzakian second. Second reading was omitted after reading by title, and was then passed, adopted and ordered to print by the following vote: AYES: Councilmen - Fuller, Hughes, Kat- zakian, Robinson and Mitchell NOES: Councilmen - None ABSENT: Councilmen - None Minutes of June 6, 1956, continued Ordinance No. 557 was then signed by Mayor Mitchell in approval thereof. '.VO. 558 ORDINANCE NO. 558, ENTITLED "AN ORDINANCE AMENDING ADOPTED ORDINANCE NO. 536 AND AMENDING SET -BACK LINE ON SOUTH SACRAMENTO STREET", having been introduced in regular meeting of May 16, 1956, was brought up for passage on the motion of Councilman Katzakian, Fuller second. Second reading was omitted after reading by title, and was then passed, adopted and ordered to print by the following vote: AYES: Councilmen - Fuller, Hughes, Kat- zakian, Robinson and Mitchell NOES: Councilmen - None ABSENT: Councilmen - None Ordinance No. 558 was then signed by Mayor Mitchell in approval thereof. ORD. NO. 559 ORDINANCE NO. 559, ENTITLED "AMENDING ORDINANCE ADOPTED NO. 469 TO REDUCE BUILDING SET -BACK REQUIREMENTS IN THE R-1, R-2 AND R-3 RESIDENTIAL DISTRICTS", having been introduced in regular meeting of May 16, 1956, was brought up for passage on the motion of Councilman Fuller, Hughes second. Second read- ing was omitted after reading by title, and was then passed, adopted and ordered to print by the following vote: AYES: Councilmen - Fuller, Hughes, Kat- zakian, Robinson and Mitchell NOES: Councilmen - None ABSENT: Councilmen - None Ordinance No. 559 was then signed by Mayor Mitchell in approva; thereof. GARBAGE RATES Mr. Weller then reported that he had received a INCREASED request for an increase in garbage rates from the Sanitary Scavenger Company. He reported that in his opinion an increase could be justified but not to the extent requested by the company. He suggested that the condition of the Company could be analized if the cannery business, carried on by the City Scavenger Company would be included as business income when the rates are set. He also felt that the Company should be protected from loss of this cannery business from other individuals or Companies by a suitable amendment to the Garbage Ordinance. Mr. George Kerston, representing the Sanitary Scavanger Company pre - ORD. NO. # 560 sented arguments on behalf of the company. Council - INTRODUCED man Hughes, statedthat he felt the Council shculd determine the basis by which the need for rate increases should be met. He suggested that this be done by establishing a rate of return to the Comapny. Councilman Hughes then moved to intro- duce Ordinance No. 560 to amend the Garbage Ord- inance to provide for the increase of domestic garbage rates from .65 to .85 with the rate to be based on the assumption that the Company will be protected in the handling of Cannery garbage. Mr. Weller asked if it was understood that the Company would receive 100°%° of the gross income a.6 Minutes of June 6, 1956, continued from the Cannery collection, rather than pay 15% to the City. The Council agreed that the City would not collect its 15% from this item. GAS TAX The City Engineer, Heckinlaible and his Assistant, PROJECTS Chapman then joined the City Council to disscuss the major Street Gas Tax projects for 1956-57. The proposal was approved for the widening of Lodi Avenue from School Street to the Southern Pacific Tracks, also extended to Main Street.
