Council- men Brown, Culbertson, Dow, Ullmann and Katzakian (Mayor) present. None absent. Also present: City Manager Glaves, Planning Director Rodgers, No written comments, for or against the proposals, had been received by the City Clerk. The Mayor asked if anyone in the audience for or against the proposals wished to be heard, but there was no response. Mayor Katzakian then closed the hearing to the public and asked for discussion by the Council, an analysis of the proposed amendments having been previously presented in writing to the members of the Council. Councilman Brown questioned the advisability of having only a 1i -foot right of way for street light standards, etc., since the base of a light standard is 2 feet square. The City Attorney said that from a legal viewpoint, City appurtenances should not encroach on private property. Councilman Culbertson said that it has not been too long since the City increased the width from 50 to 55 feet so as to have wider driving lanes. He said that the front yard setbacks had been reduced from 25 to 20 feet and he could see no good reason for reducing the street width also. Planning Director Rodgers explained that the pro- posed collector streets were for through traffic and that the 50 foot residential street right of way which would have a 37 foot paved area would be adequate for the residential traffic. MINUTES Minutes of May 16, 1962 were approved as written and mailed after correcting the roll call as follows; "Councilmen Brown, Dow, Ullmann and Kat2'akian (Mayor) present.Councilman Culbertson absent." PUBLIC HEARINGS SUBDIVISION Notice thereof having been published in accordance ORDINANCE with law, Mayor Katzakian called for public hearing AMENDMENTS on the following changes in the Subdivision Ordinance as recommended by the Planning Commission: ORD. NO. 724 INTRODUCED 1. Provide an alternate procedure for guaran- teeing street and utility installations in subdivisions by authorizing submission of "an instrument of credit" as authorized by new State law. 2. Increase minimum right of way width for expressway from 100 feet to 110 feet. 3. Extend maximum length for cul-de-sac street from 300 feet to 400 feet. 4. Reduce minimum width for residential street from 55 feet to 50 feet. Add provision for a residential collector street with minimum width of 55 feet. No written comments, for or against the proposals, had been received by the City Clerk. Councilman - 1 - 27,1, Minutes of June 6, 1962, continued Dow stated that if there were no significant difference in the safety factor, he would favor reducing the street width. Councilman Culbertson said that the children play in residential streets and that wider streets give more sight distance resulting in greater safety. Mayor Katzakian said that the minimum width had been increased to 55 feet a few years ago and he felt that an additional 5 feet for the subdivider would not make much difference. Councilman Culbertson said that it should be kept in mind that when the residential rights of way were 50 feet the front yard setback lines were 25 feet. Mayor Katzakian said that backing from a driveway into a narrow street could be hazardous because of the danger of backing into parked cars. Councilman Brown moved the intro- duction of Ordinance No. 724 amending Chapter 22 of the Code of the City of Lodi as recommended by the Planning Commission. The motion. was seconded by Councilman Dow. Councilman Culbertson moved that the motion of Councilman Brown be amended by deleting the recommendation of the Planning Com- mission that residential streets be reduced from 55 feet to 50 feet right of way. The motion to amend was seconded by Councilman Ullmann and passed by the following vote: AYES: Councilmen - MR N, CULBERTSON, ULLMANN and KATZAKIAN NOES: Councilmen - DOW cad SKDW14 I Mr. Ted Schneider, 205 S. Crescent Avenue, voiced his objections to the Council's decision, stating that the City may as well not have a Planning Commission since the Council does not follow its recommendations and that a 50 -foot right of way for a residential street would provide plenty of travelled way and parking area. Ordinance No. 724 amending Chapter 22 of the Code of the City of Lodi by providing for the use of an "instrument of credit" as a guarantee for street and utility installations in subdivisions, increas- ing the right of way width for expressway streets from -100 feet to 110 -feet and extending the maxi- mum length for a cul-de-sac