ROLL CALL Present; Councilmen - CULBERTSON, DOW, KIRSTEi4, WALTON and B'20X'TN (Niayor ) Absent: Councilmen - None Also present were City bianager Glaves, City Attorney Mullen, Administrative Assistant Peterson and Planning Director Schroeder. MINUTES On motion of Councilman Culbertson, Kirsten second, the minutes of December 16, 1964, were approved as written and mailed. PUBLIC HEARIi-tGS REZONING Hotice thereof having been published in accordance with ROYLL HOST law, Niayor Brown called for public hearing on the proposed AREA 70 rezoning of property lying between Cherokee Lane and 99 C-2 Freeway from Hale Road to Lodi Avenue from the R-1 Ona - Family Residential District and the R-4 Niultiple-Family ORD. NO. 777 Residential District to the C-2 General -Commercial Dis- INTRODUCED trict. City Manager Glaves read the recommendation of the Planning Commission that the proposed rezoning be approved. Mr. Bill Williams, Royal Host Inn, 710 South Cherokee Lane, and Mr. Bob Peters, Tokay Bowl, 620 South Cherokee Lane, spoke in favor of the rezoning. There were no protests, written or oral. After some discussion on development of the property it was moved by Councilman Dow that Ordinance No. 777 be introduced rezoning property between Cherokee Lane and 99 Freeway.from Hale Road to Lodi F -venue to C-2. The motion was seconded by Council- man Walton and carried unanimously. SIGN ,Notice thereof having been published in accordance with ORDINANCE law, the Mayor opened the public hearing on the proposed sign ordinance. The City Manager read Section (1) of the proposed ordinance which had been corrected by changing the word "building" to "use" in subsection a, adding the words "are permitted" to the first sentence in subsection d, and by changing the first sentence in subsection h -to read "All signs, excepting as provided in part (5) of this section (Outdoor Advertising Displays Adjacent to Freeways), in violation of the provisions of this Ordinance shall be made to conform with said provisions or shall be removed within five years of the effective date of this ordinance or within five years of annexation to the City of the property upon which the sign is located, whichever is the later date." Mr. Marlowe Weil, Weil Motors, 2 West Lockeford Street, asked if a use permit would be allowed beyond five years and was told that they would; the -five-year limitation mentioned in the ordinance did not refer to signs erected through issuance of a use permit. Mr. Irving Baker, 508 - East Lodi Avenue, objected to the ordinance. Mr. Bob Peters, Tokay Bowl, 620 South Cherokee Lane, objected to the 50 -foot height limitation, and was told that such a height had been considered sufficient fox viewing from the Freeway. Mr. Harvey Berglund, Ryan Advertising Agency, said that the -use permit mentioned in the ordi- nance should be clarified. Mr. Stanley Kirst, 18 Worth - 1 - 152 Minutes of January 6, 1965 continued School Street, objected to the ordinance, stating that it was infringing on people's rights; that safety measures were all right, but the City was overstepping its bounds when it got into aesthetic values. Dir. Weil said the Council should only be concerned with safety regulations. Jnr. Lindsay Marshall, 703 Wast Pine Street, representing Shell Oil Company, said the 73' high sign recently erected by Shell could not been seen from the Freeway if it were lowered because of the depressed Freeway in this area. Dir. Lloyd Patton, Richfield Oil Company distributor, 930 Victor Road, objected to the ordinance and advocated that a large sign pointing to Lodi be placed under the Shell sign and stated he would contribute up to $100 for such a sign. Dir. Williams of the Royal Host Inn said he had made a survey of his patrons and that 18% of the tourists would have missed the Inn except for the sign. He stated signs had to be 65 feet in height or more to be seen from the Freeway. k -ix. Cye Vaughan, Del Rancho Mo tel, 501 North Cherokee Lane, said there are too many restrictions now and that a 50 -foot -high sign would not be high enough for his business. The City Clerk stated that letters had been received in regard to the ordinance. Councilman Walton said the letters should be acknowledged but not read. On motion of Councilman Culbertson, Kirsten second, reading of the letters was approved by the following vote: Ayes: Councilmen - C ULBERTSON, DOW, KIRSTEN and BROWN Noes: Councilmen - WALTON . The letters were then read from the following: 1. Clarence L. Jones, Chairman, Civic Affairs Committee, Lodi District Chamber of Commerce, urging adoption of the ordinance providing it meets State requirements in connection with the freeway beautification program financed by the State. 