CITY HALL COUNCIL CHAMBERS
MAY 4! 1960
This regular meeting of the City Council of the City of
Lodi held beginning at 8:00 o'clock p.m. of Wednesday, May 4,
1960; Councilmen Brown, Katzekian, Mitchell, Ullmann and Cul-
bertson (Mayor) present= none absent.
City Manager Glaves, Administrative Assistant Carlton, City
Attorney Mullen and Planning Director Rodgers present; City
Clerk Garibaldi absent.
MINUTES Minutes of April 19, 1960 and April 20, 1960
were approved as written and mailed.
PUBLIC HEARINGS
PALM TREE AT In the matter of the palm tree at 415 West
415 W• ELM Elm'Street, the City Manager read a letter
from Mr. John Sypnieski, 415'West Elm Street,
requesting removal of the tree by the City
because it is too close to his driveway and
creates a'hazard. The City Manager summarized
the memo from the Depaitment of Public Works
which did, not consider the tree particularly
hazardous but felt..the property owner—should
be permitted.-to.remove -th_e.tree at his own

that additional access into the property be
provided by a street extending easterly from
Orange Avenue and that this additional access
be worked out prior to approval of the zoning.
The matter was set for public hearing on
May 18, 1960.
TENTATIVE MAP The Planning Commission had approved the tenta-
GLENHURST tive map of Glenhurst Place Subdivision and
PLACE SUBD. it was now before the Council for concurrence
since several features of the map and its
approval are unusual. The map shows residen-
tial lots backing to Ham Lane, thus making
these lots reverse frontage lots. This type
of lot was proposed by the subdivider and
approved by the Planning Commission because
of the unknown effect of the future City
corporation yard across Ham Lane to the west.
Such lots would not have access to Ham Lane.
Conditions imposed by the Planning Commission
on the approval of the map were as follows:
1. A 50 foot dedication on Ham Lane as a
part of an eventual 100 foot right-of-way
for an expressway street.
2. The corners at Cardinal and Ham are to
have 20 foot radii.
3. The right of access along the reverse
frontage lots is to:be deeded to the City.
¢. A screening fence is to be erected by
the subdivider along the rear of these lots
on Ham Lane. Said fence is to'be six feet
high and either a chain link fence with
lath inserts or a solid masonry wall.
5. Adequate utility easements.
In the subdivision proposals contained on the
map, the subdivider specified that no street
improvements were proposed to be installed in
HamLane, that R-2 zoning is requested for
the lots shown, and that commercial zoning
would probably be requested for the five acres
on Kettleman Lane.. The Commission made no
recommendation as to the improvement of Ham
Lane. The R-2 zoning met with Commission
approval, but the proposed commercial zoning
was not encouraged. The Commission required
that Sunset Drive be extended to this parcel
so that it may be subdivided at some future
date. Planning Director Rodgers explained
that the stipulation of a 100 -foot right of
way for Ham Lane was based on the idea that
Ham will be a main Stockton route and may have
an interchange on State Highway 12. Council-
man Katzakian favored -an 80 -foot right of way
for Ham Lane and stated the subdivider should
pay the cost for Ham Lane improvements. Mr.
Vic Goehring, 931 Tara Place, representing
the property owner, stated the 100 -foot right
of way was over -planning. He stated that
plans of the City for its property on the..west —
side of the proposed Ham Lane were vague and
that FHA would.be reluctant to lend on lots
facing Ham until plans were firm. It was
moved by Councilman Katzakian, Brown second,

that the Council concur in the approval of the
tentative Glenhurst Place Subdivision map as
recommended by the Planning Commission except
that Ham Lane be retained as an 80 -foot right
of way and that the subdivider be required to
improve Ham Lane. Motion passed unanimously.
Councilman Katzakian moved; Brown second, that
the setback on the City's property on the west
side of Ham Lane be landscaped. Motion passed
unanimously.
COMMUNICATIONS
PRISONER COST Letter from C.P. Kenyon, County Administrator,
AT COUNTY JAIL stated that the cost of care of prisoners at
the County Jail had increased to $3.07 per
prisoner per day and that the County must
charge the City for actual cost of caring for
the City's prisoners. The City is presently
paying 750 per prisoner. Supervisor Bull
stated he would urge a $1.53 per day charge.
The Council expressed its approval of Super-
visor Bull's intentions on this matter.
MARCHESE A petition from property owners of one acre
ANNEXATION on the north side of West Lodi Avenue request-
ing annexation thereof. The boundaries have
RES. NO. 2317 been approved by the County Boundary Commis -
ADOPTED sion. On motion of Councilman'Ullmann, Kat-
zakian second, the Council adopted Resolution
No. 231-7 stating its intention to annex the
property as the Marchese Addition and setting
public hearing thereon for June 15, 1960.
CARDINAL- Petition for street lights from owners of

fications'for the Cardinal-Ribier Street Light-
ing District.' The Council then adopted Rea-
olution No. 2319, on motion of Councilman
Brown, Mitchell second', resolution of inten-
tion for conptruction of street light standards
and necessary wires and conduits in the Cardinal-
Ribier Street Ldght`ing District and setting
public hearing thereon for June 1, 1960.

