HomeMy WebLinkAboutMinutes - November 5, 1958344 CITY COUNCIL, CITY OF LODI COUNCIL CHAMBER, CITY HALL NOVEMBER 5, 1958 This regular meeting of the City Council of the City of Lodi held beginning at 8:00 o'clock p.m. of Wednesday, November 5, 1958; Councilmen Brown, Culbertson, Mitchell, Robinson and Katzakian (Mayor) present; none absent. Also present: City Manager Glaves, Administrative Assistant Brown, City Attorney Mullen and Planning Director Rodgers. MINUTES SAFETY A'W'ARD Minutes of October 15, 1958, were approved as written and mailed on motion of Councilman Culbertson, Brown second. PUBLIC HEARINGS CARDINAL ST. REZONING ORD. NO. 628 INTRODUCED Mr. James A. Limbaugh of the State Compensation Insurance Fund, complimenting the City and its employees, presented Mayor Katzakian with a plaque awarded to the City for the greatest improvement in accident prevention during fiscal 1957-58 among cities throughout the State having 150 to 300 employees. The award was made in connection with a yearly safety con- test conducted jointly by the State Compensa- tion Insurance Fund and the League of California Cities. The Mayor called for public hearing on the rezoning from R-1 to R-2 of Lot 40 and the west 46 feet of Lot 41, West View Subdivision, generally described as the westerly two lots on the north side of Cardinal Street between_ Crescent Avenue and Fairmont Avenue. There were no protests either written or oral. The Council discussed the fact that the rezoning was required because the property owner had violated the zoning ordinance. The Council held no sympathy for the property owner but felt that if the lots were not rezoned, it would work a hardship on other property owners in the area as otherwise one lot would have to remain vacant, creating a nuisance. It was also noted that there was R-2 zoning across the street. On motion of Councilman Mitchell, Culbertson second, the Council introduced Or- dinance No. 628 rezoning the above:described two lots from R-1 to R-2, by reading of title only and waiving reading of the ordinance in full, by unanimous vote. COMMUNICATIONS MARC STREET ABANDONMENT Letter from Robert D. Houston requesting the abandonment of Marc Street in Lodi Industrial Park subdivision. In lieu of this street he proposes to dedicate a 60 -foot street along tho south line of this subdivision. He also suggested that a study be made of the present design_ of the proposed freeway with particular referenceto the need for a connection between the victor Road interchange and Lockeford Street to accommodate Lodi -bound traffic from the south and also to the need for a crossing 345 RES. ?4'0. 2177 and possible interchange at Lodi Avenue to ;130PpED provide direct access to this major street. on motion of Councilman Robinson, Mitchell second, the Council adopted Resolution No. 2177 declaring its intention to abandon. Marc Street and setting public hearing thereon for December 3, 1958, and also referred the matte_ to the Planning Commission for rec- ommendation. Councilman Robinson., stating that he was interested in having Lodi Avenue extended across the freeway, moved than the possibility of extending Lodi !venue east to the east boundary of the City limits be referred to the Planning Commission for study and report. The motion was seconded by Coun- cilman Mitchell and carried. ALLEY A request from property owners for abandon- ABAND 0ifYENT ment of a portion of the easterly 'Walnut Street -Lodi :venue alley west of Cherokee Lane. Councilman Culbertson, Brown second, moved t -at the request be referred to the Planning Commission for recommendation and that the petitioners be informed that a deposit to cover costs would be required be- fore abandonment proceedings could be started. Motion carried. HIGHW:;Y Notice of Joint Interim Committee on Highway PROBLEMS Problexs meeting to be held in Stockton on MEETIitiG 'iovember 19 for the purpose of examining into the local impact of the State -gide freeway and expressway system as proposed in the re- port of the Department of Public Works. Coun- cilman Robinson signified that he would attend this meeting. S:_NT& CLARA Resolution from the City of Santa Clara re- RESOLUTIO:f questing the League of California Cities to direct its representatives in the State Leg- islature to oppose any measure introduced _ therein having for its purpose the taxing of municipal utilities for school or other pur- poses. This was approved by the League at its annual meeting. STATE- ?OUTS 12 Letter and resolution from the City of Rio Vista endorsing reconstruction of State High- way 12 from the Mokelumne giver to Highway 99. REPORTS OF THE CITY MAN,,!CZR iETTL:-:M_7- The City Manager read a letter dated October iUTCHINS 14, 1955 from the Division of Highways to the 7`WTERSECTiO4 Director of Public 'Works stating that the Division recommended that instead of traffic t�S. `W0. 21',8 signals being installed, parking be restricted .D OPT:r� at the Kettleman Lane -Hutchins Street inter- section.. The Director of Public .works had 'et with the District Traffic Engineer to discuss "no parking" zones in this area and now recommended no parking on the north side of Kettlem an Lane for 66 feet west of Hut- chir.s Street and for 115 feet east of Hut- chins Street. On motion of Councilman Mit- chell, julbertson second, the Council adopted Resolution Vo. 2179 establishing the no park- ing limits as recommended. '346 Minutes of November 5. 