HomeMy WebLinkAboutMinutes - September 15, 1965CITY COUNCIL, CITY OF LODI CITY HALL COUNCIL CHAMBERS SEPTEMBER 15, 1965 This -regular meeting of the City Council of the City of Lodi was held beginning at 8 p.m. of Wednesday, September 15, 1965, in the City Hall Council Chambers. ROLL CALL Presents Coungiimen - BROWN, CULBERTSON, DOW, WALTON and KIRS1EN (Mayor) Absent. Councilmen - None Also presents City Manager Glaves, City Attorney Mullen, Administrative Assistant Peterson and Planning Director Schroeder. MINUTES On motion of Councilman Dow, Brown second, minutes of September 1, 1965, were approved as written and mailed. PUBLIC HEARINGS ABANDON Notice thereof having been published in accordance POR OF SACTO with law, Mayor Kirsten called for public hearing on ST TO CORRECT the proposal to abandon a portion of Sacramento Street DEED at Tokay Street. Abandonment proceedings were initiated at the Council meeting of August 18, 1965 as a means of getting a corrected deed from Mrs. Inez Huppert for _ the Sacramento Street right of way. There were no protests, written or oral. On motion of Councilman Dow, Brown second, the City Council adopted its Order abandoning a portion of Sacramento Street at the north- east corner of Sacramento and Tokay Streets. PLANNING COMMISSION REQUEST C-2 The Planning Commission recommended approval of the ZONING FOR request of Mr. Henry Gunsch for C-2 Commercial soning KUNDERT ADDN for the Kundert Addition located at the northwest cor- ner of Cherokee Lane and Almond Drive. This property is outside the City Limits, but is in the process of requesting annexation. On motion of Councilman Dow, Culbertson second, the Council set the requested zoning for public hearing on October 6, 1965. PROPOSE The Planning Commission also recommended approval of REZONING the request of Mr. Stanley D. Kirst for the rezoning NW CORNER-- of property at the northwest corner of School and SCHOOL AND Lockeford Streets from the R-4 Multiple Family Insti- LOCKEFORD..-.., tutional District to the C-2 Commercial District. On TO C-2 motion of Councilman Brown, Dow second, the proposed rezoning was set for public hearing on October 6, 1965. RECOMMEND - The Planning Commission passed a resolution finding ABANDONMENT that the abandonment of Pleasant Avenue between Pine PLEASANT BTW and Elm Streets for the erection of the Public Safety PINE_,AND-,ELM. Building Was in harmony with the Lodi General Plan and recommending its abandonment. PC ACTIONS Other actions of the Planning Commission at its meeting of September 13, 1965, were as follows: 1. Denied rezoning from R-2 and R-4 to R-3 for property on the east side of School Street between Tokay and Vine Street. 2. Approved the County referral of Kirst Estates No. 4 Subdivision in Woodbridge subject to certain conditions. - 1 - Minutes of September 15, 1965 continued INTENTION TO City ylanager Glaves recommended that the City proceed A"NDON PLEASANT- with abandonment of Pleasant Avenue between Elm and BTW PINE & ELM Pine Street and portions of the alleys abutting the street which would become a part of the Civic Center. RES. NO. 2864 On motion of Councilman Dow, Culbertson second, the ADOPTED City Council adopted Resolution No. 2864 stating its intention to abandon Pleasant P_venue between Elm and Pine Streets and portions of abutting alleys as recom- waded, and setting public hearing thereon for October 6, 1965. - 2 - 3. Approved County referral of the request of Mr. Henry Gunsch for a use permit to expand an existing trailer parkonthe west side of Cherokee Lane north of Almond Drive subject to certain conditions. 4. Approved the County referral of the Tokay Distributors for a use permit to establish a home occupation at 546 North Cluff Avenue. CCWUNICATIa-IS R. TRIOLO A letter was read from Mr. Russell Triolo appealing APPEAL the action of the City Planning Commission in denying his request to rezone the property at 723 South School Street from R-2 Single Family Residential to R-3 Limited Multiple Family Residential. On motion of Councilman Dow, Walton second, the appeal was set for public hearing on October 6, 1965. NATIONAL A communication was received from Mr. J. G. Meyer, HIGHWAY WEEK District Engineer, Division of Highways, notifying the Council that September 19-25 will be National RES. NO. 2861 Highway Week and that endorsement by the Council would ADOPTED be appreciated. On motion of Councilman Dow, Walton second, the City Council adopted Resolution No. 2861 endorsing National Highway [geek and urging its observ- ance -by the people of this community. THANKS FROM Thanks were received from the Loyal Order of Moose MOOSE LODGE Lodi Lodge for the City's cooperation which helped make their Pre -Festival Street Dance a success. REPORTS OF THE CITY -MANAGER CLAIMS Claims in the amount of $155,189.23 were approved on motion of Councilman Culbertson, Dow second. PREVAILING On motion of Councilman Dow, -Walton second, the City WAGE RATES Council -adopted Resolution No. 2862 adopting the scale of prevailing wages for building and construction RES. NO. 2862 trades. ADOPTED REMOVAL OF No bids had been received at opening time for the sale HOUSES AT 216 of the