This regular -~eeting of the City Council of the City of
Lodi held beginning at 8:00 o'clock p.m, of `Nednesday, May 7,
195°; Councilmen =rown, Culbertson, '`itc:^.ell, Robinson and
Katzakian (Payor) present; none absent. City ''tanager Glaves
and City Attorney atullen present .
On the motion of Councilman Mitchell, Brown second, the
minutes of April 15 and April 16, 195A, were approved as written
and nailed.
PUBLIC HEARIJGS
REZONING Mayor Katzakian called for public hearing on
505 W. !.ETTLEMAN the rezoning of 505 West Kettlenan Lane from
R-3 Residential to C-2 Commercial. Mr. Robert
ORD. NO. 615 '.dertz, representing Mr. Norris Reiswie, owner
Ii!TRODTJCED of the property, spoke in favor of the rezoning
and stated that $450 had been deposited with
the City as requested to cover the cost of erect-
ing a fence along the north and west boundaries
of the lot. There were no protests, either
written or oral, On -notion of Councilman
Brown, Mitchell second, the Council introduced
Ordinance No. 615, rezoning the '_ot at 505
West Kettlenan Lane to C-2 Commercial, by
reading of title only and waiving reading of
the ordinance in full.
ANNEX 75TH ADD',;. The :dayor then called for public hearing on
the intention to annex the 75th Addition, L_;_nds
ORD. NO. 616 South of East Pine Street, with ','-Industrial

the map and authorized the Mayor to sirn. The

proceed with condemnation of the Dow property
required for opening of Elm Street between
Pacific Avenue ana Siam Lane. Councilman
Robinson objected to paying for the property
and stated that Stone Bros, hau promised to
obtain the right of way; there ore it was
not the responsibility of the City. He
stated that buying the property would set
a precadent. Councilman Mitchell said the
matter "lar been before the Council for the
past four years and would not set a precedent,

both stated that since Elm Street was a major
street, the area should be opened. The

that the award be Made to Pepsi-Cola Bottling
Company since the Company had also a= -reed to
develop the patio area around the main concession
stand and to install temporary stands on week-
ends. On motion of Councilman Culbertson,
Brown second, the Council adopted Resolution
No. 2121 awarding the contract for the Lodi
Lake Park concession to Pepsi-Cola ?ottling
Company of Stockton.

Manager recommended the bid be accepted if
the City were able to do so. There was some
cuestion because of the fact that Mr. Schaffer
was a partner of Mayor Katzakian in the real
estate business, The Mayor stated that he had
no previous knowledge of the bid and has no
interest in such a venture. The City Attorney
ruled that if the Mayor had no interest in the
matter, the City could accent the b_d; however,
the Mayor s__^.ould abstain from voting on it,
The Manager reported that the best bid for the
frame garage was from Clifford Davis for 02p
and for the metal aaraae from Fred Shaw for
,K101; he reco-rnende-d that these bids be accepted.
On motion of Councilman Robinson, Culbertson
second, the Council adopted Resolution No. 2122,
awarding the apartw.ent house to Ben Schaffer,
the frar:e garage to Clifford Davis and the
metal gar-ge to Fred Shaw, by t' -.e following
vote:

The City Manager recon-rended that the Council

would cost X15,925. The City is using

convenience to local oarkers to ha -.e the same
type of meters installed and this outweighed
the difference in cost, moved the adoption
of Resolution No. 2123 awarding the contract
for parking meters to the Magee -.'ale Parr: -0 -
Meter. Company. The motion was seconded by
Councilman Robinson, and carried unanimously.
CLAIMS
Claims in the amount of 4163,822.60 were

A report on an unsafe dwelling at 716 Wiest
Lodi Avenue was deferred to the meeting of
May 21, 1958 for action.

The City Engineer's survey of driveways and

appear to be unnecessary was reviewed by the
City Manager.. On motion of Councilrian Robinson,
Brown second, the Council ordered elimination
of driveways to be replaced by on -street park-
ing stalls in the following areas:
1. At Viola's Beauty shop, 12 North Church
street.
P. In front of Hust & Sons, 216 N. School
Street.
3. Reduction of a 45' driveway to 1�' on
Church Street adjacent to Mitchell &
Koenig,
4. At Loewen's Used Car Lot, School and
Walnut ats.
5. 37' driveway on 'Walr_ut Street adjacent
to the Marvel Store parking lot.
6. On Sacramento Street adjacent to nrch
.[otors.

Councilman Mitchell stated that he had promised

to brin the matter of stop signs at Ham Lane
and Lockeford Street before .he Council. He
considers the present situation dangerous and

wants stop signs erected on Ham Lane at Locke-

ford Street. At present there are stop signs
on Lockeford Street at Ham Lane. The `"ayor
said the matter should be referred to the
Planning Cov- ission and the City Engineer
for recommendation. Councilman Robinson felt
the Council should be able to decide the matter
without re-erral, and ^cved the adoption of
Resolution No. 2124, reinstalling the stop
signs on Ham Lane at Lockeford Street, The
motion was seconded by Councilman Mitchell.
Councilman Culbertson stated that Ham Lane
was a najor street and he would prefer flash-
ing stop signs on Lockeford Street at this
intersection. The City Manager read the
accident. -report from the Chief of Police
stating that accidents occurred to cars

the tree on Ham at the southeast corner of the
intersection could be tce cause. He also stated
that Ham Lane was being ^raintained as a major
street and that its use should not be discouraged,
Councilman Brown stated that the traffic proble-
was acute around 8 and 9 a.m. and ' p.-. and
that four way -stops were required. The resolution
was then adopted by the following vote,

The City Manager presented a report from Lobaugh
a: Elson, the Cityts Broker of Record, regard-
ing insurance not presently carried by the
Cit;;. He then presented their suggested policy
for the service, handling an -4 writin7 of the
City's insurance. On motion of Councilman Brown,
Mitchel_ second, the Council accepted the ser-
vice policy suggested by the ->roker of Record
and instructed the Broker of Record to obtain_
insurance on contractors equipment as outlined
in their report.

desire for a _oar:: in the northwest area of_
„he City with a view toward purchasing Mr.
Van 'Buskirk's property at the corner of
Pleasant and Daisy ^venue$. However, he
reported t.at Mr. Van Buskirk did not wish to
sell the property, but wishes to give it to
the City providing the City would -give
priority to development o' the area and wo-ld
construct a fence on the north side of the
property. Also, the Junior Chamber of Com-
merce, the Recreation Department and Mr.
Van Buskirk: would lice the Little League
Baseball equipment which the Junior Chamber
is securing installed at this site rather
than at the Emerson School grounds as
previously requested. On motion of Council-
man Mitchell, ',�ulbertson second, the Council
accepted with thanks the gift of the park
site from Mr. Van Buskirk. The City Manager
noted that it had been contemplated to name
a oar after 'Ar. Van Buskirk because of '-is
many years on the Recreation Commission and
his long-cor_tinued interest in the welfare
of the City, and he suggested that the
na-:e of Van Buskirk Park for this site
would be especially apr,ropriate. All *-en-
bers of the Council expressed their gratifica-
tion of Mr. Van Buskirk -Is generosity, and
on motion of Councilman Brown, Mlitchell second,
the Council requested the City Manager to
write a letter of appreciation to N!r, Van
Duskirk and requesting their permission to
name the park Van Buskirk Park.
