COUJCIL CHA?MEER, CTR HALL MARC:: 19, 1958 This regular meeting of the City Council of the City of Lodi held 'beginning at 8:00 o'clock o.^'. of Wednesday March 19, 195-9; Councilmen Katzakian, Mitchell, Hobinson and Hughes ("Mayor) present; Councilman Fuller absent. City 'Manager Glaves and City Attorney Mullen present. On the motion of Councilnan Katzakian, ".itchell second, the ^!inutes of March 5, 1959 and March 12, 195-9, were approved as written and mailed, ?UBLIC HEARINGS REZONE =UGi_3I Mayor Hughes called for public hearing on the PROPERTY 07i rezoning of the east side of Ham Lane between LOCUST & LA'j7. Lockeford Street and Elm Street and the north side of Locust Street between Ham Lane and oun- ORD, ii0. 613 set Drive from R-1 Family Resident -al to R-2 I:;TROD -C=D Family Residential. There being, no protests, either written or oral, Ordinance No. 613 approving the requested rezoning, was introduced on -potion of Councilman "Mitchell, Katzakian second. PLANNINCr COM1•1ISSION FI_vAL 'MA? LODI The final map of Lodi Industrial Park was sub - INDUSTRIAL PARA mitt -d for approval. On the motion of Council- man Robinson, Mitchell second, the Council approved the map and authorized the Mayor to sign. The acceptance of the streets offered for dedication is subject to improvement of the Stre,ts to City standards before they will be maintained by the City. Minutes of March 19, 1958 continued 2?i DELTA WATER- Letter from the County of San Joaquin Planning WAYS Department enclosing a "Preliminary Plan for Delta '�:aterways". The Council referred the Plan to the Sunerintendent of Recreation and Parks. HOEGERMAN Communication from Wm. C. Hoegerman appealing APPEAL FRO" the decision of the Planning Commission which PC DECISION denied his request for use of his property at the intersection of Lodi Avenue and Hutchins Street as a used car lot. On notion of council- man Robinson., Mitchell second, the matter was set for public hearing on April 16, 1958, and referred to the Planning Co:rmission for report. WERNER APPEAL Letter from Ed Werner of Wernerls VfF. Co. F'RG"' PC a?neal_ng ecision of !___ Plan_i� - ":)-1- DECISION mission which denied his request for continuance of his variance permit for enlargement of his -.non= conforming manufacturing plant at 600 York Street. A second letter explained that Mr. Werner was now asking for an extension to allow him more time to move to a new location. On motion of Councilman Robinson, Mitchell second, the matter was set for public i'_earing on April 16, 1958, and referred to the Planning Commission for report. ABC LICEiSES Two appl_cations for transfer of Alcoholic Bever- age Licenses, On Sale Beer and Wine: one for the Liberty Cafe, 442 South Main Street, and the other for the Victory Club, 122 North Sacra- mento Otreet. REPORTS OF THE CITY MANAGER CENSUS REPORT The City Manager reported that the Special Census conducted by the bureau of the Census had been completed and that the preliminary report showed the present population to be 20,066. SUNSET AVE. The City Manager presented the tabulation of bids ST. L=GHTING for construction of street lighting facilities DIST. AWARD for the Sunset Avenue Street Lighting District and recommended that award be mare to Electric RES, N0. 2107 Equipment Company which had the lowest bid, ADOPTED 09,172.00. On motion of Councilman Mitchell, Katzakian second, the Council adopted Resolution No. 2107 awarding the contract for construction of street light facilities in the Sunset avenue Street Li.hting District to the Electric Equip- ment Company. CLAIMS Claims amounting to 970,548.66 were approved on motion of Councilman Katzakian, Mitchell second. PURITY STORE The City Manager read a report from the Director DRIVEWAY of Public Works regarding the request of Purity Store for a driveway on Hutchins Street near Chestnut Street. It was brought out that it would not be practical to T7ove the exit to Chestnut Street due to location of the stock roo-n door and also to the fact that Purity delivery trucks had doors on the rizht side for unloadinc:. The Store was willing to install a flashing warn- ing device at the southwest corner of the build- ing which would start flashing as soon as trucks started'.to move into Hutchins Street. The Gity Manager reco— ended that in view of the circum- stances the request for the driveway be granted. The report included a request from Mr. Ted Schneider for a 25 -foot entrance driv=way on Lodi tivenue on the Purity Store site. The Director of 472 '.'i -Utes of Yarch 1�-, 195' continued Public worts recom-ended that Mr. Schneider be granted a 20 -foot entrance driveway, There was then considerable disc•_:ssion among Council mem- bers regarding the City's policy for apprcving driveway requests. Council-nan Robinson moved that before a buildin:7 permit for commercial buildings is granted, complete plans be submit- ted to the Engineering Department including plot plans with exits and entrances and any driveways in excess of 20 feet be referred to the City Council. The -notion died for lack of a second, Councilman Katzaiian moved t at t^e request for a 20 -foot driveway for the ?urity Store on Hutchins Street near Chestnut be granted pro- viding the Store installed safety devices as proposed and also that a 20 -foot driveway, entrance only, on Lodi avenue be granted to Ted Schneider. The motion was seconded by Council- man Robinson and carried unanimously. Council - ran Katzakian then moved that t! -,p present policy regarding driveways be retained. The motion died for lack of a second. OUTSIDE Mr. Glaves inforned the Council that ^ir. R._=.. UTILITY Frey ''_ad built a home on the southeast corner SER V.':E :7 jR of Stockton Street and r:ettleman Lane, which 7 -R -7Y is outside the City Limits, This property is adjacent to the City's w8 well. In order to avoid possible contamin__tion of the well which :night result if Mr. Frey should construct a septic tank, the Superintendent of Utilities recommends that the City provide Mr. Frey with utility ser- vice, with Mr. Frey paying for costs of extensions. Councilman Mitcnel1 :-loved, Katzakian second, that in order to avoid the possible hazard of contamination of R well, tl:^e request be granted with the understanding that the costs would be borne by ",Ir. Frey. The utility service will be both do7estic water an' sanitary sewers. HOLL`,' DRI':' The City "_"_anager gave a report on the present status of :Holl'; Drive opening, stating that the deeds required were in the hands of the County Counse 1 for processing.
