WEDNESDAY, OCTOBER 8, 1969
An adjourned regular meeting of the City Council of the City of Lodi was held
beginning at 8:00 a. m. on Wednesday, October 8, 1969 in the City Hall Council
Chambers.
ROLL CALL Present: Councilmen - BROWN, CULBERTSON, HUNNELL,
SCHAFFER and KIRSTEN ('Mayor)
-Absent: Councilmen - None
Also present- City Manager Glaves, Assistant City Manager
Peterson, assistant City Attorney Sullivan
and Planning Director Schroeder.
PLEDGE Mayor Kirsten led the Pledge of Allegiance to the flag.
MINUTES On motion of Councilman Brown, Schaffer second, the
Minutes of September 17 and September 24, 1969 were
approved as written and mailed.
PRESENTATIONS
CA�1P FIRE Cama Fire Giris Robin DeVo1, Patricia Nelson, Linda
GIRLS Schwartz and Jacqueline Moe, presented Mayor Kirsten
with a Certificate of Appreciation.
CERTIFICATES TO Mayor Kirsten presented a Certificate of Appreciation to
ELLIOTT AND Robert Elliott thanking him for his service to the com-
BAINBRIDGE munity while serving on the City Planning Commission.
Mayor Kirsten also read a Certificate of Appreciation
for Robert Bain bridge thanking him for his services on
Me Library Board. Judge Bainbridge was not in
attendance to receive the certificate.

REZONING 1617 and Notice thereof having been published in accordance with

Courcil_nan Brown, then moved introduction of Ordinance
No. 912 rezoning certain parcels located at 1615 and 1751
West Lockeford Street and 410 and 420 North Lorna Drive
to be in the R -GA Garden Aaart_:-ient Residential District.
The :-notion was seconded by Councilman Culbertson and
carried, with Council -ria- Schaffer abstaining from the vote.
COMPLAINT-- Mrs. Anna Shaw, �'1" East Tokay- Street, Vlrs. Leona Miller.
rRUCKS 513 East Tokay- Street. and .1v1rs. Grace Buchmiller, 516
East Tokay- Street, spoke concerning the nuisance created
by co-n-merc_a1 trucks traveling on East Tokay Street.
They requested tae Council reroute the trucks to keep
them off of residential streets.
Mayor Kirsten requested the staff to study the possibility
of establishing a truck route for this area and to report
back to the Counc_1 on the matter.
PLANNING CO.%ItiIISSION
The City \Ianager gave the following report of the
Planning Co,= issfon meeting of September 22, 1969:
1. Aporo-ved the request of \ars. Thelma J. Harklerode for
a use permit to establish a home for the care of two
rnentally-retarded ch'_ldren at 1215 Liebig Street.
2. Approved the landscape plan and the bylaws of the
Homeowners' Association as requested by Mr. Robert
D. Houston for the Town and Country Park Subdivision
located at the southeast corner of West Turner Road
and Rutledge Drive.
3. Called a special meeting for October 20, 1969 to deter-
mine the procedures for reviewing the nonconforming
signs within the City of Lodi.

ABC LICENSE The following notices of application for alcoholic beverage
license were read:
1. Application for transfer to Bessie L. and Wayne H.

ANTITRUST SUIT A resolution was read from the Board of Supervisors of _
L. A. COUNTY Los Angeles County urging cities to intervene in the suit
against automobile manufacturers for violation of the
Sherman Antitrust Act. The Council requested the City
Attorney to make a recommendation on the matter at the
meeting of October 15, 1969.
CLAIM FOR A "Claim for Damages and Loss of Property" was
DAMAGES received from Henry Hansen, Karen Hansen, Richmaid
Ice Cream Company and Ingrid Hansen, in the amount of
$20,000. Claimants claim their premises were burglarized
due to failure of their burglar alarm to be properly con-
nected at the Police Department. On motion of Councilman
Culbertson, Schaffer second, the matter was referred to
the City Attorney for recommendation.
PETITION RE A petition bearing 74 signatures was received from
TRUCKS ON residents of East rokay Street requesting that all
E. TOKAY ST. commercial trucks be rerouted off of East Tokay Street.
PETITION RE A petition bearing 31 signatures was received irom
TRAFFIC residents of Virginia Avenue and West Tokay Street
VIRGINIA AVE. complaining of hazardous traffic conditions in the area.
& W. TOKAY The staif was requested to check for traffic problems
in this area.
REPORTS OF THE CITY MANAGER
CLAIMS Claims in the amount of $380,201.18 were approved on
motion of Councilman Brown, Hunnell second.
HOUSING SURVEY Mayor Kirsten explained that the discussion of the housing
survey had been continued from the meeting of September
24, 1969• He gave a brief summary of the previous
discussions concerning the proposed leased -housing program
in Lodi, and then called upon Mr. Allen R. Reed, Secretary -
Executive Director of the Housing Authority of the County
of San Joaquin to further comment on the program.
Mr. Reed reviewed the program and answered questions
of the Council. He discussed the necessary resolutions
to be adopted by the Council in the event the program is
approved. He pointed out that in the selection of tenants
for the program, the Housing Authority would give pre-
ference to all eligible applicants who reside and/or work
in Lodi. He said the Housing Authority would not be
importing persons from other areas.
City Manager Glaves presented letters from the Lodi
Board of Realtors and the Downtown Merchants' Association
requesting the Council to delay action until both groups
have studied the matter and have made a recommendation
to the Council.

