This meeting of the City Council of the City of Lodi, regularly --
adjourned from April 6, 1966, was held at 8:00 p.m. of Tuesday, April 19,
1966.

COMMISSION
FINAL NAP
The final map of the Pioneer Subdivision, having

been approved by the Planning Commission, was pre-
sented for Council approval, along with improvement
plans and specifications for the development of the
subdivision. The subdivider has complied with City
requirements and has signed a subdivision agreement
for development of the subdivision. On motion of
Councilman Culbertson, Dow second, the City Council
approved the final map of the Pioneer Subdivision and
the plans and specifications therefor, and authorized
the Mayor to execute the Subdivision Agreement covering
this subdivision.
PC ACTIONS
The following actions of the Planning Commission were
repor ted :
1. Recommended the approval of the referral of the
San Joaquin County Planning Commission of the
request of Airs. Ruth Surdez for a variance to
reduce the required side yard from four feet
(41) to zero feet (01) for a carport in an area
zoned I -H, Interim -Highway on the east side of
Main Street in the Tovm of Woodbridge.
2. Reaffirmed its previous decision and recommended
the denial of the amended request of Mr. Stanley D.
Kirst for a change in zoning (1) from the R-3,
Residential District to the C-1, Neighborhood -
Commercial District for a parcel at the northwest
corner of Indiana and Chestnut Streets and (2)
from the R-3, Residential District to the C-R,
Commercial -Residential District for parcels located
at the southwest corner of Indiana and Chestnut
Streets and on the west side of Chestnut Street
from about.185 feet to 260 feet south of Indiana
Street in the Town of Woodbridge.
This recommendation for denial was based on the
City Planning Commission's policies concerning
spot zoning, mixed land use and minimum standards
for neighborhood shopping facilities.
3. Recommended ithe approval of the referral of the
San Joaquin'C-aunty Planning Commission of the
request of Air. John K. Looser for Mr. O. L. Robinson
for a use permit to expand an existing athletic
club to include banquet and private bar facilities
on the east side of Gest Lane, 2300 feet south of
Kettleman Lane, in an area zoned I -PA, Interim -
Protected Agricultural with certain conditions.

4. Denied the request of virs. Rose M. Schwiesow for
a use permit to establish a single -unit trailer
park on the rear of a lot- at 505 Hilborn Street
in an area zoned R-4,Axlultiple-Family, Residential -
Institutional zone.
5. Denied the request of Mr. Harry Larides for a use
permit to erect &.flashing-azzow sign attached to
an existing sign at a restaurant at 114 North
Cherokee Lane in an area zoned C-2, General
Commercial.
6. Recommended that the alternate sites for the
future Worth Campus of San Joaquin Delta College
located (a) at the northwest corner of West Lane
and Harney Lane and (b) on the south side of Harney
Lane west of the Woodbridge Irrigation District
Canal be approved.

COMPLAINT
Creek, California, objecting to having received a
parking ticket.downtown and suggesting free off-street
parking as a means of keeping shoppers in the downtown
area.
THAWS
Thank you letter was received from Area Two United
Republicans of California thanking the City for its
hospitality during their convention in this city.
OUTSIDE
A letter was received from Lodi 14edical Development
WATER SERVICE
Company requesting outside water service for a hospital
GRANTED
being developed outside the city limits at Lower
Sacramento Road and Vine Street. The letter further
states the company agrees to annexation of the property
at such time as the City considers such annexation
desirable. On motion of Councilman Brown, Dow second,
the City Council granted the request for outside water
service to Lodi Medical Development Company on condition
the company agrees to annexation of the property when
requested by the City, as set forth in the company's
letter.

Notice was received of application for Alcoholic
Beverage License, Adding Partner, Louis Anagnos and
Jerry Ballard, Club 15,,15 I3orth Sacramento Street,

iir. Glaves recommended making award to the low bidder.
On motion of Councilman Dow, Walton second, the City
Council adopted Resolution No. 2940 awarding the con-
tract for the above mentioned project to the lour bidder,
W. Ti. Lyles Company for a total of $12,449.04.

