HomeMy WebLinkAboutMinutes - February 4, 1959CITY COUNCIL, CITY OF LODI COUNCIL CEiAMB.ER, CITY FALL FEBRUARY 4, 1959 This regular meeting of the City Council of the City of Lodi held beginning at 8:00 o'clock p.m. of Wednesday, February 4, 1959; Councilmen Brown, Culbertson, Mitchell, Robinson and Katzakian (Mayor) present; none absent. Also present: City - Manager Glaves, City Attorney Mullen and Planning Director Rodgers. MINUTES Minutes of January 21, 1959 were approved as written and mailed on motion of Council- man Culbertson, Robinson second. PUBLIC HEARINGS LOCKEFORD STREET Mayor Katzakian called for continuance of REZONING the hearing on the rezoning from C-1 neigh- borhood commercial to C-2 general commercial ORD. NO. 633 of the area bounded by Hutchins, California INTRODi;CED and Lockeford Streets and the Woodbridge branch of the Southern Pacific Railroad. Mr. Chester Aldridge, who had initiated the rezoning request, stated he was ready to answer any questions regarding his lawnmower business. Dr. Thomas Carleton, who owns the veterinary hospital east of the proposed rezoning, stated that he favored the rezoning as he liked to see Lodi grow. Yvonne Gin- occhio, representing her parents who own property along Lockeford Street, stated that they favored the rezoning as it would mean greater opportunity to sell their property. Against the rezoning were Mr. & Mrs. Spiros Stathatos, owners of an apartment house on West Lockeford Street, who were represented by Attorney Robert Mertz. Mr. Mertz stated that: (1) Many C-2 uses would be detrimental to the area, such as drive-in restaurants and bars, poultry dealers, trailer camps and processing plants. (2) C-2 zoning would increase traffic on Lockeford Street which has already become a problem. (3) The :Master Plan does not call for C-2 zoning in this area and since the Council had rejected a request for a C-2 use at Lodi Avenue and Hutchins Street, it should be consistent and adhere to the Master Plan in this instance also. There were no other Protestants. The City Manager then read the report from the City Planning Commission which had voted 4 to 3 in favor of the rezoning. On motion o£ Councilman Culbertson, :Mitchell second, the City Council by unanimous vote introduced Ordinance No. 633 rezoning to C-2 the area bounded by Lockeford, Hutchins, California Streets and the railroad tracks. A -T -R The Mayor then called for public hearing on STREET LIGHTS the assessment of $1.38 per front foot to be levied on the Alicante-Tamarack-Rimby Street RES. NO. 2201 Lighting District. There were no protests ADOPTED to the assessment. On motion of Councilman Mitchell, Brown second, the Council adopted Resolution No. 2201 confirming the assess- ment for the above-named district. Mr. Leland Lust, representing other property .:Laucas o: j'abruary d, 1959 continued 378 owners in the district, voiced objection to the lighting at the corners on Hutchins Street and Crescent Avenue, stating that the light shines on these streets rather than towards the houses in the district, and the:, felt the lights should be turned to give more light along the streets in the district. Tom Killelea, Superintendent of llitilities, stated that a different lamp would be installed which should give a more satisfactory light pattern and that if there still wasn't sufficient light, the arms on the light standards could be moved, but that they were placed in their present position so that the corners would be lighted and made safer. Mr. Donald Soles, 1321 S. Hutchins Street, also stated his objection to the present lighting on the corners. Both idr. Soles and Mr. Lust stated that the solution offered by `r. Killelea sounded satisfactory. LODI GARD:Eii Mrs. Ralph Orlandella, President of the Lodi Garden CLUB Club, appeared before the Council on behalf of the Club and read a statement that the Club was familiar with the trees on Cherokee Lane and cognizant of the fact that a few of the trees are causing damage to sidewalks and gutters, are poor specimens and no doubt should be removed; however, they wished to go on record as opposed to the Droposed removal of a number of trees on Cherokee Lane or of trees in any other such area in the City until such time as the group request- ing the removal shall have made a plan to either replace the planting or present a Dlan for greater beautification of the given areas. A copy of the statement was given to the City Council. PLA:;NIXG COMMISSION 3HEROKEE LAME The Planning Comtiission recommended that the 7EZO'1IiG easterly 170 feet of the property on the east side of Cherokee Lane between Eden and To'_ta„v Streets be rezoned from R-4 residential to C-2 commercial. This is the site of a proposed bowling alley. On motion of Councilman Robinson, Culbertson second, the matter was set for public hearing on February 25. COi1IUNICATIONS ARLO COURT Petition from Dronerty owners along Carlo Court that the name of the street be changed to "Carlo .day". The petition was referred to the Planning Commission for recommendation on motion of Council - Man (Mitchell, 3rown second. SPGR=S 0, THE CITY .,AtiAGER AIiCS Claims anountinz to 581,585.23 were approved on motion o Councilman Culbertson, Brown second. 3.7Minutes of February 1, 1959 continued POPE The City Manager read the proposed agreement ?ASEA.ENT from the Pope family containing the conditions WELL All under which they are willing to grant an easement to the City along the east and south sides of their property for a water main from well X11. One of the requisites is that the City furnish a maximum of 300 gallons Der minute of water for irrigation purposes to the Pope property. On motion of Councilman Xitchell, Brown second, the Council accepted the easement deed from the Popes subject to the conditions outlined and authorized the City Clerk to sign the agreement on behalf of the City. S.P. CO. The City Manager presented an agreement with EASE'MENT the Southern Pacific Company for an easement under their Valley Springs Branch line tracks RES. NO. 2202 for installation of a storm drain to serve ADOPTED the Don Leach property on North Stockton Street. On motion of Councilman Culbertson, Brown second, the Council adopted Resolution No. 2202 authorizing the Mayor and Clerk to execute the agreement with the Company. 