HomeMy WebLinkAboutMinutes - May 3, 19611-13 CITY COUNCIL, CITY OF LODI CITY HALL COUNCIL CHAMBERS MAY 3, 1961 This regular meeting of the City Council of the City of Lodi held beginning at 8:00 p.m. of Wednesday, May 3, 1961. Councilmen Brown, Katzakian, Mitchell, Ullmann and Culbertson (Mayor) present; none absent. Also present: City Manager Claves, Admin. Asst. Carlton, Planning Director Rodgers and City Attorney Mullen. MINUTES Minutes of April 199 1961 were approved as written and mailed on motion of Councilman Katzakian, Brown second. PUBLIC HEARINGS LOWEIS VILLAGE Notice thereof having been published in accordance STREET LIGHTS with law, Mayor Culbertson called for public hearing on the completion of and the assessment RES. N.O. 2438 on the Lowe's Village Street Lighting District. There were no questions or protests, written or oral. On motion of Councilman Brown, Mitchell second, the Council adopted Resolution No. 2438 confirming the assessment on the Lowe's Village Lighting District. W, REESE Mr. Willian Reese, 739 South Central, asked if any action had been taken to obtain water from Folsom Dam. City Manager.Glaves answered that the City belonged to the North San Joaquin Water Conserva- tion District which had filed for water from the dam. Mr. Reese then asked if the City had ever drilled wells in the Clements area which he felt would raise the water table and was told by the City Attorney that to his knowledge the City had never considered such a proposal. Mr. Reese then requested the City to do something about the blue jays which were destroying the nut crop and he also wanted the City to remedy the poor con- dition of East Tokay Street, particularly in the area of the railroad tracks. Mayor.Culbertson informed Mr. Reese that his requests would be referred to the proper departments.. SCHOOL ST. lir. Jerry Rinn, 712 Cardinal, on behalf of the CLOSING FOR Retail Merchants Division of the Chamber of AUTO & BOAT Commerce, requested permission to close School SHOW Street between Pine and Oak and between Oak and Walnut on Monday, May 15, 1961, between 9 a.m. and 9 p.m. for the purpose of displaying cars and boats, Oak Street would remain open as well as the alleys. City Manager Glaves stated he had discussed the request with Police Chief Coon who had no objections thereto. Councilman Kat- zakian moved that the request be granted as pre- sented. The motion was seconded by Councilman Brown and carried. PLANNING COMMISSION FINAL MAP The final map of Willow Glenn Unit No. 2 was WILLOW GLENN#2 presented for approval, all provisions of the subdivision ordinance having been complied with. It was pointed out that additional easement should be required as follows: 6' along the 114 Minutes of May 3, 1961 continued west boundary line and 8' along the south boundary line which would not be part of the subdivision, 5' between lots 113 and 11¢, 10' between lots 117 and 118 and between lots 99 and 100, and increase from 5' to 6' the easement on the south line of lots 107 and 108. On motion of Councilman Mit- chell, Brown second, the map was approved subject to obtaining the easements above mentioned and with one of the streets to be named Roper Avenue rather than Green Oaks Way. REPORTS OF THE CITY MANAGER CIVIC CENTER City Manager Glaves introduced Mr. Charles Blair and Mr. Norman Hanson of Wilsey, Ham & Blair and Mr. Ed Parks of Ernst & Ernst. These gentlemen were at the meeting to summarize and explain the Wilsey, Ham & 31air report on Civic Center space requirements, copies of which had been given to members of the Council, and to answer questions thereon. Mr. Parks, who had made the inventory of existing space, gave a resume of space the -City has now, space presently needed, and space needs to 1980, and explained building and land needs in relation to space needs. Mr. Hanson spoke on building and land needs, going over the proposed plot plan of the Civic Center site comprising the two blocks surrounded by Elm Street, Church, Pine Street and Lee Avenue, excepting for the properties occupied by the Turnage Market, the apartment building west of the library, the Masonic Building$ the Woman's Clubhouse and the Christian Science Church. He showed how the Center could be developed as needs increased and said that priority should be given to erection of a Hall of Justice and Fire House, with the re- moval of the Police Department and Court from the City Hall, that building should be adequate for the remaining departments for the next twenty years. With some adjustments, space in the Library was considered sufficient for the present. Mr. Blair emphasized that the report was just a guide and must be flexible. Miss -Amy Boynton, City Librarian, differed with the report regarding space requirements for the library. Mr. Jerald Kirsten, Library trustee, presented a resolution adopted by the Library Board of Trustees asking the Council to defer action on the Wilsey, Ham & Blair report until a survey of local library . requirements could be made by the State Division of Libraries. Members of the Council were agreed that they would have to study the report further before reaching a decision. Wilsey, Ham & Blair and Ernst & Ernst were complimented on their report and their regesentatives were thanked for their explana- tions and answers to questions. Mr. Glaves stated that Mr. Parks would be in Stockton for the next month and would be available in the event the Council had further ouestions. CLAIMS Claims in the amount of $102,683.81 were approved ' on motion of Councilman Katzakian, Mitchell second. STATE City Manager Glaves presented for renewal the PERSONNEL annual contract with the