2. Mrs. Lloyd.Madison, Woman's Club of Lodi, advising that the Board of Directors of the Club supported passage of the . ordinance. S. Curt Heisner, 1100.Holly Drive, stating he was not particularly interested in the aspects of the proposed ordinance, but felt the Council should take up the prob- lem of signs in connection with traffic safety. Councilman Dow said the Council was not ready for a final draft and that more study was needed on specific height for signs along the Freeway, the ordinance should have more specific guidelines, there should be uniformity of application, and parts of the ordinance were not suf- ficiently clear. He said it should be discussed more and he would like to hear from more people in the com- munity. Councilman Dow moved that the hearing on the sign ordinance be continued to the meeting of January 20 and that -the City Manager be requested to investigate the feasibility of 50 -foot signs along the Freeway. His motion died from lack of a second. Councilman Kirsten said he would like to have surveys on habits of motorists in regard to signs on the Freeway and the feasibility of lengthening the amortization period for removal of non- conforming•signs. Councilman Walton said he did not find flashing signs objectionable. He moved that the proposed ordinance be tabled until further information - 2 - 1'1r)3 Minutes of January 6, 1965 continued could be obtained on the height of.signs and the possible danger of flashing signs. There was no second to the motion. Councilman Culbertson said there was a lot of good in the ordinance and he was in favor of continuing study of the ordinance as.long as necessary. City Manager Glaves reminded the Council they would be busy the next couple of months with the Capital Outlay program. Councilman Walton moved to continue the sign ordinance for reconsideration and to -continue the public hearing thereon to March 17, 1965. His motion was seconded by Councilman Dow and carried unanimously. CO101UNICATIONS FUGAZI A letter was read from Louis Fugazi appealing the APPEAL decision of the Planning Commission in denying his re- quest for the rezoning from R-2 to R-3 for Lot 1, Fugazi Nanor, located on North Pacific E.venue south of Reiman Street. On motion of Councilman Culbertson, Dow second, the matter was set for public hearing on January 20, 1965. COUNTY RE A Resolution from the San Joaquin County Board of SANGUINETTI Supervisors was received approving the appeal of Henry USE PERMIT A. Glaves for the Lodi Planning -Commission from the decision of San Joaquin County Planning Commission grant- ing a conditional use permit to the L. R. Sanguinetti Estate to establish a service station on property located on the northeast corner of Turner Road and the extension of Church Street. DOS PALOS A communication was read from the City of Dos Palos requesting the City to participate in financing the trip of the Dos Palos High School Band to Washington, D. C. for.the inaugural parade. A suggestion was made that 'the letter be referred to the Chamber of Commerce. REPORTS OF THE CITY MANAGER CLAIMS - Claims in the amount of $159,955.37 were approved on motion of Councilman Culbertson, Dow second. CLASSIFICATION Mr. Glaves introduced Mr. Vernon Schweitzer, Survey AND SALARY Director, State Cooperative Personnel Services, who has SURVEY been in -charge of the classification and salary survey for the City, Mr. Schweitzer.explained the procedure for handling employee appeals. He said that 41 appeals had been received affecting 23 different classes and 11 of the recommendations in these appeals were recognized in whole or in part. A written summary of the final report was presented by Mr. Schweitzer and he said the complete report, including explanation of action on the appeals, would be forwarded to=the City within the next week. On motion of Councilman Walton, Dow second, the Council accepted the survey as being complete. Council- man Dow then moved that consideration of the State report be postponed to the meeting of January 20, 1965. His motion was secondby Walton and carried. (OtLtci/ AWARD - Piz. Glaves reported that only one bid had been received PICKUP TRUCKS on the two pickup trucks. The bid received was from RES._NO. 2786 Krieger Ford for a total of $30"215.39. He said the bid