1953 UNIFORM The City Manager read the title of a proposed BLDG. CODE ordinance to adopt the 1958 edition of the Uniform Building Code and read the revisions, additions and exceptions thereto. On motion of Councilman Culbertson, Mitchell second, public hearing on the proposed ordinance was set for the Council meeting on February 25. SALARIES Salaries being next on the Agenda, the Coun- cil reviewed the data which had been previously submitted by the City Manager on local sal- aries and salaries of cities surveyed. The City Manager had recommended that no increase be given to the Clerk Typist I and Stenographer - Clerk I classifications and also the Drofes- sional engineering classes as these salaries appear to be adequate at present. However, he recommended that the entrance salary for Civil Engineer I be raised one step as the present entry step is too low. This classi- fication would then have a four -sten range. He recommended a one-step increase for all classifications based on the laborer's position, but made no recommendation on the police and fire salaries as they are in line with other cities surveyed, but are below those of Stockton and it is a matter of policy for the Council to determine. Council- man Robinson moved, Mitchell second, that the City continue the present salary schedule. The motion passed by the following vote: AYES: Councilmen - Culbertson, Mitchell and Robinson _TOES: Councilmen - Brown and 7 atzakian ABSENT: Councilmen - .Tone she City Manager recommended that the salary of Police Chief Coon be raised to 5700. On motion of Councilman Robinson, Culbertson second, the Council approved the increase for the Police Chief. :inutes of Fabruary 4, 1959 continua ­ 375 CLASS & The City Manager recommended that the present SALARY CHANGE classification of Automotive Serviceman be changed to Equipment Maintenance Tian with a salary range ORD, NO. 634 one step above the current range as the type of I`ITRODUCED work being done by the employee in the class had increased in scone. On motion of Councilman Cul- bertson, Brown second, the Council introduced Ordinance No. 634 amending the Salary Ordinance by changing the classification of Automotive Serviceman to Eo_uinment Maintenance Man with a salary range of 5325-395 and changing the salary range for Civil Engineer I to $481-556. POLIC2-FIRE The City ;tanager stated that in order to keen the PENSIO`; police and fire pension contributions in line with CONTa-.BUTIO?+S the increased OASI contributions it would be necessary to change Section 9.2 of Pension Or - ORD. No. 635 dinance No. 579. On motion of Councilman aitchel'_, INTROD C_D Brown second, the Council introduced Ordinance No. 635 amending Ordinance No. 579, Sec. 9.2, by providing that rates of police and fire personnel over and above the regular contributions be 2j -s of the first $4800 of gross annual salary. HrIALT3 The City Manager stated that notice had been re - IN SJRA:OE ceived from Metropolitan Life Insurance Company that the Dremiums on the medical insurance of employees and their dependents would be raised on April 1 because of the claims exa_erience of the past year. The premium covering employees would be increased from $3.98 to 55.97 and the premium for dependents would increase from 37.78 to 311.67. The City Manager will make a study and report at a later meeting. AWARD CARS City Manager Glaves presented a tabulation of the bids received for six Dolice cars and one business RES. :+0. 2203 coupe for the Engineering Department. The low ADOPTED bid for the Dolice cars was from Krieger .tutor Company for $7,445.86 and the low bid for the business coupe was from Loewen Auto Company for $1,552.00. On motion of Councilman Mitchell, Culbertson second, the Council adopted Resolu- tion No. 2203 awarding the contract for the automobiles to the above bidders. Councilman Mitchell stated that he would like to make a study of the costs of operation in relation to mileage on the police cars as he might be able to suggest a more economical method of purchas- ing cars than the present procedure. The City Manager said he would supply Councilman Mitchell with the pertinent information. PEACE On motion of Councilman Brown, 'Vitchell second, RES0L:;TI011 the Council adopted Resolution No. 2204 adopting the resolution submitted by Mr. Wm. Trampleasure RES. 'i0. 2204 at the previous Council meeting, requesting ADOPTED study of the economic Droblems of disarmament by the Congress of the united States. Mr. Tram= pleasure thanked the Council for adopting the resolution, ani Mr. Robert Fossgreen, represent- ing the Methodist Church's committee on social and economic relations, commended the Council for its action. 37 r.inuies of February 4, 1959 continued RICHFIELD OIL Mr. Glaves reported that P:r. Riney Bender, TIME EXTENSION operator of the Richfield Service Station at the corner of Pine and Church Streets, was requesting that the time given for removal of his business from this site be extended from February 15 to March 1. Mr. Glaves recommended that extension be granted to March 6; however, the Council wished to give the company ample time to vacate, and on :potion of Councilman Culbertson, Mitchell second, granted an extension to March 15, 1959, to the Richfield Oil Corporation. LODI LAK? The City Manager presented a contract from AiGHITECT Paul Tritenbach, landscave architect, which had been approved by the Recreation Commis- sion, for the preparation of a preliminary master plan for Lodi Lake Park for $1600. On motion of Councilman Culbertson, Brown second, the City Clerk was authorized to sign the agreement on behalf of the City. MEETINGS The City Manager stated he had received a letter from the City Manager of Tracy stat- ing that the Cities and County of San Joa- quin Association had changed their meeting date from February 12 to February 19. He also informed the City Council of the State- wide industrial Development Conference to be held in San Mateo on February 18.