Letter from C.P. Kenyon, County Administration,
SANITARY FILL
with a copy of an Order from the County Board
TRACTOR
of Supervisors enclosed, notifying the Coun-
oil that the Board approved purchase of a new
tractor for the Sanitary Fill''and would appro-
priate its share of the,cost.
ABC LICENSES
Notification of the following applications for
transfer of Alcoholic Beverage Licenses:

OF THE CITY MANAGER
TRACTOR SPECS
City Manager Glaves presented specifications
for the tractor to be used at the Sanitary Fill.
Specifications call for a D-7 Caterpillar
Tractor, 1960 model. He stated that a Civil
Defense surplus tractor at'Sacramento Surplus
Equipment Depot may be available for between
$2,000 - $2,500. On motion of Councilman Brown,
Katzakian second, the Council approved the
.specifications
for the D-7 Caterpillar Tractor
and authorized calling for bids. Motion
carried unanimously.
S.P. CO. LOT
The City Manager presented a request from
LEASE
Southern Pacific Company that its lease with
the City covering its property at the south-
eaat corner of Pine and Sacramento Streets
be amended so as to increase annual rental to
$400. The City is paying $5 per annum at
present. The Company is requesting this
adjustment in view of the fact that 1959-60
taxes for this area amounted to $351. On
motion of Councilman Brown, Mitchell second,
the matter was held over to May 180 1960,
FESTIVAL
The City Manager then presented a modified
STADIUM
lease agreement of the stadium by the Grape
CONTRACT
Festival which added a hold harmless clause
so as to relieve the City of Lodi of liability
for injuries resulting from the Grape Festivals
use of the facility. On motion of Councilman
Brown, Katzakian second, the Council unani-
mously approved the agreement and authorized
its execution by the Mayor.
TRACTOR-
The City Manager reported the following bids

Mr. Don Leach challenged the low bid as not
meeting the specifications, stating it was a
farm type tractor and not an industrial type-
tracty . Mr. Glaves recommended continuance
to the meeting of May 18 so as to investigate
the spread in prices and conformance to the
specifications. On motion of Councilman Kat-
zakian, Mitchell second, the Council postponed
the award until May 18, 1960.
FEES AT The Recreation Commission recommends that
LAKE PARK swimming and boating fees at Lodi Lake Park
INCREASED be increased: swimming for children and adults
from 100 and 250 respectively to 20¢ and 35¢;
and row boats from 500 per hour to 750 and power
boats from $1.50 per hour to $2.00. The in-
creases were requested on the basis that
present fees do not return the costs of operat-
ing the facilities and our fees are substan-
tially lower than those charged in other
cities. Councilman Katzakian moved, Brown
second, that the recommendation of the Recrea-
tion Commission be accepted and that the new
fees be effective Play 8, 1960. Motion passed
unanimously.

CLAIMS
Claims in the amount of $92,377.66 were approved
on motion of Councilman Brown, Katzakian second.
STORM
The City Manager gave a report of the status
DRAINAGE
of proposed storm drainage in Eden Street and
along the 99 Freeway bypass. The City has
received an agreement from'the State Division
of Highways which will enable the City to con-
struct the drainage ditch between the Freeway
and the frontage road from Eden Street south
AGREEMENT
to Kettleman Lane. The State will participate

to the extent that the City is able to drain
the section of the Freeway constructed at

grade. It will not join with the City system
ADOPTED
to drain the depressed section of the Free-
way, but will provide its own pumps and pipe
line to the River. The City will need to go
all the way to Kettleman Lane and must acquire
65 feet of right of way and deed it to the
State. The total estimated cost of the East
Side Storm Drainage project came to $147,650
for right of way -and construction. The State
may also dig a portion of the City's ditch
and use the dirt to widen the Highway south of
Lodi, thereby saving the City of Lodi about
$10,000 construction costs. Councilman Mit-
chell moved, Brown second, that the project
be authorized as presented. Motion passed
unanimously. Councilman Brown, Katzakian
second, then moved the adoption of Resolution
No. 2320 approving the agreement with the State
and authorizing the Mayor to sign. Motion
carried unanimously.
SPECS -
Specifications for furnishing and installing
EDEN STREET
the Eden Street storm drain with pre -cast or
PIPE LINE
cast -in-place pipe were presented. There was
some discussion regarding validity of cast -
in -place pipe. On motion of Councilman Kat-
zakian, Mitchell second, the specifications
were approved and call for bids authorized.
COMPLAINT -
A complaint was received regarding the noise

made by garbage trucks when collecting during
the early morning hours. The City Manager is
to investigate to see if anything can be done
about early pickup.
