Councilmen Brown, Culbertson, Dow, Ullmann and Katzakian (Mayor) present. None absent. Also presents City Manager Glaves, Administrative Assistant Carlton, Planning Director Rodgers (arrived 8s05 p.m'.) and City Attorney Mullen. MINUTES The minutes of May 29 1962 were approved as written and mailed on motion of Councilman Brown, Dow second. PLANNING COMMISSION WEST LANE The San Joaquin County Planning Commission will REALIGNMENT hold a public hearing on May 17, 1962 to consider a precise plan for West Lane from Kettleman Lane to the Calaveras River. This precise plan proposes a realignment of West Lane in the area between Eight Mile Road and Armstrong Road which will eliminate the jogs in West Lane at these points and West Lane will continue to enter the Lodi area at Hutchins Street. The plan also proposes an ultimate widening of the right of way to 110 feet with limited access provisions. The Lodi Planning Commission has recommended to the County Planning Commission that.this precise plan for West Lane be adopted and also recommended that a similar precise plan be developed and adopted for a route which would enter the Lodi area at Ham Lane. PC ACTIONS The Planning Commission took the following actions at its meeting of May 14, 1962: 1. Denied the request of Dr. C. R. Keszler for a change of zoning from the R_1 resi- dential zone to the C-1 commercial zone for a one-half acre parcel of land located at the northwest corner of Kettleman Lane. and Fairmont Avenue. 2. Approved the revised Map No. 2 of the Loma Court Subdivision, subject to certain design conditions. 3- Approved a zoning variance to permit the creation of a single substandard lot in the Loma Court Subdivision because of a hardship in the development of the Sub- division. REZONING OF The Planning Commission recommends that the prop - 514 W. arty at 514 West Lockeford Street be changed from LOCKEFORD the R-4 multiple family residential zone to the C-1 neighborhood commercial zone. On motion of Councilman Brown, Ullmann second, the matter was set for public hearing on June 6, 1962. REZONING BTW The Planning Commission also recommends the HAM & FAIRMONT rezoning from the R-1 single family residential S OF SYLVIA E(T.zone to the R-3 limited multiple family residential - 1 - 2?O Minutes of May 16, 1962, continued zone for property located between Fairmont Avenue and Ham Lane extension and between a westerly extension of the south line of Sylvia Drive and a line 273.feet south of said south line of Sylvia Drive. The matter was set for public hearing on June 6, 1962 on motion of Councilman Dow, Brown second. COMMUNICATIONS FAMILY A letter was read from the Lawrence School P.T.A. SERVICE stating that the City of Lodi needs the type of AGENCY service given by the Family Service Agency and urging that the Agency be continued. kThe Agency has been receiving Federal funds but this is being discontinued so funds must be obtained elsewhere if the Agency is to continue.) A communication on the same subject was received from the Lodi Council of Churches which requested that the City undertake the major support of the Family Service Agency and asking that discussion of this matter be had in an open meeting. Mayor Katzakian said that evidently there was some misunderstanding on the part of some -of the public regarding hearings before the Council as any matter may be brought before the Council during the public hearings at each meeting without prior request. It was felt that representatives of the City should meet with the Family Service Agency to learn more about the Agency before the Council makes a decision. The Mayor appointed the following committee to meet with the Agencys Councilman Dow, City Manager Glaves, City Attorney Mullen and Mayor Katzakian. SAFETY A letter was read from the Lodi District Safety COUNCIL RE Council thanking the City Council for its recent PARALLEL & action in changing the angle parking on Sacramento ANGLE PARKING Street between Oak and Pine Street to parallel parking and urging the City to consider similar changes in other downtown areas where angle parking is presently being used. PARALLEL A letter protesting the establishment of parallel PARKING ON parking on the west side of Sacramento Street S. SACRAMENTO between Pine and Oak Streets was then read. It had been signed by the followings Henderson Bros., Tolliver Printing Company, Biller Floor Covering, Cluff-Atkineon Floor Company, A-1 Upholstery, David Melcher, James L. Gleeson, Wm. Bauer, M. F. Robertson and Lester A. Lind. They requested to be heard on this subject at the meeting of June 6. Mayor Katzakian restated that people can appear at any meeting to be heard. ABC LICENSES The following notices of application for alcoholic beverage licenses were receiveds .1. On Sale Beer and Wine, for Henrietta and Terry Mulka,.Isle of Capri, 5 East Elm Street. 2. On Sale Beer and Wine, Sandra L. and William R. -Pratt, Lodi E1 Rancho, 621 North Cherokee Lane. REPORTS OF THE CITY MANAGER CLAIMS Claims in the amount of $167,408.41 were approved on motion of Councilman Brown, Ullmann second. Minutes of May 16, 1962, continued 2 DRIVEWAY - The Bethel Church located at the southwest corner BETHEL CHURCH of Locust and Church Streets has requested that two driveways on Locust Street be combined to form one driveway. At present there is approximately - one foot between the two driveways which, if com- bined, would make one driveway of approximately 27 feet. The Department of Public Works recommends that the request be granted. Councilman Brown moved that the request of the Bethel Church for the combining of two driveways to make one 27 -foot driveway be granted, it being understood that all costs thereof are to be borne by the Church. Motion was seconded by Councilman Dow and carried. TREE, CURB The City Manager stated that four alternative plans & GUTTER ON had been presented to property owners on the north LOCUST ST. side of Locust Street between Crescent Avenue and California Street regarding the curb, gutter and sidewalk problem caused by the sycamore trees in this area. The majority of the property owners prefer Alternate Plan 2 which provides for the retention of the trees by widening the planting strip by reconstructing the curb and gutter two feet south of the existing curb and gutter and the sidewalk two feet north of the existing sidewalk. The other plans called for removal of the trees and planting of new trees. Alternate Plan 2 would narrow the street from 40 to 38 feet; however, this street is considered a residential street so the narrower width should not be