ADOPTED was reasonable and recommended that award be made. On motion of Councilman Dow, Kirsten second, the City Council adopted Resolution No. 2786 awarding the contract for the two pickup trucks to'Krieger Ford in accordance with their bid. - 3 - 194 Minutes of January 6, 1965 continued SPECS -war. Glaves stated specifications for sewer and water UTILITIES - lines across the Woodbridge Irrigation District canal WID DITCH AT at the east side;of Sacramento Road had been prepared SAC70 RD about a year ago and submitted to the District for approval. The District had given its approval at that time subject to conditions which were rejected by the Council— It then became too late to do the work before water would be let into the ditch so the City bad waited until the present time. The District had now been asked to lock at the present specifications to determine the work would not interfere with its operations and the City Manager and Director of Public Works had met with the District's Board of Directors in order to reach an understanding. The Board complained of problems caused by subdivisions bordering the canal. fir. Glaves expressed the hope that the City and District could work together and felt that the most satisfactory means of communi- cation would be to have a meeting of the City Council and the Irrigation District Board. In regard to the extension of utilities across the canal at Sacramento Road, the City Manager said the Council could stop the project, defer the work for further discussion, or go ahead on the belief that the City has the right.to do the work as long as it does not impede the flow of water into the canal. He said the City would like to cooperate with the District. He read an unsigned memo from the Irrigation District referring to maintenance of ditches within the City and the need for an understanding between the City and the District. i+ir. Glaves said he had phoned iir. Sherwood Beckman of the District Board and had been told that the City could go ahead with the water and sewer extensions. Councilman Dow moved that the plans and specifications for "Utilities Extension - Woodbridge Irrigation Ditch, Sacramento Road, and Lodi Ave." be approved and calling for bids authorized. His motion was seconded by Councilman Kirsten and carried. '=DBRIDGc Councilman Dow then moved that the City Manager be IRRIGt+TION directed to correspond with the Woodbridge Irrigation DISTRICT District inviting the Board of Directors to meet with the liEETING Council on the evening of January 27, 1965 and that at that time the District present in writing an itemized list of its complaints. His motion was seconded by Councilman Kirsten and carried. DRIVEWAYS - A request was presented from iir. Henry Hanson for the MVD BLDG ON construction of two driveways at the new Department of E. PINE ST. Motor Vehicles building at 672 East Pine Street, one being 22 feet wide and the other 20 feet. The Director of Public Works had recommended their approval. On motion of Councilman Culbertson, Dow second the City Council approved the two driveways as requested. DRIVEWAYS - The Firestone Tire and Rubber Company is requesting FIRESTONE approval of driveways for its building at the corner of TIRE AND Oak and Sacramento Streets. Prints showing the location RUBBER CO. of two 30 -foot driveways on Sacramento Street and one 20 -foot driveway on Oak Street were studied by the Council. The Director of Public Works had recommended that the driveways be approved. On motion -of Councilman Culbertson, Walton second, the Council approved the driveways for Firestone 'lyre and Rubber Company as requested. DEED - City Attorney Nullen stated that Wr. Edgar Beoshanz had L.ODI AVE.R/4 agreed to accept the appraiser's figure of $2350 for right of way to widen Lodi Fvenue at the northeast corner of Lodi and Central Avenues. On motion of Council- man Dow, Kirsten second, the City Council approved pur- chase of right of way from Edgar Beoshanz for a total of $2350. EXECUTIVE The Council then adjourned for approximately ten minutes SESSION to go into Executive Session. P.PPOINTME -IT PALTER NORBY After the meeting reconvened, Mayor Brown requested TO PC approval of the'appointment of Mr. Walter Norby to the vacancy on the City Planning Commission created by the resignation of Mr. Thomas Bandelin. On motion of Councilman Culbertson, Kirsten second, the City Council concurred in the appointment of Palter Norby to the City Planning Commission for a term expiring June 30, 1966.
