HomeMy WebLinkAboutMinutes - August 28, 1969 SM418 CITY COUNCIL, CITY OF LODI CITY HALL COUNCIL CHAMBERS THURSDAY, AUGUST 28, 1969 A special meeting of the City Council of the City of Lodi was held beginning at 5:40 p. m, on Thursday, August 28, 1969 in the City Hall Council Chambers. ROLL CALL Present: Councilmen - BROWN, CULBERTSON, HUNNELL, SCHAFFER and KIRSTEN (Mayor) Absent: Councilmen - None Also present: Assistant City Manager Peterson, City Attorney Mullen and Public Works Director Jones. A-2 BASIN Mayor Kirsten explained to the City Council that the special meeting had been called to discuss the agree- ment between the City of Lodi and the Westmont Development Company concerning the purchase of a parcel of land by the City for the A-2 Basin. He then asked Assistant City Manager Peterson to introduce the subject. The Assistant City Manager gave a brief history of the A-? Basin. He explained that the staff had met with representatives of the Westmont Develooment Company to negotiate the agreement as directed by the City Council at the meeting of August 20, 1969. He gave a resume of the staff's discussions with the developers and reported they had been unable to arrive at a mutually satisfactory agreement relative to the bicycle oath and the extra fill which were a part of the proposed agreement and had been included in the City's specifications. Mr. Robert Houston, representing the Westmont Development Company, agreed with the Assistant City Manager's remarks. Mayor KLrsten then stated that the Council must start anew to negotiate the agreement as at this point there was no agreement. After considerable Council dis- cussion_, Mayor Kirsten suggested the City purchase the property at $4500 per acre and provide the extra fill and cost of the bicycle path which he felt would be consistent with treatment given to other developers. Councilman Hunnell asked what the cost of the extra fill would be. Public Works Director Jones reported that Claude C. Wood Company had estimated the cost of the bicycle path and the extra fill to be approximately $8, 100. After further discussion concerning the bicycle path and the extra fill, Councilman Culbertson moved that the bicycle path be a part of the A-2 Basin. The motion was seconded by Councilman Schaffer and carried by unanimous vote. - 1 - ADJOURNMENT M M-Inutes of August 28, 1969 continued Councilman Culbertson then moved the City offer to pur- chase the approximately 16. 64 acres as .planned for $4500 per acre; grading of the entire park area to be plus or minus 0. 1 foot tolerance; the City to pay $8, 100 far,.: the bicycle path and the extra fill required as specified in the basin design and considered above excavation and grading requirements in previous ponding basins; and the timing of the removal of the -dirt to be consistent with City specifications. The motion was seconded by Councilman Brown and carried by unanimous vote. Mr. Victor Meyer, speaking on behalf of the Westmont Development Company, accepted _the offer of the City, stating it was his understanding that the Company would be obtaining the dirt without chargeand requested the sale of the property be closed by September 1 or 2. The Council agreed there would be no charge for the dirt and the sale would be closed as soon as possible. .There being no further business,. the Council adjourned. at approximately 6:30 p.m. Attest.EB SSLE L. 1, E T� City.
