HomeMy WebLinkAboutMinutes - September 7, 196045 CITY COUNCIL, CITY OF LODI CITY HALL COUNCIL CHAMBERS SEPTEMBER 7, 1960 This regular meeting of the City Council of the City of Lodi held beginning at 8:00 o'clock p.m. of Wednesday, Septem- ber 7, 1960. Councilmen Brown, Katzakian, Mitchell, Ullmann and Culbertson (Mayor) present; none absent. Also present: City Manager Glaves, Administrative Assistant Carlton, City Attorney Mullen and Planning Director Rodgers. MINUTES The minutes of August 17 and of August 24, 1960 were approved as written and mailed on motion of Councilman Katzakian, Mitchell second. C014MTJHIC AT IONS ABC LICENSES Notices of the following.applications for Alcoholic Beverage Licenses: REPORTS OF THE CITY MANAGER SAFETY AWARD DSr. Glaves notified the Council of an award received by the City from the American Auto- mobile Association for having no pedestrian . fatalities during the past three years. Mayor Culbertson commended the Police Department and the citizens of Lodi for their safety efforts. CLAIMS Claims in the amount of $146,506.51 were approved on motion of Councilman Brown, Katzakian second. AWARD - The City Manager read the tabulation of bids 1960 SUBD. on the Subdivision Paving Project 1960, the PAVING low bidder being Claude C. Wood Company in the amount of $55,500. Two other bide were received, 1. Transfer On Sale General, Albert T. Bischof and Alvin C. Mindt, "011ie's", 22 North School Street. 2. Original On Sale Beer, Pizza Restaurants, Inc., 531 West Lodi Avenue. PROTEST In regard to the application. of^Pizza Restau- ABC LICENSE rants for an On Sale Beer License, the City FOR PIZZA Manager read a recommendation from the Chief RESTAURANTS of Police that the City Council -protest issuance of the license on the grounds that the restau- rant would beapproximately 320 feet from the High School Last Campus and that sale of beer at this location would aggravate the problem of policing the area. The City Manager stated that the High School Board had taken no action, but that Dr. Lawson Smith, Superintendent of Schools, had voiced his disapproval. Council- man Mitchell moved that the Council accept the recommendation of the Chief of Police and that the Citywrite to the Department -of Alcoholic Beverage Control protesting the issuance of an On Sale Beer License to Pizza Restaurants at 531 West Lodi Avenue -because the sale of beer in the vicinity of the school would be contrary to public welfare and morals. The motion was seconded by Mayor Culbertson and passed by four affirmative votes with Coun- oilman Katzakian abstaining because of indirect interest. On motion of Counoilmaa Katzakian, Mitchell second, the Council adopted Resolution Iio. 2356 awarding the contract for the Subdivision Paving Project 1960 to Claude C. Wood Company. WITHDRAW On motion of Councilman Katzakian, Brown second, MARCHESE ADDN the City Council adopted Resolution No. 2357 FROM WRCFPD withdrawing the Marchese Addition from the RES. NO. 2357 Woodbridge Rural County Fire Protection District. EASEMENT City Manager Glaves presented a recommendation VACATION from the Assistant City Engineer and the Super- KRISTMONT #3 intendent of Public Utilities that portions of easements in Kristmont Acres Unit No. 3 be abandoned since the City has no present or prospective future public need for these tor - tions. On motion of Councilman Katzakian, Ullmann second, the Council adopted an order vacating certain portions of easements in Kristmont Acres Unit No. 3. TURNER RD. The City Nanager presented the plans for the UNDERPASS reoonstru;tion of Turner Road Underpass and the proposed agreement with the County in RES. NO. 2355 connection therewith. On motion of Council - ADOPTED man Brown, Mitchell second, the Council approved the agreement and authorized its execution by the Mayor. On motion of Coun- cilman Brown, Mitchell second, the Council then adopted Resolution No. 2355 verifying that all procedural and technical steps -have been completed in connection with the City of Lodi's application for funds from the California Highway Commission for the con- struction of the Turner Road Underpass and authorizing the Mayor to execute on behalf of the City all necessary documents in connection therewith. FOLSOM- City Manager Glaves stated that representatives SOUTH CANAL of local water agencies and other interested parties had met and adopted a resolution RES. N0. 2358 supporting early construction of Folsom -South ADOPTED Canal and urging the California Water Commis- sion to grant a number one priority to the project and to ask Congress to authorize its construction. The City Council was being asked to endorse the resolution and on motion of Councilman Katzakian, Brown second, the Council adopted Resolution No. 2358 endorsing the above mentioned resolution and the policy of local water agencies in their efforts to expedite construction of Folsom -South Canal. APPOINTMENT WESLEY SMITH Mayor Culbertson proposed the appointment of TO P.C. Dr. Wesley Smith to the'City Planning Commis- sion to fill the unexpired term of Craig Mathews, subject to approval of other members of the Council. On motion of Councilman Katzakian, Brown second, the Council ratified the appointment. 4? Minutes of September 7, 1960 continued ORDINANCES SALARIES ORDINANCE N0. 682, entitled "AN ORDINANCE AMENDING SECTION 7, TABLE III, AND SECTION 12 ORD. N0. 682 OF ORDINANCE NO..444 ENTITLED 'AN ORDINANCE ADOPTED FIXING THE COMPENSATION OF OFFICERS AND EMPLOYEES OF THE CITY OF LODI$ AND REPEALING - ALL ORDINANCES AND PARTS OF ORDINANCES IN- CONSISTENT HEREWITH", having been introduced at -the regular meeting of August 17, 1960, was.brought up for passage on motion of Coun- cilman Brown, Mitchell second. Second read- ing was omitted after reading by title, and was then passed, adopted and ordered to print by the following vote: AYES: Councilmen - Brown, Katzakian, Mit- chell, Ullmann and Cul- bertson NOES: Councilmen - None ABSENT: Councilmen - None SCHOOL CROSSING Councilman Katzakian stated that he had AT HUTCHINS received complaints that motorists were not AND TOKAY heeding the school crossing signs at Hutchins and Tokay Streets so that children were hav- ing difficulty crossing Hutchins Street.