Mayor Kirsten then recognized Mir. Orwin Dow, the
City's representative to the Community Action Council
and Mr. Keith Perryman, Director of the Community
Action Council, who were in the audience. Mr. Dow
thanked the Council for the consideration it has given
the housing program.
:Mayor Kirsten then invited anyone interested in speaking
on the proposed leased -housing program to do so. The
following persons spoke and asked questions concerning
the program:

Mr. Rudolph Vaccarezza, 1240 South Pleasant Avenue;
Mr. Duane Linstrom, 360 North Lorna Drive;
Mrs. Ruth Wright, 429 Valley Avenue;
Mrs. Doris McCaughna, 6433 Analitis Drive;
Mir. Arthur Raab, 1800 West Walnut Street;
Mr. Ronald Thomas, 730 Maplewood Drive;
Mrs. Ann Cerney, 900 West Vine Street;
Mr. Mike Lapenta, 431 South Lee Avenue;
Mr. W. A. Feerer, 708 South Rose Street;
Mrs. Diane Hernandez, Secretary of Woodbridge
Imarovement Association; 208 South Filbert Street,
Stockton;
Mr. Joseph Baccaro, 838 Cortez Way;
Mr. Biff Baffoni, Chairman of the Downtown Merchants'
Association, 540 Kensington Way;
Mr. Orwin Dow, 8 North Rose Street;
Mfrs. Inez Huppert, 1241 South Pleasant Avenue.
There being no others in the audience wishing to speak
on the subject, Mayor Kirsten closed the public portion
of the discussion.
After further discussion by the Council, Mayor Kirsten
informed representatives of the Lodi Board of Realtors
and the Downtown Merchants' Association that the City
Council as well as representatives of the Housing
Authority would meet with them at a time mutually agreeable
to further explain the program and answer any questions
they might have.
Councilman Schaffer then moved the matter be continued
to the meeting of November 5, 1969. The motion was
seconded by Councilman Brown and carried by unanimous
vote.
On motion of Councilman Culbertson, Schaffer second, the
Council then directed the staff to assist the Housing
Authority in preparing the necessary resolutions and
to present them at the next regular meeting of October 15,
1969.

The Council then suggested certain amend.^ -tents to the -
resolutions. Mr. Reed will redraft the resolutions
as directed by the Council and forward copies to the
City Manager i=n.-r_ediately.
RECESS At 10.15 p.m. the Mayor declared a five-minute recess.
COMPLAINT-- The City Manager presented a report from the Public
TREES ON Works Director concerning the request for removal
E. WALNUT of trees at 340, 344 and 348 East Walnut Street. The
report stated that the trees have a certain amount of
mildew, but are not dead, diseased or hazardous.
Mr. Giaves explained that since the City policy is
that trees will not be re -roved unless they are dead,
diseased or hazardous, the Pudic Works Director
could not authorize removal of them.
Mr. and Mrs. Leonard Mayer, 701 Eureka Avenue,
and Mr. A. A. Mehlhaff, 3:3 `north Stockton Street,
spoke, requesting rernoval of rhe above trees. They
stated that the leaves are constantly falling and this
creates a dust which is detrimental to their health.
The Council discussed the matter and requested the
staff to investigate the matter-'urther. Councilman
Hunnell then moved the matter be continued to the
meeting of October 15, 1969. The motion was
seconded by Councilman Brown and carried.
SPECS-- On motion of Councilman Hunnell. Brown second,
15 -KV CABLE the City Council approved specifications for 15-kv
cable and authorized advertising for bids.
SPECS--IZ-KV On motion of Councilman 1-lunnell, Schaffer second,
CAPACITORS the Council approved specifications for 12-kv
capacitors and authorized advertising for bids.
FINAL MAP-- All requirements of the City having been met, the
TOWN & COUNTRY final map of Town and Country Park Subdivision was
PARK presented for Council approval. On motion of
Councilman Brown, Culbertson second, the final
map was approved and the Mayor was directed to
execute the Subdivision Agreement and the Electrical
Utility Agreement on behalf of the City.
SPECS--I2-KV On motion of Councilman Culbertson, Schaffer
TRANSFORMERS second, the Council approved specifications for
12-kv transformers and authorized advertising
for bids.

PARKING LOT Councilman Culbertson asked if the parking lot on
the west side of the Bank of America property
could be used on a monthly rental basis. The
staff will study the matter and report back to
the Council.
BLDG. FEES Councilman Culbertson questioned how the City's
building permit fees, penalties and business
license enforcement compare with other cities.
The staff will study this and report back to the
Council.
ELECTRIC Councilman Culbertson also stated he would like
:METERS to know the electric meter requirements of the
City and how the Electric Code is enforced.
The staff will report back to the Council on
this :natter.

COMPLAINT-- Council -man Culbertson reported that he had
COSTA DRIVE received a complaint from a citizen concerning
holes in the street on Costa Drive. The City
-Manager will investigate the matter and report
to the Council.
CURFEW Councilman Culbertson suggested that some con-
sideration be given to enforcement of a curfew
for the City in an effort to eliminate problems
of drugs and delinquency. The Council discussed
this and it was felt this would be an appropriate
topic for discussion at a Cities and County meeting.
No action was taken.
SIDEWALKS-- Council -man Schaffer stated that he felt sidewalk
S. STOCKTON should be installed on South Stockton Street and
STREET he suggested irnplementation of the City's
sidewalk installation program could begin there.
CARDIAL- Councilman Schaffer also mentioned that frequent
CRESCENT accidents occur at the intersection of Cardinal
INTERSECTION Street and Crescent Avenue and he requested
the staff to determine if there is a safety
factor involved.
APPRECIATION Councilman Schaffer moved the Council present
L. DABRITZ -ir. Lester Dabritz, Executive Vice -President
of the Lodi Chamber of Commerce, with a
resolution of appreciation for his service to
the community. The rnotion was seconded by
Council --man Culbertson and carried by unanimous
vote.
ADJOURN.. MENT There being no further business, the meeting
was adjourned at 11:2.0 p.m.
