A regular meeting of the City Council of the City of Lodi was
?� held beginning at $:00 p.m. of Wednesday, April 4, 1962. Council-
men Brown, Katzakian, Mitchell, Ullmann and Culbertson (Mayor)

PLANITING COMMISSION
MILLS AVENUE City Manager Glaves read the memorandum from the
RE-ALIGNMEit^1 Planning Commission recommending that Mills Avenue
between Tokay Street and Vine Street be re -aligned
to the west as proposed by the property owner.
Such re -alignment Vould place the street adjacent
to the proposed 50 -foot right of way for storm
drainage ditch. The property owner would dedicate
and improve the west side of Mills Avenue at such
time the City might require it, but stipulates
that the City install and maintain landscaping and
screening area between the street and the ditch.
Mr. Glares pointed out that a precedent would be
set which would affect future subdivisions to the
south and/or adjacent to the WID canal; if the
City were to provide and maintain a landscaped
area, there would be the question of benefit to
the public. There is also the problem concerning
the eventual alignment of Mills Avenue to the
south through property that is not being presently
subdivided. Mr. Reuben Rott, representing the
property owner, Mrs. Ida L. Hutchins, stated that
the re -alignment next to the drainage ditch right
of way was needed in order to provide for the
adequate development of the property in accordance
with the standards established in Hutchins -Sunset
Park. The Woods School District has selected a
school site in the property to be developed and
Mr. Rott feels that it would be preferable to have
Mills Avenue adjacent to the drainage ditch right
of -way rather than to have lots rearing on the
ditch and facing the school. He is of the opinion -
that lots across from a school are greatly depreci-
ated in value. Councilman Katzakian stated that
he had checked with F.H.A. and that lots rearing
on a ditch were more desirable than lots which
would be facing a ditch. He said he would like to
see preliminary plans of the subdivision. In
answer to query, Dr. Chris Keszler said he had no
problem selling lots rearing on the W.I.D. canal
in his subdivision. There was further discussion
concerning the desirability of having lots rear to
the ditch and facing school grounds. Councilman
Brown moved that the matter be postponed to the
meeting of April 17, 1962, so that an over-all plan
which would show the location of Mills Avenue could

construction of a redwood fence. Plans for the
fence, as requested and approved by the F.H.A.,
were submitted with the letter. The City Manager
read a report from the Planning Director which
stated that the Planning Commission had specified
a six-foot chain link fence with redwood lath
inserted or a solid masonry'wall of the same height.
The purpose in specifying this type of fence had
been to insure that a permanent fence would be
installed. The question to whether the fence pro-
posed by Dr. Xeszler is an adequate substitute
for the two alternatives originally required.
After discussing the requirements of F.H.A.'and
the proposed specifications, the Council agreed
that the proposed fence was an adequate substitute
for the type of fence originally required, and on
motion of Councilman Katzakian, Mitchell second,
the Council approved the specifications for a red-
wood fence as presented by Dr. Xeszler.

WALL APPEAL A communication was read from Edwin F. Nail
RE USE PERHIT appealing the decision of the Planning Commission
denying their request for a Use Permit to operate
a one -operator beauty salon at 612 11. Lockeford
Street in the R-3 multiple family residence zone.
The appeal was set for public hearing on April 17,
1962, on motion of Councilman Brown, Mitchell
second.
REPORTS 0„ THS CITY HADAGER
CLAIMS Claims in the amount of 113,403.97 were approved
on motion of Councilman Brown, Ullmann second.
DRIVDIAY AT A request teas presented from Mr. Al Dais for a
601 S. HUTCHIUS 25 -foot driveway to serve a fourplex at 801 South
Hutchins Street. The City Manager recommended
that the request be granted. On motion of Council-
nan Brown, Xatzakian second, the Council approved
the installation of a 25 -foot driveway at 801
South Lutchine Street.
ELECTRIC The City Ifanager reviewed the supplemental report
DISTRIBUTION on the City's Electrical Distribution System
SYSTEM which had been prepared by Rogers Zngineering
Company. The City Manager had considered it
expedient to get a supplemental report because of
the accelerated load growth over the past two
years. :logers Engineering is recommending that
the changeover to 60 ICV be started as soon as the
12 ICV changeover is completed rather than waiting
until 1969 as originally planned, which means that
the money to finance this project will have to be
provided sooner than expected. This will call for
an increase in the amount of funds being set aside
in the Utility Outlay Reserve Fund. The Council
discussed the need for faster expansion of the
electric distribution system and the amount of
funds that would be required. Councilman 3rown
moved that the matter be tabled until budget time.
The motion was seconded by Councilman Mitchell and
carried.
CAPITAL OUTLAY The Council then proceeded to consider theitems in
PROGRAM the Capital Outlay Program as a preliminary to
calling for a special bond election. The City

to include a hall of justice and fire station
building. There were no remarks from the audience.
The members of the Council were agreed that this
item should be included in a bond election.
STORM The City Manager explained the City's drainage
DRAIITAGE problem and reviewed the Cityls master storm drain-
age plan. Mr. Roy heaver, 1149 Ii. Eldorado Street,
Stockton, representing the Protective Landowners
group, stated that facts on the City's proposal
were somewhat lacking, preliminary plans were not
available concerning the proposed storm drainage
ditch, that the. cost estimates were not valid, and
that there was not enough information regarding
the plan on which a bond issue could be based.- HA
read a memorandum from Clinton Henning, Consulting
Engineer, who had reviewed the City's master
drainage plan at the request of the Protective
Landowners and recommended (1) that the City Council
visit cities in the Central Valley area to inspect
storm drainage systems, including open ditches;
(2) that the City ascertain the present and reason-
able future storm drainage requirements for the