Minutes of April 19, 1956 continued
BASEBALL PARK The City Manager presented for consideration by the
CONCESSION Council an agreement with J. c Ferguson fox the
CONTRACT concessions at the Lawrence Park Baseball Stadium.
The term of the contract mould be from the present to
September 1, 1968. Mr. Glaves reviewed the other
terms of the agreement. On motion of Councilman
Culbertson, Walton second, the Council approved the
contract and authorized its execution by the blayor.
LEASE - Mr. Glaves then presented a lease agreement with the
LODI BASEBALL Lodi Baseball Club for use of the baseball diamond and
CU S facilities at Lawrence Park. He reviewed the terms
of the agreement which included stipulations made by
the Council at its meeting of January 19, 1966. On
motion of Councilman Culbertson, Dow second, the City
Council accepted the lease with the Lodi Baseball Club
and authorized the Mayor to execute same.
STATE
Mr. Glaves reported that on April 14, 1966, an election

had been held among City employees on the State

employees had voted unanimously in favor of entering

the State system. Miscellaneous employees had voted
120 in favor and four against and, in addition, the

six probationary employees had voted in favor of the

system. On motion of Councilman Culbertson, Dow
second, the City Council introduced Oxdinance No. 814
authorizing the Mayor to execute a contract with the
State Board of Administration of the California State
Employees' Retirement System making City employees
members of said system.
City Attorney Nullen stated that an ordinance would
have to be adopted repealing the City's retirement
system effective when the State plan is effective.
!_iso, an ordinance would need to be adopted modifying
the personnel ordinance to provide a maximum retirement
age of 65 years, which is the present maximum age under
the City's retirement system. Copies of both ordinances
had been presented to the Council.
REPEAL114G On motion of Councilman Dow, Culbertson second, the
CITY RETIRE- City Council introduced Ordinance iio. 815 repealing
NE.QT SYSTEri Article II of Chapter 17 of the Lodi City Code
entitled "Retirement System."

AT 65 17-2.1 to the Lodi City Code setting forth the maxi-
mum age of employment to be 65 years.

INTRODLCED
SAFETY BLDG. City Manager Glaves recommended that the City contract
RES. 611GINEER with Mr. Clinton Howe to serve as Resident Engineer
for the Public Safety Building. His fee would be $650
a month and he would serve for the duration of the
job. On motion of Councilman Culbertson, Dow second,
the City Council authorized the City Manager to secure
the services of Mr. Clinton Howe in accordance with
the City Manager's recommendation.
LIBRARY A letter was received from the Library Board of Trustees
PARKING asking that two additional 12 -minute parking spaces be
marked off in front of the Library. With the con -
RES. NO. 2942 struction of the Public Safety Building, parking and

and Nr. Glaves recommended that the request be granted.

City Manager Glaves stated he had received a deed and

City for the sum of $50,000. City Attorney Wullen
stated that after considerable negotiation and with
the concurrence of the City's appraiser, Mr. Robert
Orr, the sum of $50,000 had been agreed upon. He felt
this was a fair offer and recommended acceptance of
the deed. On motion of Councilman Brown, Ualton second,
the City Council approved acceptance of the deed in
payment of $50,000 to Miss Eddlemon.

Brown, Dow second. Second reading was omitted after

reading by title. Mr. Wm. S.-Rempfer, 115 South

Fairmont Avenue, protested passage of the ordinance,
stating the property was agricultural and the rezoning
was inconsistent with the Uaster Plan and further that
the zoning was premature; the City should wait until
it has the results of the traffic survey being made
by Dr. Faustman so that the effect of the proposed
zoning on Lodi Avenue traffic can be determined. He
urged that adoption of the ordinance be postponed until
the traffic survey is available. Mr. Stanley D. Kirst
concurred in the statements of Mr. Rempfer, requesting
that adoption of the ordinance be postponed until the
traffic facts were known.- There was no one else in
the audience who wished to be heard on this matter.
I.:r. Glaves pointed out that I-ir. Rempfer was in error

