HomeMy WebLinkAboutAgenda Report - November 19, 1997 (83)CITY OF LODI COUNCIL COMMUNICATION AGENDA TITLE: Acquisition of 20 -Foot Storm Drain Easement Adjacent to Roget Park MEETING DATE: November 19, 1997 PREPARED BY: Public Works Director RECOMMENDED ACTION: That the City Council authorize fee title acquisition of an existing 20 -foot storm drain easement adjacent to Roget Park. BACKGROUND INFORMATION: The Sunwest XIV residential development project incorporates an existing 60 -inch trunk storm drain that runs north/south along the project's west boundary adjacent to Roget Park (see Exhibit A). The storm drain is within a public utility easement located in the proposed rear yards. This is an undesirable situation and will likely lead to problems in the future. The storm drain was installed by the Sunwest 4 project in 1986, long before plans for Roget Park or Sunwest XIV were conceived. The Sunwest XIV subdivision map would include easement restrictions that would prevent trees from being planted and various amenities, such as storage sheds and swimming pools, would be prohibited. However, enforcing these types of restrictions can be difficult and often leads to friction between the City and future homeowners. Purchasing the strip in fee and incorporating it into the adjacent park will solve these problems and is the best long-term solution. The developer is willing to sell the strip for $30,000, which is equivalent to $83,700/acre. The amount would be credited against impact fees for the project when the map is filed; however, the developer needs to know if the purchase is acceptable in order to complete the map. Staff recommends approval of the purchase and that the cost be split 50/50 between the Storm and Park Impact Mitigation funds.
