City Manager Glaves, administrative Assistant Brown and Planning Director Rodgers present; City Attorney Mullen absent. MINUTES On motion of Councilman Katzakian, Mitchell second, the minutes of April 15, 1959 were approved as written and mailed. PUBLIC HEARINGS LOTS 1 AND 64 Mayor Brown called for hearing on the proposed CAPELL MANOR rezoning from R-2 One -Family osidential to R-3 REZONED TO R-3 Limited Multiple Family Residential of Lots 1 and 64, Capell Manor subdivision. The Planning ORD. NO. 643 Commission has recommended the proposed rezoning. I_dTRODUCED <here were no protests to the rezoning Y&nd on motion of Councilman Culbertson, Robinson second, the City Council by unanimous vote introduced Ordinance No. 643 rezoning said property to the R-3 Limited Multiple Fmmily Residential District by reading of title only and waiving reading of the ordinance in full. SUELZLE The Mayor then called for hearing on the appeal of VARIANCE Mrs. Tillie Suelzle from the decision of the DENIED Planning Commission denying her request for a variance to permit the re-establishment of a { plumbing shop as a non -conform ing use at 616 1 South Garfield Street. Petitions were received both for and against the re-establishment of the plumbing shop and the following people appeared at the meeting to voice their protest: Lloyd Miller, 513 East Tokay Street; Christ Ulrich, 512 Eden Street; and Pete Kacoliris, 445 East Tokay Street. Mrs. Suelzle spoke in behalf of her request. On motion of Councilman Katzakian, Culbertson second, the Council upheld the decision of the Planning Commission and denied the request of Mrs. Suelzle by the following vote: AYES: Councilmen - Culbertson, Katzakian, Mitchell and Brown NOES: Councilmen - Robinson PLANTING COMMISSION ZONING ORD. The Planning Commission recommended that certain change CHANGES be made in the Zoning Ordinance. These changes involve the following: Minimum yard requirements, minimum lot width and area requirements, dwelling group regulations, and creation of a commercial office zone. On motion of Councilman Robinson, Katzakian second, the matter was set for public hearing on May 20, 1959• CIVIC CENTER The Planning Commission notified the Council that SITE it had approved the tentative map of the Tokay Gardens No. 2 subdivision which comprises the major portion of the site recommended by the Commission as the location of the Lodi Civic Center, and advised the Council that if it desired to acquire this site, it should take the necessary action prior to approval of a Final map and the installa- tion of improvements on the property. The City Clerk certifies that there are less than twelve RES. NO. 2225 registered voters in the area and the boundaries ADOPTED have been approved by the County Boundary Commission. Resolution No. 225, resolution of intention to annex said property as the Nordman addition and setting public hearing thereon for June 3, 1959 was adopted on motion of Councilman Robinson, Culbertson second. PETITION TO Petition from Adolph Fischer and Bertha Herron ANNEX FISCHER for annexation to the City of Lodi of 1.24 acres ADDITION adjacent to the High School 'West Campus property at Walnut Street and Pacific avenue extended. RES. NO. 2226 The petitioners also request that the property ADOPTED be zoned R-3 Limited Multiple Family Residential to become effective coincident with the effective date of annexation. The City Clerk certifies that there are less than twelve registered voters in the area and that the boundaries have been approved by the County Boundary Commission. Giraudo, Del Monte Club, 121-23 North ADOPTED Cherokee Lane. REPORTS OF THE CITY MANAGER C.C.T.CO. The City Manager presented a proposed agree - EASEMENT ment with the Central California Traction AGREEMENT Company which would permit the City to ORDIid_aNCE install two 12 -inch water lines beneath the RES. NO. 2228 tracks of the Traction Company to carry ADOPTED water from the new well which is located near the East Side 'pinery. The City Manager recommended that the agreement be accepted. On motion of Councilman