A regular meeting of the City Council of the City of Lodi was held
beginning at 8:00
p.m. of Wednesday, March 4, 1964, in the City Hall
Council Chambers.

MINUTES
Minutes of February 19, 1954 were approved as written
and mailed on motion of Councilman' Brown, Dow second,
after correcting the paragraph entitled "Diagonal
Parking" by changing the second sentence to read as
follows:. "Councilman Dow said that at the ti=e
Sacramento Street was under' consideration, the Council
had decided it would not change just a portion of the a
street to parallel, but would wait until such time as zA
the entire street could be changed.'!'

law, Mayor Katzakian called for hearing on the proposal,,,
ACRES
to abandon the alleys in Bewley Suburban Acres, Map B, a3
being alleys in the four blocks bounded by School
Street, Sycamore Street, Pleasant Avenue and Sierra wi
Vista Place. These alleys have never been opened or e�
improved and many of the property owners have extended;
their yards to the center of the alleys. The Planning
Commission recommends that the alleys be abandonedas
suggested by the Superintendent of Utilities and the
Director of Public Works. No protests to the proposal
were received, written or oral. Councilman Brown
moved the adoption of an order vacating the alleys in
Bewley Suburban Acres as recommended. The motion was
seconded by Councilman Dow and carried by unaniwous vote.

Notice thereof having been published in accordance with
SETBACK LINE
law, Mayor Katzakian called for public hearing on the
proposal to adopt a.revised setback line on Bast Lodi
ORD. NO. 759
Avenue between the Southern Pacific railroad tracks
INTRODUCED
and Cherokee Lane. The recommended setback line would
establish the setbacks at 40 feet each side of the
centerline of the present 70 -foot right of way, thus
reserving an 8a, -foot -wide area for the street.
.Mr.
Glaves read the recommendation of the Planning Com-
mission favoring the revised setback line. There were
no protests, written or oral. After Council discussion,
Councilman Brown moved the introduction of Ordinance
No. 759 repealing Ordinance No. Sol and establishing
setback lines 40 feet each side of the centerline of the
East Lodi Avenue right of way. The motion was seconded
by Councilman Ullmann and carried unanimously.

The Planning Commission recommended a change of zoning
C -P ON S.
from the R-3 multiple family residential zone to the
FAIRI,A)NT
C -P commercial -professional office zone for the property
located at 916 - 926 South Fairmont Avenue as requested
by Dr. C. C.'Bunch. The matter was set for public
hearing on March 18, 1954, on motion of Councilman Dow,
Culbertson second.

C0144UNICATIONS
H ALTH DISTRICT A letter was received from the Board of Trustees of
RE SALE OF San Joaquin Local H,:alth District urging the City to
RAA k-ULK adopt an ordinance prohibiting retail distribution of
raw milk and creaw. After comments from some of the
councilmen concerning the request, it was suggested by
City [Manager Glaves that a representative of the Health
District be asked to discuss with the Council the need
for such regulations.
KNIGHT A petition was presented from all the owners of 36.6
ADDITION acres of uninhabited territory, to be known as the
Knight Addition, for annexation of their property to
RES, No. 2702 the City. The proposed annexation has been approved by
ADOPTED the County Boundary Commission and by the Local Agency
Formation Commission of San Joaquin County. On motion
of Councilman Culbertson, Dow second, the Council
adopted Resolution ido. 2702 giving notice of the
intention to -annex the Knight Addition as uninhabited
territory and setting public hearing thereon for Warch 18,
1964.
TOBACCO USE A letter was received from Councilman J. O. Lee Solomon
BY MINORS of Redondo Beach asking the Council to request the
League of California Cities to sponsor legislation at
the 1965 General Session of the Legislature to prohibit
the use of tobacco in any form by minors. The letter
was tabled on motion of Councilman Brown, Culbertson
second. _
101,00LINI A letter was read from Wrs.*R. Mandolini, 1618 West
REFUSE Elm Street, stating that she has been overcharged for
OVERCHARGE refuse since July 1959 and asking for a refund. The
letter was referred to the Administration for investi-
gation and report.
ABC_LICERSE Wotice was received of the transfer application for
alcoholic beverage license, on -sale general, for Roslyn
L. and Robert. E. Francis,, al Patio, 222 West Lockeford
Street.

motion of Councilman Dow, Brown second.

