HomeMy WebLinkAboutMinutes - December 17, 1969 (4)475 CITY COUNCIL, CITY OF LODI CITY HALL COUNCIL CHAMBERS DECEMBER i7, 1969 A regular meeting of the City Council of the City of Lodi was held beginning at 8:00 p.m. on Wednesday, December 17, 1969 in the City Hall Council Chambers. ROLL CALL Present: Councilmen - BROWN, CULBERTSON, HUNNELL and SCHAFFER (Mayor pro tempore) Absent: Councilman - KIRSTEN (Mayor) Also present: City Manager Glaves, Assistant City vlanager Peterson, Assistant City Attorney Sullivan, Planning Director Schroeder and Public Works Director Jones. PLEDGE Vice %Iayor Schaffer led t:ie Pledge of Allegiance to the flag. MINUTES On motion of Councilman Hunnell, Schaffer second, the Minutes of December 3, 1969 were approved as written and mailed. PUBLIC HEARIINGS CAPELL MANOR Notice thereof having been published and posted in STREET LIGHTS accordance with law-, Vice Mayor Schaffer called for hearing on the proposed formation of the Capell Manor RES. NO. 3328 Street Lighting District. City vlanager Glaves explained NO. 3329, NO.3330 that under the 1911 Improvement Act, proceedings had been AND NO. 3331 initiated by the property owners who had presented a petition for the lights signed by owners of more than sixty percent of the :rout footage in the proposed district. There were no persons present who wished to speak on the matter and the public portion of the hearing was closed. Councilman Brown moved adoption of Resolution No. 3328 overruling protests on the Capell Manor Street Lighting District. The motion was seconded by Councilman Hunnell and carried. Councilman_ Hunnell moved adoption of Resolution No. 3329 adopting the scale of prevailing wage rates. The motion was seconded by Councilman Brown and carried. On motion of Councilman Culbertson, Hunnell second, the Council then adopted Resolution No. 3330 ordering the work to be done. Councilman Culbertson then moved adoption of Resolution No. 3331 directing that the assessment be prepared for the Capell Manor Street Lighting District. The motion was seconded by Councilman Hunnell and carried. Councilman Brown then stated that he had been informed the subdivider had installed conduit in this subdivision at the time it was developed. The Council requested the staff to determine if the conduit had been installed in the subdivision and to report back on the matter at the next meeting. M! 476 Minutes of December 17, 1969 continued TRAFFIC - Mr. Williar= Gretsinger, 904 West Turner Road, spoke, HANI & TURiITER stating he felt there was a traffic hazard at the corner of Ham Lane and Turner Road. He explained that several accidents had occurred in that area and he felt= — that Ham Lane should be widened to correct the pro' -t^ n. EMERGENCY Mr. Gretsinger also suggested that the City try to sim�lify PHONE NUMBERS the telephone numbers for emergency calls to both police and fire departments. GRAPE BOWL - Mr. Eugene McQueen, 1328 South Sacramento Street, MOTORCYCLE representing the Port of Stockton Motorcycle Club, RACING DENIED requested the Council to permit the Club to use the Lodi Grape Bowl for motorcycle races. Mr. Ken McGuire, 12691 Munday Lane, presented a peti- tion bearing seventy-six signatures in favor of the request. City Manager Glaves explained that representatives of the Port of Stockton Motorcycle Club had appeared before the Recreation and Parks Commission requesting permission for the .:se of the Grape Bowl. The Commission had denied the request. The Council discussed the request and asked questions of Mr. McQueen. Councilman Brown moved the request of the Motorcycle Club for use of the Grape Bowl be denied. The motion was seconded by Councilman Hun; ell and carried by the folloro ing vote: Ayes: Councilmen - Brown, Hunnell and Schaffer Noes: Councilman - Culbertson Absent; Councilman - Kirsten (Mayor) Councilman Culbertson then explained that he voted against the motion because he felt a public hearing should be held before the Council made a decision on the matter. PLANNING COMMISSION The City Manager gave the following report of the City Planning Commission meeting of December 8, 1969: REZONING - The Planning Comr-nission recommended approval of the PREZONING following rezoning and prezoning request of Mr. T. J. HAL LINA. i Hallinan: PROPERTY a. The rezoning of a parcel located at the southwest corner of the U.S. 50-99 Freeway and the Mokelumne River (i. e.. The 64th Addition to the City of Lodi) from the M-2. Heavy Industrial District to the C-2, General Commercial District; b. The prezoning of a parcel on the east side of North Cherokee Lane, 414 feet north of East Lockeford Street (i. e. , that portion of the Hallinan Addition to the City of Lodi located west of the U.S. 50-99 Freeway) from the 1 -PA, Interim -Protective Agricul- tural District to the C-2, General -Commercial District. -2- 477 Minutes of December 17. 