HomeMy WebLinkAboutMinutes - April 6, 1960CITY COUNCIL, CITY OF LODI CITY HALL COUNCIL CHAMBERS APRIL 6, 1960 This regular meeting of the City Council of the City of Lodi held beginning at 8:00 o'clock p.m. of Wednesday, April 6, 1960; Councilmen Culbertson, Katzakian, Mitchell, Robinson and Brown (Mayor) present; none absent. City Manager Glaves, Administrative Assistant Carlton, City Attorney Mullen and Planning Director Rodgers present. MINUTES Minutes of March 16, 1960 were approved as written and mailed on motion of Councilman Katzakian, Culbertson second. PUBLIC HEARINGS ANNEX Notice thereof having been published in accordance ZORNIG ADDN. with law, Mayor Brown called for public.hearing on the proposed annexation of the Zornig Addition. ORD. N0. 674 The annexation thereof has been approved by the INTRODUCED City Planning Commission. There were no protests, written or oral. A letter was presented from the peitioners offering to deed to the City the west 40 feet and the south 5 --feet of their property for street purposes and agreeing to paying the costs of the improvements thereof. On motion of Councilman Robinson, Mitchell second, the City Council introduced Ordinance No. 674 annexing the Zornig Addition to the City of Lodi, subject to acceptance of a deed for rights of way and approved the conditions set forth in the letter from the peititioners. The motion carried unani- mously. PALM AVENUE Notice thereof having been published and posted STREET LIGHTS in accordance with law, Mayor Brown called for public hearing on the Palm Avenue Street Lighting RES. NO. 2304 District. A written protest was received from RES. NO. 2305 Mrs. Maude Cope, 506 Palm Avenue, who objected AND to having lights on the street and the cost thereof. RES. NO. 2306 Mrs. Stanley Laidlaw, 719 Palm Avenue, voiced ADOPTED similar objections. There were no other protests, either written or oral. On motion of Councilman Katzakian, Culbertson second, the Council adopted Resolution No. 2304 overruling the protests. On motion of Councilman Katzakian, Mitchell second, the Council adopted Resolution No. 2305 ordering the work on the Palm Avenue Street Lighting District, and on motion of Councilman Katzakian, Mitchell second, the Council adopted Resolution No. 2306 directing that the assessment thereon be prepared. COMMUNICATIONS CVD, LCC Letter from Gustine stating that the regular April meeting of the Central Valley Division of the League of California Cities had been cancelled and that the next meeting would be in Modesto on July 28. ABC LICENSES Two notices of application for Alcoholic Beverage Licenses: 1. On Sale Beer, Themistoklis Athanasekos, Royal Dafe, 117 North Sacramento Street. 2. On Sale Beer, Alfred E. Broux and Rienna J. Broux, Clinton Club, 5 East Elm Street. 49 Minutes of April 6, 1960 continued WATER BILL Letter from Mrs. Jack Owen, 422 Railroad Ave - REFUND nue, asking for a refund on water charges which she felt she had overpaid since 1953• The City Manager read a memo from the Finance Department giving a resume of what had trans- pired and stating that Mrs. Owen had been given a refund for the 12 -month period prior:to her request which was the maximum refund period allowed in accordance with established policy of the City. Councilman Mitchell, Culbertson second, moved that the City Manager answer Mrs. Owen's letter informing her of the policy of the City in this regard. Motion carried. W ESTSIDE Letter from the Division of Highways informing FREEWAY the Council that a meeting will be held at Thornton Community Hall, Thornton, at 10 a.m., April 21, to explain proposed routes for the Westaide Freeway. REPORTS OF THE CITY MANAGER AWARD The City Manager presented the tabulation of POLICE CARS bids for seven police cars as follows: RES. N0. 2307 Krieger Motor Company - Ford Fairlane $92588-75 ADOPTED Loewen Auto Company - Chevrolet Bel Air 9,853..47 Woodrow Mitchell - Plymouth Belvedere 9,700.00 Voodrow Mitchell - Plymouth Patroller (Alt.) 8,818.00 Loeppke and Keszler were disqualified because their bid was submitted after the deadline for acceptance of bids. The City Manager recommended that award be made to Woodrow Mitchell for the Plymouth Patrollers as the lowest and best bid. He also stated that the heavy duty three speed automatic transmission had been omitted from the specifications, but he felt it should be included in the purchase of the cars for better service and trade-in value. Councilman Culbertson, Katzakian second, moved the adoption of Resolution No. 2307 awarding the contract for seven police cars to Woodrow Mitchell for the Plymouth Patrollers for a sum of 98,818.00, plus $149.80'for the heavy duty transmission, making a total of $8,967.80. Motion carried. Councilman Mitchell has no direct or indirect interest in the transaction. AWARD City Manager Glaves then presented the tabula - FIRE DEPT. CAR tion of bids for one car for the Fire Depart- ment: RES. NO. 2308 ADOPTED Loewen Auto Company - Chevrolet Biscayne $2,190.00 Krieger Motor Company - Ford Fairlane $2,176.00 Woodrow Mitchell - Plymouth Patroller $2,170.00 The Council adopted Resolution No. 2308 award- ing the contract for the Fire Department car to Woodrow Mitchell for $29170.00 plus $21.40 for the heavy duty transmission on motion of Councilman Katzakian, Robinson second. Council- man Mitchell has no direct or indirect interest. Minutes of April 6, 1960 continued 495 SPECS Specifications for a deep -well turbine pump and DEEP -WELL motor for installation on Well No. 11 were approved PUMP and call for bids authorized on motion of Coun- cilman Katzakian, Mitchell second. SPECS Specifications for a tractor loader for use in TRACTOR the Street Department were approved and call for LOADER bids authorized on motion of Councilman Katzakian, Culbertson second. DRIVEWAYS ON The City Manager presented a request from Mr. W. WALNUT ST. George Mason for two, 30 -foot driveways at 1340 APPROVED West Walnut Street where eight dwelling units and carports have been constructed. The Depart- ment of Public Works recommended that the request be granted. On motion of Councilman Culbertson, Katzakian second, the City Council approved the two, 30 -foot driveways requested by Mr. Mason. ROBERT LEHR City Manager Glaves presented a letter from Mr. METER REMOVAL Robert Lehr asking for removal of a parking meter at his place of business on Sacramento Street at Pine Street. He had installed gas pumps so as to operate the place as a gas station and now needs the driveway for his customers. Mr. Lehr stated he had a contract with the Tidewater Oil Company for three years. Councilman Culbertson moved that the parking meter in question be removed for as long as the adjacent property was being used as a bona fide gas station. Motion was seconded by Councilman Mitchell and carried unanimously. LEHR PARKING Councilman Katzakian moved that the proper City METER officials be directed to issue a complaint for non - CITATIONS payment of any parking meter citations that might have been issued to Mr. Robert Lehr. Motion was seconded by Councilman Robinson and carried. CLAIMS Claims in the amount of $172,653.49 were approved on motion of Councilman Culbertson, Katzakian second. FIRE DISTRICT Councilman Katzakian, Mitchell second, moved the WITHDRAWALS adoption of Resolution No. 2309 withdrawing the Lutheran Church kddn. from the Woodbridge Rural LUTHERAN County Fire Protection District. Motion carried. CHURCH ADDN. Councilman Mitchell, Robinson second, moved the BY RES. NO. adoption of Resolution No. 2310 withdrawing the 2309 Church Street Addition from the Woodbridge Rural CHURCH ST.ADDN County Fire Protection District. Motion carried. BY RES. NO.2510 City Manager Glaves reported that in compliance PALM TREES ON with a request of the Council the Department of HUTCHINS AT Public Works had investigated the five palm trees OAK as a traffic hazard on the west side of Hutchins Street immediately north of Oak Street. According to the department, the traffic does not warrant removal of the trees at this time. The City Manager recommended that the trees be thinned by removal of every other tree. This could be done without injury to the curb, gutter or sidewalk. Councilman Robinson, Katzakian second, moved that every other tree be removed because of the safety factor. Motion carried. TRACTOR AT The City Manager stated that the tractor which SANITARY FILL the City had on trial for a 30 -day period out at the Sanitary Fill was not in satisfactory con- dition and would not be worth the additional cost for repairs. He stated that the Department of Public Works would continue to look for a suitable secondhand tractor. 496 Minutes of April 6, 1960 continued STREET DEFICIENCY Mr. Glaves then presented a Street Deficiency REPORT FOR STATE Report which had been prepared by the Depart- ment of Public Works in compliance with State RES. NO. 2311 Senate Concurrent Resolution No. 62. The ADOPTED Council adopted Resolution No. 2311 accepting the Report and ordering copies thereof sent to the State Division of Highways on motion of Councilman Katzakian, Mitchell second. DETECTIVE JOB The City Manager recommended the reclassifica- SPECIFICATIONS tion of Detective to include the work which 1 has formerly been handled by the Juvenile RES. NO. 2312 Officer. On motion of Councilman Culbertson, ADOPTED Mitchell second, the City Counciladopted Resolution No. 2312 adopting the specifica- tions for Detective as presented by the City Manager. ORDINANCES R-4 ZONING ON ORDINANCE N0. 672, entitled "AMENDING THE S. FAIRMONT AVE. OFFICIAL DISTRICT MAP OF THE CITY OF LODI AND THEREBY REZONING PROPERTY ON THE EAST SIDE OF ORD. NO. 672 SOUTH FAIRMONT AVENUE TO BE IN THE R-4 MUL- ADOPTED TIPLE FAMILY INSTITUTIONAL RESIDENTIAL ZONE", having been introduced at the regular meeting of March 16, 1960, was brought up for passage on motion of Councilman Katzakian, Culbertson second. Second reading was omitted after reading by title, and was then passed, adopted and ordered to print by the following vote: AYES: Councilmen - Culbertson, Katzakian, Mitchell, Robinson and Brown NOES: Councilmen - None ABSENT: Councilmen - None i PROHIBIT ALL- ORDINANCE NO. 673, entitled "AN ORDINANCE OF NIGHT TRUCK THE CITY OF LODI ADDING SECTION 14-55.1 TO PARKING THE LODI CITY CODE, 1959 PROHIBITING PARKING OF HEAVY DUTY TYPE COMMERCIAL VEHICLES IN ORD. NO. 673 CERTAIN ZONES DURING CERTAIN HOURS OF THE ADOPTED MORNING", having been introduced at the regu- lar meeting of March 16, 1960, was brought up for passage on motion of Councilman Mitchell, Katzakian second. Second reading was omitted after reading by title, and was then passed, adopted and ordered to print by the following vote: AYES: Councilmen - Culbertson, Katzakian, Mitchell, Robinson and Brown NOES. Councilmen - None ABSENT: Councilmen - None Mayor Brown moved that the City Employees Association be sent a letter commending the employees on the wonderful job they did during Community Services Week.