houses at 216 and 220 Hest Elm Street in AND 220 W. ELM response to advertising thereon; however, subsequently an offer had been received from R. B. Custer in the -- RES; NO. 2863 amount of $101 for the house at 220 West Elm Street. ADOPTED Mr. Glaves recommended that the offer from Mr. Custer be accepted and that the staff be authorized to negoti- ate, for the sale of the house at 216 West Elm. On motion of Councilman Culbertson, Walton second, the City Council adopted Resolution No. 2863 awarding'the house at 220 West Elm to Mr. Custer and authorizing the City Manager to negotiate for the removal of the house at 216 West Elm. RES. NO. 2864 On motion of Councilman Dow, Culbertson second, the ADOPTED City Council adopted Resolution No. 2864 stating its intention to abandon Pleasant P_venue between Elm and Pine Streets and portions of abutting alleys as recom- waded, and setting public hearing thereon for October 6, 1965. - 2 - 285 Minutes of September 15, 1965 continued SPECS - The City Attorney stated that the Armstrong property REMOVAL OF at 302 West Elm Street had been vacated, a stipulation BUILDING AT having been made by the Superior Court for possession 220'-1 & 302 by the City. On motion of Councilman Culbertson, W. ELM.'- Brown second, the City Council approved specifications for the sale of the apartment building at 2203� West Elm Stteet and the house at 302 West Elm Street and authorized calling fox bids thereon. R/W FOR Mr. Gloves presented a deed for right of way on the W. LODI AVE. north side of Lodi Avenue west of Lee Avenue from Rudolph F. Bockenheim. A letter from Mr. Bockenheim states that the deed is being delivered subject to the following conditions; There will be no cost to Mr. Bockenheim in connection with the transfer; and at the time the street is widened the City will pay the cost of installing paving, curb, gutter and side- walk, for the relocation of the sprinkler system, for establishment of a new grade for the lawn or the con- struction of a retaining wall therefox, and for the relocation of a sign. Mr. Gloves recommended that the Council accept the conditions and authorize accept - once of the deed. On motion of Councilman Brown, Dow second, the City Council approved the conditions for the acceptance of the deed from Mr. Bockenheim and authorized acceptance of the deed on behalf of the City. FMCHASE TWO Mr. Gloves stated the City would need to purchase two POLICE CARS police cars in the near future and that the Chief of THROUGH STATE Police was requesting that the City.purchase the cars SERVICES through the California Department of General Services. Legislation passed several years ago enables a city RES. NO. 2865 to make purchases.through this department which has ADOPTED a larger purchasing power than would be the case of some cities. The State has awarded the bid for the purchase of Dodge 880 Police Pursuit vehicles ordered to rigid State specifications. This is a superior ve- hitle to the " normally purchased by the City and the price is quite comparable. Councilman Walton stated this car was one of the finest. The only problem might be shat it was built for cross country use and might develop problems around the city; however, he was in favor of trying these cars. Councilman Brown said the Council should give the matter a lot of con- sideration before deciding to purchase out of town. Councilman Dow felt the City should purchase the cars to see how they work out. -Mayor Kirsten said local dealers haven't made much profit in selling cars to the City and since the Police Chief feels the cars purchased through the State are superior, they should be tried. Councilman Culbertson stated that in dealing with the State there would be no trade-ins and this should not be overlooked. Mr. Gloves said the City may be able to trade the cars for other vehicles or sell them outright. On being asked by Councilman Walton to give an opinion, Police Lieutenant Cross, who was in the audience, said that the Dodge Pursuit was designed for police functions and that trying them out would show if they are practical for the City. He said the price was competitive and the department no longer has their cars serviced at the agency where purchased; they have found that having the cars serviced at one place is more satisfactory. Councilman Brown said he would be willing to go for two cars. It was moved by Councilman Walton that the purchase of two police cars through the State Department of General MWIM r s � Minutes of September 15, 1965 continued Services be authorized. His motion was seconded by Councilman Dow and carried. Councilman Culbertson then moved the adoption of Resolution No. 3865 author- izing purchase of two Dodge 880 Police Pursuit vehicles by the State Department of General Services on behalf of the City and that Fred C. Wilson, Director of Finance, be authorized to sign the application and other documents in connection therewith. The motion was seconded by Councilman Walton and carried by unanimous vote. LIEBIG Councilman Brown asked why Sacramento Street at Tokay COIRNER (abutting the Liebig property) had not been widened. Mr. Glaves said he would have to check on the matter.
