Councilmen Brown, Katzakian, Mitchell, Ullmann and Culbertson (Mayor) present; none absent. Also present; City Manager Glaves, Admin. Asst. Carlton, Planning Director Rodgers and City Attorney Mullen. MINUTES Minutes of November 19 1961 were approved as written and mailed on motion of Councilman Katzakian, Brown second. PUBLIC HEARINGS ANNEX Notice thereof having been published in accordance CHEATHAM ADDN with law, Mayor Culbertson called for public hear- ing on the proposed annexation of the Cheatham ORD. -N0. 710 Addition. There were no protests, written or oral. INTRODUCED The recommendation of the Planning Commission favoring the annexation was read. On motion of Councilman Brown, Ullmann second, the City Council by unanimous vote introduced Ordinance No. 710, annexing the Cheatham Addition to the City of Lodi, by reading of title only and waiving reading of the ordinance in full. EASEMENT Notice thereof having been published in accordance ABANDONED FOR with law, the Mayor called for public hearing on ST. PAUL'S the intention to abandon a 10 -foot easement ex- LUTH. CHURCH tending through Lot 6, Barbour -Beckman Tract No. 2. This property belongs to the St. Paul's American RES. NO. 2489 Lutheran Church which wishes the easement to be ADOPTED abandoned so that the Church can enlarge its build- ings. The Church has offered another easement for utilities and has agreed to pay all expenses of the abandonment proceedings and the cost of relocating the water main which is in the ease- ment to be abandoned. The Planning Commission has recommended the abandonment subject to the acceptance of an alternate easement for services to the property and to payment by the Church of all expenses in connection with the abandonment and relocation of the utilities. On motion of Councilman Mitchell, Katzakian second, the City Council accepted the agreement of the Church to pay the costs and to provide an alternate easement and adopted _Resolution No. 2489 abandoning the easement in Lot 6, Barbour -Beckman Tract No. 2. The City Manager read the recommendation of the Planning Commission for the rezoning. On motion of Councilman Katzakian, Brown second, the City Council by unanimous vote introduced Ordinance No. 711 rezoning the northwest corner of Fairmont Avenue and Cardinal Street to R-3, by reading of title only and waiving reading of the ordinance in full. 186 Minutes of November 15, 1961 continued REZOITING Notice thereof having been published in accordance 600 ELK with law, payor Culbertson called for public hear- FAIRMONl ing on the proposal to rezone from R-3 limited multiple family residential zone to C -P commercial - ORD. N0. 712 professional office zone the property located along INTRODUCED the east side of South Fairmont Avenue in the 600 block immediately north of Tokay Street. There were no protests, written or oral. City Manager Glaves read the report of the Planning Commission for the rezoning. On motion of Councilman Brown, Katzakian second, the City Council by unanimous vote introduced Ordinance No. 712 rezoning the east side of Fairmont Avenue in the 600 block to C -P, by reading of title only and waiving reading of the ordinance in full. LAUREL AVE Mayor Culbertson then called for continuance from S OF TURNER the meeting of November 1 of the hearing on the proposal to change the name of Laurel Avenue south of Turner Road to "Mason Street." City Manager Glaves reported that if the name were to be changed, the Engineering Department felt that the best solution to the numbering problem was to have the block in question designated as the 1100 block of Mason Street. This was not an ideal solution since other blocks south of Turner Road were num- bered 900, but the Engineering Department felt that changing the name and number was preferable to the present situation. Mayor Culbertson pre- sented a petition signed by property owners in the 1000 block of Mason Street requesting that the street name be changed because it is normal for a street on either side of an intersection (Lake Home Drive) to have the same name and because of the difficulty in finding Mason Street when entering town from Turner Road. Mrs. James Haley, 906 Laurel Avenue,.owner of the sole residence facing on the block in question, stated that her reasons for being against the ohange were the .same as those she gave (inconvenience of change in address and liked name "Laurel" better) at the previous hearing. Councilman Brown stated