This regular meeting of the City Council of the City of Lodi was
held beginning at 8100 p.m. of Wednesday, March 16, 1966, in the City
Hall Council Chambers.

On motion of Councilman Brown, Walton second, the
Minutes of March 2, 1966, were approved as written and
mailed .ter correcting the second paragraph on page 4
by changing the word "three" in the second sentence
to "two."

Notice thereof having been published in accordance
with law, Mayor Kirsten called for public hearing on
the recommendation a the City Planning Commission to
amend Chapter 27 (zoning ordinance) of the City Code
by permitting the following building height limit in
"K" Industrial zones: Five stories but not to exceed
100 feet. Buildings requiring a height in excess of
this provision may be erected after first securing a
use permit from the Planning Commission. No cormuni-
cations on this matter had been received and there was
no one in the audience who wished to be heard. On
motion of Councilman Brown, Dow second, the City Council
introduced Ordinance No. 812 amending the City Code
to provide the above recommended height limit in "iii"
zones.

LOWER SACTO RD
The Planning Commission recommended the prezoning of
a 13 -acre parcel located at the southwest corner of
Lodi Avenue and Lower Sacramento Road to C -S Commercial
Shopping District which is in the process of annexation
to the City. On motion of Councilman Dow, Culbertson
second, the matter was set for public hearing at the
meeting of April 6, 1966.
PC ACTIONS Other actions of the Planning Commission of interest
to the Council were reported as follows:
1. Denied a request of change of zoning from R.1
to C-1 for property on the north side of
Turner Road about 400 feet west of Ham Lane.
2. Denied a request for change of zoning from R-1
to P -D to include commercial, multiple -family
and single-family land uses for property between
West Lodi Avenue and Iris Drive from Ham Lane
to Hutchins Sunset Park Subdivision.
3. Denied the request for a variance to permit the
construction' of a detached second unit at 921 S.
Garfield Street in the R-3 zone.
4. Approved request for a variance to reduce the
required side yard from 5 feet to 4 feet 8 inches
to allow an addition to a dwelling at 209 Watson
Street in the R-3 zone.

5. Approved the following County referrals:
a) Request of East Side tJinery for a change
in zoning at the winery site on Victor Road
at Central California Traction Company tracks
and also_fox a parcel adjacent to the
Mokelumne River and -west of the CCTCo. tracks.
b) Request of Claude C. Mood Company for a use
permit to expand outside storage of heavy
equipment on the north side of Lockeford
Street from the cast Frontage Road to Cluff
Avenue.
6. Received withdrawal -of application for rezoning
the northwest corner of Lodi Avenue and Ham
Lane from R-1 to C-1
Councilman Culbertson moved that the report be accepted.
COMMUNICATIOUS
LOADING ZONE,
Request of Gienger Linoleum.Service for a loading zone
REQUEST
for their business at 15 West Oak Street. On motion
of Councilman Dow, Culbertson second, the matter was
referred to the Administration for study and report.,
LEGISLATIOIi
A letter was received from Supervisor Warren M. Dorn
RE MARIJUANA
of Los Angeles County asking the Council to oppose any
proposal to place an initiative measure on the ballot
which would legalize growth and sale of marijuana in
this state and enclosing"a resolution of the Los
Angeles County Board of Supervisors stating its oppo-
sition to such legislation. Councilman Culbertson
moved that decision on the request be postponed to
'the meeting of April 6, that information thereon be
obtained from the League of California Cities, and
that a copy of the proposed legislation be obtained.

ABC LICENSE
Notice was read of the application for Alcoholic
Beverage License, Premises to Premises Transfer, On
Sale General, by Garry,and Vionne Seefried' for Garry's
Lounge, 7 South School Street. -

A letter was read from the Chamber of Commerce

requesting peaission to close School Street between

shoppers. (City Attorney Mullen arrived.) Councilman
Brown moved that*the.City Manager be authorized to
work with.the Chamber of Commerce on closing a portion

of School Stieet as requested. His motion was seconded
by Councilman Dow_and carried.

