Councilmen Brown, Katzakian, Mitchell, Ullmann and Culbertson (Mayo present; none absent. Also present: City Manager Glaves, Admin. Asst. Carlton, and Planning Director Rodger; City Attorney Mullen absent. MINUTES Minutes of September 61 1961 were approved as written and mailed on motion of Councilman Katzakian, Brown second. PUBLIC HEARINGS ANNEX Notice thereof having been published in accord - NATHAN ADDN ance with law, Mayor Culbertson called for pub- lic hearing on the proposed annexation of the ORD. NO. 704 Nathan Addition. There were no protests, INTRODUCED written or oral. On motion of Councilman Brown, Mitchell second, the City Council by unanimous vote introduced Ordinance No. 704, annexing the Nathan Addition to the City of Lodi, by reading of title only and waiving reading of the or- dinance in full. ANNEX Notice thereof having been published in accord- LOBAUGH ADDN ance with law, Mayor Culbertson called for pub- lic bearing on the proposed annexation of the ORD. NO. 705 Lobaugh Addition. There were no protests, INTRODUCED written or oral. Members of the Council dis- cussed the problem of providing storm drainage to this area and were told that the property owner was aware of the situation. On motion of Councilman Brown, Ullmann second, Ordinance No. 705, annexing the Lobaugh Addition to the City of Lodi, was introduced by unanimous vote by reading of title only and waiving reading of • the ordinance in full. PLANNING COMMISSION S. FAIRMONT City Manager Glaves read a recommendation from REZONI?TG the Planning Commission that the property along DR. HOFF the east side of South Fairmont Avenue in the 400, 500 and 600 blocks be rezoned from R-4 multiple family residential to C -P commercial professional office zone. The proposed rezon- ing was set for public hearing on October 4, 1961 on motion of Councilman Katzakian, Mit- chell second. S. FAIRMONT The Planning Commission also recommended the REZONING rezoning of property on the east side of Fair- FAIRMONT mont Avenue between Windsor Drive and York INVESTMENT CO. Street which would be as follows: rezoning of Lots 24, 25, 46 and 47, Windsor Tract, from the R-3 limited multiple family residential zone to the C -P commercial professional office zone and rezoning of Lots 26 and 45, Windsor Tract, from the R-1 one family residential zone to the R-3 limited multiple family resi- dential zone. On motion of Councilman Mit- chell, Ullmann second, the proposed rezoning was set for public hearing on October 4, 1961. 1b3 Minutes of Setpember 20, 1961 continued CPC ACTIONS The City Manager then reported the following actions of the Planning Commissions 1. Approved the request of Mr. Jacob Ferguson for a use permit to operate a metal salvage yard at 1020 South Sacramento Street in the "M" industrial zone. 2. Approved the request of the Saint John's Episcopal Church for a use permit to construct a church building on a four acre site located along the west side of Mills Avenue and 400 feet north of Lodi Avenue in the R-1 one family resi- dential zone. 3. Recommended the County Planning Commission's precise zoning be adopted for a two and one- half square mile area north of the Mokelumne River and southwest of Acampo. 4. Took no action on a petition from property owners in the vicinity of the J & J Market at the northeast corner of Hutchins Street and Park Street which requested that a restaurant be prohibited from using the property and that the property be rezoned to a residential Cate- gory. Petition for street lights from owners of more STREET LIGHT than 601% of the property in the 400, 500 and PETITION 600 blocks of South Crescent Avenue, and the property fronting on Kimberly Drive and Perry RES. The.Council •adopted Resolution No. 2472, adopting Plans and Specifications for the South Crescent Avenue Lighting District, on motion of Councilman Brown, Mitchell second. On motion of Councilman Katzakian, Brown second, the Council adopted Resolution No. 2473, reso- lution of intention for construction of street light standards and necessary wires and con- duits in the South Crescent Avenue Lighting District and setting public hearing thereon for October 18, 1961. REPORTS OF THE CITY;MANAGER CLAIMS Claims amount to $165,060.72 were approved on motion of Councilman Katzakian, Ullmann second. TRACTION CO. A road deed from Central California Traction DEED FOR E. Company to the City for