objectionable. The cost of replacing the curb and gutter would be borne by the City and the cost of the sidewalk by the individual prop.erty owners. The two prop - arty owners who did not approve the plan have no sidewalk problem so it will not be necessary to replace their sidewalk. Right of way will have to be obtained from the other property owners in order to replace the balance of the sidewalk two feet north of the existing sidewalk. Councilman Brown moved that Alternate Plan No. 2 be approved as presented. The motion was seconded by Councilman Ullmann and carried. AUGUST METTLER The City Manager reported that he had investigated REFUND REQUEST the request of Mr. August Mettler, 1306 South Lee Street, for refund on overcharge of garbage rates since July 1957. The Finance Department had - refunded Mr. Mettler the overcharge for .the pre- ceding year in accordance with established policy of the City. However, Mr. Mettler felt entitled to further refund so had sent his request to the Council. The City Manager explained that the customer has a joint responsibility in keeping his account correct and should have notified the City before this time; also, the City has no way of verifying such claims. Councilman Ullmann moved that the policy of the City to refund on erroneous accounts for the preceding twelve months only be reaffirmed and that the request of August Mettler for additional refund be denied. The motion was seconded by Councilman Brown and carried. KETTLEMAN LANE Mr. Glaves presented a deed from A. W. Andrevs, RIGHT OF WAY C. V. Christensen, at al, for 5-1 feet of right of DEED way along Kettleman Lane at the northeast corner of Kettleman and School Street being the site of the Signal Oil Company service station. The deed - 3 - Z72 Minutes of May 16, 1962, continued was delivered with the understanding that no structures would encroach upon the area being conveyed by said deed. On motion of Councilman Brown, Dow second, the City Council accepted the deed from C. V. Christensen, et al, for Kettleman Lane right of way as presented. CRESCENT AVE. A deed from the Keszler Building Fund for Crescent S OF LODI AVE. Avenue south of Lodi Avenue was presented for DEED ACCEPTED Council acceptance. The street had been improved by Dr. Keszler and the public had been using it for the past five years. When the property had.' been purchased by the Keszler Building Fund, 57 feet hid been reserved by Mr. S. W. Allison who has been paying the taxes on this 57 feet. Mr. Allison is unwilling to deed this to the City with- out some compensation for the taxes, but the City has no liability in this regard. The City Atto=eyt opinion is that Mr. Allison no longer has good title to the property. The City Manager and City Attorney recommended that the deed be accepted. On motion of Councilman Brown, Dow second, the City Council accepted.the deed from the Keszler Building Fund for Crescent Avenue south of Lodi Avenue, including 10i -foot right of way along Lodi Avenue. AGREEIPIENT RE The City recently granted the United States an CROP DAMAGE easement over the City's 303 acres for the erection AT 303 ACRES of an electric transmission line and the United States agreed to pay the City for any damages RES. NO. 2540 caused to crops growing in this easement. The ADOPTED Bureau of Reclamation was now requesting that the City execute a subordination agreement whereby the City would agree to assign to the lessee of the 303 acres all the compensation which the City might receive from the Federal Government for damage to crops. Councilman Brown moved the adoption of Resolution No. 2540 authorizing the Mayor to execute the subordination agreement as presented. The motion was seconded by Councilman Ullmann and carried. OUTSIDE City Manager Glaves submitted a letter from Raymond UTILITY Taylor, 604 North Loma Drive, requesting temporary - SERVICE ON utility connections to his property with the under - N. LOMA DR. standing that the property will be annexed to the City as soon as possible. Councilman Dow movect that the request of Mr. Taylor for utility con- nections be granted with the conditions stipulated in the letter. Motion was seconded by Councilman Ullmann and carried. WEST LANE - Mr. Glaves stated that the County of San Joaquin FEDERAL AID was preparing an application for the addition of West Lane Road to the Federal Aid Secondary System RES. N0. 2541 so that it could qualify for Federal funds. In ADOPTED order to complete the application the County required City concurrence on that portion of the road within the City Limits. A map of the route was presented. Councilman Brown moved the.adoptton of Resolution No. 2541 approving the route desig- nation of West Lane within the City Limits assn addition to the Federal Aid Secondary System. The motion was seconded by Councilman Ullmann and carried. - " - G%t Minutes of May 16, 1962, continued POPULATION The City Manager reported that notice had been ESTIMATE received from the State Department of Finance that work on the population estimate for the City of Lodi had been completed and that a population of .24,350 persons is being certified as the official population estimate as of April 1, 1962. He stated -- that this would mean an additional amount of around $6,000 in State subventions for the coming fiscal year. Mr. Glaves felt it.would be worthwhile to have a population estimate made annually. RECONSTRUCTION The City Manager stated he had received a .OF W.,LOCKEFORD memorandum from the Director of Public Works AND SANITARY regarding the reconstruction of West Lookeford SEWER LINE Street. Since the sanitary sewer line in this street..is very close to the.surface, it would be impossible to properly compact the street without crushing portions of the sewer line. The only solution appears to be to replace the line and since it is being requested that the budget provide for the installation of a sanitary sewer line in Locust Street, the Director of Public Works is recommending, that the line proposed for Locust Street be transferred to Lockeford Street, thus replacing the Lockeford Street line with a deeper line. Such action would delay the work until after the beginning of the next fiscal year, but the Director of Public Works would like to get approval to proceed with plans for such a project. Members, of the Council agreed to this solution of the problem, and on motion of Councilman Dow, Brown second, approved the installation of a sanitary sewer line in Lockeford Street as pro- posed and authorized the Department of Public Works to proceed with plans and specifications therefor.
