ROLL CALL Present: Councilmen - BROWN, CULBERTS ON, KIRS TEN, S CHAFFER and HUNNELL (Mayor) Also present: City Manager Glaves, Assistant City Manager Peters on, City Attorney Mullen, and Planning Director Schroeder. PLEDGE Mayor Hunnell led the Pledge of Allegiance to the Flag. MINUTES On motion of Councilman Brown, Kirsten 'second, the Minutes of November 20, 1968 were approved as written, corrected by the City Clerk and mailed. PUBLIC HEARINGS REZONE Notice thereof having been published in accordance with law, AREAS Mayor Hunnell called for the public hearing on the proposal 6 AND 7 to rezone certain parcels zoned R-1, R-3 and R-4 to R -MD and R -HD in areas designated as 6 and 7 by the City INTRODUCED ORD. UCEEDDO. 875 Planning Commission. The following persons asked questions concerning the rezoning: Mr. and Mrs. Bill Cooper, 1012 Woodrow Street Mr. Vencl Tuma, 1020 Woodrow Street Mrs. Edward Heil, 1119 Woodrow Street Mrs. Bill Thompson, 1029 Woodrow Street Mrs. John Bender, 1004 Lloyd Street Diana Baumback, 1020 Woodrow Street Mr. Ronald Edgeton, 700 Delores Street There being no one else wishing to be heard on the matter, the public portion of the hearing was closed. After discussion, the Council, on motion of Councilman Kirsten, Schaffer second, introduced Ordinance No. 875 rezoning Areas 6 and 7 to the R -MI) and R -HD Districts. AMEND ZONING Notice thereof having been published in accordance with ORD. TO PROVIDE law. Mayor Hunnell called for public hearing on the pro - INDUSTRIAL DIST, posal to amend the Zoning Ordinance to provide for three new Industrial Districts (Commercial -Light Industrial,. Light Iridustrial and Heavy Industrial) as recommended by the City Planning Commission. Victor Meyer, 41 South Sacramento Street, spoke in favor of the proposal. There being no others in the audience who wished to speak on the matter, the public portion of the hearing was closed. After discussion, Councilman Kirsten moved the matter be continued to the meeting of December 18, 1966. The motion was seconded by Council- man Brown and carried by unanimous vote. - 1 - 285 Minutes of December 4, 1968, continued PLANNING COMMISSION - OF INTEREST The following actions of the City Planning Commission of interest to the City Council were reported: 1. Approved the tentative map of McDaniels Industrial Park with certain conditions. 2. Denied the request of Mr. Christ Goehring for variances to reduce the required rear yard from 14 feet to 8 feet and increase the lot coverage from 40% to 43.4% at 2138 West Pine Street in an area zoned R-2. 3. Approved the request of Mr. Harold Galster for a variance to add on to one of three detached dwellings at 408 East Oak Street in an area zoned R-4. COMMUNICATIONS CHAMBER RE A"letter was read from the Lodi District Chamber of KETTLEMAN LANE Commerce which stated the Chamber favors the con - GRADE SEPARATION struction of an underpass rather than an overpass at the proposed Kettleman Lane grade separation. BASIN -PARK A letter was read from Victor Meyer of Meyer and LOCATION Baumbach, 41 South Sacramento Street, requesting an opportunity to be heard regarding the location of the City's proposed basin -park; he also requested the Council's determination of City policy regarding offsite improvement bonds. MEYER An appeal was received from Victor Meyer, 41 South APPEAL - RE Sacramento Street, appealing the conditions established McDANIEL IND, by the City Planning Commission for the development of PARK SUBD. McDaniel Industrial Park. Mr. Meyer also requested an opinion by the City Attorney regarding the legality of the conditions imposed on the development of the property. Since the appeal must be filed at least seven days prior to the meeting at which the shatter is considered by Council, the Mayor acknowledged receipt of the appeal and postponed discussion of the matter to the- meeting of December 18, 1968. REPORTS OF THE CITY MANAGER CLAIMS Claims in the amount of $211, 965.30 were approved on motion of Councilman Culbertson, Kirsten second. AMEND ZONING City Manager Glaves stated that with the rezoning of ORD TO ELIMINATE all of the multiple -family residential areas of the City R-3 AND R-4 DIST, into one of the new multiple -family districts', the sections of the Zoning Ordinance providing for R-3 and R-4 Districts become obsolete. He therefore recom- mended that these sections be rescinded. On anotion of Councilman Kirsten, Brown second, the matter was -2 - :e Minutes of December 4, 1968, continued set for public hearing at the meeting of December 16, 1968. CLOSE PORTION The City Manager reported that rec6ntiy the City had WEST WALNUT performed an experiment in coryunction