CITY HALL COUNCIL CHAMBERS
NOVEMBER 5, 1969
A regular meeting of the City Council of the City of Lodi was held beginning
at 8:00 p, m. on Wednesday, November 5, 1969 in the City Hatt Council
Chambers.
ROLL CALL Present: Councilmen - BROWN, CULBERTSON,
HUNNELL, SCHAFFER and
KIRSTEN (Mayor)
Absent: Councilmen - None
Also present: City Manager Glaves, Assistant City
Manager Peterson, City Attorney Mullen and Planning
Director Schroeder.
PLEDGE Mayor Kirsten led the Pledge of Allegiance to the flag.
MINUTES On motion of Councilman Culbertson, Schaffer second,
the Minutes of October 8, 15 and 20, 1969 were approved
as written and mailed after changing the words "front
,yards" to "public rights of way" in the second paragraph
on page 4 of the Minutes of October 15, 1969.

PREZONE 14344
Notice thereof having been published in accordance with

law, Mayor Kirsten called for the public hearing on the

proposal to prezone two parcels located at 14344 North
West Lane to the R -MD, Medium Density Multiple -
ORD. NO. 914
Family Residential District. Planning Director
INTRODUCED
Schroeder pointed out the location of the property on a
map of the area. There was no one present who wished
to speak on the matter. On motion of Councilman
Schaffer, Culbertson second, the Council introduced
Ordinance No. 914 prezoning two parcels on the east
side of West Lane from 2504 feet to 2133 feet south of
Kettleman Lane to be in the R -MD, Medium Density
Multiple -Family Residential District.
ZONE N SIDE Notice thereof having been published in accordance with
W KETTLE1vMAN law, Mayor Kirsten called for the public hearing on the
BTWN SOUTH proposal to establish the zoning for a 2. 7 -acre parcel
FAIRMONT & located on the north side of West Kettleman Lane, adjacent
CRESCENT TO to the Leroy Nichols School, between South Fairmont
R -MD Avenue and South Crescent Avenue as R -MD, Medium
Density Multiple -Family Residential District. Planning
ORD. NO. 915 Director Schroeder introduced the matter showing a
INTRODUCED drawing of the area.
Mr. Allen Gooder, 1320 South Crescent Avenue and
Mr. Vernon Ekstrom, 1029 South Lee Avenue, asked
questions concerning the proposed zoning. There being
no others wishing to sneak on the matter, the public
portion of the 'nearing was closed.

Councilman Schaffer moved the introduction of Ordinance
No. 915 establishing the zoning for the above described
property to be F -MD, Medium Density Multiple -Family
Residential District. The motion was seconded by
Councilman Hunnell and carried by unanimous vote.
PLANNING COMMISSION
The City Manager gave the following reports of the City
Planning Commission meeting of October 20 and 27, 1969:
REMOVAL OF The Planning Commission recommended that the time
NONCONFORMING period for the removal of nonconforming signs be extended
SIGNS from May, 1970 to May, 1973 in order that the owners of
such signs will have every opportunity to conform to the
ordinance requirements or acquire a variance from the
Planning Commission. On motion of Councilman Brown,
Hunnell second, the matter was set for public hearing on
November 19, 1969.
SPECIFIC PLAN - The Planning Commission recommended a Specific Plan
HOWARD STREET for the future development of Howard Street between West
Lockeford Street and Lake Street. On motion of of
Councilman Schaffer, Brown second, the matter was set
for public hearing on November 19, 1969.
SPECIFIC PLAN - The Planning Commission also recommended a Specific
N STOCKTON ST. Plan for the future development of North Stockton Street
between East Turner Road and Lawrence Avenue. The
matter was set for public hearing on November 19, 1969
on motion of Councilman Culbertson, Schaffer second.
INDUSTRIAL The Planning Commission also reaffirmed its action of
DISTRICT August 25, 1969 and recommended the rezoning from the
M, Industrial District to the M-1, Light Industrial District
for (1) the area east of Stockton Street and west of Cherokee
Lane between Lockeford Street and the Southern Pacific
Railroad tracks; (2) the area bounded on the north by
Lockeford Street; on the east by the L'. S. 50-99 Freeway;
on the south by Victor Road; and on the west by Cherokee
Lane and (3) the area bounded by Victor Road on the north;
U. S. 50-99 Freeway on the east; Lodi Avenue on the south;
and the rear property line of property facing the east side
of Cherokee Lane on the west. The Council continued
discussion of the matter to November 19, 1969 on motion of
Councilman Brown, Hunnell second. Councilman Culbertson
requested the staff to prepare and submit to the Council a
map outlining the area to be rezoned.
COMMUNICATIONS
ABC LICENSE Notices of Application for Alcoholic Beverage Licenses
were read as follows:
1. Application for transfer to the Fish Net, Inc. , 902 West
Lodi Avenue, off -sale beer and wine.

