CITY HALL COUNCIL CHAMBERS
DECEMBER 16, 1970
A regular meeting of the City Council of the City of Lodi was held beginning
at 8:00 p.m. on Wednesday, December 16, 1970, in the City Hall Council
Chambers.
ROLL CALL Present: Councilmen - EHRHARDT, HUGHES, KATNICH,
- and SCHAFFER (Mayor)
Absent: Councilmen - KIRSTEN
Also present: City Manager Glaves, Assistant City
Manager Peterson, City Attorney Mullen, Planning
Director Schroeder and Public Works Director Jones.
PLEDGE Mayor Schaffer led the Pledge of Allegiance to the flag.
MINUTES On motion of Councilman Katnich, Ehrhardt second,
the Minutes of December 2, 1970 were approved as
written and mailed.
PUBLIC HEARINGS
APPEAL - Notice thereof having been published in accordance with
MR. WUTZKE - law, Mayor Schaffer called for the public hearing on
DENIED the appeal of Mr. Rudolf Wutzke from the decision of
the Planning Commission in denying his request for a
Variance to permit the conversion of a guest house
to a second dwelling in an interior lot in an area zoned
R-2 at 511 Alicante Drive. Planning Director Schroeder
introduced the matter, presenting a drawing of the
parcel and the structures thereon.
Mr. Rudolf Wutzke, 9457 Florin Road, Elk Grove,
spoke in favor of the request. He stated that when
he purchased the property it was his understanding
that the guest house could be used as a rental. No
other persons in the audience wished to speak either
in favor or against the appeal and the public portion
of the hearing was closed.
After Council discussion, on motion of Councilman
Hughes, Ehrhardt second, the Council, by unanimous
vote, denied the appeal of Mr. Rudolf Wutzke.
AMEND Notice thereof having been published in accordance with
SPECIFIC PLAN - law, v!ayor Schaffer called for the public hearing on
CENTURY BLVD the recommmendation of the Planning Commission to
amend the Specific Plan of Century Boulevard between
ORD. NO. 940 West Lane and South Stockton Street. Public Works
ADOPTED Director Jones introduced the matter and reviewed the
proposed amendment.
Mr. R. W. Siegfried, Civil Engineer, 4045 Coronado
Avenue, Stockton, representing a property owner in
the vicinity of West Lane and the Southern Pacific
Railroad tracks spoke in 'favor of the amendment to
the Specific Plan.

COMMUNICATIONS
ABC LICENSE Notices of Application for Alcoholic Beverage License
were read as follows:
1. James A., Robert A. and William G. McCarty,
Town and Country Bottle Shop, southwest corner
of Turner Road and Rutledge Avenue, off -sale
general, person - to- person, premise -to -premise
transfer.
2. George L. Scharf and Philip M. Vitale, Nut Club,
23-25 North Sacramento Street, on -sale beer public
premises, person-to-person transfer.
3. Marie Brummett, 27 Club, 27 North Sacramento
Street, on -sale beer public premises, person-to-
person transfer.
APPEAL - A letter was read from Mr. Kenneth Lane, 833 Holly
K. LANE Drive, appealing the decision of the Planning Commission
in denying his request for a Variance to reduce the
required front yard from 20 feet to 18 feet to permit
the erection of a covered front porch at 833 Holly
Drive in an area zoned R-2 District. On motion of
Councilman Ehrhardt, Hughes second, the matter was
set for public hearing on January 20, 1971.
REPORTS OF THE CITY MANAGER
CLAIMS Claims in the amount of $66,031.79 were approved on
motion of Councilman Katnich, Hughes second.
OLD FIRE The Council heard a report from the City Manager con -
HOUSE cerning the use of the old fire house by The Mensch
Coffee House youth group. He stated that the staff had
estimated the minimum cost for renovation of the fire
house to be approximately $1,960; this figure would
include no paint or floor covering.
In answer to a question raised by Councilman Ehrhardt
concerning the possibility of closing off the driveway
from Lodi Avenue, Public Works Director Jones estimated
the cost of curb and gutter for this project to be $150.
Mr. Roger Carr, Chairman of the Board of Directors
of the Lodi Junior Chamber of Commerce, 5336 East
Woodbridge Road, Acampo, addressed the Council con-
cerning the use of the fire house by the Jaycees. He
explained that approximately three years ago the Lodi
Jaycees offered to do the necessary repairs to the old
fire house so that they might use it as a meeting place
for their group. At that time the group was refused
permission to use the building as a meeting place but
did receive permission to store an old fire truck there.
He suggested that joint use of the building by both the
Jaycees and The Mensch might be possible. Mr. John
Callahan, 1806 Lake Street, also spoke concerning the
Jaycees' interest in using the building.

