HomeMy WebLinkAboutMinutes - March 21, 1961102 CITY COUNCIL, CITY OF LODI CITY HALL COUNCIL CHAMBERS MARCH 21, 1961 This meeting of the City Council of the City of Lodi, regu- larly adjourned from March -15, 1961, was held at 8:00 p.m. of Tuesday, March 21, 1961; Councilmen Mitchell, Ullmann and Cul- bertson (Mayor) present; Councilmen Brown and Katsakian absent. City Manager Glaves present. Absent: City Attorney Mullen, Planning Director Rodgers and Administrative Assistant Carlton. CANVASS Mayor Culbertson appointed Councilman Mitchell, SPECIAL Councilman Ullmann, City Manager Glaves and City REFERENDUM Clerk Garibaldi to open and count the absentee ELECTION ballots for the Special Municipal Election which was held March 14, 1961. Upon completion of the absentee ballot count and the canvass of the election returns, findings of the result of the election were made by the passage of the follow- ing resolution on motion of Councilman Mitchell, Ullmann second; RESOLUTION NO. 2430 DECLARING RESULT OF ELECTION WHEREAS, a Special Municipal Election was held and conducted in the City of Lodi on Tuesday, the 14th day of March, 1961, as is required by law, and WHEREAS, it appears from the report of the City Clerk and the records on file in her office that voting precincts were properly established and the polling places thereof designated; that election officers were appointed and qualified; that elec- tion supplies, including official ballots, were furnished each of said precincts; and that, in all respects, said election was held and conducted and the votes received thereat received and canvassed and the returns thereof made, determined and declared in time, form and manner as required by the laws of the State providing for and regulating elections in sixth class cities, and WHEREAS, the"City Council of the City of Lodi, meeting at the City Council Chambers this 21st day of March, 1961, to count the absentee voters ballots voted and to canvass the returns of election from the various precincts, finds, determines and de- clares, as a result of said count and canvass: (1) That said Special Municipal Election was held and con- ducted in the City of Lodi, California, on the 14th day of March, 1961, in time, form and manner required by law; (2) That there were nine voting precincts established in said City for the purpose of holding said election, vis: VOTING PRECINCT 1, comprising State and County precinct numbers L-1, L-2, L-3, L-4 and L-5. VOTING PRECINCT 2, comprising State and County precinct numbers L-6, L-7, L -S, L-9, L-10 and L-11. VOTING PRECINCT 3, comprising State and County precinct numbers L-12, L -12A9 L-13, L-14 and L -14A. VOTING PRECINCT 4, comprising State and County precinct numbers L-151 L-16, L -16A and L -16B. 103 Minutes of March 21, 1961 continued VOTING PRECINCT 5, comprising State and County precinct numbers L-17, L-18, L-19, L-20, L-21 and L-22. VOTING PRECINCT 6, comprising State and County precinct numbers L-28, L-29, L-30, L-31, L-32 and L -32A. VOTING PRECINCT 7, comprising State and County precinct numbers L-23, L-24, L-25, L -25A and L -25B. VOTING PRECINCT 8, comprising State and County precinct numbers L -25C, L-26, L-27, L -27A, L-34 and L -36A. VOTING PRECINCT 9, comprising State and County precinct numbers L-33, L -33A, L -33B, L-35, L-36 and L -36B. (3) That the whole number of votes cast at said election was THREE THOUSAND EIGHT HUNDRED THIRTY (3,830). (4) That the total number of votes cast for and against the measure "Shall Ordinance No. 683 amending the Official District Map of the City of Lodi and thereby rezoning certain property on the vest side of Ham Lane between Walnut Street and Lodi Avenue to be in the C-1 Neighborhood Commercial Zone be adopted?" was as follows: Precincts Absent 1 2 3 4 5 6 7 8 9 Voters Total FOR 151 165 124 205 210 178 216 234 211 14 1708 AGAINST 118 U5 lj 261 2M 12A IS 2 M 254 21 2122 269 300 258 466 429 372 605 631 465 35 3830 RESOLVED, that the results of the Special Municipal Elec- tion held in the City of Lodi on March 14, 1961 show that a majority of the voters have voted against the measure to adopt Ordinance No. 683 and therefore Ordinance No. 683 is null and void. Upon the adoption of this resolution, the City Clerk shall enter a full copy thereof on the Records of the City Council of the City of Lodi for its meeting held this 21st day of March, 1961. PROPERTY Mr. Glaves then explained that'a resolution was EXCHANGE required authorizing the Mayor and City Clerk to sign the deed in connection with the exchange of RES. NO. 2431 property at the Sewage Disposal Plant with Maurice ADOPTED 0. Ray, Jr. The exchange had been approved at the meeting of March 11,' 1961. On the motion of Councilman Ullmann, Mitchell second, the Council adopted Resolution No. 2431 authorizing the Mayor and City Clerk to execute'the-'deed to Maurice 0.