street from 300 feet to 400 feet was then introduced by the following votes AYES: Councilmen - BROWN, CULBERTSON, ULLMANN and KATZAKIAN NOES: Councilmen - DOW REZONR514 W. Notice thereof having been published in accordance LOCKEFORD TO with law, the Mayor called for public hearing on C-1. the proposed rezoning from the R-4 multiple family _ residential zone to the C-1 neighborhood commercial dRD. NO. 725 zone of the property at 514 West Lockef ord Street INTRODUCED as recommended by the Planning Commission. There were no objections, written or oral. Mrs. Lillian Maib, owner of the property, stated that the lot was in a business area and next to property in the C-1 zone and that the rezoning was in keeping with the growth of -Lodi. On motion of Councilman Brown, Culbertson second, Ordinance No. 725 rezoning the property at 514 West Lockef ord Street to C-1 was introduced by unanimous vote. REZONE RAY Notice thereof having been published in accordance PROPERTY W with law, Mayor Katzakien called for public hearing OF FAIRMONT on the proposed rezoning of the Maurice Ray prop - TO R-3 erty located between Fairmont Avenue and Ham Lane ORD. NO. 726 extension and between a westerly extension of the INTRODUCED south line of Sylvia Drive and 273 feet south of - 2 - 276 Minutes of June 6, 1962, continued said line from the R-1 single family residential zone to the R-3 limited multiple family residential zone as recommended by the Planning Commission. There were no protests, written or oral. On motion of Councilman Brown, Ullmann second, the City Council introduced Ordinance No. 7-26 rezoning the above mentioned property from R-1 to R-3 by unanimous vote. PARALLEL Mr. Hugh Steacy of Henderson Bros., 21 South PARKING ON Sacramento Street, asked that a petition signed by S. SACRAMENTO merchants along Sacramento Street between Pine and Oak Streets be read. The City Manager read the petition which requested the re-establishment of diagonal parking on the west side of Sacramento Street between Oak and Pine Streets because of added parking space, ease of parking for customers, and ease of loading industrial type vehicles which predominate in this area. Mr. Steacy commented that if the merchants involved had known beforehand that change to parallel parking was being considered, they would have voiced their objections before the change was made as they felt that this section of the street was in an industrial area and that the traffic facilities had been adequate with the diagonal parking. Mr. Francis Miller, 32 South Sacramento -Street, said he had a rear entrance to his store, but had to unload in front of the store. Councilman Culbertson said he had thought most of the merchants had been contacted and wanted to know if there was a record of traffic accidents in this area. The City Manager stated that the Police Department does not maintain a file of such acci- dents as would be caused by diagonal -parking. Mayor Katzakian said that the Council is responsible for traffic safety and that when parallel parking was placed in the downtown area this area would have been included if it had not been for the high curb. Mr. Steacy said the Council was losing eight of the fact that this was an industrial area and that there were no stores on the other side of the street. Councilman Dow stated that the action of the Council was based on the recommendations of the Safety Council and the Police Department which should be reliable. Councilman Culbertson said that he had been under the impression that most of the merchants involved were agreeable to the change and that the Police Department had statistics to back up their recommendation. Councilman Brown felt that the Council should not have considered just the one block, but should have considered the whole street. - Councilman Dow said he regretted the misunderstand--. ing, but felt the Council should sustain its'�aetion which was based on the expert knowledge of the _ Safety Council and.the.Police Department. Council- man Culbertson said the Council should follow - recommendations providing facts are presented on which to.,base a decision. City Manager Glaves stated that having no record of accidents did not mean that they did not happen, and that it was recognized by traffic officials that diagonal parking is undesirable- Councilman Culbertson moved that the matter be held over -to the meeting of June 20, 1962 so as to obtain a factual report from the Police Department and the Safety