1958 SPECS The City Manager reported that Parking Lot P.:RKiNG LOT' No. 3 on the north side of Oak Street would NO. 3 be vacated on November 30 and he recommended that notice inviting bids for removal or demolition of the structures be approved. On motion of Councilman Brown, Mitchell second, the Council approved the specifications and authorized call for bids for clearing Parking Lot No. 3. SCHOOL The =lementary School District has requested CROSSING that additional protection be given to child - HU TCHINS _T ren crossing Hutchins Street at Tokay Street. TOKAY STREET At the present time there are four pedestrian crosswalks at this intersection. Councilman Culbertson moved, Mitchell second, that the City Yanager investigate and report at the next meeting on appropriate signs for this intersection. Motion carried. PURCHASE In regard to acquiring additional land at the ADDITIONAL Hutchins -Viae Street park site, City Manager ?3RK SITE Glaves stated that Mr. Ted Schneider had beer. offered the same price for his lot on the northwest corner of Vine and Hutchins Street as the City had paid to D?r. John Capell for the adjoining property. He rec- ommended that the City pay for the improve- ments which had been installed by Mr. Schneider. Cost of the lot would be $1085; land value for street dedication, 31441; and improve- ments, $834; making a total of 33360. Mr. Schneider had agreed to this sum. Council- man :Mitchell moved, Culbertson second, that the City acquire the property for $3,360. Motion carried unanimously. TR77CK SPECS SDecifications for a pickup truck for the Parks Department were approved and call for bids authorized on motion of Councilman Mit- chell, Brown second. FIRS DEPT. The City Manager stated that it would cost PICKUP approximately 5386 to repair the Fire Depart- ment pickup truck which had been damaged in an auto accident. According to the City Attorney there would be no chance for recovery of damages. The truck is almost depreciated out and the City Manager recommended that it be reDlaced rather than repaired. On motion of Councilman 3rown, Mitchell second, the Council authorized calling for bids on a new truck. PLJM3ING CODE The City tanager read a letter from the I:iT;RPR ETAT10:1 Western Plumbing Officials Association re- lating to Section 315 of the Plumbing Code which had been questioned by Dir. William Nathan. In effect the letter stated that whether or not piping was imbedded in masonry walls depended on the design of the struc- ture. In other words, it would be the responsibility of the Building inspector to determine whether or not the piping could be installed in masonry walls, and the City Manager believes that the Building inspector ::i.^.upas of `ioveabar 5, 1958 continued 347 is correctly interpreting Plumbing Code Section 315. Councilman Brown said that under certain conditions there was nothing wrong with putting pipe in concrete or masonry walls. =`Ir. Nathan stated that he still felt tie section was misleading. __-P-R STREET Cn motion of Councilman Brown, Culbertson :- LIGHTS second, the City Council adopted Resolution RBS. 110. 2179 :o. 2179 approving the assessment diagram ADOPT -➢ for the Alicante-Tamarack-Rimby Street Lights. Second reading was omitted after reading by title, and was then passed, adopted and ordered to print by the following vote: z_ES: Councilmen - Brown, Culbertson, Mitchell, Robinson and Katzakian _10 S: Councilmen - ':one BSE:iT: Councilmen - None R -POR_J 0? -- CIT v_ MA_IAGFR ( C 0 N. -T INIJ ED) ELECTRIC The City Manager stated that the Superintendent SYSTEM of Utilities recommended that construction be FEEDER LT_=dE started on the feeder lines between the PG&E CONSTRUCTIO:i and the City substations in order to raise theelectric distribution system from 4 kv to 12 kv as set forth on page 10 of the Rogers Engineering Report. The Superintendent estimated that the cost of this construction would approximate 525,000. The Council authorized construction of the feeder lines on motion of Councilman Robinson, Mitchell second. FASEMENT k City :'anager Glaves stated that the Maggio R1rHTS 0. Y Fruit Company wished to acauire an easement over _^PUMP SITE the west portion of the City pump site which is located approximately 650 feet north of East Pine Street Extension and adjacent to the Central California Traction Company right of way. He also stated that the City would need an access road to this site and suggested t::^_at he be permitted to negotiate with Mr. :?a5gio and with the East Side `,+'finery for a roadway. On motion of Councilman Mitchell, Brown second, the Council authorized the City }:anagen to negotiate with Maggio Fruit Company and East Side Winery. 34.8 :inutes of November 5, 1959 continued SANITJURY 717 The nronosal of '.illiam E. funk of Stockton OP. R:.TIO_: to operate garbage disposal sites in the County came up for action, copies thereof having been mailed to members of the Council. On motion of Councilman Culbertson, Mitchell second, the Council .ejected the offer of William -E. Funk, but approved further negotiations with the County on operation of the City's Sanitary =ill. tentative plans were made for trios to Soledad and Pleasanton in regard to maintenance of drainage ditches and also for a tour of Lodi's installations.