2. Application for transfer to Ellsworth F. Dillon and
Alfonso A. Pepe, 45 Club, 45 North Sacramento
Street, on -sale general public premises.
3. Application for transfer to Bessie L. and William H.
Braswell and Lewis E. and Stella J. Morris, Round
House, 104 East Lodi Avenue, on -sale general
public premises.
LATE CLAIM -
The City Clerk presented an Application for Leave to File
E. HORST
Late Claim and a Claim for Personal Injuries in the amount
of $5, 000 from Ella Horst. The Council referred the

LETTER OF
A letter was read from the International Conference of
APPRECIATION -
Building Officials expressing appreciation to the City of

Lodi for permitting Chief Building Inspector J. Paul
McClure to attend the 47th Annual Business Meeting of

Building Officials in Salt Lake City, Utah.
BOARD OF
A letter was read from the Lodi Board of Realtors recom-

mending the City Council not endorse the leased -housing
HOUSING
program at this time.
DOWNTOWN A letter was read from the Board of Trustees of the
MERCHANTS- Downtown Lodi Merchants' Association stating that the
HOUSING Association was in support of the leased -housing program.
REPORTS OF THE CITY MANAGER
CLAIlMIS Claims in the amount of $466, 162. 96 were approved on
motion of Councilman Brown, Culbertson second.
SPECS -
On motion of Councilman Culbertson, Schaffer second, the
PICKUP TRUCK
Council approved specifications for a one-half ton pickup
truck for the Parks Department.
AWARD - HUTCHINS
The City Manager presented the bids received for the

Hutchins Street and Tokay Street Traffic Signal and

Lighting System as follows:

The City Manager recommended the award be made to
the low bidder. On motion of Councilman Hunnell,
Brown second, the Council adopted Resolution No. 3316
awarding the contract for the Hutchins Street and Tokay
Street Traffic Signal and Lighting System to the low
bidder, Collins Electric Company for a total of $11, 771.
AWARD - City Manager Glaves then presented bids for the
AUTO:MIOBILE standard automobile for the Utilities Department as
follows:

The City Manager recommended the award be made to
Loewen Auto Company, the low bidder. On motion of
Councilman Schaffer, Culbertson second, the Council
adopted Resolution No. 3317 awarding the contract for
the furnishing of one standard autornobile to Loewen
Auto Company for a total amount of $2, 185.49.
WAGE SCALE - Councilman Culbertson moved the adoption of Resolution
BUILDING & No. 3318 adopting prevailing rates of per diem wages as
CONSTRUCTION required by Section 1770 of the State Labor Code. The
motion was seconded by Councilman Brown and carried
RES. NO. 3318 by unanimous vote.
ACCEPT LODI On motion of Councilman Culbertson, Schaffer second,
AVE & SCHOOL the Council accepted the Lodi Avenue Widening, Church
ST WIDENING Street to School Street - School Street Widening,
Chestnut Street to Lodi Avenue as complete and author-
ized the Public Works Director to file the Notice of
Completion on the project.
ACCEPT HAM On motion of Councilman Brown, Hunnell second, the
LANE WIDENING Council accepted the Ham Lane Widening from Iris Drive
to Lodi Avenue as complete and authorized the Public
Works Director to file the Notice of Completion on the
project.
PUBLIC Mayor Kirsten stated that the next item on the agenda was
HOUSING discussion of the leased -housing program which had been
continued from the meeting of October 8, 1969. The
Mayor stated that since this was not a public hearing,
persons wishing to speak on the subject should present
information which had not been presented at a previous
meeting. He also requested that the number of persons
speaking be limited to ?our on each s ide of the question
and that each person should speak for no longer than
five minutes. The Council agreed with the Mayor's
suggestion.
RECESS The Mayor declared a five-minute recess at approximately
8:35 p. m.
The Council reconvened at 8:40 p.m.
PUBLIC Mayor Kirsten gave a brief summary of the previous
HOUSING discussions concerning the proposed leased -housing pro -
CONT' D. gram. He reported that both the Lodi Board of Realtors
and the Downtown Lodi Merchants Association had corn-
pleted their study of the matter. He then asked Dr. Frank
Johnson, who was in the audience and representing the
Board of Directors o the Lodi District Chamber of
Commerce, to report on the Board's recommendation.