that since only one house was affected there should not be too much inconvenience in changing one address, and moved that Resolution No. 2490 chang- ing the name of Laurel Avenue south of Turner Road to "Mason Street" be adopted. The motion was seconded by Councilman Ullmann. Councilman Kat- zakian mentioned that at its previous meeting the Council had not changed the name of.Edgewood Drive which was a situation similar to this one, Coun- cilman Mitchell felt that the jog in Laurel Avenue did not make any difference and that the name should not be changed. Councilman Katzakian did not approve changing the number of the block as block numbers are indicated on the street signs and having one block south of Turner in the 1100 block while the others -are in the 900 block would be confusing. He said he had been in favor of the change until he became aware of the numbering problem. Mayor Culbertson felt that changing the name was not the real solution. The motion failed to pass by the following vote; Ayes: Councilmen - Brown and -Ullmann Noes: Councilmen - Katzakian, Mitchell and Culbertson t®7 Kinutes of November 151 1961 continued PLANNING COMMISSION DAISY AVE The Planning Commission recommended that the SPELLING correct spelling of Daisy Avenue be established as "Daisy" since it is being spelled as either "Daisy" or "Dailey", depending on the subdivision. On motion of Councilman Katzakian, Brown second, the matter was set for public hearing on December 6, 1961. REZONING The Planning Commission recommended that a change SON -RAY PARK of zoning be made from the R-1 one family resi- SUBD. AND dential zone and the R-4 multiple family resi- PARK SITE, dential zone to the R-2 one family residential zone for the east 446.5 feet of the Son -Ray Park Subdivision and the north 539 feet of the Sewage Treatment Plant property. The Planning Commission feels that the correct designation of the Son -Ray Park Subdivision is the R-2 residential zone and the same should also apply to the proposed park area immediately south of the subdivision. The proposed change was set for public hearing on December 6, 1961 an motion of Councilman Brown, Mitchell second. The Planning Commission took the following actions at its meeting of November 13, 1961: 1. Re -approved the tentative map of the Glen- hurst Place Subdivision. 2. Denied the request of Mr. R.P. Barbour for a change of zoning from the R-3 limited multiple family residential zone to the C -P commercial professional office zone for property along the south side of Chestnut Street between School Street and Church Street. 3. Denied the request of Mr. Rudy E. Lux for a variance to eliminate the required yard separation between a residence and a de- tached garage. C OMMUITI C AT I ON S PETITION FOR A petition was received from merchants on School MID -BLOCK Street between Oak and walnut Streets requesting CROSSWALK establishment of a crosswalk on School Street between Oak and `Walnut. The merchants contend that the jaywalkers in this area create a serious traffic hazard and that a clearly defined cross. walk with proper signs posted would alleviate this condition. Petitions signed by approximately 750 customers supporting the merchants were also pre- sented. Mayor Culbertson asked if anyone in the audience wished to add any arguments in favor of the crosswalk, but therer was no response, Mr. Loren Powell, Secretary -Manager of the San Joaquin County Safety Counoil, spoke against the petition in behalf.46f the Lodi District Safety Council, stating 4 at such a crosswalk would increase acci- dents. He sited studies made'by the Institute of _ -.raffic Engineers, the National Safety Council, the Los Angeles Police Department, and the Presi- dent's Committee for Traffic Safety to uphold his statement. He then read a letter from the Lodi District Safety Council suggesting that the petitioners meet with the Safety Council and the Minutes of November 15, 1961 continued City departments responsible for traffic in an effort to reach a solution of the problem. Police Chief Coon stated thatpainting the crosswalk would not eli-urinate the danger, but would put the re- sponsibility on the motorist instead of the pedestrian. He said that when signal lights were placed at the School -Walnut intersection, pedes- trians crossing mid -block could be cited for Jay- walking under the Motor Vehicle Code. He said that this block was the same length as other blocks along the street as far north