Kt. Glaves read a letter from Roger Huckins, President
RESOLUTIONS
of the Central Valley Division of the League of
California Cities, recommending that resolutions to
be presented for vote to'the Central Valley Division
be submitted to the Executive Committee of the Division
for clearance at its meeting one month prior to the
Division meeting. He also stated that when a roll call
vote is requested at the Division meeting, the roll
should be called. kr'.Huckins would like to have
the Executive Committee formulate a policy in regard
to resolutions at its meeting of Narch 24. Some members
of the Council felt that having to submit a resolution
at least one month in advance might not always be

practicable. It was.suggested that copies of proposed
resolutions be submitted to..cities at least a week

before the Division meeting. The suggestion was also
made that there be a resolutions committee to which
resolutions could be submitted on the night of the
meeting. Councilman Culbertson invited other members
of the Council to attend the executive Committee -
meeting with him.
REPORTS OF THE CITY MAJAGER
CLAIMS
Claims in the amount of $157,359.29 were approved on
motion of Councilman Dow, Culbertson second.
PUBLIC SAFETY
Mr. Glaves read the recommendation of Mr. Marion J.

Varner, Architect for the Public Safety Building, on
CHANGE ORDER
the suggested Change Order which would permit use of

more standardized equipment for the elevator at a
savings of $2,360. According to Mr. Varner the change
would not lessen the quality of the elevator, but on
the contrary would be superior in some respects. On
motion of Councilman Culbertson, Dow second, the City
Council adopted Change Order Igo. 1 on the elevator
specifications under the contract for the public safety
building, subject to approval by the Civil Defense
Office.
LEASE -
City Manager Glaves recommended renewal of the Lease

with the Lodi Sportsman's Club at $300 per year _for

two acres adjacent to the old City dump site along the
Mokelumne River. On motion of Councilman Brown, Dow
second, the City Council approved extension of the
lease for one year ending March 31,-1967.
LIPELT
Rr. R. M. Lipelt is requesting renewal of a yearly
LEASE
lease with the City covering a small portion of the
Lodi Lake area immediately east of his property.
Nr. Glaves recommended that this lease be renewed.
On motion of Councilman Dow, Brown second, the City
Council renewed the lease with 'r•Ir. Lipelt for one year
ending March 31, 1967.
TREE RE40VAL
Consideration of the appeal of Mr. Ensminger of 536
AT 536 E. OAK
Bast Oak Street for removal of a sycamore tree in front
of his property having been continued from the meeting
of March 2, 1966, was brought up for action at this
time. Councilman Brown moved that the sycamoze.tree
at 536 East Oak Street be removed. His motion was
seconded by Councilman Culbertson. Councilman Walton
felt the recommendation of the Public Works Department.
which advocated root surgery rather than removal,
should be upheld. Councilman Culbertson's opinion was
that the tree would give trouble before another ten
years. Mayor Kirsten felt the Council should be guided
by a consistent policy. 1_fter further discussion,
the motion passed by the following vote:
Ayes: Councilmen - BROIfii1, CLLBERTSON and DOW
Noes. Councilmen - :711.701-1 and KIRSTEN
APPLICATION -
Lir. Glaves recommended the reapplication for a Federal

660. On motion of Councilman Brown, Dow second, the
City Council adopted Resolution i1o. 2930 authorizing

the filing of application for Federal Grant for sewage

treatment works under the terms of the Federal (later
Pollution Control Act.
FIRE TRUCK
Mr. Glaves presented specifications for a 85 -foot
PURCHASE
aerial platform truck wh ch will be needed by the Fire
Department next year. Both the City Manager and the

Fire Chief recommended that the truck be purchased
directly from,Van,Pelt Fire Truck Company in Oakdale,
California, because replacement of parts would be lass
expensive and faster than with American LaFrance or
Seagrave equipment, experience in northern California
with Van -Pelt equipment has been excellent, and,
because of the proximity of Oakdale, the equipment
could be inspected during construction and later main-
tenance would be readily available. Further, the
Van Pelt Company has given the City a firm offer of
$56,000 including sales tax wtch would be a savings
to the City inasmuch as if the truck were put to bid,
the Company's bid would be substantially higher than

their present offer. It will take a year to build this
type of truck. On motion of Councilman Brown,_
Culbertson second, the City Council accepted the offer
of the Van Pelt Fire Truck Company for purchase of an
85 -foot aerial platform truck at a total cost of
$56,000.
STATE EMPLOYEES
Nt . Glaves presented the Council with figures and

information prepared by the State Employees' Retirement
SYSTEM
System Board on what it would cost the City to place
its employees under the State Retirement System. He

also explained the transfer of City assets which the

State wanted ,converted to cash. This is expected to
result in a loss.of between $45,000 and $50,000 to the
City. In discussing the plan, Mr. Glaves recommended
that retired employees be included. The State has pre-
pared three alternatives: 1) S.3.R.S. for active
employees only; 2) S.E.R.S, for active employees and
administration of the present City system for retired
employees by S.E.R.S.; and 3) S.E.R.S. for both active
and retired employees. Costs per year, based on the
January 1966 payroll, would be as follows: Alternate 1