State Personnel Board SERVICES Cooperative Personnel Services. The contract does not obligate the City in any way but makes 116 Minutes of May 3, 1961 continued RES. NO. 2439 the services available if needed. Councilman ADOPTED Katzakian moved the adoption of Resolution Pio. 2439 approving the contract and authorizing the City Manager to execute the same. Councilman Brown seconded the motion which was then passed by unanimous vote. AWARD _ The following bids were received for the Frontage FRONTAGE RD. Road Storm Drain: On Alternate No. 1 (pre -cast STORM DRAIN pipe) H.J. .McCue, 432,418.75; Teichert & Son, 433.960.00; R. Goold, 435,181.85; and D.A. RES. NO. 2440 Parrish & Son $38,865.00. On Alternate No. 2 ADOPTED (cast-in-plaoe pipe) there were two bids: one from H.J. McCue for $29,888.75 and the other from Teichert & Son for $32,722.50. The lowest bid in both instances was above the City Engineer's estimate. Mr. CharlesdNeil. of the No -joint Concrete Pipe Company spoke on the merits of cast - in -place pipe. Councilman Katzakian stated that he had been favorably impressed with the cast -in- place pipe he had seen and that $2500 was quite a saving and he moved the adoption of Resolution No. 2440 awarding the contract for the Frontage Road Storm Drain to H.J. McCue for Alternate No. 2. The motion was seconded by Councilman Mitchell. Mr. Cecil Mumbert of Humbert Concrete Pipe Company and Mr. Robert Spiekerman of Spieker - man Concrete Pipe Company spoke on the advantages of precast pipe. Councilman Brown questioned the reliability of cast -in-place pipe. The motion passed by the following vote: Ayes: Councilmen - Kdtzakian, Mitchell, Ullmann and Culbertson Noes: Councilmen - Brown CIVIC CENTER Mr. Glaves presented a deed and letter of agree - LAND ment from Mrs. Amelia R. Putnam for the lot at ACQUISITION 216 West Elm Street which is being acquired as part of the Civic Center site. The price for the RES. N0. 2441 lot is $15,500; the tenant is to be given 90 days ADOPTED notice before the City takes possession; Mrs. Putnam is to be notified before the building is removed so that she may remove shrubs and plants from the property; and payment of rent to the City starts as of -May 1. On motion of Councilman Brown, Katzakian second, the deed and conditions thereto were accepted by the City Council. Mr. Glaves reported that negotiations for the Dickoff and Krumb properties were proceeding quite smoothly, but agreement could not be reached on acquisition of the Rich property. On motion of Councilman Katzakian, Mitchell.second, the Council authorized the City Attorney to start condemnation proceed- ings for acquisition of the Rich property, being the lot on the southeast corner of Pleasant and Elm Streets, by adoption of Resolution No. 2441. LOCKEFORD ST. In regard to obtaining rights of way for widening R of West Lockeford Street, the City Manager stated that three parcels remained on which agreement could not be reached. These. properties are on the north side of the street :rest of Pleasant Avenue and are owned by Mr. Stanley Kirst, Dr. Thomas Carleton and Mr. A.V. Carleton. Council- man Katzakian, Ullmann second, moved the adoption 116 Minutes of Ma y 3, 1861 continued RES. NO. 2442, of Resolution Pa. 2442 authorizing the City 2443 AND 2444 Attorney to start condemnation proceedings on ADOPTED the property of Stanley Kirst. Motion carried. On motion of Councilman Brown, Katzakian second, the Council adopted Resolution No.' 2443 authoriz- ing the City Attorney to start condemnation pro- ceedings on'the parcel owned by Dr. Carleton, and on motion of Councilman Katzakian, Brown second, the Council authorized the City Attorney to start condemnation proceedings on the A.Y. Carleton property by adoption of Resolution No. 2444. Mr. Glaves said that rights of way on two other parcels had to be obtained, tut that negotiations were proceeding satisfactorily. SPECS Specifications for reconstruction of Turner RECONSTRUCTION Road from Stockton Street to 99 Highway were pre - E. TURNER RD. sented for approval. The County is to pay one- half of the cost. On motion of Councilman %at- zakian, Mitchell second, the Council approved the specifications for the reconstruction of Turner Road and authorized calling for bids thereon. ORDINANCES C -S ZONE ORDINANCE NO. 692, entitled "AMENDING THE CODE OF THE CITY OF LODI BY ADDING THERETO SECTION ORD. N0. 692 27-9A ESTABLISHING THE C -S COMMERCIAL SHOPPING ADOPTED DISTRICT," having been introduced at the regular meeting of April 19, 1961, was brought up for passage on motion of Councilman Katzakian, Brown second. Second reading was omitted after reading by title, and was then passed, adopted and ordered to print by the following vote: AYES: Councilmen - BROWN, KATZAKIAN, MITCHELL, ULLMANN and CULBERTSON NOES: Councilmen - NONE ABSENT: Councilmen - NONE SPEED LIMIT ORDINANCE NO. 693, entitled "AN ORDINANCE AMENDING ON LODI AVE. ORDINANCE HO. 493 ENTITLED 'AN ORDINANCE OF THE W. OF HAM CITY OF LODI REGULATING TRAFFIC UPON THE PUBLIC STREETS...I BY ADDING A NEW SECTION DECREASING ORD. NO. 693 STATE SPEED.LIMIT,IN CERTAIN ZONES," having been ADOPTED introduced at the regular meeting of April 19, 1961, was brought up for passage on motion of Councilnan Ullmann, Mitchell second. Second reading was omitted after reading by title, and was then passed, adopted and ordered to print by the following vote. FEN C1 City Hanager Glaves reported that the Superintendent AT PARK SITE of Parks and Recreation had worked out a solution with property owners adjacent to the Vine -Hutchins park site in regard to keeping children off of the site while it was being irrigated.