Mitchell, Culbertson second, the Council adopted Resolution No. OBSOLETE 2228 approving the above mentioned agreement OiDINA110ES with the Central California Traction Company and authorized the Mayor to execute same. STADIUM WAY The City Manager stated that at the time SPEED LIMIT East Lockeford Street had been surveyed for traffic hazard, Stadium day, which is between RES. On motion of Council- man Robinson, Katzakian second, the City Council adopted Resolution No. 2229 establish- ing the speed limit on Stadium 'day at 25 miles per hour. WITHDRAd COE On motion of Councilman Katzakian, Mitchell 405 ADD. FROM second, the Council adopted Resolution No. WRCFPD 2230 withdrawing the Coe Addition from the RES. NO. 2230 Woodbridge Rural County Fire Protection District. ADOPTED CLAD?S:. Claims amounting to $166,¢13.59 were approved on motion of Councilman Katzakian, Culbertson second. JUNKDEALERS City Manager Glaves stated ths.t the present ORDIid_aNCE pawnbrokers and junkdealers ordinance was inadequate and he recommended that a new ordinance be adopted. _The members of the Council wished more time to study the ordinance, and on motion of Councilman Culbertson, Katzakian second, held action on the ordinance over to the next regular Council meeting. OBSOLETE The City Manager reported that certain ordinances, OiDINA110ES a list of which had bean presented to each councilman, have been found to be either obsolete or have been superseded by later ordinances or State law and that such ordinances should be repealed. Such action should be taken at the time the Ordinance Code is adopted, but it wss necessary to notify the codifiers at this time that such action would be taken. On motion of Councilman Mitchell, Culbertson second, the Council approved repealing the ordinances listed at such time as the Code were adopted and ordered that the Michie City Publications Company be so notified. 406 Minutes of May 6, 1959 continued APPOINTMENTS R. BAINBRIDGE Mayor Brown stated that he had selected Robert TO LIBRARY BD. Bainbridge to fill the unexpired term of A. W. Marquardt on the Library Board, which would be to June 30, 1960. On motion of Councilman Katzakian, Mitchell second, the Council concurred in the appointment. AVERY GASSI`i TO The Mayor then requested ratification of his PLANNING COM11. appointment of Avery Gassin to the Planning Commission. On motion of Councilman Robinson, Culbertson second, the Council concurred in the appointment of Avery Gassin to complete the term vacated by Councilman Culbertson to June 30, 1959 and for a four-year term commencing July 1, 1959. ORDINANCES WESTWOOD AVE. ORDINANCE NO. 641, entitled "AN ORDINANCE ESTABLISH - SETBACK LINES ING BUILDING SETBACK LINES ON WESTWOOD AVENUE AND ITS PROPOSED E%TENSION BETWEEN LOCKEFORD STREET ORD. NO. 641 AND LAKE STREET", having been introduced at the ADOPTED regular meeting of April 15, 1959, was brought up for passage on the motion of Councilman Katzakian, Mitchell second. Second reading was omitted after reading by title, and was then passed, adopted and ordered to print by the following vote: AYES: Councilmen - Culbertson, Katzakian, Mitchell, Robinson and Brown NOES: Councilmen - atone ABSENT: Councilmen - None CIVIL DEFENSE ORDIN:iNCE NO. 642, entitled "AN ORDINANCE RELATING ORDINANCE TO CI`,iIL DEFENSE AND DISASTER AND REPEALING ORDINANCES NO. 427 AND 432 OF THE CITY OF LODI", ORD. NO. 642 having been introduced at the regular meeting of ADOPTED April 15, 1959, was brought up for passage on the motion of Councilman Culbertson, Katzakian second. Second reading was omitted after reading by title, and was then passed, adopted and ordered to print by the following vote: AYES: Councilmen - Culbertson, Katzakian, Mitchell, Robinson and Brown NOES: Councilmen - None ABSENT: Councilmen - None CITY MANAGER Mayor Brown recommended that the salary of the SALARY INCREASE City Manager be raised to $12,000 and on -notion of Councilman Culbertson, Katzakian second, the Council raised the annual salary of the City Manager to $12,000 by unanimous vote, effective immediately.
