AGENDA TITLE: Increase in Septic Tank Dumping Fees
MEETING DATE: November 19, 1997

RECOMMENDED ACTION: That the City Council adopt the attached resolution increasing the septic
waste dumping fee from $62.96 per thousand gallons to $133.67 per
thousand gallons for all waste originating outside the City limits.
BACKGROUND INFORMATION: Staff began discussions of this item with the City Council in May of
this year. Since that time, City staff has had two meetings with
County personnel. The last meeting with the County took place on
Thursday, September 11, 1997. A copy of the meeting summary is
attached. At this meeting, the County representatives concurred that the rate proposal was fair and
equitable and that they had verified the accuracy of the fees with their own independent experts.
Supervisor George Barber indicated that the County was supportive of the proposed fee increase.
This increase will not affect the costs of loads of grease hauled from businesses within the City limits
that have grease interceptors (i.e., restaurants, grocery stores, meat markets, cafeterias, etc.).
We are asking the City Council to adopt a new fee at this time for waste originating outside the City
limits; however, it is not planned to implement the fee until January 1, 1998. This will provide the
existing haulers adequate time to adjust to the new rates. The existing haulers will be notified as soon
as the City Council adopts this fee increase.

As you will recall, on August 19, 1997, during a Shirtsleeve Session, the Public Works
Department staff discussed septic waste dumping at the White Slough
WaterMastewaterTreatment Plant along with a proposed fee increase for haulers.
Subsequently, on Thursday, September 11, 1997 City staff presented to County
representatives the proposed new "tipping" fee for septic waste disposal at the City's
facility. The proposed fee as presented to Council and to the County is $133.67 per
1,000 gallons as calculated by Bartle Wells Associates under contract to the City for a
wastewater rate study. The current fee is $62.96.
The County representatives concurred that the rate proposal was fair and equitable and
that they had verged the accuracy of the fees with their own independent experts.
George Barber indicated that the County is supportive of the proposed new fees.
The City Public Works Department will bring the fee increase proposal to Council for
adoption in October. We expect to give the haulers adequate time to adjust to the new
rates and would propose at least a 30 day notice prior to implementation of the new
fees.

RESOLUTION NO. 97-190
A RESOLUTION OF THE LODI CITY COUNCIL REPEALING
AND REENACTING RESOLUTION NO. 91-4 RELATING TO
SEWER CHARGES AND FEES, ADDING SUBPARAGRAPH
"B" TO "HOLDING TANK WASTES"
WHEREAS, the City Council had adopted Chapter 13.12 of the Lodi City Code, entitled "Sewer
Service", which provides the method of establishing charges and fees for sewer service, sewer
connections, holding tank wastes, and the use of the storm drain system; and
and
WHEREAS, the City Council desires to provide current and equable sewer charges and fees;
NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Lodi:
1) That the following sewer charges and fees be established and implemented effective
November 19, 1997 except for "HOLDING TANK WASTES" Item B shall be in full force
and effect January 1, 1998.

bedroom residence (206) gallons per day and having BOD and SS strengths of less

Consent Calendar - November 19, 1997
Honorable Council Members,
On Friday I received a notification dated November 13, 1997
of your intentions to raise the "tipping" fee for septic waste
disposal at Lodi's facility. As a resident of Livable and
Lovable Lodi I think someone should check the Welcome Mat at the
edge of town to see if it still says, "WELCOME" or did someone
turn it over.
Based on the existing rates charged by the various Cities in
this County, Lodi has the highest rates. For our truck with a
capacity of 3,500 gallons, tipping charges per gallon are:
Lodi 6.30 cents per gallon
Stockton 2.87 cents per gallon
Manteca .004 cents per gallon
Tracy 2.10 cents per gallon
Lodi's new proposal at 14.4 cents per gallon is excessive.
Either Lodi's new rate is greatly padded or the Council Members
of the above other Cities are not practicing good stewardship of
their Cities resources.
My own monthly sewage bill is $8.90. A county resident
needing to have 1,200 gallons of waste tipped in Lodi will pay
$160.80 plus the cost of pumping and trucking. This is EIGHTEEN
TIMES the monthly rate charged a city resident that uses the
system everday.

Fortunately for the Council the county residents who will
have to pay these new tipping rates do not have any idea what is
being done to them. A few each day will find out when they have
their septic tank pumped. However the number will be small and
any fear of a mass protest can be disregarded. It is unfortunate
that a notice does not have to be published in the newspaper.
Over the years I am sure every septic pumper has been tempted
to haul septic waste from the Lodi area to another city. Lodi's
new rates will be a tremendous windfall for the unscrupulous
pumper. An extra $120.00 per load can be made by charging to tip
a load in Lodi while dumping it illegally at another city or road
side ditch. The City of Lodi can be happy as their problem with
septic waste will be deflected to another City or the County.
The real problem is between the County and Cities. When the
County stopped allowing septic dumping at the land fill they
promised to build a treatment plant. The County never has and
the Cities are forced to take the waste. As in Lodi's case most
of the Cities do not want to take the waste. Each has enacted
rules and tipping fees. Lodi by taking their proposed action
is showing how county residents and septic waste is thought of.
In the next breath county residents are asked to think of the
City as their trade center.
If this action is fair, so be it! However it appears to be
excessive from this writers view point.