Council. The motion was seconded by Councilman Brown and carried by the following votez AYES: Councilmen - BROWN, CULBERTSON, DOW and ULLMANN NOES: Councilmen - KATZAKIAN 3 - 2?, Minutes of June 6, 1962, continued PLANNING COMMISSION LAWRENCE The Council was informed that the Planning RANCH NO. 2 Commission had approved the tentative map of TENT. MAP Lawrence Ranch Subdivision, Unit No. 2. REZONING N The Planning Commission recommended the rezoning SIDE OF ELM of the property along the north side of West Elm BTW PLEASANT Street between Church Street and Pleasant Avenue A1fD CHURCH STS. from the C -P commercial -professional office zone to the 0-2 general commercial zone. On motion of Councilman Brown, Culbertson second, the proposed rezoning was set for public hearing on June 20, 1962. COMMUNICATIONS ED ROTH RE A request was received from Ed Roth, Lodi Radio and BLDG. CODE Television Center, 507 South Sacramento Street, for a variance from the requirements of Chapter 5, table 5a of the Uniform Building Code. Mr. Roth operates a radio and television center at his home at the above address and he wishes to construct a carport roof over the parking space in front of the office section of his residence. According to J. Paul McClure, the Chief Building Inspector, the Uniform Building Code requires a masonry fire wall on the property line for this roof. The roof will be all steel and aluminum construction which Mr. Roth feels will not create additional fire hazard. The Building Code does not provide for variances. The Chief Building Inspector, who was in the audience, explained the requirements for a fire wall in the "M" industrial zone, the zone in which the property is located. The Council decided to table the matter to the meeting of June 20, 1962. KESZLER Letter dated May 16, 1962 from William A. Ford on APPEAL behalf of Dr. C. R. Keazler appealing the decision WITHDRAWN of the City Planning Commission denying his request for rezoning a parcel of land at the northwest corner of Fairmont Avenue and Kettleman Lane from R-1 to C-1 was presented to the Council along with a letter from Dr. Keszler dated June 5, 1962 with- drawing his appeal. FAMILY A letter was received froom the Family Service SERVICE Agency stating the Agency would be happy to meet AGENCY with the Council Committee and asking the Council to consider using part of an +18,750' bequest the City had received from Mr. Lee Jones to support the Agency. A tentative meeting between the Council Committee and the Agency was set for Monday, June 11, 1962, at 7:30 P.M. in the City Hall Conference Room. Letters in support of the -Family Service Agency were received from the Lodi Coordinsge Council, the Lodi Union Council P.T.A. and the Leroy Nichols P.T.A. ABC LICENSE Notice was received of the application for alcoholic beverage license, off sale beer and wine, of James Val and Mardee Kidd, Mar -Val Food Stores #5, 429 West Lockeford Street. REPORTS OF THE CITY MANAGER CLAIMS Claims in the amount of 4171,437.72 were approved on motion of Councilman Brown, Culbertson second. - 4 - 2 :� Minutes of June 6, 1962, continued EASEMENTS The City Manager presented two agreements from the FROM CCTCO Central California Traction Company, one for storm FOR STORM, drains and sanitary sewer line and the other for a SANITARY, & water line, all to be installed under the tracks of WATER LINES the Company east of Cherokee Lane. The agreements provide that if the easements are not used within RES. NO. 2542 a year, they will be voided, and the City Manager & NO. 2543 said there was some question as to whether the- ADOPTED installations would be in use within that time. The City Attorney stated that the stipulation of one year was customary in this type of agreement in order to protect the company in the event the easement was never used, but he felt that there would be no problem as far as the City was concerned. The City Manager felt that this matter could be taken care of by letter. Councilman Brown moved the adoption of Resolution No. 2542 authorizing the Mayor to execute an agreement with the Central California Traction Company for easement for storm drains and sanitary lines under the Company's tracks east of Cherokee Lane. The motion was seconded by Councilman Dow and carried by unanimous vote. On motion of Councilman Dow, Culbertson second, the City Council adopted Resolution No. 2543 authorizing the Mayor to a%ecute an agreement with the Central California Traction Company