COLMCIL, CITY OF LCOX CITY HALL COUNCIL Ci�MORS NOVEMBER 2, 1966 A regular meeting of the City Council of the City of Lodi was held beginning at 8:00 p.m. of Wednesday, November 2, 1966, in the City Hall Council Chambers. ROLL T' Present: Councilmen - BROMI, HLMELL, KIRSTEN and CULBERTSON(Mayor Pro Tempore) Absent-. Councilmen - VM.LTON (Mayor) PLANNUTG COaI4SSION APPdAL RE Wr. Glaves reported that the Planning Commission_ had SIM reviewed the sign ordinance in regard to sign regu- lations in the C -P zone and recommended to the Council that no changes be made. He stated that Mr. Sam Salas, who had appealed the decision of the Planning Com- mission -in regard to a sign at the Lodi Funeral Home on Fairmont Avenue, had requested that the hearing on his appeal be postponed to the first meeting in December. On motion of.Councilman Kirsten, Brown second, the Council set the appeal of Mr. Salas for public hearing on December 7, 1966. PLANNING The following actions of the Planning Commission were COMMISSION reported:---- - - ACTIONS a. Approved the request of Pacific Investment CompaAy for variances to reduce the required fifty -foot street -side setback in the C -S Commercial - Shopping District to forty-two feet on West Elm Street and thirty-nine feet on North Ham Lane to permit the erection of a new building while pro- viding safe automobile circulation at the Lakewood Mall Shopping Center. The Planning Commission based its approval of the variances on the deter- mination that a dangerous circulation problem existed in the area. By moving the building southeasterly a wider driveway would be provided which would aid in the reduction of the hazard. In related action the Planning Commission continued the consideration of a use permit for Phase III of Lakewood Mall pending submission of final building plans. Councilman Culbertson questioned the granting of a variance to reduce the setback lines. Planning Director Schroeder stated the parking lot was not properly designed and resulted in an unsafe situation. Councilman Culbertson felt that perhaps the building could be redesigned rather than changing the setback. b. The Planning Commission recommended the denial of the request of Mr. Orville W. Patrick for a use permit to expand an existing television sales and service shop in an area zoned R-2 Residential in the Town of Woodbridge. Er. Glaves stated that the City's appeal from the action of the County Planning Commission in granting a use permit to establish a plant nursery on West Lane had been denied by the Board of Supervisors. - 1 - 464 ;Ur.utes of November 2, 1955 continued CObb,L)+iICE.Tia i5 FAPPI-CITY A letter was read from the Stockton Chamber of Commerce BANQUET inviting the Council to attend the annual Farm -City banquet to be held at the San Joaquin County Fair- grounds on November 19, 1966, ABC LICENSE Notice was read of application for Alcoholic Beverage License, Original Application, Beer and mine, Off - Cale, by Albertson's, Inc., 340 gest Kettleman Lane. I_PORTS OF THS CITY MANAGER CLAIMS Claims in the amount of $134,956.50 were approved on motion of Councilman Kirsten, Hunnell second. SPUR TRACK FOR Hr. Glaves stated that General Nills has recently GENERAL MILLS announced plans to -add an extensive warehouse expansion to its present plant. In connection with such plans RES. NO. 3004 they will require a railroad spur to service the new warehouse. Before obtaining approval for the spur track from the Public Utilities Commission, approval from the City for crossing Turner Road is required. On motion of Councilman Brown, Kirsten second, the City Council adopted Resolution No. 3004 authorizing General Mills to construct, maintain and operate a railroad industrial track across Turner Road. CIVIL ENGINEE3 III & Flf,TER & SEv&R SUPERVISOR SALARIES i'4r. Glaves requested permission to hire a Water and Sewer Supervisor and a Civil Engineer III at the fourth step in their -salary ranges. He stated that for both positions the top candidate was well above the next highest candidate and since they are now making salaries well above the fourth step of the salary range, he would like to try to secure their services at the fourth step. After discussion, it was moved by Councilman Kirsten that the City Manager be author- ized to hire a Civil Engineer III at the fourth step of the salary range. The motion was seconded by Councilman Hunnell and carried by the following vote: Ayes: Councilmen , CULBERTSON, HtVNELL and KIRSTEN Hoes; Councilmen - BROWN Absent: Councilman - WALTON. Councilman Kirsten then moved that the City Manager be authorized to hire a %later and Sewer Supervisor at the fourth step of the salary range. The motion was seconded by Councilman Hunnell and carried by the following vote: Ayes: Councilmen - CULBERTSON, HUNNELL and KIR ST, -;A I ?