Dr. Johnson read a report of the Board of Directors'
which stated that the Board of Directors of the Lodi
District Chamber of Commerce could not justify
implementation of Section 23 of the Leased Housing
Program in the Lodi area.
The following persons then spoke concerning the program:
Mr. Orwin Dow, President of the Community Action
Council, 8 North Rose Street, spoke in favor of the
program.
Mrs. Maria Gonzales, 323 East Locust Street, spoke in
favor of the program.
Mrs. Mary Laidlaw, 719 Palm Avenue, spoke in
opposition to the program.
Mr. Will Elliott, 820 Mariposa Way, spoke in favor of
the program.
Mr. Joseph Baccaro, 838 Cortez Way, spoke in favor of
the program and presented a list of persons who -are' also
in favor of the program.
Mrs. Allen Gooder, 1320 South Crescent Avenue, spoke
against the program.
Mrs. Marta Martz, 324 South Orange Avenue, spoke
against the program.
Mr. Allen R. Reed, Secretary -Executive Director of the
Housing authority of the County of San Joaquin then dis-
cussed questions raised by the audience and answered
questions of the Council.
.%Irs. Martha Yule, 11423 East Benndorf Road, questioned
the cost of the program.
Mr. Arthur Raab, 1800 West Walnut Street, pointed out
that agricultural workers had not been included in the
survey which had been conducted by the Housing Authority.
The Council discussed the possibility of the City of Lodi
establishing a local housing authority and contracting with
San Joaquin County Housing Authority for services.
Mr. Reed felt this would not be feasible for Lodi and stated
he would not recommend it. Councilman Culbertson
stated he was concerned about retaining as much local
control as possible and questioned if the Housing Authority
would accept advice from a citizens' advisory committee.
Mr. Reed suggested the Council discuss representation
on the Board with County Supervisor Vernon Lehman.
The Council discussed the number of units to be provided
under the program if the program is adopted in Lodi. The

application, as submitted, recommended 250 units.
The Council felt this was an excessive number of
units to begin the program with and generally
agreed that 150 units would be a more acceptable
number. After considerable discussion, Councilman
Hunnell moved that Section 23 of the United States
Housing Act of 1937, as amended, shall apply to the
City of Lodi, and further directed the staffto work
with Mr. Reed of the Housing Authority in preparing
resolutions for Council approval at an adjourned
meeting of November 12, 1969. The motion was
seconded by Councilman Culbertson and carried by
the following vote:

Hunnell and Kirsten
Noes: Councilmen - Schaifer
ORDINANCES
SPEED ZONE Ordinance No. 913 entitled, "AN ORDNANCE
L. SACTO RD AMENDING SECTION 14-21. 1 OF THE CODE OF THE
CITY OF LODI ENTITLED, 'DECREASING STATE
ORD. NO. 913 SPEED LIMIT ON CERTAIN STREETS,' AND THEREBY
ADOPTED DECREASING THE STATE SPEED LIMIT ON LOWER
SACRAMENTO ROAD BETWEEN CORBN LANE AND
LODI AVENUE, " having been introduced at the meeting
of October 15, 1969 was brought up for passage on
motion of Councilman. Brown, Schaffer second. Second
reading was omitted after reading by title, and the
ordinance was then passed, adopted and ordered to print
by the following vote:
Ayes: Councilmen - Brown, Culbertson,
Hunnell, Schaffer and
Kirsten
Noes: Councilmen - None
ANNUAL City Manager Glaves reported that the Annual Audit for
AUDIT 1968-69 prepared by H. P. McCandless was complete
and he presented each of the Councilmen with a copy of
the audit.
ADJOURNMENT
At approximately 11:30 p, m., on motion of Councilman
Culbertson, the Mayor adjourned the meeting to 8:00 p.m.
