HomeMy WebLinkAboutMinutes - November 18, 1964CITY COUNCIL, CITY OF LODI CITY HALL COUNCIL CHAMBERS NOVEMBER 18, 1964 A regular meeting of the City Council of the City of Lodi was held beginning at 8 p,m. of Wednesday, November 18, 1964, in the City Hall Council Chambers. ROLL CALL Present: Councilmen - Culbertson, Dow, Kirsten, Walton, and Brown(Mayor) Absent. Councilmen - None. Also present were City Manager Glaves, City Attorney Mullen, Administrative Assistant Peterson and Planning Director Bob;foeder. MINUTES. On motion of Councilman Walton, Dow second, the minutes of November 4, 1964, were approved as written and mailed after.changing the paragraph on page 2 entitled "J. Ramos re Golf Driving Range" by deleting the last two sentences and substituting therefor the following: 144r. Mullen said the City did not have sufficient legal _ evidence to break the lease since the fence had been raised and there was no further action the City could take at this time." PLANNING COMMISSION FINAL MAP Mr. Glaves presented a final map of the Resubdivision RESUB OF POR of Lots 57-61, 78-81, and a portion of Lot 98 in GLci,IIiURST #2 Glenhurst Place Unit No. 2, the subdivider having met all requirements of the Subdivision Ordinance. This ORDER VACF_i3NG map changes the plans for the south end of the Glenhurst EASEbESNT Iii Place Unit No. 2 subdivision, providing a turning circle GLEPIHURST 02 at the intersection of Tamarack Drive and Sunset Drive. The resubdivision does away with the necessity for a certain easement within the original subdivision and it is therefore recommended that this easement be aban- doned. On motion of Councilman Culbertson, Dow second, the City Council approved the final map of the Resub- division of Lots 57-61, 78-81, and a portion of Lot 98 in Glenhurst Place Unit No. 2. On motion of Councilman Dow, Kirsten second, the Council adopted its Order abandoning an easement along lots 61, 78, 81, 98 and 99 in Glenhurst Place Unit No. 2 since the City has no present or future need for such easement. CCN-AviUtIICATI ONS EMPLOYEES An invitation was received to attend the regional LEAGUE NTG meeting of the California League of City Employees on November 21, 1964 at the Tokay Bowl. COURT RE The City Clerk read in part a copy of the Court Order GOLF DRIVING dated November 9, 1964 concerning the claim of Joe E. RANGE Ramos vs. the City of Lodi, Otto Pirtle dba Lodi Golf Driving Range, and Randy Kiedrowski which stated that the City owes no duty to keep the premises(Golf Driving Range) in a safe condition after transfer of possession to the Lessee and that the action would be dismissed as to the City. CIVIC AFFAIRS A letter was read from the Lodi District Chamber of COilila'ITZE aE Commerce Civic Affairs Committee urging enforcement of SIDEWP.LK the City ordinance which prohibits the display of WERCHANDISE merchandise on sidewalk and parkway areas. The com- mittee feels this would be a major step towards beauti- fying the.City+s streets. Mr. Glaves stated that a survey of sidewalks has been delayed because of other work which has been more pressing. -.1 - xae Minutes of November 18, 1964 continued REPORTS OF THE CITY MANAGER CLAIMS Claims in the amount of $236,483.98 were approved on motion of Councilman Walton, Dow second. BLRZAU OF Vir. Glaves explained that under the contract by which RECLAMATION the City had granted the U. S. Bureau of Reclamation an RE DAMAGE easement over the City's 303 -acre parcel on Thornton CLP.Ii•i Road for an electric transmission line, the Bureau h`3 agreed to pay for any damage that might be done to crops or improvements on the land during construction. The Bureau has presented an agreement whereby the City would be compensated in the amount of $50 for any damage. Bdr. Glaves stated that the damage was negligible and he recommended the agreement be approved. On motion of Councilman Kirsten, Dow second, the Council approved the agreement and authorized its execution by the Mayor. CLASS AND 14r. Glaves introduced Mr. Bruce Austin, Northern SALARY California Wanager, and Mr. Marcus Nlihai.l, Personnel SLRVEY Analyst, of the State Personnel Board Cooperative Personnel Services. Mr. Austin addressed the Council in regard to the "Classification and Salary Survey" report, copies of which had been presented to members of the Council. He gave a resume of the State's method of conducting the survey and went through the report briefly in explanation of the method of presentation and recommendations. Mr. Austin answered various questions put to him by members of.the Council and explained that the final stage of the survey was the appeal review period during which time any employees who disagreed with their recommendations would have an opportunity to request a review of their position. He suggested the employees be given up to November 27 to make their requests. Councilman Culbertson