for an easement for installation of a water line under the Company's tracks east of Cherokee Lane. LOADING ZONE The City Manager presented a request from the Lodi REQUEST DENIED Typewriter Company and Colburn's Color Carrousel for a joint loading zone in front of 107 and 109 West Pine Street. The zone would be used primarily for the benefit of customers patronizing these two stores and, in the case of the Typewriter Company, for the convenience of the owner in loading and unloading equipment. The generally accepted use of a loading zone is for commercial vehicles loading and unloading freight shipments. Because of the. need for on -street parking in this area, the Engineering Department recommended that the request be denied., The Council appreciated the problem which these two stores had, but felt that other businesses had the same problem and that zones could not be provided for all. On motion of Councilman Culbertson, Brown second, the City Council denied the request of the Color Carrousel and -Lodi Typewriter Company for a loading zone by unanimous vote. ELK ST BTW City Manager Glaves reported that the current PACIFIC & HAM budget provided for $1,000 for a 24 -foot base on Elm Street between Pacific Avenue -and Ham Lane. The Engineering Department has re -estimated this projsct and found that the cost will be approxi- mately x1,400 primarily because of the quantity of dirt that must be removed. The Department has also estimated the cost of putting in a 44 -foot base to be 32,500; putting the 44 -foot base in would save a second move -in by the crews. The City Manager did not recommend placing the 44 -foot base at this time. After discussion by the Council, Councilman Culbertson moved that an additional ;1500 be appropriated for installation -of a 44 -foot base on Elm Street between Pacific and Ham. The motion was seconded by Councilman Ullmana and carried, Council- man Dow abstaining from voting because of possible remote personal interest. - 5 - 276 Minutes of June 6, 1962, continued SPECS - The City Manager presented specifications for an AERIAL TOWER aerial tower to be used for tree trimming; the tower would also be used by other departments. Councilman Culbertson moved that the specifications for the aerial tower be approved and call for bids authorized. The motion was seconded by Councilman Dow and carried. A.TEICHERT A request had been received from A. Teichert & Fron TIMI EXTENSION for extension of time on their contract for con- struction of Freeway Utilities which has been delayed because of the strike action of the Laborers Union. Under the circumstances the City Manager feels that the extension of time is justified. Councilman Brown moved that the extension of time be granted for the length of time of the strike. The motion was seconded by Councilman Ullmann and carried. SAFETY The City Manager stated that he had received a COUNCIL copy of a letter from the Lodi District Safety ENDORSEMENT Council to the State Highway Commission endorsing full expressway status for Highway 99 between Lodi and Stockton. W;TER.COMM. The City Manager said he had also received a notice MEETING of a special meeting of the Advisory Water Commission of the San Joaquin County Flood Control and Water Conservation District being held June 6, 1962, 7130 p.m. in Stockton. BEgUEST OF Mr. Glaves reported that the City had received MR. LEE JONES $18,750 as preliminary distribution of the City's portion of the bequest of the late Lee Jones. Mayor Katzakian stated that it was hard to express the appreciation of the City for this welcome contribution which he hoped the City would use in memory of Mr. Jones. CITIZENS' COM- Councilman Culbertson said he wished to publicly MITTtE THANKED thank the Citizens' Committee for the tremendous effort they had put forth in trying to put over the bond issue. RAY BENDER Councilman Culbertson also expressed his appreciation C.OMM.ENDED of the beautiful work being done by the City's Parks Gardener,Ray Bender, at the City Hall and Lodi Lake Park, and complimented him for a fine job. 1962-63 Copies of the operating budget had been presented BUDGET to the Council prior to the meeting, but the City Manager apologized for not having the written report thereon ready for the Council. The budget had been delayed because of the bond election, 'dnd the results thereof required .review of the work program. Mr. Glaves said he hoped to have a report on the budget and the City's fiscal status within a week.
