ROLL CALL Present: Councilmen Brown, Culbertson, Walton and Hunnell (Mayor pro tempore) Absent: Mayor Kirsten Also present: Administrative Assistant Peterson and Planning Director Schroeder. MINUTES Minutes of August 2, 1957, were approved as written and mailed on motion of Councilman Walton, Brown second. CON1+IUffICATIa,TS APPEAL RE A letter was received from Victor W. Meyer, on behalf SHADY ACRES of A. Costa, appealing the requirement of the Planning SUBDIVISION Commission that approval of the Tentative Map of Shady TENT. MAP r_cres Subdivision requires the developer to provide REQUIREMENT 6 -foot fencing to shield the City's well site from proposed Lots 20 and 21, such fencing to consist of redwood boards with pipe posts located on continuous concrete curb. the subdivider had agreed to this con- dition without having knowledge of specific design or costs, but since plans have been developed and estimated costs determined,the subdivider is asking the City to share in the costs. Planning Director Schroeder stated that Section 22-9(b) of the Code requires that an appeal shall be filed vrith the City Clerk within 15 days of the action of the Planning Commission and at least 7 days prior to the Council meeting at which it is to be considered. The Planning Commission had con- ditionally approved the tentative map of this subdi- vision on April 24; however, a period of 101 days has elapsed between that time and August 3, 1967, the date Of tit. keyer's appeal. Neyer, being present, stated that it was three to four weeks after the Planning Commission had set the requirements that he had actually determined what type of fence the City required and that the cost would be between $1500 and $16CO. At the time the map was before the Planning Commission he and the subdivider had assumed the cost would be around $450 and had not wanted to hold up approval of the map for such a minor consideration. Vice -Mayor Hunnell stated that first consideration of the Council was whether the appeal should be allowed. Both Councilmen Brown and Culbertson recalled that at the time the report was read to the Council From the Planning Commission regarding the conditions for approval of the Tentative i•Iap of Shady Acres they had had reservations concerning this requirement. Council- man Walton moved that the appeal of A. Costa by Victor Meyer be set for public nearing at the meeting of September 6, 1967. The motion was seconded by Council- man Brown and carried by unanimous vote. Mr. Meyer asked if the motion would permit the subdivider to go ahead with the subdivision providing he put up a bond fox the entire cost of the fence. It was felt that under these circumstances he should be allowed to proceed as he would be complying with present require- ments. Councilman Culbertson moved that the status of Shady Acres not be affected by any future hearing on - 1 - 141 i.;inutes of August 9, 1967 continued the subdivision requirements. The motion was seconded by Councilman Brown and carried. Lyles Co. 115,942.44 - 0 - On motion of Councilman Brown, ;dalton second, the City Council adopted Resolution Ho. 3074 awarding the con- tract for the Ham Lane Stora Drain and Sanitary Sewer to the low bidder, Tompkins and Gallaven for Alternate 1 in the amount of $99,146.53. Goold & Son 11,820.00 Rr7J0MIT1.:idT On motion of Councilman Ualton, Brown second, the City Council adopted Resolution Vo. 3075 awarding the con- tract for the Traffic Signal at :lam and Lodi Avenue to the low bidder, Collins Electrical Company. The Vice-kayor asked For a report on the status of the paving of Ham Lane south of Loci Avenue.