next ten years; (3) that the City instruct its
engineers to prepare preliminary plans, outline
specifications and preliminary cost estimates for
facilities necessary to provide adequate storm
drainage without resorting to the use of open
ditches; and make specific recommendations as to
the contents of the plans. It was explained that
at least six alternatives have been studied by
Wilsey and 'nam and all involved economic or legal
disadvantages which precluded serious consideration.
It was pointed out that the City had adopted the
Master Storm Drainage plans prepared by Wilsey and
Ham in May of 1959 and that opponents of the pro-
posed ditch were then told of the plans and
invited to advise the City of any reasonable
alternatives to the City's plans, but they have
delayed until the eleventh hour. Mr. Henning was
asked if he knew of a better way of solving the -
City's drainage problem. He stated that he recog-
nized the City's plan as the most economic method
of taking care of its ultimate drainage needs, but
his clients did not hire him to solve the City's
problems. He also questioned the estimate for the
ditch construction cost as being too low, and
stated that the cost of poured -in-place pipe was
only slightly higher than the cost of ditch con-
struction. His estimate on poured -in-place pipe
was questioned for accuracy by Councilman Brown
and Director of Public Vorks Heckenllible. Mr.
Elmer Reiswig, Box 23, Lodi, objected to not knowing
where the ditch was going. It was pointed out that
approximate locations had been designated, but that
the City could not spend j150,000 for engineering
plans before the citizens had approved the project.
The Council then discussed at length the -design of
the proposed ditch, the use of poured -in-place
pipe, costs, etc. A Mr. Neely from Stockton
representing a client in Oakland wanted to know
the exact location of the ditch and was told that
the exact location would not be known until an
engineering study was made. Councilman Xatzakian
moved that the Council finds that no facts or plans
have been presented which would provide for storm
drainage in a more economical manner than the City's
Master Storm Drainage Plan and therefore the said
plan be retained as part of the Capital Outlay
Program. The motion was seconded by Councilman
Mitchell and carried unanimously.
The City Manager then reviewed the program for
street improvements, water system improvements, -
sanitary sewer system improvements, park and recre-
ation facilities, corporation yard, and fire
station and alarm system.
LIBRARY The Council then considered expansion of the
library which the Citizens' Committee for Lodi had
recommended be postponed --until 1966. Mr. A. W.
Marquardt, 700 Palm Avenue, spoke in favor of
placing the library improvement before the voters
at this time. Mrs. Esther Lund, 713 Howard Street,
Chairman of the Citizens'.'Committee on Public
Facilities, gave the reasons why the committee had
advocated postponing the library improvements to
1968. Members of the Council felt that the citizens
should be given the opportunity to vote on the
library along with the other capital improvements.
Councilman Brown moved that the library be placed

on the ballot. Motion was seconded by Councilman
Katz akian. IIr. Jake Rietz, 946 South Central
Avenue, member of the Citizens' Committee, said
the committ3e had studied the library facilities
and reported the way they saw it, but it was all
right if the Council saw otherwise. Mr. Robert
Mertz, Chairman of tie Citizens' Committee, stated
that the people on the committees had worked hard
and he felt their opinions were reasonsd and well
thought out, but they would be willing to go along
with the Council's decision. The motion to place
tae library on the ballot for a special bond
election passed by unanimous vote.

of the municipal water system of the City of Lodi.

storage buildings, equipment sheds and other facilities for the
care, custody and operation of city -owned equipment and materials
storage and parking areas, paving, surfacing, yard lighting,
fencing, storm drains and other site improvements; water, gas
and electrical facilities; lands, easements and rights of way;
and other works, property or structures necessary or convenient
for a corporation yard for the City of Lodi.

ments, including construction of new fire station together with
furniture, fixtures and equipment therefor; new city-wide fire
alarm system; lands, easements and rights of way; and other
works, property or structures necessary or convenient for fire
department improvements for the City of Lodi.

other storage areas, reading and conference rooms and reference
and staff facilities; furniture, fixtures and equipment; site

Section 2. That the acquisition, construction and completion
of said municipal improvements, and each of them, are necessary and

Section 2. The Board of Supervisors of the County is
hereby requested to order the consolidation of said special
municipal bond election with said primary election to be held on
TUESDAY, JUNE 5, 1962, insofar as the City is concerned, and to
further provide that within the territory affected by said order
of consolidation, to wit, the City, the election precincts,
polling places and voting booths shall in every case be the same,
and there shall be only one set of election officers in each of
said precincts. Said measures for incurring bonded indebtedness
hereinabove set forth shall be set forth in each form of ballot
to be used at said election insofar as the same is held within
the City. Said Board of Supervisors of the County is further
requested to order the County Clerk of the County (i) to set forth
on all sample ballots relating to said consolidated elections, to
be mailed to the qualified electors of the City, said measures
hereinabove set forth, and to mail with said sample ballots to
said electors printed copies of arguments (if any) for and against
said measures, and each of them, and (ii) to provide absent voter
ballots for said primary election and said special municipal bond
election consolidated therewith for use by qualified electors of
the City who are entitled thereto, in the manner provided by law.
Section 3. Said Board of Supervisors of the County is hereby
further authorized to canvass, or cause to be canvassed, as pro-
vided by law, the returns of said special municipal bond election
with respect to the votes cast on each of said measures and to
certify such canvass of the votes cast for and against each of
said measures to the Council.
Section 4. The City Clerk is hereby authorized and directed
to certify to the due adoption of this resolution and to transmit
a copy hereof so certified to the Board of Supervisors of the
County and to file a copy hereof so certified with the County Clerk
of the County.