City Manager Glaves recommended that award be made to
the low bidder. On motion of Councilman Brown, Ullmann
second, the City Council adopted Resolution No. 2703
awarding the contract for four police cars to Loewen
Auto Company for $5,246.

Mr. Glaves recommended that award be made to the low
bidder. On notion of Councilman Brown, Ullmann second,
the City Council adopted Resolution I•io. 2704 awarding
the contract for the Lakewood Unit No. 1 Storm Drain
to Dukes Construction Company for a total of $4,790.

side of Turner Road.
On'motion of Councilman Brown, Dow second, the City
Council adopted Resolution No. 2705 establishing cross-
walks as recommended.
DRIVEWAY -
The Claude C. Wiod Company has requested a 30 -foot
C.C. WOOD CO.
driveway approach to the east frontage road located
approximately 350 feet north of East Lockeford Street.
The Company will construct a 30 -foot gate opening and
install a 12 -inch corrugated metal pipe under.the.drive-
way. The Engineering Department recommends approval of
the request. On motion of Councilman Dow, Ullmann
second, the City Council appzoved-the request of Claude
C. Wood Company to construct a 30 -foot driveway at the
East Frontage Road.

Air. Glaves presented a deed from Irvin R. Bender, et al,
WEST'DALE SUED.
to the City of.Lodi'covering certain property in the
STORM BASIN
Tally Tract and Westdale Subdivision for storm water
storage. The deed limits the City's right to use the
property solely for the purpose of storage of'storm
waters and when the property is no longer needed for
that purpose, title is to be -conveyed back to.the.
grantors. The land would be used to provide'stotw
drainage for the Viestdale Subdivision until such time
as the City can provide drainage in accordance with the
City's Master Storm Drainage Plan: The subdivideZs
acquired the land'for ponding.purposes, but FHA required
that -the ponding rights be vested in the City. One of
the subdividers, Mr. John Capell stated that the pond
area was completed except for installation of a solid
fence along the Tokay Street side. The Council'dis-'
cussed the problem of accepting subdivisions before the
City was able to furnish them with permanent drainage.
Councilman Culbertson felt it was a mistake to accept
subdivisions when the City could not provide drainage.
He said that by accepting the deed the City would be
taking on maintenance of the pond. He was also concerned
that subdividers might want other subdivisions accepted
on the same basis. City Manager Glaves said he would
recommend against accepting any more subdivisions on this

