CITY HALL COUNCIL CHAMBERS
JUNE 15, 1960
This regular meeting of the City Council of the City of
Lodi held beginning at 8:00 o'clock p.m. of Wednesday, June 15,
1960; Councilmen Brown, Katzakian, Mitchell, Ullmann and
Culbertson (Mayor) present; none absent.
City Manager Claves, Administrative Assistant Carlton, City.
Attorney Mullen and Planning Director Rodgers also present.
MINUTES
Minutes of June 1, 1960 were approved as written
and mailed on motion of Councilman Brown, Katzakian
second, after correcting the second paragraph
to show City Attorney Mullen absent.
PUBLIC HEARINGS
MARCHESE ADDN.
Notice thereof having been published in accord-
ance with law, Mayor Culbertson called for
ORD. NO. 676
public hearing on the proposed annexation of

the Marchese Addition with R-3 zoning. There
were no protests, written or oral. The City
Manager read the recommendation of the Planning
Commission that the property be annexed with
R-3 zoning and that right of way for Lodi
Avenue be acquired before annexation. On
motion of Councilman Brown, Katzakian second,
the City Council introduced Ordinance No. 676,
by reading of title only and waiving the read-
ing of the ordinance in full, annexing the
Marchese Addition with R-3 limited multiple
family residential zoning, with the proviso
that the property owners deed to the City a
40 -foot right of way along Lodi Avenue in
exchange for the installation of curb, gutter
and sidewalk by the City.
ANNEXATION
City Attorney Mullen explained the legal
AND ZONING
problems involved in zoning property coincident
with annexation. As long as the zoning conforms
to the Master Plan there is no problem; however,
if the Council should introduce an ordinance
annexing property with zoning contrary to the
Master Plan, objecting property owners would
have the legal right to prevent passage of the
ordinance. Therefore, the Council should
either (1) revise the Master Plan before pro-
ceeding with the annexation or (2) annex the
property without the desired zoning and then
rezone the property after annexation by follow-
ing the procedure set forth in the Zoning
Ordinance.
PLANNING
COMMISSION
REZONING TO The Planning Commission recommended that the
R-3 ON property on the West side of Church Street
N. CHURCH between Louie Avenue and Turner Road be re-
zoned from the R-2 one family residential
zone to the R-3 limited multiple family resi-
dential zone. On motion of Councilman Kat-
zakian, Mitchell second, the matter was set
for public hearing on July 6, 1960.

COMMUNICATIONS
PG&E GAS PATES Notice from the Pacific Gas & Electric Company
that it had applied to the California Public
Utilities Commission for authority to increase
its rates for gas service. On motion of
Councilman Brown, Katzakian second, the communi-
cation was placed-on.file and the City Manager
instructed to keep the Council informed regard-
ing the application.
REPORTS OF THE CITY MANAGER
CLAIMS Claims in the amount of $280,322.47 were approved
on motion of Councilman Katzakian, Mitchell
second.
AWARD - Bids received for the 1/2 -ton truck for the
1/2 -TON TRUCK Utility Department were as follows:

Krieger Motor Company 1,815.77
RES. NO. 2337 By unanimous vote the Council adopted Resolu-

1/2 -ton truck to Loewen Auto Company on motion
of Councilman Katzakian, Brown second.

On motion of Councilman Katzakian, Brown second,
ADOPTED
the Council by unanimous vote adopted Resolu-
tion No. 2338 awarding the contract for the
chain link fence to the lowest bidder, The
Colorado Fuel and Iron Corporation, for
52,440.50.

of Councilman Katzakian, Ullmann second.
STATE SENATE
Mr. Glaves reported that the Board of the
REAPPORTION-
League of California Cities would be meeting

in July and would consider the State Senate
reapportionment proposition which it is,expected
will be on the November ballot. He recommended
that the Council wait until September or
October before taking action on the request of
Californians against Inequitable Reapportion-
ment which was presented at the meeting of June 1.
TRAFFIC AT
Mr. Glaves stated that he had received a report

on traffic conditions at School and Chestnut

and also at Washington and Locust intersec-
tions. He said that accidents at these inter-
sections had been of a minor _nature and no
more prevalent than in other areas of the
City and that in both instances major streets
were just one block away. He recommended
against placing stop signs at these intersections.

Councilman Mitchell suggested that school
crossings be painted at the School -Chestnut
intersection. Mr. Howard Babcock who had
asked for the stop signs at the meeting of
June 1, reiterated his concern over traffic
hazards in the area and his desire for accident
prevention, being particularly concerned with
the children going -to Needham School. Mayor
Culbertson instructed the City Manager to
investigate the possibility of having pedestrian
or school crossings at this intersection.
FIRE DISTRICTS The City Manager presented a proposed agree -
MUTUAL AID ment for day-to-day mutual aid between the
AGREEMENT City of Lodi and the Woodbridge Fire Protec-
tion District, Liberty Fire Protection District,
Mokelumne Fire Protection District, and
Vaterloo-Morada Fire Protection District. The
agreement had been prepared by City Attorney
Mullen and was the outcome of an address given
by him on "Extraterritorial Activities of City
Officers and Employees" at the 1959 Annual
Conference of the League of California Cities.
The City Attorney stated that it had been the
policy of the fire districts in the area to
give mutual aid when needed, but that the
written agreement would provide protection
for the employees. It has the endorsement of
the County Counsel. Councilman Mitchell' -moved
that the mutual aid agreement be approved and
the Nayor and City Clerk authorized to execute
the same. Motion seconded by Councilman Brown
and carried unanimously.
1960-61 Copies of the proposed budget and a memorandum
BURG -72 thereon having been sent to each councilman,
the City hanager further explained the func-
tions of the Operating Budget, Capital Outlay
Budget and Utility Outlay Budget. The Council
then reviewed the supplemental requests of
the Public Works, Finance, Fire and Parks
Departments.
EMPLOYEESLoren Cromwell, President of the City Employees
PICNIC Association, invited members of the Council.
and their families to the Employees' picnic
on June 25 at Lodi Lake Park.
On motion of Councilman Mitchell, Eatzakian
second, the Council adjourned to June 22, 1960
at 8 p.m.