MEMO OF Assistant City Manager Peterson presented the "Memo -
UNDERSTANDING - randum of Understanding Between'The City of Lodi and
EMPLOYEES ASSN City of Lodi Chapter, San Joaquin County Employees
Association, Inc. " for Council approval. Said memo -
RES. NO. 3444 randum sets forth the salaries and fringe benefits that
have been mutually agreed upon by'designated repre-
sentatives of the City and the Employees Association.
Copies of the Memorandum had been presented to the
Council prior to the meeting. Councilman Katnich then
moved adoption of Resolution No. 3444 approving the
"Memorandum of Understanding Between the City of
Lodi and City of Lodi Chapter, San Joaquin County
Employees Association, Inc. " The motion was seconded
by Councilman Ehrhardt and carried by unanimous
vote.
MEMO OF City Manager Glaves then presented the "Memorandum
UNDERSTANDING - of Understanding Between the' City of Lodi (Lodi Public
EMPLOYEES ASSN Library) Lodi Chapter, San Joaquin County Employees
(LIBRARY) Association, Inc. " for Council approval. Said memo-
randum also sets forth the salaries and fringe benefits
RES. NO. 3445 that have been mutually agreed upon by designated
representatives of the City and the -Employees Association.
The City Manager reported that the Library Board,
in a special meeting, had approved the salaries included
in the memorandum. On motion of Councilman Ehrhardt,
Hughes second, the Council unanimously adopted Reso-
lution No. 3445 approving the "Memorandum of Under-
standing Between the City of Lodi (Lodi Public Library)
and City of Lodi Chapter, San Joaquin County Employees
Association.
UNCLASSIFIED On motion of Councilman Hughes, Katnich second, the
PERSONNEL Council unanimously adopted Resolution No. 3446 increasing
SALARY salaries for unclassified personnel as follows:

The director of The Mensch Coffee- House,- Miss Arlene
Ackerman, 16 West Tokay Street, reported The Mensch
had been unsuccessful in its attempts to obt. ikn' a'.•meeting
place. She said she would be willing to look into the
possibility of joint use of the building, but this would

be the decision of the Board of Directors of The

Mensch::- After discussion -by the Council, Mayor
Schaffer -suggested the Councilmen make a personal
inspection of the fire house before arriving at a decision.
Councilman Ehrhardt then- moved the discussion of the
use of the old fire house by The Mensch be continued
to the meeting .of January 6, 1971'so that the Council
might make -a personal inspection of the building. The
motion was seconded by Councilman Hughes and carried
by unanimous vote.
EXECUTIVE
At approximately •9:30- p, m. the Mayor adjourned the
SESSION
meeting to an executive session. The Council recon-
vened at approximately 9:55 p.m.

City Manager Glaves presented for the Council's approval

AWARD -
City Manager Glaves presented bids for a pickup truck

The City Manager recommended the award be made
to the low bidder. On motion of Councilman Katnich,
Hughes second, the Council adopted Resolution No.
3448 awarding the contract for the furnishing of one
pickup truck to the low bidder, Loewen Auto Company,
for a total amount of $2,821.00.
FLOOD PLAIN The City Manager presented information received from
INSURANCE the League of California Cities concerning flood and
mudslide insurance. He explained that new regulations
RES. NO. 3449 of the National Flood Insurance Program now make it
possible for City Councils to initiate action which will
make federally subsidized insurance for flood and mud-
slide damage available to property owners. To make
the program operative the City Council must take certain
actions and evidence a positive interest in securing
flood insurance. After discussion, Councilman Ehrhardt
moved adoption of Resolution No. 3499 stating the City

of Lodi's interest in securing coverage under the national
flood insurance program. The motion was seconded
by Councilman Hughes and carried by unanimous vote.
APPRECIATION Mayor Schaffer remarked that previous actions taken
concerning salaries was an indication of the Council's
confidence in the City Manager, and he expressed
appreciation to the City Manager and Department
Heads for their dedicated service to the City.
ANNUAL Councilman Ehrhardt reported on the 47th Annual
CONGRESS Congress of Cities which he recently attended in
OF CITIES Atlanta, Georgia, on behalf of the City.
ADJOURNMENT
There being no further business, the Council, on motion
of Councilman Ehrhardt, Katnich second, adjourned
the meeting at approximately 10:40 p.m.