1969 continued C. The prezoning of portions o_ Lots 44 43, 47, 48 and 49 of the Lawrence Homestead Addition (i. e. , the southerly 446 feet of that portion of the Hallinan _. Addition to the City of Lodi lying easterly of the U.S. 30-99 Freeway) from tie I -PA, Interim - Protective Agricultural District to the M-2, Heavy Industrial District; d. The prezoning of portions of Lots 40, 4i, 42, 43 an -i 44 of the Lawrence Homestead Addition (i. e. , the area northerly of the southerly 446 feet of the Hallinan Addition to the City of Lodi lying easterly of the U.S. 30-99 Freeway) from the I -PA, Interim -Protective Agricultural District to the C-2, General- Commer -ial District. The matter was set for public hearing on January 7, 1970 on motion of Councilman Hunnell. Brown second. Councilman, Culbertson abstained from the discussion and voting because of a possible conflict of interest. SPECIFIC PLAN - The Planning Commission recommended an amended ver - N. ST`OCKTON ST. sion of the Specific Plan for North Stockton Street between Turner Road and Lawrence Avenue which moved the centerline ten feet westerly between Lawrence Avenue and the north line of the parcel being obtained from the Hallinan Family and which affects only properties owned by the City of Lodi. (The revised plan had been for- warded to the Recreation and Parks Commission for consideration.) OF INTEREST The Planning Commission also took the following actions of interest to the City Council: 1. Instructed the Planning Director to conduct research concerning ordinance controlling the development of Mobile Home Parks and the building of structures within the Flood Plain of the \,!okelumne River. 2. Recommend that the City Staff prepare data concerning a solution of the house numbering problem on Turner Road. 3. Recommended the approval of the County Referral of the request of the Carpenters' union Local 41418 to establish a Carpenters' Local Meeting and Hiring Hall in an existing commercial building at the northwest corner of Taylor Road and Lower Sacramento Road in an area zoned I -PA, Interim -Protective Agricultural. COMMUNICATIONS HEALTH The City 4lanager presented a tetter from the San Joaquin DISTRICT Local Health D --strict which stated the Health District had arranged for public rabies vaccination clinics throughout the County during the month of January, 1970. -3- Minutes of December 17, 1969 continued CIR A letter was noted from the California Council on Inter- governmental Relations which requested comments from City and County officials concerning current regional boundaries. RESOLUTION OF Vice Mayor Schaffer read a letter received from Richard APPRECIATION Doty, Lodi News -Sentinel reporter, in which he stated R. DO TY he would be leaving the Lodi News -Sentinel staff shortly and he wished to thank the Council and City staff for the courtesies shown to him. On motion of Councilman Culbertson, Brown second, the City Council adopted a Resolution of Appreciation on be- half of the fine job ,,Ir. Doty- has done in reporting City news. LEAGUE Annual appointments to committees of the League of APPOINTMENTS California Cities were noted as follows: Revenue and Taxation - .Mayor Kirsten Sister City- - Councilman Culbertson Transportation - Councilman Schaffer REPORTS OF THE CITY .yl_�N 1GER CLALv1S Claims in the amount of 3153, 234.23 were approved on motion of Councilman Brown, Culbertson second. S. P. CO. An agreement with Southern Pacific Company was pre - AGREEMENT sented for Council approval. The agreement would permit the City's water line crossing under the RES. NO. 3332 Company's tracks or. Cherokee Lane. On motion of Councilman Brown, Hunnell second, the Council adopted Resolution_ No. 3332 authorizing the Vice -Mayor to execute the agreement on behalf of the City. COUNTY City Manager Glaves presented the agreement with the ELECTION County of San Joaquin for its services for the 1970 SERVICES Municipal Election. On motion of Councilman Culbertson, Hunnell second, the Council adopted Resolution No. 3333 RES. NO. 3333 authorizing execution of the agreement with the County. SPECS - AUTO On motion of Councilman Brown. Culbertson second, the Council approved specifications for an automobile for the Fire Department and authorized advertising for bids thereon. BASEBALL The City Manager presented a lease and concession AGREEMENT agreement between the San Diego Padres and the City of Lodi for the rental of Lawrence Park Baseball Stadium and the concession stand. After discussion, Councilman Hunnell moved. Culbertson second, approval of the lease and concession agreement and authorized its execution. The Council then directed the City Manager to work with the Recreation and Parks Director to provide an agree- ment whereby any monies owing the City from last year's -4- 4?9 Minutes of December 1+. 1969 continued baseball c_ntra t. ....ht be recovered. BUILDING The Council revievaed the report prepared by the Public PERMIT-' FEE '.Yorks Director concern_ng comparative building permit STUDY policies. Conies of the re?ort had been received by the Council prier to the meeting. the Council commended Public Works Director Shelley Jones on the report. They agreed that policies concerning building permit fees -Would be a good t --p,-,- for d.scussior- at a future Cities and County meeting.