•foes: councilman - BROIIYI Absent: Councilmen - '01.LTOif SPECS - The City Planagex presented specifications fox one AUICOMOBILES four -door sedan; four compact sedans and one sports van. On motion of Councilman Kirsten, Brown second, the City Council adopted said specifications and authorized calling for bids thereon. Glaves explained that when the City adopted the HOTEL-P60TEL hotel -motel tax, Federal and State employees were TAX EXEMPTIONS exempted from the tax because it was believed cities could not legally impose a tax on these people. ORD. NO. 829 However, an Attorney General's opinion has been issued T_NTRCDL= declaring such a tax can be imposed. On motion of Councilman Kirsten, Brown second, the City Council introduced Ordinance Pdo. 829 repealing Section 23-14 of the City Code and thereby eliminating the provision for hotel -motel tax exemptions. POOL HALL City Manager Glaves stated the Hayor was interested in ;2'GULATIOI4S regulation of pool halls particularly because of the trend toward family billiard parlors. Councilman Kirsten moved that the City Manager give a report on a proposed revision of the ordinance on pool halls to include regulations for family billiard parlors and that a moratorium be established on the issuance of use permitl for family billiard parlors until such time as an ordinance was adopted. The motion was seconded by Councilman Hunnell and carried by unanimous vote. Councilman Culbertson said he would like a copy of the draft of the proposed ordinance with notations showing alternates and reasons for the recommendations. NO. 3011 therein for inclusion in the City street system. On motion of Councilman Brown, Kirstensecond, the City Council adopted Resolution Ido. 3011 accepting the streets in Twin Oaks West Unit Ifo. 2 as public streets. APPROVE Mr. Glaves stated that he had approved extension of EXTENSION electric conduit southerly to the Pine -Oak alley OF ELECTRIC during the construction of phase one of the underground COidDUIT electric facilities and requested confirmation by the Council. On motion of Councilman Kirsten, Brown second, the City Council approved the action of the City Manager in directing that the conduit be extended. LODI_LAKE Ti:e City Manager presented two proposed elevations BATH HOUSE for the Lodi Lake Bath House being designed by Arlie Preszler. The Council selected one of the elevations and decided on concrete block as the material. CIVIC CENTER biz. Glaves stated that in discussing the Civic Center MALL mall plans with Mr. Varner, Mr. Varner had recommended that the brick along the walkway end at the sidewalk on Pine Street rather than at the curb as indicated on the landscape plans. The motion was seconded by Councilman Hunnell and carried by unanimous vote. WOOD PROPERTY— Administrative Assistant Petexson reported that the VINEWOOD SCHOOL Director of Public Worcs had met with Nr. Don Wood CHILDREN in regard to providing a walkway along his property on West Lodi Avenue for children going to Vinewood School. IMr, blood has agreed to dedicate right of way in front of his house in exchange for curb, gutter and sidewalk and has agreed to permit installation of a temporary walkway along the balance of his property. SISTER -CITY Councilman Culbertson suggested that the Council hold C010a TTEE a meeting with members of the Sister -City Committee in view of the fact that I•ir. George Creighton, former chairman, is no longer a member of.the committee. It was decided to have a breakfast meeting on Tuesday, November S. CITY HALL Councilman Culbertson said Wr. Varner feels he can SPACE STUDY start the master plan for the City Hall. City Manager Glaves suggested that the space study include possible addition of a wing to the building. Councilman Culbertson moved that the City 24anager contact Mr. [Marion J. Varner for a proposal as to scope of the space study and fee therefor for presentation to the Council at its meeting of Iiovember 16 if possible, the proposal to be presented in person if Nx . Varner can do so, or otherwise by letter. The motion was seconded by Councilman Kirsten and carried by unanimous vote. COUNCIL TO TOU2 The Council set Wednesday, November 9, starting at CITY FACILITIES 1:45 p.m., to tour City facilities.