with the Lodi High School in an effort to alleviate excessive noise ORD. NO. 876 created by traffic in the area of the East Campus. He INTRODUCED explained that barrizades were used to close off West Walnut Street between Hutchins Street and South Rose Street between the hours of 11:00 a, m. and 1.00 p. m. , and that School officials had reported that the noise was sufficiently reduced as a result of the experiment. He recommended the Council take action to close the street as above mentioned. Mr. Thomas Bar_delin, Principal, Lodi High School East Campus, spoke in favor of the proposal and expressed thanks to the Council and the Police Department for the cooperation the School had received in this matter. Mr. Corell Smith, 604 West Locust Street, also spoke in favor of the proposal stating there was a safety factor involved as well as the noise problem. Councilman Kirsten moved introduction. of Ordinance No. 676 adding Section. 14-7.2 to the Lodi City Code prohibiting traffic on West Walnut Street between South Hutchins Street and South Rose Street between the hours of 11:00 a, m. and 1:00 p. m. on any day that school is in session. The motion was seconded by Councilman Schaffer and carried by unanimous vote. WHITE SLOUGH City Manager Glaves stated that there is a considerable WPCP - MAINT. amount of instrumentation at the White Slough Water AGREEMENT Pollution Control Plant which requires maintenance. At the present time the City does not have personnel capable of performing this type of maintenance. The supplier of the majority of the instrumentation., Honeywell, Inc. , has agreed to provide this service including emergency calls for an annual iee of $3, 419. 00 the first year and $5, 377. 00 each year thereafter_ The City Manager recommended that a one-year contract with Honeywell, Inc. be approved at this time. He also stated that personnel from the Utility Department will work with the Honeywell people during the first year to determine if it is possible for City personnel to maintain the system thereafter. On motion of Councilman Schaffer, Kirsten second, the City Manager was authorized to execute on behalf of the City the Instrumentation Maintenance Agreement with Honeywell, Inc. ACQUISITION The City Manager requested authorization to proceed with WELL SITE #15 the acquisition of a proposed well site at the corner of Lower Sacramento Road and Turner Road including necessary street improvements, for a price of $4, 000. He explained it will also be necessary to pro-:ide working area off-site when drilling the well and an agreement has - 3 - 287 Minutes of December 4, 1968, continued ADJOURNMENT There being no further business, the Mayor ad;ourned the meeting at 9:45 p. m. The motion was seconded by Councilman Brown and carried unanimously. 1911 IMPROVE- City Manager Gtaves reported that his recommendation MENT ACT regarding use of 1911-1913 Bonding Act for subdivision improvements had not changed from that set forth in his memorandum to the Council dated August 1, 1966. A copy of the memorandum had been forwarded to the Council prior to the meeting. He reported that he had sent a letter to Assemblyman John Knox requesting further information on a proposed bill which would pro- hibit use of assessment bonds for subdivision purposes. After discussion, the Council agreed to continue the matter to the meeting of December 18, 1968. AMBULANCE On motion of Councilman Culbertson, Schaffer second, RATE INCREASE the City Council accepted the proposed rates of the Lodi ACCEPTED Ambulance Service as submitted. RES. RE Mayor Hunnell reported that he had received tetters from BORDER cities in Southern California urging the City of Lodi to CONTROL adopt a resolution urging legislators to control the entrance of minors into Mexico relative to the drug problem in California. The matter was tabled until further information is available on the subject. ORDINANCES REZONE AREAS ORDINANCE NO. 874, entitled "AMENDING THE 3 AND 5 OFFICIAL DISTRICT MAP OF THE CITY OF LODI AND THEREBY REZONING CERTAIN PARCELS ZONED ORD. NO. 874 R-2, R-3, R-4 AND 11/1 -INDUSTRIAL DISTRICTS TO ADOPTED R -GA, R -MD, AND R -HD DISTRICTS LV AREAS DESIG- NATED 3 AND 5, " having been introduced at the meeting of November 20, 1968, was brought up for passage on motion of Councilman Brown, Schaffer second. Second reading was omitted after reading by title, and the ordinance was then passed, adopted and ordered to print by the following vote: Ayes: Councilmen - Brown, Culbertson, Kirsten, Schaffer and Hunneli Noes: Councilmen - None Absent: Councilmen - -None ADJOURNMENT There being no further business, the Mayor ad;ourned the meeting at 9:45 p. m.