as Lockeford Street and granting the request would compound the problem. He said that installation of "walk" and "don't walk" signals at intersections should be considered. Members of the Council were in agree- ment that installation of a crosswalk in the middle of the block did not appear to be satis- factory solution to the problem, but on motion of Councilman Katzakian, Brown second, tabled the request of the merchants and referred the problem to the petitioners and the local Safety Council for possible solution. BETHEL CHURCH A letter was received from the Bethel Open Bible RE TREES Church concerning the nuisance caused by"sap drip- ping from trees in the parkway in front of the church at the southwest corner of Locust and SAPEETY Church Streets. The Church would like to have the CONTEST trees removed. On motion of Councilman Brown, Mitchell second, the matter was referred to the City Manager for investigation and report. MOSQUITO A communication was read from the Northern San ABATEZ?E14T Joaquin County Mosquito Abatement District notify - TRUSTEE ing the Council that the term of Robert Fuller as a trustee for the District would expire on Decem- ber 31, 1961, and that Mr. Fuller was willing to THANKS serve another term. ABC LICENSE A notice of application for transfer of Alcoholic Beverage License, On Sale Deer, for Lucille and Philip Binder, Royal Cafe, -117 Forth Sacramento Street, was read. SAPEETY A communication was received from the League of CONTEST California Cities containing the results of the State-wide 1960-61 Employee Safety Contest in which Lodi placed 21 out of 39 cities in its group. J. KIRSTEN A letter from Jerald'Kirsten was read asking that the Council accept his resignation from the Library Board of Trustees to be effective December 31, 1961, Action on the request was postponed pend- ing consultation with Mr. Kirsten. THANKS A letter was read from Rev. John Raymond of St. Johns Espicopal Church commending the Police Department for its efficiency in recovering articles which had been stolen from the Church office. REPORTS OF THE CITY MANAG-"R CLAIMS Claims in the amount of $112,893.58 were approved on motion of Councilman Katzakian, Mitchell second. Minutes of 'November 15, 1961 continued LOADING ZONE City Manager G1-aves read a recommendation from FOR DAY CARE the Department of Public Works that a 40 -foot CENTER passenger loading zone be established on the south side of Lodi Avenue at the east end of Maple RES. N0, 2490 Square as requested by the Lodi Child Care Center ADOPTED in order to lessen traffic hazards caused by -parents picking up their children at the Center. Such a loading zone will necessitate the removal of two parking stalls, but will result in less traffic congestion on Lodi Avenue. On motion of Councilman Katzakian, Brown second, the City Coun- cil adopted Resolution No. 2490 establishing the loading zone as requested. WILLOW GLEN #,'2 The City Manager presented a request for abandon - EASEMENT ment of a portion of an easement in Ufillow Glen VACATED Unit No. 2 since the City has no present or pros- pective future public need for this portion of easement. On motion of Councilman Mitchell, Brown second, the Council adopted an Order Vacat- ing Portion of Easement in Willow Glen Unit No, 2. WITHDRA:1 The annexation of the Nathan Addition to the City NATHAN ADDN of Lodi having been completed, Councilman Kat - FROM WRCFPD zakian moved the adoption of Resolution No. 2491 RES. NO. 2491 withdrawing the Nathan Addition from the Ifood- ADOPTED bridge Rural County Fire Protection District. The motion was seconded by Councilman Brown and carried. WITHDRAW The annexation of the Lobaugh Addition to the City L03AUGH ADDU of Lodi having been completed, Councilman Mitchell, FROM WRCFPD Brown second, moved the adoption of Resolution RES. NO. 2492 No. 2492 withdrawing the Lobaugh Addition from the ADOPTED Woodbridge Rural County Fire Protection District. Notion carried. AWARD City Manager Gloves presented the following list S. V ARD Mr. Glaves reported that E.C, Cooley Company had DISPOSAL PLANT submitted a bid on a blower with a single speed BLOV RR motor for the Sewage Disposal Plant. This unit would cost 49014 in comparison Vo the Company's RES. 210. 2495 prior bid of x9,846 for a blower with a two speed ADOPTED motor. Mr. Carlton Yoder, the City's sanitary engineering consultant, considers the single speed motor sufficient for Lodi's disposal plant' require- ments.