moved that the report be taken under submission and copies turned over to the department heads for referral to employees. His motion was seconded by Councilman Dow and carried. Councilman Walton suggested that a copy of the report be made available to the Employees Association, and Mr. Glaves said he would do so. REQUEST FOR The City Manager reported that he had been studying the GARBAGE RATE request of the Sanitary City Disposal Company for an INCREASE increase in domestic garbage rates, but he was not .ready to make a recommendation at this time; there were a number of questions he wished to.have resolved first. Mr. Robert Mertz, 404 West Pine Street, representing the disposal company, said he would prefer to wait until the City Manager was ready with a recommendation before making his presentation on behalf of the company. Councilman Dow moved that consideration of the request be postponed to the regular meeting of December 2, 1964. His motion was seconded by Councilman Walton and carried, with Councilman Kirsten abstaining. SIG111 The Council then reviewed the proposed sign ordinance ORDINANCE which had been revised -in accordance with suggestions made at the previous meeting. Councilman Walton moved that the ordinance be changed so as to provide that flashing, animated or moving signs be subject to a use permit. His motion was seconded by Councilman Dow. There was considerable discussion concerning determinatior of what signs should be permitted. Councilman Culbertson voiced disappointment that persons who would be affected by the ordinance had not appeared before the Council to state their views and asked that more publicity be given to the proposed ordinance in an effort to find out -what the town thinks. After further discussion of - 2 - 139 Minutes of November 18, 1964 continued the problems inherent in issuing use permits for signs, the motion was voted on and carried, with Councilman Culbertson voting no. City Manager Glaves pointed out the subsection requiring the elimination of non- conform-ing signs within five years. After discussion of this section as related to the motion just passed, it was moved by Councilman Walton that the subsection changed by the previous motion be amended -to provide that flashing, moving or animated signs be subject to a use permit and any signs at the time the ordinance goes into effect shall acquire a use permit within the time set forth -for removal of non -conforming signs. His motion wis:.seconded by Councilman Kirsten and carried. The Council then discussed the use of seasonal signs for decoration. City Manager Glaves suggested that the section covering such signs be placed under general provisions and that the word "home" be eliminated. The Council agreed. _ On motion of Councilman Dow, Walton second, the City Council set.the proposed sign ordinance for public hearing on January 6, 1965. The proposed ordinance is to be duplicated and distributed to those interested. VACATE The Superintendent of Utilities and Director of Public EASE1,ENT IN Works recommend the abandonment of an easement in the WESTDALE SUED. Westdale Subdivision -since the ftsement is not now occupied and the City has no present or prospective use for it. On motion of -Councilman Dow, Culbertson second, the City Council adopted its Order vacating an easement for public utilities along the East 6 feet of Lot 67 and the West 6 feet of Lot 66 in the;Westdale Subdivision. CENTERLINE The City Manager presented the Council with a report STRIPING OF from the Director of Public Works on:centerline striping STREETS of City streets. Attached to the report were three maps indicating the following. Map "A" - Streets presently marked by center lines. Map "B"• Streets presently marked by center lines. plus streets that would•grid the City in approximately 2 -block i-ntervals except for streets with a minimum width of less than 40 feet. Map "CII - The same as "B" except for a minimum width of 36 feet. The Director of Public Works recommended that the width for streets marked with center lines be no less than 36 feet from. curb to curb, since studies indicate that center lines would be hazardous on streets of narrower width. Second reading was omitted after reading by title, and the ordinance was passed, adopted and ordered to print by the following vote: F.YES : Councilmen - CULBERTSON, DOLS, I¢RSTnN, WALTOV and EMIN NOES: Councilmen - hone F.3 ENT: Councilmen - None BEAUTIFICATION Councilman Culbertson asked other members of the Council COe+miITTEF_ to keep in mind the formation of a committee to work on beautifying entrances to the City, etc., and urged that appointments be made by the first of the year. He also mentioned a report he had received from the League Committee on the Future on what could be done to beautify our cities. 14r. G&sxes said he would have it duplicated for distribution.
