MARCH 12, 1958
This regillar meeting of the City Council of the 'City of
Lodi duly adjourned from March 5, 1954, held beginning at 8:00
o'clock P.M. on Wednesday, March 12, Councilmen tiller,
Katzakian, Mitchell, Robinson and Hughes, ('-"ayor) present; none
absent, City "anager Glaves and City Attorney 'Mullen oresent,
PARKING The City Clerk announced that this was the time
DISTRICT N'0.1 and place for receiving bids on the sa'_e of
4380,000 Off Street Parking Bonds Por Parking
District No. 1. The tollowin bid was opened,
examined and declared: From J.B. Hanauer & Co.
and Associates:
"For ,0380,000 par value City of Lodi, Off -Street
Parking Bonds of 1958, scheduled to be so'_d by
you on :!arch 12, 1958, and maturing March 15,
1959 to 19'35, inclusive, we offer herewith to
pay the par value thereof, plus accrued interest
to date of delivery, plus a premium of Eleven
& No/100 Dollars 011.00). Our bid is r-ade
subject to the conds bearing interest as follows:
"tall of the bonds shall bear interest represented
by coupons attached, at the rate of Five and
one- uarter ercent (5 1/u i;) per annum from
their date of issue, March 15, 1958, to their
respective dates of maturity, and shall also
bear interest represented by detachable coupons,
at the rite of Three-cuarters of one percent
(3/40) per annum from their date of issue,
March 15, 195', to 'larch 15, 1965, or to their
respective dates of maturity, whichever is sooner.
"Our bid is made subject also to all of the terms
and conditions outlined in your official notice
of sale, and subject to the unqualified approving
legal opinion of Messrs. Orrick, Dahlquist, Herring-
ton & Sutcliffe, San Francisco, California, In
ac ordance with your notice of sale we enclose
California Bank cashier's check No. 1513895 in
the amount of $7,500,00."
No other bid was received.
The bid was referred to Attorney Williams of
the law firm of Kirkbride, Milson, Harzfeld
do Wallace for analysis and r•�port.
RL'.OL�T'I N Attorney niliiams advised the Council that the
N0. 2104 bid of J.b. Hanauer & Co, was the highest
ADOPTED responsible bid submitted, Resolution No. 2104,

On motion of Councilman Katzakian, seconded by
Councilman Fuller, and unanimously carried, said
resolution was adopted,
CORRECTIOi`i Attorney Williams advised the Council that a few

The City Manager presented a petition from Clare

Industrial coincident with annexation and states
ADOPTED
that the boundaries of the area were approved
as to definiteness and certainty by the County
Boundary Corml_ssion on March 3, 1958. On motion
of Councilman Fuller, Katzakian second, the
Council adopted Resolution No. 2105 "Resolution
of the City Cou__ci1 of the City of Lodi Giving
Notice of the Proposed Annexation of the Here-
inafter Described Territory Designated as '75th
Addition, Lands South of East Pine Street' to
the City of Lodi, and Classifying Said Territory
in the M Industrial District", and settinz the
public hearin= for Yay 7, 1958.
DIAGONAL
A request from the Lodi Public Schools for diagonal

parking in front of the West Carpus High School

was presented. A memorandum from the Director
of Public Works states that the area is recessed
eighteen feet and that there would not be the
usual hazard of diagonal parking; he therefore
recommends that the request be granted. On
motion of Councilman Mitchell, Katzakian second,
the Council authorized angle parking in the
recessed area in _front of the West Campus as
requested.
CURB & GUTTER The City Manager gave a resume of a meno from

the Director of Public Works regarding the curb
PURITY STORE
and gutter on Hutchins Street along the west
side of the Purity Store property. The curb

was put in at a time when the property was zoned

for residential use which requires an eight -
foot side yard. It was later rezoned to commer-
cial which eliminated the side yard requirement.
The Purity Store plans show the building adjacent
to the property line which would leave aporox'_-
mately two feet between the building and the
curb and gutter. Since the Purity Store is
not willing to change its plans, the Director
of Public Works recommends that the City move
the cur:-. and gutter .-est approxi^ately three
feet in order to allow installation of a five-
foot s_dewalk. Such action .could require the

the elimination of _oarkins on that side
of Hutchins Street, but would leave suffi-
cient area for four 11 -foot traffic lanes
and one parking lane along the west curb,
The City Manager agreed with this recoru!enda-
tion. On motion o£ Councilman Fuller, Mitchell
second, the Council adopted Resolution No.2106,
authorizing the En..-.ineering DepartTMert to move
the curb and' gutter on the east side of Hutchins
Street for the lenth of the Purity store
building in order to allow custruction of a
five-foot s`_dewalk adjacent to the store and
est_eLblis^ing a red "No Parking" zone on the
east side of Hutchins Street from Chestnut
Street to Lodi Avenue, Council -an Robinson
cast a dissenting vote, statin= he opposed any
encroachment into the street area.
P7RITY STORE
A request was presented from Purity Store for

approval of driveways in excess of 2• f eet as
shown on a plot plan of the Store's property,
The Director of Public evor:s recorm erde^ that
the request be granted except that the 35 -foot
driveway requested be reduced to 30 feet, Council-
man Katzakian, Fuller second, moved that all
driveways in excess of 20 feet be approved with
the 35-1'oot driveway being reduced to 30 feet,
The motion was approved unanimously, Council-
man Robinson noted the 20 -foot driveway request-
ed on the corner of Chestnut :End Hutchins and
stated that in his opinion it would be a traffic
hazard to have vehicles move in out of this
area because the proximity of the buildin- would
create a blind corner. It has been the policy
of the City to - grant requests for 20--fooL drive-
ways. Councilman Robinson moved, Mitchell second,
that the request for this 20 -foot driveway be
referred to the Director of Public Korks for
report and that no permission for this drive-
way be granted until approved by the City
Council. The motion passed by the fol'_owing
vote:
