Wednesday, February 21, 1962. Councilmen 3rown, Katzakian, Mitchell and Ullmann present; Mayor Culbertson absent. Vice -Mayor Katzakian presided. Also present; City Manager Glaves, Planning Director Rodgers and City Attorney Mullen. Absent: Administrative Assistant Carlton. CAiiOPIF.S with law, Vice-;iayor Katzakian called for hearing & ZiiCROACHMEITT on the appeal of Richfield Oil Corporation from RiS. .i0. 2511 the decision of the City Planning Commission in ADOPTED denying the Company's request for a variance to permit canopy structures to encroach into the front yard and street side yard at the northwest corner of Kettleman Lane and Hutchins Street. The City Manager read the appeal of the Company and the report from the Planning Commission which had denied the request because it felt sufficient hardship had not been shown. There were no pro- tests, written or oral. Mr. C. V. Wetteroth of the Richfield Oil Corporation described the type of canopy which would be used, showing pictures thereof - and they would be 13.6 feet in height and would not obstruct visibility; also, the canopies would be ¢0 feet from the nearest property line. The Council felt that the request was reasonable and on motion of Councilman Brown, Mitchell second, reversed the decision of the Planning Commission and granted a variance for the erection of canopies within the front yard and street side yard at the north- west corner of Kettleman Lane and Hutchins Street. Councilman Brown then moved the adoption of Resolution No. 2511 repealing Resolution No. 2509 and granting an encroachment permit for pump islands with canopies within the setback line on Kettleman Lane subject to removal of said struc- tures at no expense to the City or State at such time that the property is required for the widening of Kettleman Lane. On motion of Councilman Brown, Ullman second, the City Council introduced Ordinance No. 717 re- zoning the property on Elm Street between Church and Pleasant (except for the northwest corner of Elm and Church which is C-2) from R-4 to C -P by reading of title only and waiving reading of the ordinance in full. NO. 718 City Code which would permit civil defense I:;TRODUCED shelters to be located within a front yard or street side yard subject to the issuance of a use permit. There were no protests, written or oral. On motion of Councilman Drown, Ullmann second, the City Council introduced Ordinance No. 718 amending the City Code to permit civil defense shelters within a front yard or street side yard subject to a use permit, by reading of title only and waiving reading of the ordinance in full. C API PAL OUTLAY FINAfCIAL Since Mr. Mel Davison of Stone and Youngberg REPORT was present and waiting to give a report on the study of the financial aspects of the City's Capital Outlay Program, the Council agreed that that item on the agenda should be presented at this time. Mr. Davison reviewed the letter and accompanying tables dated February 15, 1962 from Stone and Youngberg, copies of which had been sent to members of the City Council. He stated that this was a preliminary summary and that the report in final form would not be made until final determination on the Capital Outlay Program had been made. Stone and Youngberg recommended that the program be divided.into two phases of five years each and that the first five- year program could best be financed by general obligation bonds of approximately 35,000,000. PLANNING COMMISSION WEST LANE- The Planning Commission recommended that the HAM LANE County be requested to include Ham Lane in its ALIGNMENT current study of the relignment of West Lane which is presently aligned with Hutchins Street. After discussion concerning costs and feasibility of both routes, Councilman Brown moved that the Council concur with the recommendation of the Planning Commission and request the County to in- clude Ham mane as an alternate route in its study of the realignment of :Jest Lane. - 2 - 216 iiinutes of February 21, 1962 continued C 01•1111li2I C A^1 IOii S APP --.L: A letter was received from carry Kries and EZAWY SIIOP Claudia Kries appealing the action of the Plan - A^1 517 II. ning Commission in granting a use permit to Ci'TJ-JC H 2elen Kolb to establish a one -operator beauty shop at 517 North Church Street in the 2-3 multi- ple family residence zone. On motion of Council - Lan :3rown, Mitchell second, the appeal was set for public hearing on :March 7, 1962. TJIiLOCK An invitation was received from the City of Turlock to attend the dedication of their new City Tall on February 24, 1962. It was moved that a letter be sent to Turlock thanking them for the invitation and extending congratulations. TWT;: CITIES A letter was read from the Executive Director PROGRAIM of the Twin Cities Association, Italy, to ifayor Culbertson thanking him for his cooperation in furthering this program and informing him he had been appointed an uonorary Member of the Twin Cities Association. Council - mar, Nitchell moved that the specifications be approved and that call for bids thereon be author- ized. iiotion was seconded by Councilman 'town and carried. 1ID CAiFAL City Manager Glaves notified the City Council C 2,05311TG that since approval of the right of way on AGREENEI T January 17, 1962, for the extension of 'Pokay Street across the Woodbridge Irrigation District canal, the developer has acquired additional property which will permit the construction of the Tokay Street bridge perpendicular to the canal rather than at an angle as originally pro- posed. The City Hanager stated that the perpen- dicular crossing would be preferable and recom- mended that the revised description be approved. On motion of Councilman Mitchell, Ullmann second, the City Council approved the corrected description of the right of way for the extension of Tckay Street across the `l ID canal. EASLPJ:', iT AT The City Manager stated that the United States DISPOSAL SITE Bureau of Reclamation has requested another ease- G2Ai?TED TO ment through the City's 303 -acre disposal site U.S.A. and has offered the City 82,075 as compensation for the easement which covers 8.1 acres, including RES. NO. 2512 2.0 acres which will be removed from City use. The City Manager recommended that the easement be granted subject to the above con- ditions. Councilman Drown moved the adoation of Resolution. 'o. 2512 authorizing the a=ecution of a contract and grant of electric transmission line easement through the 303 -acre disposal site for the sum of 82075, with the understanding that the City would have use of the land for the construction and operation of oxidation ponds for sanitary and industrial waste and would pro- vide access to the towers. The motion was seconded by Councilman Ullmann and carried. AWARD - The following tabulation of bids on the South S. On motion of Councilman Mitchell, Brown second, the City Council adopted Resolution No. 2515 awarding the contract for pipe, fittings and sprinkler heads to Rainmaker Pipe Company for a total of 34,450.18. On motion of Councilman ?Titchell, 3rown second, the City Council adopted Resolution io. 2517 eliminating- the parking stalls as recommended and establishing no parking zones therein.