the opening of Lodi LODI AVE. Avenue from Cherokee Lane east to the freeway was presented for Council approval. On motion of Councilman Brown, Katzakian second, the Council approved the deed and authorized the City Clerk to accept same on behalf of thB_City. 164 Minutes of September 20, 1961 continued SPECS The City Manager presented specifications for BLOWER FOR an electric motor driven blower for the Sewage SZiER PLAi1T Treatment Plant, for which $12,250 has been included in the current budget. On motion of Councilman Katzakien, Brown second, the City Council approved the specifications and authorized calling for bids on the above blower. SPECS Specifications for two cars for the Police Be - FIVE CARS partment, one for the Fire Department, one for the City Manager and one for the Director of Public Works were approved and advertising for bids authorized on motion of Councilman Mitchell, Brown second. SPECS Plans and specifications for the swimming pool WEST CAMPUS at West Campus, the cost of which is to be SWIMMING POOL shared by the High School District and the City, were presented for Council approval. The plans have already been approved by the School District, the Recreation Commission and the State. Coun- cilman Mitchell moved that the plans and speci- fications be approved. The motion was seconded by Councilman Katzakian and carried by unanimous vote. Ali ARD The following bids had been received on the Sub- SUBD. PAYING division Paving Project, 1961: PROJECT 1961 Claude C. Wood Co. $24,480 LIES. NO. 2474 Holden &: Gorham, Inc. 24,896 ADOPTED On motion of Councilman Mitchell, Brown second, The City Council adopted Resolution No. 2474 awarding the contract for the Subdivision Pav- ing Project, 1961 to Claude C. Wood Company for an amount of $24,480 as the lowest and best bid. REVI91 OF Mayor Culbertson then opened the meeting toa LIBRARY NEEDS review of the space need studies made for the Library. Mr. Jerald Xirsten, representing the Library Board, spoke concerning the meeting of the Library Board with Mr. Ed Parks of Ernst and Ernst in regard to Mr. Park's recommendation concerning Library space requirements. Mr. Kirsten felt that Mr. Park's recommendations were not -valid since Mr. Parks had not received proper figures on which to base his recommendation and that he had not taken into consideration sufficient factors in reaching his conclusions. Mr. Y.irsten supported his statements by referring to two independent surveys which had been made by I:r. Coit Coolidge, Library Consultant, and Miss Brother of the State Library, both of which recommended similar space needs above that,of Mr. Parks. He stated that the Library Board was concerned with providing a Library that would be adequate for the community. _Members of the Council were inclined to consider the re- sults of Mr. Parks' survey valid and realistic, but decided to consider the report further at a later meeting. SANITARRY Review of the Yoder Sanitary Sewer Study was SEWER REPORT on the agenda, but members of the Council decided it would be better to study the report at a special meeting rather than to go over it at this time. Minutes of September 20, 1961 continued 165 SALARY INCREASES ORDINANCE NO. 703, entitled "AN ORDINANCE AMEND - ORD. NO. 703 ING SECTION 7, TA3LE III, OF ORDINANCE NO. 444 ADOPTED ENTITLED 'ALT ORDINANCE FIXING THE COMPENSATION OF OFFICERS AND EMPLOYEES OF THE CITY OF LODI' AND REPEALING ALL ORDINANCES AND PARTS OF OR- DINANCES INCONSISTENT HERWITH," having been introduced at the regular meeting of September 6, 1961, was brought up for passage on motion of Councilman Katzakian, Mitchell second. Second reading was omitted after reading by title, and was then passed, adopted and ordered to print by the following vote: AYES: Councilmen - BROWN, KATZAKIAN, MIT- CHELL, ULLMANN and CULBERTSON NOES: Councilmen - NONE ABSENTS Councilmen - NONE CITY ATTORNEY Mayor Culbertson moved that the salary of the SALARY City Attorney be increased from $400 to $700 INCREASE a month effective September 1, 1961, since his present salary was inadequate in comparison to that of attorneys for other cities. 3e also commended City Attorney Mullen for his outstand- ing service to the City. The motion was seconded by Councilman Brown and carried unanimously. The Council then adjourned to 8 p.m. of Septem- ber 27, 1961 on motion of Councilman Katzakian, Brown second.