- $93,515; Alternate 2 - $96,875; and Alternate 3 -
$110,711. Mr. Glaves cited reasons why S.E.R.S. would
be advantageous to the City. In discussing the pro-
posal to adopt the State Retirement System, the Council
expressed concern over inadequacy of the present City
pension for retired employees. Councilman Walton
moved the adoption of Resolution_ido. 2931 giving
notice of the City's intention to approve a contract
providing for participation in the State Employees'
Retirement System for active and retired employees.
His motion was seconded by Councilman Brown and

A deed to the Thomas J. Carey property at 312 West

Elm Street was presented for acceptance by the Council

to June 30,. 196.6, . City Attorney Mullen and City
Manager Glaves recommended acceptance of the deed. On
motion of Councilman Culbertson, Walton second, the
City Council accepted the deed to the property at
312 lest Elm Street, with Councilman Dow abstaining.

SPECS -
Specifications for the replacement of two trucks for

the Public Works Department were presented. On motion
of Councilman Culbertson, Brown second, the City
Council approved the specifications and authorized
calling for bids for two trucks by unanimous vote.
SPECS -
Nr. Glaves recommended the replacement of a car in

extensive repair work, he feels that it would be more
economical to trade it in at this time. On motion of
Councilman Brown, Dow second, the City Council approved
specifications for a sedan for the Public Works
Department and authorized calling for bids thereon.
PUBLIC :ARKS
Mr. Glaves recommended that the Council establish the
INSPECTOR
classification of Public i]orks Inspector. Because of

the amount of subdivision work going on, a full time
employee is needed plus a car for his use. On motion

On motion of Councilman Dow, Culbertson second, the

WATER The State Department of Water Resources has asked the
RESOURCES City for an exploration permit to conduct surveys on
SURVEY the City's Thornton Road disposal area. This work is
in connection with the Peripheral Canal. On motion
of Councilman Dow, Culbertson second, the Council
authorized Mayor Kirsten to sign the exploration permit
allowing the State to conduct surveys at the disposal
area as requested.
COMPUTERS FOR In connection with the traffic survey being conducted
TRAFFIC SURVEY by Dr. Faustman, an agreement has been prepared which
would permit use of State-owned computers at no cost
RES. NO. 2933 to the City except for furnishing the State Division
ADOPTED of Highways with ten copies of the traffic report.
On motion of Councilman Culbertson, Dow second, the
City Council adopted Resolution ilo. 2933 approving the
agreement with the State Division of Highways and
authorizing its execution by the Piayox.
CITY HALL Kx; Glaves reported that because of the construction
PARKING of the Public Safety Building, parking in the area
will be very limited, and he recommended that the
parking lot east of the City Hall be reserved for
police cars and other City vehicles and remaining stalk
for City Hall business. On motion of Councilman
Culbertson, Dow second, the City Council approved the
recommendation.
PLAQUES FOR i4ayor Kirsten stated that Administrative Assistant
COUNCILMEN Peterson had made arrangements for having plaques made
for retiring councilmen and would need to know how
many should be ordered. The Wayor felt that each
retired councilman should be given a plaque and other
members of the Council agreed. Councilman Brown moved
that twenty-five plaques be purchased. His motion was
seconded by Councilman Walton and carried.

TREES AT Councilman Brown mentioned that Mr. W. C. Hoegerman,

which he wished to plant in the'City's right of way
area in front of his home rathei than liquid ambers
which are preferred by the Public corks Department.
After some discussion, it was decided that Mr. Hoegerma.n
be told that he could plant the ginkos, but that the
City prefers liquid amber.

Councilman Culbertson mentioned having seen photos
PHOTOS
in Turlock's City Hall of mayors who had served that
City which he considered a nice idea and he suggested
that photos be obtained of persons who had served on
Lodi's City Council. Standard type frames could be
used for hanging the pictures in a suitable place in
the City Hall. Councilman Dow suggested the City
i6anager consult the architect on the remodeling of the
Council Chambers concerning this idea.

Councilman Walton asked if anything had been done

towards having a crest made to put on blazers for City

officials, There was some discussion of blazers and
a trine -colored fabric was suggested. The Administrative
Assistant was requested to get information on crests
and blazers which would be distinctive for the City
of Lodi.