basis and also felt that FHA would resect any more loans
under similar conditions. Councilman Dow moved that
the deed be accepted as presented. The motion was
seconded by Councilman Brown and carried. Councilman
Culbertson voted no, stating there was no provision in
the motion that other subdivisions would not be accepted
by the City unless they could be provided with drainage
through the City's permanent system.
C-1 BASIN The City WFinager reported that the contractor oa tiie
EXCAVATION freeway between Lodi and Stockton would be needing soil
for base material by the end of march and that this
would be an opportunity for the City to have one of its
drainage basins excavated in exchange for the dirt. He
said the soil at the A-1 Basin site had been tested and
found to have too @ sand; however, the soil at the
C-1 Basin site was satisfactory to tae contractor
except for the top two feet which could be ripped off
and replaced. The City would end up with a basin ten
feet in deptih.McGlaves stated the site would need to be
fenced, but there would be no point in developing it as
a park until subdivisions were started in the vicinity.
The site can be purchased at this time and the owners
will accept a price in the neighborhood of that accepted
by the State for the one -acre parcel the City purchased
last December. Ar. O. D. Kettelman, 1136 South Cherokee
Lane, objected to having a hole in the area and said
he was opposed to the basin unless it were made into a
park. Wr. Glaves said there was.no intention of digging
a permanent hole, but that it would be turfed avid land-
scaped when the area was subdivided. Mrs. Kettelman
wa-ited to be assured in writing that the site would be
made into a park when the surrounding property was
developed. Mr. Glaves requested the allocation of $3CO
for the drawing of preliminary landscaping plans for
Basin C-1 by lir. Paul Tritenbach. Councilman Oow iaoved
that the City Manager proceed with negotiations for
acquisition of the C-1 Bade site and for removal of the
dirt and that $3LO be allocated for preliminary designs
by Wr. Triteabach. ine motion was seconded by Council -
wan Culbertson aiie carried unanimously. The City
i•ianager is to write a letter to the Kettelman•s e:,,p_ain-
ing the City•s plans regarding development of the drain-
age basins.
WIOEOING In connection with,the City.-* regular curb and Sutter
2�'3 BLOCK replacement program, the City has -had a request from
TOKAY ST, property owners in the 200 block of cast Tokay Street
that the street be widened by the removal of the exist-
ing 3�1 to 4 -foot planting strip, including four trees,
aid. placement of the.curb and gutter next to the sidewalk
on the north side of the street. This would cost an
additional $1100, covering.grading, compaction, plant
mix and additional concrete work. The existing street
width is 4C feet. Kr. Glaves said he could not recoL:-
mend the widening of this block. Wrs. L. .1. Floyd,
229 last Tokay Street, said the curb was out and in
the planting strip there were only four little trees
which had been planted last year. She said that trucks
had been re-routed so as not to use Tokay Street, but
after a year they were using this street again and sae
felt this block should be widened now before new curb
and gutter were put in. After further discussion, it
was moved by Counciluan BrovAi that the planti"g strip
on the north side of 3ast Tokay Street in the "0 block
be eliminated and the curb,and gutter be placed next to
the sidewalk. The motion was seconded by Councilman
Culbertson and carried.

SMP SIGNS
Complaints have been received by the City and the State
AT TURNER RD -
about the stop signs installed on Turner Road at the
FR3aWAY OFF
Freeway off ramp for traffic going south on the Freeway
RAY-iP
and turning onto Turner Road. Traffic from the ramp has
the right of way, but according to studies made by the
State, Turner Road traffic tends to make quick stops
and pull out, anticipating the off ramp traffic must
also stop. Checks by the Lodi Police Department sub-
stantiate the State's findings. Traffic counts show
301 cars travel through on Turner Road and 492 enter
Turner Road from the Freeway. Since the stop signs
were installed at the request of the City, the Division
of Highways would like the opinion of the City Council
as to whether the signs should be changed. Councilman
Dow moved that the City recommend to the Division of
Highways that the signs be reversed so that traffic
entering Turner from the Freeway would have to stop.
The motion was seconded by Councilman Brown and carried.
LEASE OF The lease of the Grape Festival property by the City for
GOLF DRIVING a golf driving range has expired and a new lease has
RANGE been drawn for a period of five years terminating
January 3�_, 1939. The conditions are similar to those
R3S. NO. 2706 of the previous lease and have been approved by the
ADOPTED County. Councilman Dow moved the adoption of Resolution
No. 2706 approving the lease with the Grape Festival
and National Wine Show and authorizing its execution by
the Mayor. The motion was seconded by Councilman
Culbertson and carried.
SCHOOL BUS Wt. Glaves reported that a problem for busses traveling
TRAFFIC between the cast and nest Campuses has been created by
PROBLi-i the installation of the right turn lane at the inter-
section of Ham Lane and Lodi Avenue since the busses
are unable to negotiate the turn without ha_ard to other
vehicles. Bus traffic on Walnut Street is undesirable,
and the School District suggests that the City pave an
area on school property just north of Lodi Avenue which
would enable the School District to use its extension
of Pacific Avenue for two-way traffic. the matter was
referred to the City Wanager for further information
from the School District.
POPULATION At the request of the City, the State Department of
E STI1_M E Finance has agreed to make a population estimate for
the City and has forwarded an agreement therefor for
RES. NO. 2707 execution by the City. On motion of Councilman Dow,
ADOP7 D Culbertson second, the City Council adopted Resolution
No. 277 approving the agreement and authorizing its
execution -on behalf of the City by the City Wanager.