in stating that the zoning* would not conform to the
Naster Plan since the Master Plan indicates such
zoning at this site. He said there was merit to the
concern over traffic problems on Lodi Avenue, but it
was logical to assume that traffic decreases as it
moves westerly on the avenue. The Council passed
Ordinance No. 813 by the following vote:

records on file in her office that voting precincts were properly estab-
lished and the polling places thereof designated; that election officers
were appointed and qualified; that election supplies, including official
ballots, were furnished each of said precincts; and that in all respects,

received and canvassed and the returns thereof made, determined and
declared in time, form and manner as required by the laws of the State
providing for and regulating elections in general law cities; and

4HEREFS, in accordance with Resolution Uo. 2921, the City Clerk
conducted the canvass of the returns of said election; and
WHERaAS, the City Council of the City of Lodi, meeting at the City
Council Chambers this 19th day of April, 1966, to declare the results
of the election and to install the newly elected officers, finds, deter-
mines and declares, as a result of said count and canvass as certified
by the City Clerk:
(1) That said General Municipal Election was held and conducted
in the City of Lodi, California, on the 12th day of April, 1966, in time
form and manner required by law;

RESOLVED, THER FORE, that at said General Municipal Election, held
in the City of Lodi on April 12, 1966, the following named persons were
elected to the office of City Councilman:
FRED M:. &:OSA1, for a term of four years from and after the 19th
day of April,`*19661 and until his successor shall -have been elected and
shall have'qualified;
;-JAWS' F. CULBERTSOii, for a term of four years from and after the
19th day of April, 1966, and until his successor shall have been elected
and shall have qualified;
ROBERT F. HUTMLL, for a term of four years.from and after the 19th
day -of April, 1966, and until his successor shall have been elected and
shall have qualified.
Upon the adoption of this resolution, the City Clerk shall enter
a full copy thereof on the records of the City Council of the City of

PLAQUE FOR
Layor Kirsten congratulated Councilmen Brown and
COUNCIUMN
Culbertson on their re-election to the Council. He

then expressed his pleasure at having serVed on the
Council with outgoing Councilman Dow and presented
him with a plaque in appreciation of Mr. Dow's services
to tie City during his term of office. Councilman
Dow thanked the Mayor and stated he hoped he left
with the City as much as he had taken. Wayor Kirsten
also welcomed Councilman -elect Robert Hunnell.

u%e City Clerk administered the oath of office to

i;r. Brown, Mr. Culbertson, azul ii:. Hunnell and pre-
sented a certificate of election to each.
Mayor Kirsten thanked the Council for having selectee,
him as ifayor and for their cooperation during the
past year. .He then relinquished the chair to the
City Clerk.

closed on motion of Councilman Brown and Councilman
Walton was elected by the following vote: Kirsten - 2;

l:ayor 'Walton then took the chair as presiding officer,
and after thanking the Council for his election as
i•3ayor and complimenting irir. Kiraten for the fine job
::e had done, called for nominations for Wayor Pro
Tempore. Councilman Brown nominated Councilman
Culbertson. Councilman I:irsten nominated Councilman
. Lmmell. The nominations were then closed and Air.
Culbertson was elected by the following vote.
Culbertson - 4; Hunnell .- 1.
'ouncilman Kirsten notified other members of the
Council that they had been invited to ride in the
Boy Scout Parade on Saturday, April 23.
Councilman Culbertson expressed his extreme gratitude
to Councilman Kirsten for his devotion to his•job as
Iiayor during the past year and for his efforts in
campaigning for the successful bond election. He
also expressed his pleasure in having worked on the
Council with Mr. Dow. Councilman Brown thanked
Councilman Kirsten for the tremendous job he had done
as tdayor and thanked I -Ir. Dow for his work and coopera-
tion. Wayor dalton also thanked Air. Dow for,his accom-
plishments on the Council.
On motion of Councilman Culbertson, the Council
adjourned to 5:30 of lipril 27, 1966.
